LEAVE & LICENCE AGREEMENT

This Agreement made at Pune on this 17th day of Dec 2009 between Mr./Miss
_____________ an Indian Inhabitant, residing at (Address)
________________________________________________
Hereinafter called “the LICENSOR” (which terms as far as the context thereof shall
mean and include his heirs, executors and assigns) of the ONE PART AND
Mr./Miss _____________an Indian Inhabitant, residing at (Address)
________________________________________________. Hereinafter called “the
LICENSEE” (which terms as far as the context thereof shall mean and include his
heirs, executors and assigns) of the OTHER PART

WHEREAS:
1. The LICENSOR is the Owner of and is absolutely entitled to use and
occupy flat no. … admeasuring . … sq.ft.(Built-up)consisting of ….. Bedroom, ….
hall and …. kitchen. Situated at (rent property Address)
________________________________________________-(which flat is hereinafter referred
to as “the licensed premises”)
2. It has been agreed that the Licensee shall with the leave and licence
have the use and occupation of the licensed premises for his residential purpose
upon the terms and conditions hereinafter mentioned.

NOW IT IS HEREBY AGREED BY AND BETWEEN THE PARTIES HERETO AS


FOLLOWS: -

1. The Licensee shall by leave and licence of the Licensor hereby granted,
shall have the use and occupation of the licensed premises for a period
of 11(eleven) months commencing from 1st day of August, 2009 and
ending on 30th day of June, 2010.

2.a) The Licensee shall pay to the Licensors fee or compensation of Rs.
8000 (Rupees –Seven Thousands Only) per month for the period
August 09 to June 10 shall be payable in advance on or before the 10th
of every English Calendar month.

b) The Licensee shall deposit a sum of Rs.


30000 (Rupees twenty Thousands Only) as interest free security
deposit. This amount will be returned to the Licensee on the termination of
license period. The Licensor shall return the said deposit amount to the
Licensee against the Licensee simultaneously handing over the peaceful
and vacant possession of the premises by way of Demand Draft or Pay
Order only.

In the event of the Licensor failing to return to the Licensee, the interests
free security deposit on termination/expiry of this Agreement.

a. The deposit amount will attract interest at the rate of 21% from
the date of termination/expiry of the Agreement ie, from the date of
handing over the peaceful possession of the said flat till payment.

3. The Licensed premises shall be used only for the purpose of residence of
the Licensee and the Licensee shall not use the premises for its trade,
business or other than residential purpose.

4. The Licensor shall not be responsible or liable for any theft, loss,
damage or destruction of any property of the Licensee or any other person
living in the licensed premises nor for any bodily to any person in the
licensed premises from any cause whatsoever.

5. The Licensor aggress to pay society, water, garage and municipal taxes,
and other dues payable to various government authorities in connection
with the said premises.

6. In the event of the Licensee committing any breach of the terms and
conditions herein contained and failing to remedy or made good such
breach on receipt of notice in writing from the Licensor within 30(thirty)
days then the Licensor shall be entitled to terminate this licence forthwith.

7. On termination of this licence, the Licensee shall remove all belongings


from the licensed premises and handover peaceful and vacant possession
of the licensed premises to the Licensor.

8. The Licensee shall observe and comply with the rules and bye-laws of
the society, if formed and agrees to indemnify the Licensor from and
against all claims and losses which the Licensor may suffer in event of the
Licensee failing to comply with the said rules and bye-laws.

9. The Licensor shall observe and comply with all the terms and conditions,
agreements, covenants and provisions on which the Licensor hold the
licensed premises and shall punctually pay and discharge regularly all the
liabilities to the Society and/or other authorities.

10. The Licensee shall not make any alternations or additions to the
portion/area of any part of the licensed premises in any manner
whatsoever.

11. The Licensee shall not store or allow to be stored in the premises any
goods, articles or things of a hazardous, inflammable or combustible
nature.

12. The Licensee shall keep the interior of the licensed premises and the
fitting and fixture including electrical, sanitary therein good and tenantable
repair and condition.

13. The Licensor shall be responsible for carrying out external repairs and
painting.

14. The Licensor declares that there is no person except the said Licensor
interest in the said premises and the Licensor aggress to
indemnify/reimburse against any claim made by any person regarding the
title to the said premises for all costs and expenses incurred by the
Licensee including the cost of defending such a claim.

15. The Licensees and the Licensor agree to put an end to this Agreement
by giving 1(One) months notice in writing to the either party (both side
applicable).

16. Nothing herein contained nor any subsequent act of the parties shall
be considered as giving to the Licensee any right upon the licensed
premises to constitute tenancy or sub-tenancy or assignment or transfer
partially or otherwise of the Licensor interest in the licensed premises or
portion thereof.

17.It is agreed by and between the Licensor and the Licensee that Section
13(A) 1 of Bombay Rent Control Act, 1947, will govern this Agreement.

IN WITNESS WHEREOF the parties hereto have hereunto set and
subscribed their respective hands the day, month and year first
hereinabove written.

RECEIVED WITH THANKS a sum of Rs.--30000------------/-(Rupees----Thirty
Thousands Only) towards interest free security deposit in respect of the
above referred licensed premises and more particularly mentioned in 2 (b)
of this Agreement.
