Commission on Sri Lanka

Hon' chairman, Hon' Ministers, Hon' Leader of the opposition and my dear
colleagues,
On behalf of the Northern Provincial Council, I welcome the Report of the Office

of

High Commissioner for Human Rights' Investigation on Sri Lanka released on 16


September 2075. Mandated to conduct a'Human rights'investigation'into abuses
committed in Sri Lanka between the period of February 2OOZ and November
201,'1,, the report is the most ccmprehensive fact-finding report to -date on what
had transpired during the period investigated and represents a dramatic step
towards our quest to ensuring accountability, truth, justice and achieving
reconciliation built upon the addressing of the structural causes for the conflict
and entrenching a new culture of respect f,rr human rights of all.

We commend the investigation' panel for conducting

methodical and
comprehensive examination of the abuse committed during the period by all
parties to the conflict, namely the government forces, pro-government
paramilitaries and the LTTE. We welcome the findings of the investigation that

quoteJ "The sheer number of allegations, their grqvity, recurrence qnd the
similorities in their modus operandi, as well as the consistent pattern of conduct
they indicate, all point towards system crimes. " (unquote) The principal findings of
the report also states that "there are reasonable grounds to believe that gross
violations of internqtional human rights' law, serious violotions of international

court of law, many of
these allegations would amount, depending on the circumstances, to
war crimes
and/or crimes qgainst humanity. ,, (unquote)

We also welcome the finding that the investigations into international


crimes of
the scale that had taken place during the period investig ated "will require
more
than a domestic mechanism" and,the need to form a mechanism which
would give
confidence to the victims of such violations, confidence in the independence
and
impartiality of the process. To that end the report has suggested the adoption
of

international best practices

We welcome the recommendations and conclusions of the report including


comprehensive recommendations on institutional reforms, justice,
Truth and
reparations. We at NPC, as per our electoral mand-ate,.have for long
committed
ourselves to securing justice, truth, accountability and reconciliation
through a
mechanism that is independent and international in character, practices
and
standard, so that it acts as the foundation for meaningful reconciliation.
We urge the Government to implement the recommendations of the
Report
immediately by embarking on a transitional justice process which
takes into
account the scope and breadth of the violations, the diverse nature
of affected
parties and offending individuals, the need for time-boundedness in
delivering
accountability, justice and reconciliation, the Need for addressing structural
causes of the conflict and the Need for a victim centered Approach.

were given no role. It is equally
crucial from a practical standpoint,
for transitional justice meqsures depend, to a
large extent, on the willingness of victims and others to participate,,.

at NPC will work with all the stakeholders to ensure that
our victims are given the
time, space and capabilities to shape the Transitional justice process
and actively
participate towards achieving a meaningfur outcome.

A country at peace is one that comes to terms with its sordid
past no matter how
difficult it might be, make amends and ensures that such a past
never revisits us
ever again' We strongly believe that this Country and its people
are more than
capable of facing up to the past and craft a new future
that may have looked

highlights, like all other
communities, we the Tamil people too will have to come
to terms with our role in
