We are writing in support of t he Application for Direct App ellate Review in this
case. We a re the a uthor s of Eugene Volokh, One-to-One Speech vs. One-to-Many
Speech, Criminal Harassm ent Laws, and "Cyberstalking," 107 Nw, U. L. Rev. 73 1
(20 13), and Aaron H . Ca pla n, Free Speech and Civil Harassment Orders, 64 Ha sti ngs L.J. 781 (20 13), recent articl es t h at deal, a mong ot her th ings, with orders
restricting speech about people.
This ca se involves a "question j] of fir st impression" before this Court; it involves
a question concerning the F irst Amen dment to t he Constitution of the U nit ed
States ; a n d we believe it involves a quest ion of great public interest, becau se it
deals with a kind of controversy that has been arising rep eatedly in recent ye ars,
a nd is sure to arise a ga in . App . P . R. 11. Th is Court's a ttention is t he refore needed
to cla rify this area of the law .
In recent years, some cou rts t h roughout the cou ntry- inclu din g in Ma ssa chusetts- have entered str ikin gly broad injunction s th at bar a wide r ange of speech
about particul ar peop le . These injunctions, like the one in t his case, are not limited
to unprotected speech , such as proven libel, "figh ting words," threats, 0 1' speech
intende d to a nd likely to incite imminent illegal con duct. Nor are t hey limited to
unwanted speech to a person. Ra thel', the y restrict a wid e range of speech to t he
public about t he person.
Thus, for instance, in Chan v. Ellis, 770 S.E.2d 851 (20 15), th e Georg ia Suprem e
Court reversed a n inj unction t hat ordere d a web site ope rator, Ma tthew Chan, to
delete "all posts relating to [Linda] Ellis" from hi s web site , a nd likely forbade the

posting of future posts as well. The Geor gia Supreme Court conclu ded t hat the
inj u nct ion was not authorized by Georgia law, large ly beca use it covere d speec h
about a person and not just speech to her . The cour t therefore di d not need to reach
the serious Fi rst Amendment objectio ns to the inju nction.
Likewise, in Kleeni v. Ham rick , a local gadfly and pa st local ca nd ida te , blogged
offensive thing s about t he sis ter of a tow n's mayor , who was a lso a local civic figure.
An Ohi o Court of Com mon Pleas judge responded by ordering t ha t the blogger "is
p roh ibited from post in g a ny informa ti on/com men ts/threa ts/or a ny ot her da ta on a ny
inte rne t sit e, regardin g t he petiti oner a nd a ny member of her immedi a te or
exte nded family . . . on a ny s ite ," inclu din g both her own blog and t he
Cleveland.com news site.'
In Kim berlin v. H'a lher, a Ma ry la nd cou rt similarly enjoined a blogge r from
blogging abou t a political a ctivis t who was also a conv icted cri minal.> T hat order,
too, wa s la ter va ca te d- thou gh not for a mon th a h alf, t ime during which the
blogger's First Ame ndment right s were suppressed ." And in Ni lan v. Valenti, a
Ma ssachuset t s cou rt ordered a blogger (and former professio nal journalist) to
remove his blog post s ab out a woma n who h a d been accused of criminal negli gence
a n d leaving t he sce ne of a n acciden t after hit ting a ped estrian with her car, and
who happened to be th e daught er of a loca l judge.! Again, th at order wa s la ter
va ca ted .s

Va lkenburg, therefore appears to be a n unconstitutionally overbroad prior


restra int. "An inju nct ion that forb ids speech act ivities is a cla ssic exa mp le of a prior
restra int." Care & Protection of Edith, 42 1 Mass. 703, 705 (1996); see also
Organ izat ion for a Better Austin v. Keefe, 402 U .S. 415 (197 1) (str iking down a n
injunct ion barring leafl ett ing critica l of a person) ; NAACP v. Claiborne Hardware,
458 U. S. 88 6, 924 n.67 (1982) (like wise) ; People v. Bethea, No. 2003BX0368 14, 2004
WL 190054 , a t *1-2 (N.Y. Crim. Ct . J a n. 13, 2004) (rejec ting crimin a l ha r assment
prosecution of wom an who had posted leafl ets sh arply crit icizing t he a llegedly
deadbeat fa ther of her child, a nd relying on t he principl e that "Ame rica ns are, after
a ll, fr ee to criticize one a nother").
And ev en the narrower portions of the inj u nctio n, if severed from t he rest of the
injunction , would still ra ise seriou s First Amendment probl ems. An injunction
banning only speech that "encour age [s] 'ha te mobs'" wou ld be unconstitution al,
since it is not limited to p u nishable speech t hat is inte nde d to a nd likely to promote
im minent law less conduct , und er Brandenburg v. Ohio, 395 U.S. 444 (1969), a nd
Hess v. Indiana, 414 U .S . 105, 108-09 (197 3). (Note t hat the U.S. Sup reme Court's
decisi on overturning the injuncti on in Clai borne Hardware involve d spe ech t h at,
according to pla intiffs, h ad the pot ential to lead others to retaliate aga in st the
target of t he speech ; so did the decisions reversing the injunct ions in Kim berlin and

N ilan, supra .i
Likewise, eve n an inj u nct ion banning only informati on about Van Va lkenburg's
"pe rsonal life" wou ld likely be unconstitutional. Speech restrict ion s aimed at protecting privacy, like other rest rict ion s, must comp ly wi th the First Am endment. S ee,
e.g., Care & Protection of Edith, 421 Mass. at 70 6. "Mere in t rusi on on a person's
alleged priva cy interest is not by itself a n a dequate ba se on which to predica te a
broad prior rest raint on a nother's fre e speech." Nyer v. Munoz- Mendoza, 385 Mass.
184, 189 (1982); Keefe, 402 U.S. at 419-20 ; see also Collins v. Bazan , 568 S.E. 2d 72,
73-74 (2002) (concluding t h at , "[i]n const ruing the stalking statu tes so as to find
t he m constitu ti onal," th e Georgia Supreme Court rea d them as limited to spee ch
that "is not prot ect ed expression under t he F ir st Ame n dment, " a nd that the stat utes
th erefore do not au t horize a n inj u nct ion eve n agains t "ext re me ly insen sitive" speech
"publishin g or di scussing [an ex-girl fr ien d's] medica l condition"). Thus , eve n if some
narrow injunctions a ga in st speech may be justified on priva cy gro un ds , a ban on all
speech about a person's "pe rso nal life" ca nnot.
This case thu s involves a recurrin g a nd im portant constitutional issue, wh ich is
of substantial importance to Ma ssachuset t s citizen s as well as to t he bench and the
bar, a nd th erefore meri t s di rect appellate rev iew by this Court.
