FileSeek End User License Agreement (EULA)

1. General
Please read the terms and conditions of this license agreement carefully before
continuing with this installation. Binary Fortress Software's end-user license a
greement ("EULA") is a legal agreement between you (either an individual or a si
ngle entity) and Binary Fortress Software for the software products identified a
bove which may include associated software components, media, printed materials,
and "online" or electronic documentation ("software"). By installing, copying,
or otherwise using the software, you agree to be bound by the terms of this EULA
. This license agreement represents the entire agreement concerning the program
between you and Binary Fortress Software, (referred to as "licenser"), and it su
persedes any prior proposal, representation, or understanding between the partie
s. If you do not agree to the terms of this EULA, do not install or use the soft
ware.
2. Grant of License
Binary Fortress Software grants you the right to install and use a copy of the s
oftware, within the limits of the license restrictions (listed below), on a comp
uter running a validly licensed copy of the operating system for which the softw
are was designed. You may also make copies of the software as may be necessary f
or backup and archival purposes.
3. Copyright
The software is protected by copyright laws and international copyright treaties
, as well as other intellectual property laws and treaties. The software is lice
nsed, not sold. All title, including but not limited to copyrights, in and to th
e software and any copies thereof are owned by Binary Fortress Software. All tit
le and intellectual property rights in and to the content which may be accessed
through use of the software is the property of the respective content owner and
may be protected by applicable copyright or other intellectual property laws and
treaties. This EULA grants you no rights to use such content. All rights not ex
pressly granted are reserved by Binary Fortress Software.
4. Free Version License Restrictions
The free version of FileSeek is ONLY valid for PERSONAL USE. If you are using Fi
leSeek in a company environment, you must use a FileSeek Pro Standard, Site or E
nterprise license. Non-profit, charity or educational institutions may use the f
ree version without purchasing a license.
5. Standard License Restrictions
The Standard License version of FileSeek is valid for 1 computer only. The Stand
ard License may be used in a personal or company environment. This computer may
be used by more than 1 person, but only 1 person may use this license at a time.
6. Site License Restrictions
The Site License version of FileSeek is valid for an unlimited number of compute
rs at 1 physical location (site).
7. Enterprise License Restrictions
The Enterprise License version of FileSeek is valid for an unlimited number of c
omputers at an unlimited number of physical locations (sites) belonging to the p
urchasing company.
8. Description of Other Rights and Limitations
You must not remove or alter any copyright notices on any and all copies of the
software. You may not distribute registered copies of the software to third part
ies. Free versions available for download from Binary Fortress Software's websit
e may be freely distributed with written permission from Binary Fortress Softwar
e - this does not include paid for versions. You may not reverse engineer, decom

pile, or disassemble the software in whole or in part, except and only to the ex
tent that such activity is expressly permitted by applicable law notwithstanding
this limitation. You may not rent, lease, or lend the software. Binary Fortress
Software may provide you with support services related to the software. Any sup
plemental software code provided to you as part of the support services shall be
considered part of the software and subject to the terms and conditions of this
EULA. You must comply with all applicable laws regarding use of the software.
9. Update Checks
FileSeek will occasionally check for a newer version with our update servers (bi
naryfortress.com). During this update process, FileSeek will send:
- Product Version (ex: 8.4.1)
- Windows Version (ex: 6.2.9200)
- Windows Bitness (ex: 32 or 64)
- Feature Status (ex: which product features you have enabled, no specific detai
ls are sent about how they are configured)
- License Hash (ex: a hashed string of your license key)
Sending this information allows us to tailor the updates and only serve files th
at you need. This saves both of us bandwidth by not downloading unnecessary file
s, and ensures that your version of FileSeek is always up-to-date. You can opt o
ut of these update checks at any time by unchecking the "Check for updates autom
atically" option in the FileSeek Settings window.
10. Termination
Without prejudice to any other rights, Binary Fortress Software may terminate th
is EULA if you fail to comply with the terms and conditions. In such event, you
must destroy all copies of the software in your possession.
11. No Warranties
Binary Fortress Software expressly disclaims any warranty for the software. The
software is provided as-is without any express or implied warranty of any kind,
including but not limited to any warranties of merchantability, non-infringement
, or fitness of a particular purpose. Binary Fortress Software does not warrant
or assume responsibility for the accuracy or completeness of any information, te
xt, graphics, links or other items contained within the software. Binary Fortres
s Software makes no warranties respecting any harm that may be caused by the tra
nsmission of a computer virus or other such computer program. Binary Fortress So
ftware further expressly disclaims any warranty or representation to Authorized
Users or to any third party.
12. Limitation of Liability
In no event shall Binary Fortress Software be liable for any damages (including,
without limitation, lost profits, business interruption, or lost information) r
ising out of use of or inability to use the software, even if Binary Fortress So
ftware has been advised of the possibility of such damages. In no event will Bin
ary Fortress Software be liable for loss of data or for indirect, special, incid
ental, consequential (including lost profit), or other damages based in contract
, tort or otherwise. Binary Fortress Software shall have no liability with respe
ct to the content of the software or any part thereof, including but not limited
to errors or omissions contained therein, libel, infringements of rights of pub
licity, privacy, trademark rights, business interruption, personal injury, loss
of privacy, moral rights or the disclosure of confidential information.
