IN THE NATIONAL ASSEMBLY OF BELIZE 2015
SENATE
MOTION
TAKE NOTICE THAT pursuant to Standing Orders 23 and 25 of the Senate
Standing Orders, the Senate is be moved for a Motion as follows:
WHEREAS Section 61(A) (2) of the Constitution of Belize, Chapter 4 of
the Laws of Belize sets out the powers and functions of the Senate as
including:
“(d) Instituting and conducting enquiries and investigations on any
‘matter of public interest or importance, including inquiries into
mismanagement or corruption by persons in the central government
or public statutory bodies;
(g) Requiring the attendance before it of any Chief Executive Officer
ina Government Ministry in respect of any matter of which he has
knowledge by virtue of his office, or in respect of anything related to
his office and the due execution of his duties; and
AND WHEREAS on August 16, 2015, officers and vessels of the
Guatemalan Navy entered Belizean internal waters and committed an
incursion, as was acknowledged by Prime Minister Dean Barrow in his
address to the Nation made on August 19, 2015;AND WHEREAS the Prime Minister in his address to the Nation on
August 19, 2015, stated that “our BDF are routinely challenged by the
Guatemalans and as happened just last Tuesday, are frequently told
to turn back. The Prime Minister also stated in that address that “ They
always complete their mission even when as also happened last
Tuesday, they are threatened by the Guatemalan Navy, with the
ramming of their boat and/or a firefight.” ;
‘AND WHEREAS there is no other information provided to the Senate and
the Belizean people, other than in the address of the Prime Minister, as
stated above and no other detail has been provided to the Senate, by the
Government of Belize as to how long this situation in the Sarstoon River
has been occurring; the steps that the Government of Belize has taken in
respect of the same; and if any protest has been made to Guatemala, both
in respect of the incident in the Sarstoon River on August 16, 2015, and
any other incident or incursion previous to that;
AND WHEREAS the matter of the territorial integrity and sovereignty of
Belize and the exercise thereof, by Belize over the Sarstoon River up to
‘the midpoint of the main navigable channel and all our borders and
boundaries is a matter of the highest public national importance and
therefore, do fall within the duties of the Senate which include “instituting
and conducting enquiries and investigations on any matter of public
interest or importance”;
AND WHEREAS this is therefore a matter within the duties, rights and
responsibilities of the Senate of urgent public interest and importance and
THEREFORE REQUIRE THAT THE SENATE EXERCISE ITS POWERS
IN ORDER TO FULFILL ITS ROLE AND FUNCTION UNDER THE
CONSTITUTION OF BELIZE AND REQUIRE THE ATTENDANCE
BEFORE THE SENATE of the Chief Executive Officer in the Ministry ofNational Security and the Chief Executive Officer in the Ministry of Foreign
Affairs, in order to be questioned and to explain, and to provide as much
information and detail possible to the Senate as possible relating to the
incidents involving the Belize Defence Force and Belize Coast Guard and
the Guatemalan Navy in the Sarstoon River, and any other border
incursion or confrontation and to explain the exercise of sovereignty and
preservation of territorial and maritime integrity of Belize over all its
terrestrial and maritime borders or boundaries.
BE IT RESOLVED THAT the Senate shall be moved in the exercise of its
powers, duties and responsibilities as set out in accordance with Section
61(A) (2) of the Constitution of Belize, Chapter 4 of the Laws of Belize as
follows:
1) To require the attendance before the Senate, of the Chief Executive
Officer in the Ministry of National Security and the Chief Executive
Officer in the Ministry of Foreign Affairs, in order to be questioned
and to explain, and to provide as much information and detail
possible to the Senate as possible relating to the incidents involving
the Belize Defence Force and Belize Coast Guard and the
Guatemalan Navy in the Sarstoon River, and any other border
incursion or confrontation and to explain the exercise of sovereignty
and preservation of territorial and maritime integrity of Belize over all
its terrestrial and maritime borders or boundaries.
2) To question these said persons and inquire into all matters
involving the incidents involving the Belize Defence Force and
Belize Coast Guard and the Guatemalan Navy in the Sarstoon
River, and any other border incursion or confrontation and to
explain the exercise of sovereignty and preservation of territorial3)

To examine all such persons as are required to attend before the
Senate as witnesses, pursuant to Standing Order 72 of the Senate
Standing Orders;
To hold and conduct its sittings and meetings in public.
