AN
ORDINANCE CREATING AND INSTITUTIONALIZATION OF THE
PROVINCIAL TRAINING & EMPLOYMENT SERVICES OFFICE (PTESO) UNDER
THE OFFICE OF THE PROVINCIAL GOVERNOR, INTEGRATING THE EXISTING
TRAINING NETWORK & PLACEMENT PROGRAM (TPNP) AND THE PUBLIC
EMPLOYMENT SERVICES OFFICE (PESO). PROVIDING FOR ITS DUTIES AND
FUNCTIONS AND APPROPRIATING THEREON ITS FUNDING REQUIREMENT FOR
ITS OPERATION.

WHEREAS, unemployment and underemployment continue to be the perennial problems of the
country and have repercussions on the Province of Tarlac and these problems can be
attributed to various factors such as (1) inability of our economy to generate adequate
jobs; (2) labor market imperfections; and (3) lack of information about labor market
supply and demand;
WHEREAS, Section 3 of Article XIII of the 1987 Philippine Constitutions provides the State shall
afford full protection to labor, local and overseas, organized and unorganized, and
promote full employment and equality of employment opportunities for all, The
same policy is also contained in Book 1, Title 1, Chapter 2, Section 16 of the Local
Government Code of the Philippines and in Chapter 1, Article 3 and Book 1, Article
12 of the Labor Code of the Philippines;
WHEREAS, Section 2 of Republic Act No. 8759 otherwise known as Public Employment
Service Office Act of 1999 declares that the State shall provide full employment and
equality of employment opportunities for all, and for this purpose, to strengthen and
expand the existing employment facilitation service machinery of the government
particularly at the local levels.
WHEREAS, RA 7160 or the Local Government Code of 1991, Section 76 states that every local
government unit shall design and implement its own organizational structure and
staffing pattern taking into consideration its service requirements and financial
capability, subject to the minimum standards and guidelines prescribed by the Civil
Service Commission;
WHEREAS, in response to strengthen efforts and maximize capabilities to efficiently reduce
unemployment and underemployment in the province of Tarlac, there is a need to

(PTESO) for the purpose of intensification, continuity (and legacy) of employment
generation, and skills training & development program of the Provincial government.
Hence, producing highly competitive Tarlaqueo workforce having the Right Skills
for the Right Job that would fit in the Labor Market both domestic and foreign.
Furthermore, such creation of the said office will serve as One Stop Shop for
Tarlaqueos pertaining accessibility to training and employment opportunities.
WHEREAS, by institutionalizing the same, the Provincial government of Tarlac is making a
commitment in prioritizing the employment needs of our citizenry.
NOW THEREFORE, on joint motion, unanimously carried
RESOLVED, that the Sangguinang Panlalawigan of Tarlac, in regular session, assembled, hereby
ordains that:
ARTICLE I
TITLE AND SCOPE
Section 1. Title. This Ordinance shall be known as The Provincial Training and Employment
Office of Tarlac.
Section 2. Scope. This Ordinance shall be find application only within the territorial jurisdiction
of the Province of Tarlac.

Section 3. Declaration of Policy. It is hereby the policy of the Province of Tarlac to be a
prosperous, peaceful and environment-conscious province with sustainable and globally
competitive agriculture; a major logistics, investment, and tourist destination; with well planned
communities that are home to healthy, productive and principled citizenry.
Following the roadmap of development its leaders have crafted, the provincial government
addresses among others the areas of employment, education, health, infrastructure, trade and
industry, environment, peace and order, and preservation of its cultural heritage vis--vis effective
public governance.
The Provincial Government advocates for the attainment of optimized human resources where
human dignity is foremost. Hence, this Ordinance is enacted to harness at its best the human
resources of the Province of Tarlac to alleviate and/or eradicate poverty in the city, by providing
all qualified Tarlaqueos to a decent job/work that is suited to everybodys capabilities and selfworth.
Through the Provincial Training and Employment Service Office (PTESO), the Provincial
Government shall ensure the prompt, timely and efficient delivery of manpower development and
employment services, and provision of information relative to skills training and employment
opportunities.

ARTICLE II
THE PROVINCIAL TRAINING AND EMPLOYMENT SERVICES OFFICE
Section 1. Creation of the Provincial Training and Employment Services Office (PTESO).
There is hereby created the Provincial Training and Employment Services Office (PTESO) which
shall be placed under the control and supervision of the Office of the Provincial Governor and
shall be linked with the DOLE, TESDA, POEA, and OWWA and other government agencies for
the purpose of coordination and technical assistance.
Section 2. General Objectives of the PTESO. Specifically, the PTESO shall:

Provide a venue where Tarlaqueos could explore simultaneously various trainings


(soft trade, modular trades, and Technical-Vocational courses) and employment options
and actually seek assistance they prefer;
Serve as referral and information center for the various services and programs of DOLE,
TESDA, POEA, and OWWA and other government agencies present in the area;
Provide clients with adequate information on available trainings, employment, and
labor market situation in the area;
Network with other Public Employment Service Offices (PESOs) within the region on
employment for job exchange purposes; and
Bring training and employment services closer to Tarlaqueos by expanding reach of
existing programs and services.

Section 2. General Objectives of the PTESO.


1) The PTESO shall provide Labor Market Information (LMI) services.
For this purpose, it shall:
(a) Market and promote each services, through all forms of media, to all its labor
market clients;
(b) Regularly obtain a list of job vacancies from employers;(c) Generate and maintain an updated registry of skills;
(d) Gather, collate and process data or information on employment trends,
particularly labor supply and demand, and disseminate such data or information
to labor market clients; and
(e) Provide information on licensed or authorized recruitment agencies or
recruiters for local and overseas employment.
2) The PTESO shall provide referral and placement services for local and overseas
as well as private and civil service employment. In accordance with existing
policies, rules and regulations, it shall:
(a) Undertake active sourcing of vacancies - the PTESO shall encourage employers
to submit to the PTESO on a regular basis a list of job vacancies in their
respective establishments in order to facilitate the exchange of labor market
information between job seekers and employers by providing employment

information services to job seekers, both for local and overseas employment
and recruitment assistance to employers;
(b) Evaluate the qualifications of jobseekers in relation to wage employment
options;
(c) Refer jobseekers for appropriate employment assistance and monitor the result
of such referrals;
(d) Institute measures to ensure that recruitment and placement services, both for
local and overseas, are in accordance with existing laws, rules and regulations.
3) The PTESO shall provide training and vocational guidance and employment
counselling services. It shall:
(a) Conduct the following available Community Based Training (CBT) upon
request of a local government unit (municipal, city, or barangay):

Modular trades (Reflexology, cellphone repair, candle repair, candle


making and other related trades),

(c) Conduct pre-employment counselling, including values development and


enhancement of work ethics, to prospective local and most especially to
overseas jobseekers;
(d) Administer and evaluate psychological tests or examinations;
(e) Undertake employability enhancement trainings or seminars for jobseekers as
well as those intending to change careers or enhance their employability; and
(f) Conduct orientation and training to prospective local and overseas jobseekers
regarding rules and regulations on anti-illegal recruitment.
4) The PTESO shall provide self-employment services. It shall:
(a) Maintain and provide updated directory of government and non-government
institutions with existing skills training and livelihood programs, including the
directory of lending institutions;
(b) Determine clients potentials for entrepreneurial undertakings;
(c) Refer clients for appropriate self-employment or livelihood assistance and
monitor the results of such referrals.
5) The PTESO shall provide reintegration assistance services to reintegration
assistance services to returning overseas Filipino workers (OFWs). It shall:
(a) Provide a mechanism for the reintegration of OFWs;
(b) Determine or obtain information on returning OFWs and provide periodic
information of job opportunities;
(c) Undertake other appropriate programs to promote the welfare of OFWs and
assist in gathering or tapping the skills and potentials of the returning OFWs;
and
(d) Facilitation of referral of OFWs to the Overseas Workers Welfare
Administration (OWWA).
6) The PTESO shall monitor performances of the City/Municipal PESOs, SUCPESOs, and Barangay Training and Employment Coordinators (BTECs) leaders
for the purpose to address issues and concerns including updates related to
program implementation. Likewise, the PTESO shall provide the necessary
assistance in the conduct of the regular meetings of the BTECs which is facilitated by
the city/municipal Public Employment Service Offices (PESOs). Further, field
visitations and regular coordination with Local Chief Executives form part of the
technical supervision and administration of the PTESO.
7) The PTESO shall likewise perform other functions analogous to the above
including programs or activities which is offered by TESDA pertaining Skills
Training and Manpower development, and programs or activities developed by
the DOLE to enhance provision of employment assistance to clients, particularly
for special groups of disadvantaged workers such as persons with disabilities
(PWDs) and displaced workers.

8) The PTESO shall perform such other tasks related to its functions and to
undertake pertinent assignment and duties as may be assigned and/or requested
by the Provincial Governor.
9) In addition to the foregoing, the PTESO shall undertake the following programs
and activities:
(a) Job Fair This is being conducted periodically in the Province to bring together
in one venue the job seekers and employers for immediate matching. This
employment facilitation strategy is aimed to fast-track the meeting of job seekers
and employers in one venue at a specific date to reduce cost, time and effort on the
part of the job seekers;
(b) Special Credit Assistance for Placed Overseas Workers this type of assistance
will enable poor but qualified applicants to avail of opportunities for overseas
employment;
(c) Special Program for the Employment of Students and Out-of-School Youth
(SPESOS) This program provides employment to deserving students and out-ofschool-youth coming from poor families during summer and/or Christmas
vacations as provided for under Republic Act No. 7323 and amended under
Republic Act No. 9547, to enable them to pursue their education by facilitating the
employment of secondary level students, this is being implemented throughout the
year especially during summer and/or Christmas vacations and of tertiary,
vocational, and technical level students any time of the year. Under the program,
60 percent of the salaries and wages of the program beneficiaries will come from
the LGU while 40 percent from the DOLE;
(d) Work Appreciation Program (WAP) This program aims to develop the values
of work appreciation and ethics by exposing the young to actual work situations;
(e) Livelihood and Self-Employment Bazaars These will give clients information
on the wide array of livelihood programs they can choose to avail of by referring
them to the Provincial Cooperative and Enterprise Development Office (PCEDO)
and in coordination with other government and non-government institutions
undertaking livelihood and self-employment programs;
(f) Vocational and Career Guidance Program This is being done through
coordination with various high schools in the city and with the Department of
Education (DEPED-Tarlac) in the conduct of vocational guidance sessions
designed to answer future demands from both local and foreign labor markets;
(g) Government Internship Program This is a program of the Department of the
Interior and Local Governance (DILG) where the youth is given the opportunity to
be trained and exposed to government administration. A component of the
Kabataan 2000 Program, now known as the Sikap Kabataang Pinoy Program, as
provided for by Executive Order No. 1395. Under this program, the participating

government agency shall provide the participants with stipend of not more than 75
percent of the prevailing minimum wage;
(h) Workers Hiring for Infrastructure Projects (WHIP) This program is in
pursuance of Republic Act No. 6685 which requires construction companies in the
province including contractors for government-funded infrastructure projects to
hire thirty-percent (30%) of skilled and fifty-percent (50%) unskilled labor
requirements from the areas where the project is constructed or located;
(i) Tulong Alalay sa Taong May Kapansanan (TULAY) This program aims to
assist in the integration of persons with disabilities in society by providing them
access to training and employment opportunities both in the formal and informal
sectors;
(j) Emergency Employment - This designed to provide temporary employment for
out-of-school and out-of-work youth and disadvantage workers affected by
calamities. The program beneficiaries will be engaged in short-term community
works projects.
(k) Discovering the World of Work (D-WOW) It aims to influence the career
decisions of graduating high school students by exposing them to actual work
situations through field trips or educational tours especially to establishments that
belong to the countrys Key Employment Generators (KEG) as identified by the
DOLE for the next ten years;
(l) Labor Education for Graduating Students (LEGS) Graduating students of
vocational and baccalaureate course are given orientation on labor and employment
matters though the LEGS. The Program will help graduating students become
familiar with employment facilitation services of the PESO, workers protection and
security coverage for employees;
(m) Anti-Illegal Recruitment Program This program is in support of the national
governments campaign against illegal recruitment at the grassroots level by
providing relevant and helpful information to all Filipinos planning to migrate and
work abroad;
(n) Child-Labor Program This program is in support of the government effort to
eliminate in the city all forms of child labor in compliance with R.A. 9231 ( An Act
providing for the elimination of the worst forms of Child Labor and affording
stronger protection for the Working Child, amending for this purpose Republic Act
No. 7610, as amended, otherwise known as the Special Protection of Children
against Child Abuse, Exploitation and Discrimination Act);
(o) Pwede Pa kami Program (PPKP) - This is an employment assistance program
being extended by the PTESO to its clients with age ranging from fourty (40) years
old and above.

(p) Mobile Passport Service This is in coordination with the Department of Foreign
Affairs in order to facilitate processing of passport applications and renewal of
Tarlaquenos.
(q) Mobile PRC Renewal This is another endeavor geared toward employment
which caters to the needs of the professionals. This is in coordination with the
Professional Regulation Commission (PRC) in order to facilitate the renewal of
professional licenses.
(r) Other programs and activities designed to enhance the provision of employment
assistance to PTESOs clients including Persons with Disabilities (PWDs),
displaced workers and working from the disadvantage sectors.
Section 3. Organizational Structure of PTESO. In order to effectively perform the
abovementioned powers and functions, the PTESO shall be divided into two (3) main sections and
shall be headed by the Provincial Training and Employment Services Officer (PTESO
Manager);

Sorting and encoding of applicants resume to the online job matching
facility of DOLE (Phil-Job.Net)
Perform clerical functions - Creates purchase request, purchase order,
disbursement vouchers, inspection and acceptance report, certifications,
reimbursements and follow up and keep track of the process of our
documents.
Perform other functions assigned by the PTESO Manager relative to the
foregoing.

3) Labor and Employment Section


(a)

Local Employment
i.
In charge of domestic placement, career orientation, livelihood,
domestic job fairs, schools and recruitment and placement;
ii.
Maintains recruitment calendar of activities, meetings, presentations
and various events;
iii.
Coordinates activities with recruiters, other private companies and
government agencies on available job openings and vacancies for
local employment;
iv.
Manage communications dealing with queries from applicants,
companies and recruitment partners in a professional and timely
manner; and
v.
Perform other ad hoc duties as required or as assigned by the PTESO
Manager.

(b)

Overseas Employment
i.
In charge of Registration of applicants for overseas employment,
including screening for job matching and Pre-orientation of
applicants.
ii.
In charge of migrant workers, migrant workers reintegration,
organization of OFW families and job fairs for overseas
employment;
iii.
Serve as the focal of the Persons pertaining to the concerns and
issues of OFWs;
iv.
Coordinate with Overseas Workers Welfare Administration
(OWWA) and other national agencies on programs intended to
benefit the OFWs and their families;
v.
Keep and maintain record of OFWs from the Province of Tarlac and
indicating therein their specific address where they are destined; and
vi.
Perform other duties assigned by the PTESO Manager relative to
their function

Section 4. Duties and Functions of the PTESO Manager. The PTESO Manager shall be vested
with the power to recommend to the Provincial Governor for appointment the members of the
staff, as the exigencies of the Office so require; provided, however, the recommendees to the
positions meet at least the minimum requirements of the positions.
The primary essence of work of the PTESO Manager is to manage all technical and administrative
activities.

Staff Management
(a)
Detail staff responsibilities and guide and coach staff when needed.
(b)
Identify training needs and arrange staff training as necessary (i.e. inhouse or block release) training staff, or delegating training to appropriate
staff, to undertake their duties effectively and efficiently, dealing with any
problems such staff may have undertaking their duties.

Referring to Civil Service Commission Rules when formal disciplinary
action requires to be considered.

Working Environment
(a)
Ensure that safe working practices are adopted by staff within the
department at all times.
(b)
Ensure department is maintained in a clean and tidy state at all times.

3)

Communication to the Higher Authority


(a)
Maintain effective communications with the Provincial Governor through
relevant briefing sessions or method appropriate to circumstances and
attend supervisory meetings when called.

Planning
(a)
Develop action plans, proposals and other documents needed in the
implementation of programs and services.

5)

Conducting Daily Activities


(a)
Maintain a systematic process flow to ensure the effective and efficient
running of the office and to avoid complaints from the clients.
(b)
If required to do so in emergency situations (i.e. situations where
extreme staff shortages arise) undertake duties assigned to staff to cover
his/her absences and avoid delay of transaction.

Monitoring PTESO Activities


(a)
Ensure, by regular checking, that the quality of the service is consistent to
the desired standard.
(b)
As appropriate conduct a reviews of the daily procedures being
implemented in order to update and trim down unnecessary processes and
carry out remedial action.

7)

Improvement and Problem Solution


(a)
Satisfactorily resolve internal or external matters relating to the operation
(i.e. operational or staff) referring more complex issues to the PTESO
Manager for advice or guidance (includes operational issues coming from
previous or subsequent PESO units). If any matter cannot be resolved at
this level it should be passed on to the DOLE Provincial Officer.
(b)
Ensure implementation of improvement initiatives, maintaining
appropriate records and working with staff on continual improvement of
processes and reduction of waste.

Furthermore, the PTESO Manager shall coordinate closely with the Department of
Labor and Employment (DOLE), Technical Education and Skills Development
Authority (TESDA), Philippine Overseas Employment Administration (POEA),
Overseas Workers Welfare Administration (OWWA), Department of Trade and
Industry (DTI), Commission on Higher Education (CHED), Department of

Education (DepEd), State Universities and Colleges (SUCs) and establish linkages
with various line offices in the Provincial Government of Tarlac, Non-Government
Organizations (NGOs), and other agencies offering manpower development /skills
training and labor & employment services, both local, national, and international
in the attainment of the PTESO vision, mission, goals and objectives.

perform other duties assigned by the Provincial Governor relevant to his/her


function.

Section 5. Staffing Pattern. To effectively discharge the duties and functions of all sections
under the PTESO, there shall be qualified personnel that shall be assigned to each section in
accordance with the rules and regulations promulgated by the Civil Service Commission. The
personnel positions that will be created shall comprise the PTESO are the following:

ARTICLE III
FUNDING REQUIREMENT
Section 1. Budget Requirement. The Local Chief Executive is hereby authorized to prepare the
executive budget for the salaries of its personnel, its plans programs and activities for the next
supplemental budget, the 2016 annual budget and every annual budget thereafter.
ARTICLE IV
FINAL PROVISIONS
Section 1. Repealing Clause. Local Ordinances, Resolutions, Orders, Rules and Regulations
and other issuances of the Provincial Government of Tarlac that are inconsistent with this
Ordinance are hereby repealed, amended, and modified accordingly.
Section 2. Separability Provision. If for any reasons, any section of this Ordinance, or any
portion hereof or the application of such section or provision, or portion hereof to any person,
group, or circumstance is declared invalid or unconstitutional, the remainder shall be in full force
and effect.
Section 3. Effectivity. This Ordinance shall take effect 15 days after its approval.
Adopted this ___ day of August 2015.
