Under Article IX-C, Section 2 of the 1987 Constitution of the Republic of the Philippines, the
Commission on Elections has the power to enforce and administer all laws relative to the conduct of
elections, decide all questions affecting elections, register and regulate political parties,
organizations or coalitions and ensure orderly elections. It provides:
"(5) Register, after sufficient publication, political parties, organizations, or coalitions which, in
addition to other requirements, must present their platform or program of government; and accredit
citizens' arms of the Commission on Elections. Religious denominations and sects shall not be
registered. Those which seek to achieve their goals through violence or unlawful means, or refuse to
uphold and adhere to this Constitution, or which are supported by any foreign government shall like-
wise be refused registration."
Relative to this, Section 2 of R. A. No. 7941 otherwise known as the "Party-List System Act" provides
for a party-list system of registered national, regional and sectoral parties or organizations or
coalitions thereof xxx, to wit:
"Section 2. Declaration of Policy. - The State shall promote proportional representation
in the election of representatives to the House of Representatives through a party-list system of
registered national, regional and sectoral parties or organizations or coalitions thereof, which will
enable Filipino citizens belonging to marginalized and underrepresented sectors, organizations and
parties, and who lack well-defined political constituencies but who could contribute to the
formulation and enactment of appropriate Legislation that will benefit the nation as a whole, to
become members of the House of Representatives. Towards this end, the State shall develop and
guarantee a full, free and open party system in order to attain the broadest possible representation
of party, sectoral or group interests in the House of Representatives by enhancing their chances to
compete for and win seats in the legislature, and shall provided tlle simplest possible".
Proceeding therefrom, COMELEC Resolution No. 8691 1 entitled "Rules and Regulations Governing the
Filing of Manifestation of Intent to Participate and Submission of Names of Nominees under the Party-
List System of Representation in connection with the May 10, 2010 Automated National and Local
Elections" provides as follows, to wit:
1. Any organized group duly registered under the party-list system of
"Section
representationmay file with the Commission a manifestation of intent to participate in the
party-list eLection." (Emphasis and underscoring supplied.)
On February 12, 2007, this Commission promulgated COMELEC Resolution No. 7819 2 which pertinently
provides as follows:
"RESOLVED, finally, that the following registered parties are QUALIFIED to participate in the 2007
elections for party-list upon filing of the required Manifestation pursuant to Resolution Nos. 7804
entitled, 'RULES AND REGULATRIONS GOVERNING THE FILING OF MANIFESTATION OF INTENT TO
PARTICIPATE, AND SUBMISSION OF NAMES OF NOMINEES UNDER THE PARTY-LIST SYSTEM OF
REPRESENTATION, IN CONNECTION WITH THE 14 MAY 2007 SYNCHRONIZED NATIONAL AND LOCAL
ELECTIONS', and 7804-A, entitled, 'IN THE MATTER OF AMENDING SECTION 3 OF RESOLUTION NO. 7804
AND ANNEX 'A' THEREOF', promulgated on 12 January 2007 and 18 January 2007, respectively:

All the foregoing registered parties had participated in the Party-List System of Representation in the
May 14, 2007 Synchronized National and Local Elections with the exception of the following, to wit:
(8) It fails to participate in the last two (2) preceding elections or fails to obtain at least two
percentum (2%) of the votes cast under the party-list system in the two (2) preceding elections for the
constituency in which it has registered.'
WHEREAS, COMELEC Resolution No. 2847 promulgated 25 June 1996 entitled: "In Re: Rules
and Regulations Governing the Election of the Party-List Representatives through the Party-List
System", which states:
'Sec. 6. Removal and/or Cancellation of Registration. - The Commission may
motu proprio or upon verified complaint of any interested party, remove or cancel, after due notice
and hearing, the registration of any national, regional or sectoral party, organization or coalition on
any of the following grounds:
(8) It fails to participate in the last two (2) preceding elections or fails to obtain at least two
percentum (2%) of the votes cast under the party-list system in the two (2) preceding elections for the
constituency in which it has registered.'
WHEREAS, a party registered for the two (2) preceding elections shall be considered to have
failed to obtain at least two per centum (2%) of the votes cast under the party-list system if the
latest 'Party-List Canvass Reports' for said elections show that the percentage obtained by said party
did not reach two per centum (2%) of the votes cast therein. However, this shall not apply if a party,
although receiving less than two per centum (2%) of the votes cast under the party-list system in the
May 2007 National Elections, was allocated a seat during said election pursuant to the Decision of the
Supreme Court in the case of Barangay Association for National Advancement and Transparency
(BANAT) vs. Commission on Elections, G.R. No. 179271, and Bayan Muna, A Teacher, and Abono vs.
Commission on Elections, G.R. No. 179295, as well as, the Resolutions of the Commission
implementing the said Decision."
NOW, THEREFORE, pursuant to the powers granted by the Constitution, the Omnibus
Election Code, Republic Act No. 7941 and other election laws, the Commission hereby orders:
To DELETE the following party-list [coalitions/sectoral organizations] from the list of
registered national, regional or sectoral parties, organizations or coalitions:
