AFFIDAVIT OF WITNESS
I, JANICE D. FALCATAN, of legal age, Filipino citizen and a resident of Km 4,
Barangay Pasonanca, Zamboanga City, Philippines, after having been duly sworn to in
accordance with law hereby depose and say that:
1. I personally know ARNOLD GALLO PARTOSA (ARNOLD for brevity)
considering that he is my live in partner who is one of the Respondent in NPS
Docket No. IX-06-INQ-15G-00738 for alleged Violation of Republic Act No.
9165 otherwise known as Comprehensive Dangerous Drugs Act of 2002 pending
before the Office of the Honorable City Prosecutor of Zamboanga City;
2. On 04 August 2015, at or about 8:00 oclock in the morning ARNOLD and I had
our breakfast. Thereafter, he told me that he has scheduled interview at 9:00
oclock in the morning at RABAR Construction located at BCC Complex, San
Jose, this City;
3. Before leaving the house he borrowed the amount of FORTY PESOS (P40.00)
Philippine Currency from my Mother to refuel the motorcycle which has
entrusted to him by ACO Construction;
4. Thereafter, on the same day, my husband did not return home for lunch. I did not
text him considering that I assumed that he was already hired by RABAR
Construction;
5. At or about 9:00 oclock in a rainy evening of the same date, I prepared for our
dinner while waiting for ARNOLD to return home. I texted him several times
however, he did not reply;
6. On or about 11:00 oclock in the evening on the same date, I was not able to sleep
considering that I was waiting for ARNOLD to arrive home. I waited until 2:00
oclock early dawn;
7. On 05 August 2015, on or about 6:00 oclock in the morning, my uncle asked me
if ARNOLD was at home and I answered saying that he did not return home since
yesterday. Thereafter, my uncle told me that he heard a report from BRIGADA
NEWS RADIO that there was a PARTOSA arrested in Lunzuran, this City, for
possession of illegal drugs;
8. I hereby declare under oath that my husband ARNOLD GALLO PARTOSA is a
good person and that he will never allow himself to do such unlawful acts;

I execute this Affidavit to attest to the truth of the foregoing facts based on
personal knowledge and authentic records in support to the Counter-Affidavit of
ARNOLD GALLO PARTOSA. It is thus requested that the instant case docketed
as NPS Docket No. IX-06-INQ-15G-00738is dismissed for utter lack of merit.
