RESOLUTION RECOMMENDING THE NEGOTIATED BIDDING FOR

THE SUPPLY AND DELIVERY OF EQUIPMENT REQUIRED IN THE
NRDC-MYCORRHIZA
PROJECT
(MASS
PRODUCTION
AND
MARKETING OF MYCORRHIZAL INOCULANTS FOR THE NATIONAL
GREENING PRPOGRAM) AND ITS AWARD TO
BIO LOGIX
ENTERPRISES PHILS. OF 57F RICHVILLE CORPORATE TOWER
1107 ALABANG ZAPOTE ROADM MADRIGAL BUSINESS PARK,
ALABANG, MUNTINGLUPA

WHEREAS, the Department of Environment and Natural Resources as mandated

under Executive Order No. 26 to be the lead agency in the implementation of the
National Greening Program (NGP) which aimed to plant 1.5 billion trees and cover
1.5 million hectares of public forest;
WHEREAS, the Ecosystems Research and Development Bureau (ERDB) and the
Natural Resources Development Corporation (NRDC) collaborated to develop the
technology of growth improvement of seedlings in degraded and marginal areas
through mass production of Mycorrhiza inoculants and to market same for the
production of good quality seedlings in support of the NGP;
WHEREAS, the ERDB selected the UPLB, College, Laguna as its production site
of the Micorrhiza Project and the NRDC in three (3) sites: Ramon Magsaysay
Technological Institute (RMTU) in Botolan, Zambales for Luzon, Bohol Island State
University (BISU) in Bilar, Bohol, for Visayas and Caraga State University (CSU) in
Butuan, Agusan del Norte for Mindanao;
WHEREAS the Micorrhiza Project requires the procurement of office and
laboratory equipment which are necessary in the preparation and production of
Mycorrhiza inoculants;
WHEREAS, the NRDC-BAC on Micorrhiza Project pursuant to related provisions of
the IRR of RA 9184(Government Procurement Reform Act), published the bidding of
the subject office and laboratory equipment in the PHILGEPS on March ___, 2013
and the public posting of Invitation to Bid forms on the conspicuous places in the
NRDC and other offices;
WHEREAS, the bidding on April ___, 2013 and its re-bidding on April ___, 2013
of the required office and laboratory equipment failed due to lack of bidders. In
both biddings, the Biologix Enterprise, Phils. was the sole participating bidder as
well as in its Pre-bidding conference to which the NRDC-BAC pre-qualified for having
submitted the required eligibility requirements;
WHEREAS, the NRDC-BAC on Micorrhiza Project, based on the failure of the two
(2) consecutive biddings, decided to procure the required office and laboratory
equipment through negotiated bidding and declared to:

Consider the Bio Logix Enterprises, Phils. as the winning bidder having
participated in the scheduled bidding conferences and for submitting the
required eligibility requirements and bid offers for the required office and
laboratory equipment;

accept its bid offers with warranties for the office and laboratory equipment,
and the option to deliver the required items within forty five (45) days at the
production sites with additional cost subject to deduction of One Percent (1%)
of its total cost for every day delay of delivery;

Issue the Notice of Award, Purchase Order (PO), and payment upon
acceptance by the NRDC of the delivered laboratory supplies, materials, and
equipment to Bio Logix Enterprise, Phils.

In the event of the Bio Logix Enterprise, Phils. non-compliance and/ or

violation of existing procurement laws, rules and regulations or any of the
terms and conditions as set forth in the Notice of Award and the Purchase
Order (PO) under any and all circumstances, the award to the BIO LOGIX
ENTERPRISE, PHILS. by the NRDC shall be forfeited without any obligations
whatsoever to reimburse the same to the former, and the cancellation of the
Notice of Award and the Purchase Order (PO).

NOW THEREFORE, and in view of the above premises, the NRDC-BAC

resolved to recommend as it hereby resolved and recommended the award of the
contract to the
BIO LOGIX ENTERPRISE, PHILS., 57F Richville Corporate
Tower 1107 Alabang Zapote Road, Madrigal Business park, Alabang, Muntinglupa as
a result of the negotiated bidding on
April 29, 2013 at the 9F NRDC Conference
Room, 1515 DENR by the Bay Bldg., Roxas Boulevard, Ermita, Manila for the supply
and delivery of the required laboratory supplies, materials, and equipment to the
Mychoriza Projects production sites in Ramon Magsaysay Technological Institute
(RMTU) in Botolan, Zambales for Luzon, Bohol Island State University (BISU) in Bilar,
Bohol, for Visayas.
