In sede di prima applicazione, i modelli di
organizzazione aziendale definiti conformemente alle
Linee guida UNI-INAIL per un sistema di gestione
della salute e sicurezza sul lavoro (SGSL) del 28
settembre 2001 o al British Standard OHSAS
18001:2007 si presumono conformi ai requisiti di cui
ai commi precedenti per le parti corrispondenti. Agli
stessi fini ulteriori modelli di organizzazione e
gestione aziendale possono essere indicati dalla
Commissione di cui allarticolo 6.

La Legge n. 123 dell'agosto 2007 ha introdotto due
nuovi reati-presupposto nella disciplina del D.Lgs.
231/01, vale a dire i reati di "Omicidio colposo e
lesioni colpose gravi o gravissime, commessi con
violazione delle norme antinfortunistiche e sulla tutela
dell'igiene e della salute sul lavoro" (art. 25 septies).


OHSAS 18001 Revision Process (1/2)

OHSAS 18001 was developed and came into effect in April 1999
modeled after BS8800:1996 - Guide to Occupational Health and
Safety Management Systems and other documents.

A systematic review conducted
A large majority of respondents indicated revision necessary to be
aligned to ISO 14001:2004.

February 2006
The first "Working Draft, WD1, was developed against the comments
received during the "systematic review and circulated for general
review and comment.
Approximately 500 individual comments were received against WD1.

The second and final Working Draft, WD2, was developed and
circulated for general review and comment.

March 2007

Additional 560 comments received against WD2 were reviewed.

Does the organization have to take account of its neighbours?

What is the workplace that the organization is responsible for OH&S?

What about workers who are travelling or working at a customers


To what extent should human behaviour or capability be considered?

To what extent should workers, (sub)contractors, or other interested

parties, be consulted on OH&S matters?

tolerated by the organization having regard to its legal
obligations and its own OH&S policy

identifiable, adverse physical or mental condition
arising from and /or made worse by a work activity
and/or work-related situation

3.9 incident (revised)
work-related event(s) in which a injury or ill health
(regardless of severity) or fatality occurred or could
have occurred

An accident is an incident which has

given rise to injury, ill health or fatality.


An incident where no injury, ill health, or

fatality occurs may also be referred to as a
near-miss, "near-hit", "close call" or
"dangerous occurrence".


An emergency situation (see 4.4.7) is a

particular type of incident.

NOTE When giving consideration to what constitutes a place of
work, the organization should take into account the OH&S effects
on personnel who are, for example, travelling or in transit (e.g.
driving, flying, on boats or trains), working at the premises of a
client or customer, or working at home

4.1 General requirements (revised)
The organization shall establish, document,
implement, maintain and continually improve an
OH&S management system in accordance with the
requirements of this OHSAS standard and determine
how it will fulfil these requirements.
The organization shall define and document the scope
of its OH&S management system.

4.3.1 Hazard identification, risk assessment and
determining controls (revised)
The procedure(s) for hazard identification and risk
assessment shall take into account:

c) human behaviour, capabilities and other human factors;

d) identified hazards originating outside the workplace capable
of adversely affecting the health and safety of persons under
the control of the organization within the workplace

g) changes or proposed changes in the organization, its

activities, or materials;
h) modifications to the OH&S management system, including
temporary changes, and their impacts on operations,
processes, and activities.

4.3.1 Hazard identification, risk assessment and
determining controls (continued)
For the management of change, the organization shall
identify the OH&S hazards and OH&S risks
associated with changes in the organization, the
OH&S management system, or its activities, prior to
the introduction of such changes.

measures that reduce the risks according to the
