CONTRACT OF LEASE

KNOW ALL MEN BY THESE PRESENTS:


This Contract of Lease made and entered into by and between:
SPS. MIGUEL & JOLLY FE MERCURIO, of legal age, Filipino,
married to each other and residents of District IV, Osmena St., Pastrana,
Leyte, Philippines, hereinafter referred to as the "LESSOR";
- and RODEL R. LANTAJO, of legal age, Filipino, (single / married /
widow), and a resident of Brgy. San Miguelay, Sta. Fe, Leyte, Philippines
hereinafter referred to as the "LESSEE";
WITNESSETH That:
WHEREAS, the LESSOR is the owner of a certain parcel of land situated
at Brgy. Arabunog, Pastrana, Leyte, Philippines, more particularly described as
follows:

A parcel of agricultural land, situated at Brgy.
Arabunog, Pastrana, Leyte described as Lot No. 2435 Case-19,
Cad 821-D. Bounded as follows:

containing an area of Thirteen Thousand Six
Hundred Eighty-Five (13,865), square meters, more
or less.
WHEREAS, the LESSOR desires to lease the afore-described property in
favor of the LESSEE and the LESSEE accepts the lease subject to the terms
and conditions herein set forth.

NOW, THEREFORE, for and in consideration of the terms and conditions


mutually agreed upon by the parties, the LESSOR hereby lease unto the
LESSEE, his heirs, successors and assigns, the above-described parcel of land
subject to the following terms and conditions, to wit:
1.
That the term of this lease shall be for a period of Two (2) years to
commence upon the signing of this Contract and shall be renewable for
another year at the option of the LESSEE upon mutual agreement of the
parties;
2. That the monthly rentals on the leased premises above-mentioned
shall be one-fourth (1/4) of the total net proceeds of the harvest. The rentals
shall be paid by the LESSEE to the LESSOR immediately within five (5) days
following the sale/disposal of the said harvest;
3. That the LESSEE shall pay the real property taxes levied of the leased
premises;
4. It is expressly agreed by the parties herein that any fixed
improvements or renovations that will be introduced in the subject land shall
become the property of the LESSOR after the expiration of the term of this
Contract. (No further improvement shall be introduced by the LESSEE to the land
subject of this Contract)
5. LESSEE further covenant and agree, TO:
a. Use the premises for agricultural purposes only particularly for
planting vegetables only;
b. Harvest and remove all crops in due season;
c. Keep all ditches clean of weeds and debris;
d. Mow roadsides and fence rows;
e. Destroy all noxious weeds and grasses and nuisances in
compliance with the law;
f. Commit no waste or damage on said premises and to permit or
allow none to be done;
g. Retain possession of the premises during the term hereof, and not
to assign or sublet any portion without LESSORs written consent;
6. That LESSOR or his legal representative shall have the right to enter the
premises at any time to view the same or show the same to prospective
purchasers or tenants, or to make repairs or improvements and to permit or
deny trespass and/or hunting privileges at the discretion of the LESSOR;
7. That LESSEE shall take possession of the leased premises and perform the
services to be rendered hereunder as independent contractors subject to the
usual hazards of operating a vegetable farm and will assume all risk of
accidents in pursuance of the farming operations or in performing repairs and
maintenance to buildings, storage, wells and the like;

8. That LESSEE will surrender the said premises at the expiration of the term
of this lease or upon cancellation thereof as herein provided, without further
demand or notice in such condition as shall be in compliance with the
provisions hereof;
9. That is the LESSEE shall fail to cultivate said premises as herein agreed, or
shall fail to keep any of the covenants above, the LESSOR or his representative
may have the work done and shall be reimbursed therefore from the LESSEEs
share of the harvest, or may at the election of the LESSOR, terminate this
Contract of Lease;
10. That the LESSOR promises to let LESSEE peacefully hold and enjoy said
premises during the term of this agreement without interruption by the
LESSOR or any person rightfully claiming under him, except of course when
said interruption is done for purposes of implementing or enforcing the
stipulations contained herein;
11. That nothing in this Contract is intended to make LESSEE a tenant of the
LESSOR. No other relationship will arise from the execution of this agreement
but that of Lessor-and-Lessee only;
12. That failure to pay the rental of this farm at the time specified, may give
rise to the termination of this Contract, at the election of the LESSOR;
13. That this entire agreement shall be binding upon the parties, their heirs,
executors, administrators and assigns.
IN WITNESS WHEREOF, the parties have hereunto affixed their
signatures this ___ day of October 2013 at Pastrana, Leyte, Philippines.
