MUNICIPAL ORDINANCE NO. 015-2014


FIXING AT 1,315 THE NUMBER OF FRANCHISES TO BE GRANTED FOR
OPERATORS OF TRICYCLES-FOR-HIRE IN THE TERRITORIAL JURISDICTION OF
THE MUNICIPALITY OF GUINOBATAN FOR A PERIOD OF FIVE (5) YEARS.

WHEREAS, under Section 7 par. A of Municipal Ordinance No. 02, Series of


1999, otherwise known as the Guinobatan Tricycle Code of 1999, the Sangguniang
Bayan of Guinobatan shall determine the necessary number of Franchises for Tricyclefor-hire to be granted to qualified Tricycle Operators to operate within the territorial
jurisdiction of the Municipality of Guinobatan, Albay;
WHEREAS, after a series of consultations and meetings with the representatives
of Tricycle Drivers and Operators (GUIFTODA), it was unanimously agreed to fix at
1,315 the number of franchises to be granted to qualified tricycle operators;
WHEREAS, the purpose of limiting the number of franchises to be awarded to
operators is to avoid cut-throat-competition in the transport sector particularly among
drivers of tricycle-for-hire;

WHEREFORE, in view of the foregoing premises,


BE IT ORDAINED
ASSEMBLED, THAT:

SECTION 1. AUTHORIZED NUMBE OF TRICYCLE FRANCHISE. The


authorized of tricycle franchises to be awarded to qualified applicants or operators of
Tricycle-for-Hire to operate within the territorial jurisdiction of the Municipality of
Guinobatan is hereby fixed at 1,315.
SECTION 2. 5-YEAR MORATORIUM. All applications for new tricycle franchises
in excess of the 1,315 shall be suspended for a period of five (5) years upon the
effectivity of this ordinance.
SECTION 3. EXCEPTION. Cancelled and declared vacant tricycle franchises,
however, of erring franchise holders including those dropped/surrendered shall remain
open for application and awarding to applicants possessing the necessary qualifications
and none of the disqualifications provided in the Tricycle Code of Guinobatan but shall
in no case exceed the 1,315 limit.
SECTION 4. SEPARABILITY CLAUSE. If, for any reason/s, any part/s of this
ordinance shall be held to be unconstitutional or invalid, other part/s or provisions hereof
which are not affected thereby shall continue to be in full force and effect.
SECTION 5. REPEALING CLAUSE. Section 9 (a) of Municipal Ordinance No.
02, Series of 1999, as amended, and any other ordinance/s or part/s thereof which are
inconsistent with any of the provisions of this Ordinance are hereby repealed, amended
or modified accordingly.
SECTION 6. EFFECTIVITY. This ordinance shall take effect upon its approval.
