1 INTRODUCTION
This chapter asks what contractarian political theory can tell us about the place of the
criminal law, and of criminals, in a liberal society. It begins by distinguishing two forms of
contractarian thinking: one owed to the mutual advantage tradition of Hobbes; the other
to the impartialist tradition of Kant. The argument is that both can underwrite a system of
criminal law, and of punishment, for similar reasons.
