OBJECTIVESANDAPPLICATION

Objectives—immigration

3.(1)TheobjectivesofthisActwithrespecttoimmigrationare

(a)topermitCanadatopursuethemaximumsocial,culturalandeconomicbenefitsof

immigration;

(b)toenrichandstrengthenthesocialandculturalfabricofCanadiansociety,whilerespecting

thefederal,bilingualandmulticulturalcharacterofCanada;

(b.1)tosupportandassistthedevelopmentofminorityofficiallanguagescommunitiesin

Canada;

(c)tosupportthedevelopmentofastrongandprosperousCanadianeconomy,inwhichthe

benefitsofimmigrationaresharedacrossallregionsofCanada;

(d)toseethatfamiliesarereunitedinCanada;

(e)topromotethesuccessfulintegrationofpermanentresidentsintoCanada,whilerecognizing

thatintegrationinvolvesmutualobligationsfornewimmigrantsandCanadiansociety;

(f)tosupport,bymeansofconsistentstandardsandpromptprocessing,theattainmentof

immigrationgoalsestablishedbytheGovernmentofCanadainconsultationwiththeprovinces;

(g)tofacilitatetheentryofvisitors,studentsandtemporaryworkersforpurposessuchas

(h)toprotectpublichealthandsafetyandtomaintainthesecurityofCanadiansociety;

credentialsofpermanentresidentsandtheirmorerapidintegrationintosociety.

(2)TheobjectivesofthisActwithrespecttorefugeesare

(a)torecognizethattherefugeeprogramisinthefirstinstanceaboutsavinglivesandoffering

protectiontothedisplacedandpersecuted;

(b)tofulfilCanada’sinternationallegalobligationswithrespecttorefugeesandaffirmCanada’s

commitmenttointernationaleffortstoprovideassistancetothoseinneedofresettlement;

(c)togrant,asafundamentalexpressionofCanada’shumanitarianideals,fairconsiderationto

thosewhocometoCanadaclaimingpersecution;

(d)tooffersafehaventopersonswithawell­foundedfearofpersecutionbasedonrace,

(e)toestablishfairandefficientproceduresthatwillmaintaintheintegrityoftheCanadian

refugeeprotectionsystem,whileupholdingCanada’srespectforthehumanrightsand

fundamentalfreedomsofallhumanbeings;

(f)tosupporttheself­sufficiencyandthesocialandeconomicwell­beingofrefugeesby

facilitatingreunificationwiththeirfamilymembersinCanada;

(g)toprotectthehealthandsafetyofCanadiansandtomaintainthesecurityofCanadian

society;and

(h)topromoteinternationaljusticeandsecuritybydenyingaccesstoCanadianterritoryto

persons,includingrefugeeclaimants,whoaresecurityrisksorseriouscriminals.

Application

(3)ThisActistobeconstruedandappliedinamannerthat

(a)furthersthedomesticandinternationalinterestsofCanada;

(b)promotesaccountabilityandtransparencybyenhancingpublicawarenessofimmigration

andrefugeeprograms;

(c)facilitatescooperationbetweentheGovernmentofCanada,provincialgovernments,foreign

states,internationalorganizationsandnon­governmentalorganizations;

(d)ensuresthatdecisionstakenunderthisActareconsistentwiththeCanadianCharterof

RightsandFreedoms,includingitsprinciplesofequalityandfreedomfromdiscriminationandof

theequalityofEnglishandFrenchastheofficiallanguagesofCanada;

(e)supportsthecommitmentoftheGovernmentofCanadatoenhancethevitalityofthe

EnglishandFrenchlinguisticminoritycommunitiesinCanada;and

(f)complieswithinternationalhumanrightsinstrumentstowhichCanadaissignatory.

thegovernmentofaforeignstateorwithaninternationalorganizationforthepurposesofthisAct.

Federal­provincialagreements

8.(1)TheMinister,withtheapprovaloftheGovernorinCouncil,mayenterintoanagreement

withthegovernmentofanyprovinceforthepurposesofthisAct.TheMinistermustpublish,once

ayear,alistofthefederal­provincialagreementsthatareinforce.

Consistencywithagreement

(2)Subjecttosubsection(3)butdespitetheotherprovisionsofthisAct,thefollowingmustbe

consistentwiththefederal­provincialagreements:

(a)theselectionandsponsorshipof,andtheacquisitionofstatusby,foreignnationalsunder

Soleprovincialresponsibility—permanentresidents

9.(1)Whereaprovincehas,underafederal­provincialagreement,soleresponsibilityforthe

selectionofaforeignnationalwhointendstoresideinthatprovinceasapermanentresident,the

followingprovisionsapplytothatforeignnational,unlesstheagreementprovidesotherwise:

(a)theforeignnational,unlessinadmissibleunderthisAct,shallbegrantedpermanentresident

statusiftheforeignnationalmeetstheprovince’sselectioncriteria;

(b)theforeignnationalshallnotbegrantedpermanentresidentstatusiftheforeignnational

doesnotmeettheprovince’sselectioncriteria;

(c)theforeignnationalshallnotbegrantedpermanentresidentstatuscontrarytothe

provisionsofthelawoftheprovincegoverningthenumberofforeignnationalswhomaysettle

intheprovinceaspermanentresidents,whetherthatnumberisanestimateoramaximum,or

governingthedistributionofthatnumberamongclassesofforeignnationals;and

(d)conditionsimposedinaccordancewiththelawoftheprovincehavethesameforceand

effectasiftheyweremadeunderthisAct,iftheyareimposedonaforeignnationalonor

beforethegrantofpermanentresidentstatus.

Soleprovincialresponsibility—appeals

(2)Ifafederal­provincialagreementgivesaprovincesoleresponsibilitytoestablishandapply

financialcriteriawithrespecttoundertakingsthatsponsorslivinginthatprovincemaymakein

respectofaforeignnationalwhoappliestobecomeapermanentresident,then,unlessthe

agreementprovidesotherwise,theexistenceofarightofappealunderthelawofthatprovince

respectingrejectionsbyprovincialofficialsofapplicationsforsponsorship,forreasonsoffailingto

meetfinancialcriteriaorfailingtocomplywithapriorundertaking,preventsthesponsor,except

onhumanitarianandcompassionategrounds,fromappealingunderthisActagainstarefusal,

basedonthosereasons,ofavisaorpermanentresidentstatus.

Consultationswiththeprovinces

10.(1)TheMinistermayconsultwiththegovernmentsoftheprovincesonimmigrationand

refugeeprotectionpoliciesandprograms,inordertofacilitatecooperationandtotakeinto

considerationtheeffectsthattheimplementationofthisActmayhaveontheprovinces.

Requiredconsultations

(2)TheMinistermustconsultwiththegovernmentsoftheprovincesrespectingthenumberof

foreignnationalsineachclasswhowillbecomepermanentresidentseachyear,theirdistribution

inCanadatakingintoaccountregionaleconomicanddemographicrequirements,andthemeasures

tobeundertakentofacilitatetheirintegrationintoCanadiansociety.

11.(1)Aforeignnationalmust,beforeenteringCanada,applytoanofficerforavisaorfor

anyotherdocumentrequiredbytheregulations.Thevisaordocumentmaybeissuedif,following

anexamination,theofficerissatisfiedthattheforeignnationalisnotinadmissibleandmeetsthe

requirementsofthisAct.

Electronictravelauthorization

(1.01)Despitesubsection(1),aforeignnationalmust,beforeenteringCanada,applyforan

electronictravelauthorizationrequiredbytheregulationsbymeansofanelectronicsystem,

unlesstheregulationsprovidethattheapplicationmaybemadebyothermeans.Theapplication

maybeexaminedbythesystemorbyanofficerand,ifthesystemorofficerdeterminesthatthe

foreignnationalisnotinadmissibleandmeetstherequirementsofthisAct,theauthorizationmay

Restriction

(1.1)Adesignatedforeignnationalmaynotmakeanapplicationforpermanentresidenceunder

protection,untilfiveyearsafterthedayonwhichafinaldeterminationinrespectoftheclaim

ismade;

(b)iftheyhavemadeanapplicationforprotection,untilfiveyearsafterthedayonwhicha
