SERVITUDE
THE
HEREUNDER SPECIFIED STREETS AND OPEN SPACES OF THE
MUNICIPALITY EVERY YULETIDE CELEBRATION FOR USE OF
FIESTA NAVIDAD TRADERS AND/OR VENDORS, REVISING FOR THIS
PURPOSE ORDINANCE NO. 02-2001, AS AMENDED BY ORDINANCE
NO. 04-2002 AND FOR OTHER PURPOSES.

Be it ordained by the Sangguniang Bayan of Guinobatan, Albay,

in session assembled, that:
SECTION 1.
TITLE. This ordinance shall be known and cited as the
FIESTA NAVIDAD ORDINANCE OF GUINOBATAN, ALBAY.
SECTION 2.
SITE. The hereunder streets and/or open spaces of the
municipality are hereby lifted from public servitude or closed
temporarily every year from December 1 to Three Kings of the
following year, to wit:
(a) The entire length of D. Paulate Street;
(b) Portion of A. Paulate Street, corner Rizal Street to corner D.
Paulate Street;
(c) The open space in front of the Sangguniang Bayan
Legislative Building; and,
(d) A portion of the open space along Rizal Street in front of
Glamitita Building to Ecal Building.
SECTION 3.
FEES. All spaces declared as site for the Fiesta Navidad
shall be rented out from the Local Government of Guinobatan
by way of package deal or bidding in the amount of not less
than Php200,000.00 or by individual application at the rate of
Php10.00 per square meter per day excluding electrical

consumption which shall be borne by the applicant-awardee of

space.
SECTION 4.
PERIOD. The Fiesta Navidad Celebration shall only be
opened or created every Yuletide Season which shall commence
not earlier than December 1 of the current year and ends on
the Three Kings of the following year, without any extension.
SECTION 5.
PAYMENT. The winner-applicant shall pay to the
Municipal Treasurer or her authorized representative the
required fees during the day of awarding in full. Failure to pay
on the day of the award, the Committee has the authority to
cancel the award already given in favor of other interested
applicant/s on the following day.
SECTION 6.
DATE OF AWARDING AND COMPOSITION OF THE
AWARDS COMMITTEE. The awarding of the space shall be
done at least one (1) week before the start or the opening of the
Fiesta Navidad Celebration. It shall be done through the Mayor
as Chairman and by the following Members:
(1) Municipal Treasurer;
(2) Chairman, SB Comm. on Trade, Industry & Economic
Enterprise;
(3) Chairman, SB Comm. on Barangay Affairs as Community
Representative; and,
(4) Municipal Market Head.
The presence of at least three (3) members during the day of
awarding shall constitute a quorum. Any awards made without a quorum is
null and void.
SECTION 7.
POWERS OF THE COMMITTEE ON AWARDS. The
Committee has the following powers:
(1) Approve/disapprove application;
(2) Provide the lay-out of the spaces to be rented out showing
therein reasonable space allocations for feria, parlor games,
traders, firecracker vendors, native foods and the like,
including the relocation of those persons (jeepney and
tricycle paradas) that may be necessarily affected by this
Ordinance during the Fiesta Navidad Celebration;
(3) Fixing of the specific date of awarding every year; and,
(4) Such other powers incidental to effectively and efficiently
carry-out the provisions of this Ordinance which are deemed
necessary, beneficial, practical and most advantageous to
the government, including, but not limited to, the changing
of the sites and the rates.
SECTION 8.
PROCEEDS. The fees/funds which shall be generated
from this Ordinance shall accrue to the general fund of the
Municipality.
SECTION 9.
SEPARABILITY CLAUSE. If for any reason, any section
or provision of this ordinance shall be questioned in court, and
shall be held unconstitutional or invalid, no other section or
provision of this ordinance shall be affected thereby.
SECTION 10. REPEALING CLAUSE. Ordinance No. 02-2001, Ordinance
No. 04-2002 and any other ordinance or part/s of ordinance/s
that are in conflict with provisions of this ordinance are hereby
repealed accordingly.

SECTION 11. EFFECTIVITY. This Ordinance shall take effect immediately

upon its approval.
