MUNICIPAL ORDINANCE NO. 020-2014


CREATING THE MUNICIPAL NUTRITION OFFICE AND THE PLANTILLA POSITION
OF NUTRITIONIST IN THE MUNICIPALITY OF GUINOBATAN, ALBAY, PROVIDING
FUNDS THERFOR AND FOR OTHER PURPOSES.

WHEREAS, it is a declared policy of the state under Article II, Section 9 of the
1987 Philippine Constitution to have a just and dynamic social order that will ensure the
prosperity and independence of the nation and free the people whom poverty through
policies that provide adequate social services, promote full employment, a rising
standard of living, and an improved quality of life for all;
WHEREAS, Section 17 of the Local Government Code recognizes health and
nutrition as one of the basic social services which the local government units are
mandated to provide its people;
WHEREAS, Section 443 of the Local Government Code authorities the
Sangguniang Bayan to create such other offices as may be necessary to carry out the
purposes of the municipal government;

WHEREAS, the state by virtue of its commitment as a party to the United Nations
Convention on the Rights of a Child, undertakes to defend the right of the children to
assistance, including proper care and nutrition, and special protection from all forms of
neglect, abuse, cruelty, exploitation and other conditions prejudicial to their
development, and to this end shall take all appropriate legislative and administrative
measures;
WHEREAS, the prevalence rate of malnutrition among 0-71 months olds is
12.24% in 2012; 14:11% in 2013 and 11.11% in 2014, based on the Operation Timbang
conducted by this municipality;
WHEREAS, the Municipal Government of Guinobatan is mandated to safeguard
the foregoing rights of the child as member of the society under the general welfare
clause of the Local Government Code.
WHEREFORE, in view of the foregoing premises and with the LGUS
commitment to end hunger and malnutrition in the municipality.
BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF GUINOBATAN,
ALBAY IN SESSION ASSEMBLED, THAT:
SECTION 1. TITLE. This ordinance shall be known and cited as the
GUINOBATAN NUTRITION ORDINANCE or simply as NutriO
SECTION 2. DEFINITION OF TERMS. For purposes of understanding, the
following terms as used in this ordinance shall mean:
a. Operation Timbang a yearly weighing activity of the Rural Health Unit to
assess the nutritional status of children aging from 0 to 71 months old.
b. Municipal Nutrition Office an office attached to the Office of the Mayor or
Municipal Health Office with the primary function of alleviating the situation of
malnutrition in the municipality in coordination with concerned government
agencies and instrumentalities.
c. Nutritionist a Nutrition Officer I who is a full-time and competent employee
of the municipality with specialization on nutrition appointed and assigned at
the Office of Nutrition.
SECTION 2. CREATION. There is hereby created in the Municipal Government
of Guinobatan, Province of Albay, an office to be known as the Municipal Nutrition Office
and a plantilla position of Nutritionist specially Nutrition Officer I with Salary Grade 10.

SECTION 3. COMPOSITION AND STRUCTURE. The Municipal Nutrition Office


shall be initially organized and composed of a Nutrition Officer I with a Salary Grade 10,
to be assisted by office aides to be designated by the Mayor.
The budgetary source, compensation and hiring procedure for the Nutrition
Officer I (SG 10) shall conform to the rules and policies of the Civil Service Commission
(CSC) and the Department of Budget and Management (DBM), among others.
SECTION 4. QUALIFICATION OF THE NUTRITION OFFICER I. No person shall
be appointed to the position of Nutrition Officer I with Salary Grade 10 unless he/she
possesses the following qualifications, among others:

A bonafide resident of Guinobatan, Albay;


Baccalaureate degree holder relevant to the position;
A career service professional/second level eligible; and,
Must have the required training and experience, if any.

SECTION 5. FUNCTIONS AND RESPONSIBILITIES. The Nutrition Officer I


manning the Office of the Municipal Nutrition shall perform the following tasks:
a. Assess the Nutrition situation of the Municipality.
b. Facilitate the formulation of the Municipal Plan of Action for Nutrition (MPAN).
c. Coordinate, monitor and evaluate plan implementation and recommends and
adopts appropriate actions.
d. Mobilize resources to ensure the plan is implemented.
e. Extend technical assistance to barangay nutrition committees on nutrition
program management and related concerns.
f. Monitor the performance of Barangay Nutrition Action Plan.
g. Shall report directly to the Municipal Mayor and/or Municipal Health Officer.
SECTION 6. FUNDS. Starting in the year 2015, the municipal budget officer is
hereby mandated to appropriate in the annual budget of the Municipal Government and
onwards the amount necessary for the herein created position of Nutrition Officer I, SG
10 and such amount necessary for the effective operation of the office.
SECTION 7. REPEALING CLAUSE. Any provision of ordinance, rules and
regulations and/or parts thereof inconsistent with the provision/s of this ordinance are
hereby repealed and/or modified accordingly.
SECTION 8. SEPARABILITY CLAUSE. Should any portion or provisions of this
ordinance be declared unconstitutional or invalid, the other parts or provisions thereof
which are not affected thereby shall continue to be in full force and effect.
SECTION 9. EFFECTIVITY. This Ordinance shall take effect on the first day of
January, 2015.
