MUNICIPAL ORDINANCE NO. 019-2014


STRENGTHENING THE BARANGAY NUTRITION SCHOLARS (BNS) OF
GUINOBATAN, ALBAY BY PROVIDING THEM INCENTIVES IN THE FORM OF
TRAVEL ALLOWNCE IN THE PERFORMANCE OF THEIR DUTIES AND
FUNCTIONS AND PROTECTION FROM UNDUE TERMINATION,M APPROPRIATING
FUNDS THEREFOR AND FOR OTHER PURPOSES.

BE IT ORDAINED BY THE SANGGUNIANG BAYAN OF GUINOBATAN,


ALBAY IN SESSION ASSEMBLED, THAT:
SECTION 1. TITLE. This local legislation shall be known as the BARANGAY
NUTRITION SCHOLARS (BNS) ORDINANCE of Guinobatan, Albay or simply as
BNSO.
SECTION 2. DECLARATION OF POLLICY. The Municipal Government of
Guinobatan adheres and supports the Philippine Nutrition Program now known as the
Philippine Plan of Action for Nutrition by developing a system or facility for the delivery
of basic nutrition and related health services in the grassroots through the use of
Barangay Nutrition Scholar (BNS) as mandated for by PD 1569.
SECTION 3. DEFINITION OF TERMS. For purposes of understanding, the term
Barangay Nutrition Scholar or BNS for short, shall refer to the definition ascribed for
under Section 2 of PD 1569, which means a Barangay-based volunteer worker
responsible for delivering nutrition services and other related activities such as
community health, backyard food production, environmental sanitation, culture, mental
feeding, and family planning to the Barangay, duly registered and accredited by the
Municipal Health Board, after undergoing the necessary training. As a volunteer worker,
BNS delivers nutrition and related services to the community without compensation but
maybe granted, among others by the LGUs of a travel allowance or other forms of
allowance as an incentive in recognition of their important role in maintaining a healthy
citizenry.

SECTION 4. PROTECTION AGAINST UNDUE TERMINATION. The services of


the BNS shall not be terminated without due process and only for authorized cause/s
provided for by law or ordinance. A copy of a termination paper shall be provided to the
Municipal Health Board stating therein clearly the reason/s for such termination. Any
termination made by the Barangay Council or Barangay Captain which is not in
accordance with law or this ordinance, the Municipal Government through the
recommendation of the Municipal Health Board may not be bound thereof and it may
required the concerned Barangay to provide in its budget the corresponding budgetary
requirement for their honoraria/wages as designated or appointed BNS.
SECTION 5. GROUNDS/AUTHORIZED CAUSES FOR TERMINATION. A
Barangay Nutrition Scholar (BNS) maybe terminated from service, after due notice and
hearing, on any of the following causes:
a. Serious Misconduct Or Willful Disobedience by the BNS of the lawful orders
of the Municipal Health Office and/or Barangay Council on their authorized
representatives in connection with his/her work.
b. Gross and Habitual Neglect of Duties.
c. Commission of a Crime or an Offense involving moral turpitude or an offense
punishable by at least prison correctional which is from six (6) months and
one (1) day to six (6) years imprisonment.
d. Engagement or participation in political exercises especially during elections.
e. When a BNS reaches the mandatory age of 65 years. And,
f. When no longer fit to render health service/s as certified by competent public
medical practitioner due to health reasons.
SECTION 6. GRANT OF INCENTIVE OR TRAVEL ALLOWANCE. In addition to
the current monthly honorarium being given to them by their respective barangays, the
Municipal Government of Guinobatan, Albay shall confer all BNS in the municipality an
additional monthly incentive to the form of Travel Allowance in the performance of their
duties and functions in the amount of FIVE HUNDRED PESOS (PHP500.00).
SECTION 7. NUMBER OF BNS PER BARANGAY. Every Barangay shall only
have one (1) BNS and that the current BNS in all the 44 barangays be preferably
retained, subject however, to the conditions on termination provided herein. Provided
lastly, that any increase or replacement of BNS in the barangay shall be properly
coordinated with the Municipal Health Board.
SECTION 8. REQUIREMENTS FOR AVAILMENT OF INCENTIVES. Papers or
documents for payment of the incentive shall be prepared by the Municipal Health
Office in coordination with the Personnel and Treasury Offices. Before actual payment
of the herein prescribed incentive is made, it must be shown that the BNS has complied
with all the requirements set by MHO and the BNS is included in the master list of
qualified BNS duly certified by the Municipal Health Board.
SECTION 9. FUNDING. An amount of at least Two Hundred Sixty-Four
Thousand Pesos (Php 264,000.00), starting this year, and every year thereafter, shall
be appointed for this purpose and shall form part of the mandatory 5% budgetary
allocation for Gender and Development (GAD) of the Municipal Government.
SECTION 10. REPEALING CLAUSE. Any provision of ordinance, rules and
regulations and/or parts thereof inconsistent with the provisions of this ordinance are
hereby repealed and/or modified accordingly.
SECTION 11. SEPARABILTY CLAUSE. Should any portion or provisions of this
ordinance be declared unconstitutional or invalid, the other parts of provisions hereof
which are not affected thereby shall continue to be in full force and effect.

SECTION 12. EFFECTIVITY. This ordinance shall take effect immediately upon
approval.
