SB RESOLUTION NO. 004-2015

INTERPOSING NO OBJECTION AND ENDORSING FAVORABLY THE APPLICATION FOR
LOCATIONAL CLEARANCE OF MR. ROMMEL O. PALEVINO OF RG GASOLINE STATION
FOR THE CONSTRUCTION AND OPERATION OF A GASOLINE REFILLING STATION AT SITIO
SAGAYSAY, BARANGAY MAGUIRON, GUINOBATAN, ALBAY.

WHEREAS, a Locational Clearance is a pre-requisite in the issuance of a Building Permit

to ensure its conformity/compatibility with the Municipalitys Comprehensive Land Use Plan and
Zoning Ordinance;
WHEREAS, this august body was in receipt of a request from Mr. Rommel O. Palevino,
registered business owner of RG Gasoline Station, for the passage of a resolution of endorsement
to the Housing and Land Use Regulatory Board (HLURB) for the issuance of a locational clearance
in his favor relative to his intent of constructing and thereafter operating a gasoline refilling station
at Sitio Sagaysay, Barangay Maguiron, this municipality, particularly at Lot No. 915-A, originally
titled to Mrs. Lucila Elenita R. Balbin, married to Mr. Alvin B. Balbin, under a Contract of Lease;
WHEREAS, upon due perusal of the pertinent documents submitted and upon much
deliberation, the said request is hereby found to be with merit as the same is compatible, and not in
violation, with the Municipalitys Comprehensive Land Use Plan and Zoning Ordinance, being
located in one of the expanded urban barangays of the municipality wherein 50 meters from the
roads, on both sides, whether national or provincial road, traversing in these declared/considered
urban barangays, are generally zoned for commercial purposes, and this intended project lies
perfectly within this area/zone of the said barangay. Moreover, it is of this bodys view that the
same is beneficial and a welcome development for the municipality;
WHEREFORE, in view of the foregoing premises, be it now:
RESOLVED, as it is hereby resolved by the Sangguniang Bayan of Guinobatan, Albay in
session assembled, to interpose No Objection and to Endorse Favorably to HLURB the Application

for Locational Clearance of Mr. Rommel O. Palevino for the construction and operation of a
gasoline refilling station at Sitio Sagaysay, Barangay Maguiron, Guinobatan, Albay.
RESOLVED FURTHER, that a copy of this resolution be furnished Mr. Rommel O.
Palevino, the Honorable Mayor, the MPDO, the Municipal Engineer, the Municipal Assessor and
such concerned offices/agencies, for their information and appropriate action.
APPROVED UNANIMOUSLY on joint motion of the sponsoring committees through
Honorable Councilors Ricky S. Matza and Ryan B. Palomillo, and unanimously seconded by the
other members present this 8th day of January, 2015 during their 1st Special Session.
