PRESS STATEMENT

CABINET MEETING HELD ON 10TH MARCH, 2015


H.E. President Uhuru Kenyatta today chaired the a Cabinet
Meeting at State House, Nairobi. In this meeting, Cabinet
considered and approved various Bills, Polices and Programmes:1)

(i) The Roads Annuity Programme


(ii) Establishment of a Road Annuity Fund
(iii) The Public Finance Management (Road Annuity
Fund) Regulations 2015

Over

the

years

the

Government

has

been

encountering

numerous challenges in the development and maintenance of


roads. These challenges include; budgetary constraints, high unit
costs and escalation. This has led to delays and accumulation of
outstanding payments.

The results have been very slow

implementation of Roads construction programmes in the country.


The proposed Road Annuity Programme creates a framework to
facilitate a partnership between the Government and the Private
Sector under a PPP arrangement. Under the annuity programme,
a fund will be established to ensure a seamless financing of the
roads sector from the design, development and maintenance of
roads. This will bring efficiency and deliver value for money to
the citizens.
The Road Annuity Programme Fund will be constructed under a
PPP arrangement. A significant shift from the past practice is that

payments will only be linked to completion of roads and


performance based maintenance.

This will guarantee that

Government will only pay for services received by the Nation.


Payments for services delivered by private contractors will be
made from a Road annuity Fund that will be established for the
purpose of channelling resources meant for payments for the
development of road.

The fund will guarantee the timely

payment of contractors and services. A governance structure for


the Annuity Programme and Annuity Fund has been set up.
The Governance framework puts in place regulations prescribing
how the fund will be managed, with an Oversight Committee and
Secretariat to oversee operations.
The fund will have a seed capital of Kshs.500 million initially and
also indentifies other sources of funding.
The regulations also establishes the eligibility criteria for projects
to qualify for funding under the Road Annuity Programme, and
also puts certain obligations on contractors and contracting
authorities and a clear mechanism for accounting and reporting
on the utilization of the funds as provided for under the Public
Finance Management Act, Cap 412C. A total of Kshs.1.2 trillion
will be required to implement the programme over the next 10
years.
2) The Fair Administrative Action Bill, 2014

The Cabinet approved the Fair Administrative action Bill, 2014 for
submission to Parliament.
For a long time, the impact of administrative action upon the
citizens, towards whom it is directed, has been a point of
contention between public authorities, civil society groups, and
the citizens. As a result, the constitution of Kenya, 2010 directly
addresses this matter in Article 47.
The objective of the Fair Administrative Action Bill, 2014 is,
therefore, to implement Article 47 of the Constitution by imposing
a requirement for fair and expedious administrative action. The
Bill also makes provision for review of any action that may
adversely affect a person.

3) The Proposed Health Bill, 2015


Cabinet considered and approved the Health Bill, 2015. The main
objective of the Bill is to address emerging legal issues
occasioned by the promulgation of the Constitution of Kenya,
2010, especially as it relates to devolution and the citizens right
to health.

The key objectives of this Bill are: to establish a National Health


System which shall progressively realize the right to the highest
attainable standard of health as provided for in the Constitution;
define and coordinate the functions of the National Government
and the devolved functions of County Governments; and provide
for the regulation of healthcare services and healthcare service
providers, health products and technology.
Other policy decisions approved by Cabinet today included:4) Establishment of the Regional Centre on Small Arms
in the Great Lakes Region, the Horn of Africa, and the
Bordering States (RECSA)
The Cabinet approved the establishment and financial
support of the Regional Centre for Small Arms in Nairobi.
The Centre will address the proliferation of illicit small arms
and light weapons whose effects are seen in the insecurity
occasioned in both urban and rural parts of the country. It is
for this reason that, Kenya has been at the forefront in
ensuring that the issue of curbing the proliferation of small
arms remains in the agenda regionally and globally.
5) Establishment of the National Chemical, Biological,
Radiological and Nuclear (CBRN) Reference Centre in
Nairobi
Cabinet considered and approved the establishment of a
National Chemical, Biological, Radiological and Nuclear
Materials Reference centre in Nairobi.

This Centre of

excellence will be implemented with the support of the UN


Interregional Crime and Justice Research Institute (UNICRI).

The establishment of the CBRN materials reference centre is


informed by the increasing use of CBRN materials in
industrial, agricultural, research and learning institutions
among other related fields. The CBRN Centre of excellence
will aim at implementing a coordinated strategy for CBRN
risk mitigation at national, regional, and international levels.
The proposed Secretariat in Nairobi will be the eighth to be
established worldwide, with others in Abu Dhabi, Algiers,
Amman, Manila, Ralat, Tashkent, and Tbilisi.
6) The

10th

World

Trade

Organization

Ministerial

Conference
Cabinet also approved the hosting of the 10th World Trade
Organization (WTO) Ministerial Conference to be held in
Nairobi, in December, 2015.
The WTO Ministerial Conference is the highest decision
making body of the WTO and is normally held every two
years.

It is a high profile international event which brings

together trade ministers from all WTO members from around


the world.

Due to the importance of trade in the global economy, the


event also attracts interest among the civil society and
private sector.

The publicity created by the event will

promote Kenyas tourism and investment potential and,


project a positive image for the country.
7) Launch of the Integrated Population Registration
System
This is a universal single registration system also known as
the Master Database. The Integrated Population Registration
System (IPRS) is being established pursuant to the provisions
of the Jubilee manifesto aimed at achieving a secure and
centralized registration database activated at birth.

H.E.

the President Uhuru Kenyatta will launch the IPRS on


Wednesday 11th March, 2015.

In

order

to

address

the

challenges

of

myriad

of

Government registration agencies such as the NRB, Civil


Registration Department, Immigration Department, NSSF,
NHIF, KRA and others, and streamline population registration
process, the Government has initiated the IPRS.

The

objective is to establish and maintain a comprehensive and


secure registration with information on all Kenyans and
registered foreigners resident in Kenya, as a single point of
truth on identity.

The IPRS or the Master Database is an

electronic database linked to other databases using a unique

Personal Identification Number (PIN) generated by the


system.
8) Strategy to Improve Service Delivery of Public Service
within Nairobi City
Cabinet approved this Strategy which entails a programme
of beautification, improvement of cleanliness and hygiene,
enhancement of lighting all streets and public areas in the
city and improvement of general infrastructure including
roads and drainage.
