MUNICIPAL ORDINANCE NO. 04-2014

PRESCRIBING FEES IN THE PETITIONS FOR CORRECTION OF CLERICAL


OR TYPOGRAPHICAL ERRORS IN THE DAY AND MONTH IN THE DATE
OF BIRTH OR SEX AND/OR CHANGE OF FIRST NAME OR NICKNAME OF
A PERSON APPEARING IN THE CIVIL REGISTER WITHOUT NEED OF
JURIDICAL ORDER IMPLEMENTED BY THE MUNICIPAL CIVIL
REGISTRAR PURSUANT TO R.A. 9048 AS AMENDED BY R.A. 10172.

Be it ordained by the Sangguniang Bayan of Guinobatan, Albay


in session assembled, that:
Section 1. Imposition of Fees. The following fees are hereby
imposed/prescribed for the following:
a. Petition for the Correction of the Clerical/Typographical Errors
in the Day and Month in the Date of Birth or Sex of a Person Php 3,000.00
b. Petition for the Correction of Clerical/Typographical Errors and/
or for the Charge of First Name or Nickname of a Person PhP
3,000.00
Section 2. Exemption. Indigent petitioners as certified by the
Municipal Social Welfare and Development Officer shall be exempt from the
payment of fees prescribed in the preceding section. Provided however that,
no petitioner shall be certified indigent if he/she has a regular means of
livelihood or employment.
Section 3. Proceeds. All fees collected under this ordinance shall
accrue to the Office of Municipal Civil Registrar for the modernization of the
office, hiring of additional personnel and for the procurement of office
supplies.

Section 4. Separability Clause. If, for any reason/s, any part/s of


this Ordinance shall be held to be unconstitutional or invalid, other parts or
provisions hereof which are not affected thereby shall continue to be in full
force and effect.
Section 5. Repealing Clause. Any other ordinance/s or part/s thereof
which are inconsistent with any of the provisions of this Ordinance are
hereby repealed, amended or modified accordingly.
Section 6. Effectivity. This ordinance shall take effect immediately
upon its approval.
