MUNICIPAL ORDINANCE NO. 03-2010


AMENDING SECTIONS 91, 92, 104 AND 105 OF MUNICIPAL ORDINANCE NO. 112008, OTHERWISE KNOWN AS THE GUINOBATAN REVISED TAX CODE OF 2008,
PURSUANT TO REPUBLIC ACT NO. 9514, OTHERWISE KNOWN AS THE REVISED
FIRE CODE OF THE PHILIPPINES.
BE IT ORDAINED by the Sangguniang Bayan in session assembled that:
SECTION 1.

That Section 91 is hereby amended to read as follows:


Section 91. Imposition of Fees Every person or entity who shall
establish, operate and maintain storage of flammable, combustible or
explosive substances within the Municipality of Guinobatan shall first
secure a special permit from the Bureau of Fire and Protection (BFP)
and pay the corresponding fees.

SECTION 2.

That Section 92 is hereby amended to read as follows:

Section 92. Time of Payment The fees imposed shall be paid directly to
the Bureau of Fire and Protection (BFP) upon application for said
license.
That Section 104 is hereby amended to read as follows:
Section 104. Imposition of Fees x x x Any person, natural or juridical,
who shall keep or store at his place of business or in any place in
Guinobatan, or transport or convey over the street of Guinobatan any
flammable, explosive or highly combustible materials, shall first secure a
permit from the Bureau of Fire and Protection (BFP) and pay the
annual fees prescribed therefore by law or ordinance.

SECTION 4.

That Section 105 is hereby amended to read as follows:


Section 105. Time of Payment The fees imposed in this article shall be
paid to the Municipal Treasurer except for the fire safety inspection fee
equivalent to ten percent (10%) of all fees charged by the Municipal
Building Official or other agencies concerned with the granting of

pertinent permits and licenses which shall be paid directly to the


Bureau of Fire and Protection (BFP) upon assessment.
SECTION 5.

Separability Clause. If any provision of this ordinance or the application


of such provision to any person or circumstance is declared
unconstitutional, the remainder of the ordinance or the application of such
provision to other person or circumstance shall not be affected by such
declaration.

SECTION 6.

Repealing, Modificatory and Amendatory Clause. Any other provision of


ordinances not consistent herewith are forthwith repealed, modified or
amended accordingly.

SECTION 7.

Effectivity. This Ordinance shall take effect immediately upon its


approval.

ENACTED this 12th day of April 2010, on third and final reading.
