AnOrdinancetoconsolidateandamendthelawrelatingtothesale,transport,bearingorpossessionof
arms,ammunitionormilitarystores.

Preamble.WHEREASitisexpedienttoconsolidatethelawrelatingtothesale,transport,bearingor
possessionofarms,ammunitionormilitarystores,inthemannerhereinafterappearing
ANDWHEREAStheProvincialAssemblyofWestPakistanisnotinsessionandtheGovernorof
WestPakistanissatisfiedthatcircumstancesexistwhichrenderimmediatelegislationnecessary
Now,THEREFORE,inexerciseofthepowersconferredonhimbyclause(I)ofArticle79ofthe
Constitution, the Governor of West Pakistan is pleased to make and promulgate the following
Ordinance:

CHAPTERI
PRELIMINARY

1.Shorttitle,extentandcommencement. (1) This Ordinance may be called the


Ordinance1965.

[2. Exception. Nothing contained in this Ordinance shall apply to the sale, transport, bearing or
possession of arms, ammunition or military stores by order of the Government or the Federal
Government,orbypublicservantoramemberofanyofthenonregularforceoftheGovernmentorthe
FederalGovernment,inthecourseofhisdutyassuchpublicservantormember.]

3.Definitions.(1)InthisOrdinance,unlessthecontextotherwiserequires,thefollowingexpressions
shallhavethemeaningsherebyrespectivelyassignedtothem,thatistosay
(a)ammunitionincludes
(i)ammunitionofalltypesforlightandheavyautomaticweapons,revolvers,pistols,rifles,
carbines,musketsandshotguns
(ii)ammunitionconstructedandmodifiedforfiringprojectilesorgasorsmokecontainers
(iii)gunwads,gunflints,percussioncaps,fuses,frictiontubesanddetonators
(iv)alltypesofgrenades,bombs,rockets,minesandfuelsforflamethrowers
(v)alltypesofexplosives,fulminatingmaterialandpropellants,includingallarticlesspecially
designedfortorpedooperationandcharges

(vi)allpartsofammunition,
butdoesnotincludelead,sulphurorsaltpeter
(b)armsincludes
(i)cannon
(ii)firearmsofalltypes,suchaslightandheavyautomaticandsemiautomaticweapons,rifles,
carbines, muskets, shotguns (whether single or double barrelled), revolvers, pistols and
appliancestheobjectofwhichisthesilencingoffirearms

[(iii)airpistols,bayonets,swords,swordsticks,daggers,kniveswithbladesoffourinches
or more (but not kitchen knives or knives used in good faith for the carrying on of a
profession),andflickknivesirrespectiveoftheblade]

(i)alltypesofartillery,mortars,machineandsubmachineguns

[(d)GovernmentmeansGovernmentofthePunjab]

[(dd) flickknife means a knife which has a blade which opens automatically by hand pressure
appliedtoabutton,springorotherdevicein,orattachedto,thehandleoftheknife,andincludes
anyknifewhichhasabladewhichisreleasedfromthehandleorsheaththereofbytheforceof
gravityorbytheapplicationofcentrifugalforceandwhich,whenreleased,islockedinplaceby
meansofabutton,springleverorotherdevice]
(e)licencemeansalicencegrantedunderthisOrdinance

(f)militarystoresmeansanystoreswhichthe [FederalGovernment]may,bynotificationin
theofficialGazette,declaretobemilitarystores
(g)rulesmeanrulesmadeunderthisOrdinance.
(2)Government may, by notification in the official Gazette, declare any article or substance not
specified in clause (a) or clause (b) or clause (c) of subsection (1), to be, as the case may be,
ammunition, arms or cannon for the purposes of this Ordinance, and on the publication of such
notification,sucharticleorsubstanceshallbedeemedtobespecifiedinthesaidclause(a)orclause(b)
orclause(c),asmaybenotified.

CHAPTERII
SALEANDREPAIR
4.Unlicensedsaleandrepairprohibited.(1)Nopersonshallsell,orkeep,offerorexposeforsale,
any arms, ammunition, or military stores, or undertake the repairs of any arms, except under a licence
andinthemannerandtotheextentpermittedthereby.
(2)Nothinghereincontainedshallpreventanypersonfromsellinganyarmsorammunitionwhich
he lawfully possesses for his own private use to any person who is not by any enactment for the time
beinginforceprohibitedfrompossessingthesame,buteverypersonsosellingarmsorammunitionto

any person shall, without unnecessary delay, give to the [District Coordination Officers], or to the
officerinchargeofthenearestpolicestation,noticeofthesaleandofthepurchasersnameandaddress.

5.Powertoprohibittransport.Governmentmay,fromtimetotime,bynotificationintheofficial
Gazette,regulateorprohibitthetransportofanydescriptionofarms,ammunitionormilitarystoresover
thewholeoftheProvinceoranypartthereofeitheraltogetherorexceptunderalicenceandtotheextent
andinthemannerpermittedbysuchlicence.
Explanation Arms, ammunition or military stores transshipped at a port in the Province are
transportedwithinthemeaningofthissection.

6.Powertoestablishsearchingposts.Governmentmay,atanyplacealongtheboundaryline [of
theProvince]andatsuchdistancewithinsuchlineasitdeemsexpedient,oratanyplaceintheProvince
thatitmaydeemproperestablishsearchingpostsatwhichanyperson,vessel,vehicleoranyothertype
of transport or any type of package or container in transit, may be stopped and searched for arms,
ammunitionandmilitarystoresbyanyofficerempoweredbyGovernmentinthisbehalfbynameorin
virtueofhisoffice.

7.Arrestofpersonsconveyingarms,etc.,undersuspiciouscircumstances.(1)Whenanypersonis
foundcarryingorconveyinganyarms,ammunitionormilitarystores,whethercoveredbyalicenceor
not,insuchmannerorundersuchcircumstancesastoaffordjustgroundsofsuspicionthatthesameare
beingcarriedorconveyedbyhimwithintenttousethem,orthatthesamemaybeusedforanyunlawful
purpose, any person may without warrant apprehend him and take such arms, ammunition or military
storesfromhim.
(2)Anypersonsoapprehended,andanyarmsammunitionormilitarystoressotakenbyapersonnot
beingamagistrateorapoliceofficer,shallbedeliveredoverassoonaspossibletoapoliceofficer.
(3) All persons apprehended by, or delivered to, a police officer and all arms, ammunition and
military stores seized by or delivered to any such officer under this section shall be taken without
unnecessarydelaybeforeamagistrate.
CHAPTERIV
GOINGARMEDANDPOSSESSINGARMS,ETC.
8.Prohibitionofgoingarmedwithoutlicence.(1)Nopersonshallgoarmedwithanyarmsexcept
underalicenceandtotheextentandinthemannerpermittedthereby.
(2)Anypersonsogoingarmedwithoutalicenceorincontraventionofitsprovisionmaybedisarmedby
anymagistrate,policeofficerorotherpersonempoweredbyGovernmentinthisbehalfbynameorbyvirtueof
hisoffice.
(3)Nothinginsubsection(1)and(2)shallapplytoapersoncarryingarmsunderawrittenauthority
issuedinaccordancewiththerules.
9.Unlicensedpossessionofarms,etc.Nopersonshallhaveinhispossessionorunderhiscontrolanyarms,
or any ammunition or military stores, except under a licence and in the manner and to the extent permitted
thereby.
10.Incertaincasesarmstobedepositedatpolicestationorwithlicenseddealers.(1)Anyperson
possessing arms, ammunition or military stores the possession whereof, has, in consequence of the
cancellationorexpiryofalicenceorofanexemptionorthedeathofthelicenceeorotherwise,become
unlawful,shallwithoutunnecessarydelaydepositthesameeitherwiththeofficerinchargeofthenearest
policestationor,athisoptionandsubjecttosuchconditionsasGovernment,maybyruleprescribe,with
alicenseddealer:
Providedthatwhere,withinonemonthoftheexpiryofalicenceanapplicationforitsrenewalhas
been made by registered post or by hand, the retention by the holder of such licence of the arms,
ammunitionormilitarystorescoveredbythelicenceshallbedeemedtobelawfuluntilsuchtimeasthe
licencehasbeenrenewedoritsrenewalrefused.

(2) When arms, ammunition or military stores have been deposited under subsection (1), the
depositor,orinthecaseofhisdemise,hislegalheir,shall,atanytimebeforetheexpiryofsuchperiodas
Governmentmaybyrulesprescribe,beentitled:
(a)toreceivebackanythingsodepositedthepossessionofwhichbyhimorhislegalheirshas
becomelawfuland
(b)todispose,orauthorisethedisposalofanythingsodepositedbysaleorotherwisetoanyperson
whosepossessionofthesamewouldbelawful,andtoreceivetheproceedsofanysuchsale:
Provided that nothing in this subsection shall be deemed to authorise the return or disposal of

anythingtheconfiscationofwhichhasbeendirectedundersection [20].
(3)Allthingsdepositedundersubsection(1)andnotreturnedordisposedofundersubsection(2)
withintheprescribedperiodthereinreferredto,shallbeforfeitedtoGovernment.
(4) (a) Government may make rules consistent with this Ordinance for carrying into effect the
provisionsofthissection.
(b)Inparticularandwithoutprejudicetothegeneralityoftheforegoingprovision,Governmentmay
byrulesprescribe
(i)theconditionssubjecttowhicharms,ammunitionormilitarystoresmaybedepositedwitha
licenseddealer,and
(ii)theperiodaftertheexpiryofwhichthingsdepositedasaforesaidshallbeforfeitedundersub
section(3).

CHAPTERV
LICENCES
11.Powertomakerulesastolicences.Governmentmay,fromtimetotime,bynotificationinthe
official Gazette, make rules to determine the officers by whom, the form in which, and the terms and
conditions on and subject to which any licence shall be granted, or renewed, and may by such rules
amongothermatters
(a)fixtheperiodforwhichsuchlicencesshallcontinueinforce
(b)fixafeepayablebystamporotherwiseinrespectofanysuchlicence

(d)direct that the holder of any such licence shall keep a record or account, in such form as
Government may prescribe, of anything done under such licence, and exhibit such record or
accountwhencalledupontodosobyanofficerofGovernmentauthorizedinthisbehalf
(e)empoweranyofficerofGovernmenttoenterandinspectanypremisesinwhicharms,ammunitionor
militarystoresarekeptbyanypersonholdingalicenceofthedescriptionreferredtoinsection4
(f)directthatanysuchpersonshallexhibittheentirestockofarms,ammunitionandmilitary
storesinhispossessionorunderhiscontroltoanyofficerofGovernmentsoempoweredand
(g)requirethepersonholdinganylicenceoractingunderanylicencetoproducethesameandto
produce or account for the arms, ammunition or military stores covered by the same when
calledupontodosobyanofficerofGovernmentsoempowered.

[11A.PoweroftheFederalGovernment.(1)The [Government]may,bynotificationinthe
official Gazette, specify the description, calibre or bore of arms and ammunition which are to be
prohibitedboresforthepurposeofthisOrdinance.
(2)Nolicenceforthearmsandammunitionnotifiedundersubsection(1)shallbeissuedexceptby
the

(3)The [Government]shallhavethepowertoissuelicencesfornonprohibitedboreweapons
validforthewholeoranypartofPakistan.

[11B.Prohibitionofkeeping,carrying,ordisplayingarms. [(1)TheGovernmentmay,by
generalorspecialorder,prohibitthekeeping,carryingordisplayofarmsatsuchplacesortimesoron
suchoccasions,asmaybespecifiedintheorder.]
(2) In particular, and without prejudice to the generality of subsection (1), an order issued
thereundermayprohibit
(a)thekeepingofarmswithinthepremisesofeducationalinstitutionsandthepremisesofthe
hostelsorboardingandlodginghousesrelatingoraffiliatedtheretoand
(b)thecarryingordisplayofarmsatfairsoringatheringsorprocessionsofapolitical,religious,
ceremonialorsectariancharacterorinthepremisesofCourtsoflaworpublicoffices.
(3)Anypersonkeeping,carryingordisplayinganyarmsincontraventionofanorderissuedundersub
section(1)maybedisarmedbythemagistrate,policeofficerorotherpersonempoweredbyGovernmentin
thisbehalf.]

12.Cancellationandsuspensionoflicences.(1)Anylicencemaybecancelledorsuspended
(a) by the officer by whom the same was granted or by any authority to which he may be

subordinate, or any
[District Coordination Officer] within the local limits of whose
jurisdictiontheholderofsuchlicencemaybe,when,forreasonstoberecordedinwriting,and
after giving the holder of the licence an opportunity of showing cause against the proposed
[21]

cancellationorsuspension,suchofficer, [orauthority]deemsitnecessaryforthesecurityof
thepublicpeacetocancelorsuspendsuchlicenceor
(b)byanyJudgeormagistratebeforewhomtheholderofsuchlicenceisconvictedofanoffence
againstthisOrdinanceoragainsttherulesandGovernmentmay,byanotificationintheofficial
Gazette,cancelorsuspendalloranylicencesthroughouttheProvinceoranypartthereof.
(2)Anappealagainstanorderofcancellationorsuspensionunderclause(a)ofsubsection(I)maybe
madebythepersonwhoselicencehasbeencancelledorsuspendedtotheimmediateofficialsuperiortothe
authoritymakingtheorder,withinsixtydaysofthereceiptbyhimofacopyoftheorderwhereappealliesto
Government,andwhereappealliestoanyotherauthority,withinthirtydaysofthereceiptbyhimofacopy
oftheorder.

CHAPTERVI
PENALTIES
13.Penaltyforbreachofsections4,5,8to11.Whoevercommitsanyofthefollowingoffences,
namely:
(a) sells, or keeps, offers or exposes for sale, any arms, ammunition or military stores, or
undertakestherepairsofanyarmsincontraventionoftheprovisionsofsection4
(b)failstogivenoticeofthesaleofarmsandammunitionandofthepurchasersnameand
addressasrequiredbysection4
(c)transportsanyarms,ammunitionormilitarystoresincontraventionofaregulationorprohibition
issuedundersection5
(d)goesarmedincontraventionoftheprovisionsofsection8
(e) has in his possession or under his control any arms, ammunition or military stores in
contraventionoftheprovisionsofsection9
(f)failstodepositarms,ammunitionormilitarystoresasrequiredbysection10
(g)intentionallymakesanyfalseentryinarecordoraccountwhichbyarulemadeunderclause(d)of

[14A. Certain offences triable by magistrates. (1) Notwithstanding anything contained in the
CodeofCriminalProcedure,1898(ActVof1898),anoffence,punishableundersection13orsection14
shall,unlessithasbeencommittedinrespectofanyofthearms,ammunitionormilitarystoresreferred
tointheprovisotothesaidsection13,betriablebyamagistrateofthefirstclass.

15.Breachoflicence.Whoever,inviolationofaconditionsubjecttowhichalicencehasbeengranted,
doesoromitstodoanyactshall,whenthedoingoromittingtodosuchactisnotpunishableundersection
[31]

13orsection14,bepunishedwithfinewhichmayextendto [fivethousand]rupees.

16.Knowinglypurchasingarms,etc.,fromunlicensedpersons.Whoever
(a)knowinglypurchasesanyarms,ammunitionormilitarystoresfromanypersonnotlicensedor
authorisedundersubsection(2)ofsection4tosellthesameor
(b)deliversanyarms,ammunitionormilitarystoresintothepossessionofanypersonwithout
previouslyascertainingthatsuchpersonislegallyauthorisedtopossessthesame,
shall be punished with imprisonment for a term which may extend to three years or with fine, or with
both:

17. Penalty for breach of rules. Any person violating any provision of any rule made under this
Ordinance for the violation of which no penalty is provided by this Ordinance, shall be punished with

finewhichmayextendto [twothousand]rupees.

18. Penalty for failure to give information under section 23. Any person who in the absence of
reasonableexcuse,theburdenofprovingwhichshalllieuponsuchperson,failstogiveinformationtothe
nearest police officer or magistrate in respect of any offence under subsection (1) or subsection (2) of
section 23 of which he becomes aware or which he has reason to suspect, shall be punished with
[34]

imprisonment for a term which may extend to six months, or with fine which may extend to
[five
thousandrupees]orwithboth.

19.Penaltyforrefusingorneglectingtoproducearms.Anypersonrefusingorneglectingtoproduce
any arms when so required under section 26 shall be punished with imprisonment for a term which may
[35]

extendtoonemonthorwithfinewhichmayextendto [twothousand]rupees,orwithboth.

20.Powertoconfiscate.WhenanypersonisconvictedofanyoffencepunishableunderthisOrdinance,
committedbyhiminrespectofanyarms,ammunitionormilitarystores,itshallbeinthediscretionofthe
committingCourtormagistratefurthertodirectthatthewholeoranyportionofsucharms,ammunitionor
militarystores,andanyvessel,vehicleoranyothertypeoftransportusedtoconveythesame,andanytype
ofpackageorcontainerinwhichthesamemayhavebeenconcealed,togetherwiththeothercontentsof
suchpackageorcontainershallbeconfiscated:
ProvidedthatwheresuchconvictionisinrespectofanoffencepunishableunderthisOrdinancewith
imprisonmentfornotlessthantwelvemonths,theCourtorthemagistrateconvictingsuchpersonshall
directthatthewholeoranyportionofsucharms,ammunitionormilitarystoresshallbeconfiscated.

CHAPTERVII
MISCELLANEOUS
21.Searchandseizurebymagistrate.Wheneveranymagistrateoranofficerinchargeofapolice
stationhasreasontobelievethatanypersonresidingwithinthelocallimitsofhisjurisdiction
(a)hasinhispossessionanyarms,ammunitionormilitarystoresforanyunlawfulpurposeor
(b)thatsuchpersoncannotbeleftinthepossessionofanysucharms,ammunitionormilitarystores
withoutdangertothepublicpeace
suchmagistrateorsuchpoliceofficerhavingfirstrecordedthegroundsofhisbelief,maycauseasearch
tobemadeofthehouseorpremisesoccupiedbysuchpersonorinwhichsuchmagistrateorsuchpolice
officer has reason to believe such arms, ammunition or military stores are or is to be found, and may
seizeanddetainthesame,althoughcoveredbylicenceorexemption,insafecustodyforsuchtimeashe
thinksnecessary.

22.SeizureanddetentionbyGovernment.Governmentmayatanytimeorderorcausetobeseized
any arms, ammunition or military stores in the possession of any person, notwithstanding that such
person is lawfully entitled to possess the same, and may detain the same for such time as it thinks
necessaryforthepublicsafety.
23. Information be given regarding offences. (1) Every person aware of the commission of any
offencepunishableunderthisOrdinanceshallintheabsenceofreasonableexcuse,theburdenofproving

reasonableexcuse,theburdenofprovingwhichshalllieuponsuchperson,giveinformationtothenearest
police officer or magistrate regarding any package or container in transit which he may have reason to
suspectcontainsarms,ammunitionormilitarystoresinrespectofwhichanoffenceagainstthisOrdinance
hasbeenorisbeingcommitted.

24.Searchesinthecaseofoffenceshowconducted.Whenasearchistobemadeforanyofthepurposes
ofthisOrdinance,suchsearchshallbemadeundertheprovisionsoftheCodeofCriminalProcedure,1898
(Vof1898).

25.Operationofotherlawsnotbarred.NothinginthisOrdinanceshallbedeemedtopreventany
personfrombeingprosecutedunderanyotherlawforanyactoromissionwhichconstitutesanoffence
againstthisOrdinanceortherulesorfrombeingliableundersuchotherlawtoanyhigherpunishmentor
penaltythanthatprovidedbythisOrdinance:
Providedthatnopersonshallbepunishedtwiceforthesameoffence.

26.Powertotakecensusofarms.(1)Governmentmay,fromtimetotime,bynotificationinthe
officialGazette,directacensustobetakenofanyarmsinanyarea,andempoweranypersonbynameor
invirtueofhisofficetotakesuchcensus.
(2)Ontheissueofanysuchnotification,allpersonspossessinganysucharmsinsuchareashall
furnishtothepersonsoempoweredsuchinformationashemayrequireinreferencethereto,andshall
producesucharmstohimifhesorequires.

27.Powertoexempt. [TheGovernment]may,fromtimetotime,bynotificationintheofficial
Gazette,orinexceptionalcircumstancesbyawrittenorder,exemptanypersonbynameorinvirtueof
hisoffice,oranyclassofpersons,orexcludeanydescriptionofarms,ammunitionormilitarystores,or
withdraw any part of the Province from the operation of any prohibition or direction contained in this
Ordinance.

28.Noticeandlimitationofproceedings.Nosuit,prosecutionorotherproceedingshalllieagainst
any person for anything which is in good faith done or intended to be done in pursuance of this
Ordinance.
