AFFIDAVIT OF SOLE ADJUDICATION

With DEED OF ABSOLUTE SALE

KNOW ALL MEN BY THESE PRESENTS:
I, EVARISTO V. CAHINDO, of legal age, Filipino, widower and a resident
of Tacloban City, after having been sworn according to law, depose and say:
THAT--WHEREAS, I am the sole and only surviving sibling/heir of decedent
CELESTINO KAHINDO, who died intestate in Tacloban City on 21 JANUARY
1981, leaving a certain real property in Tacloban City covered by Transfer
Certificate of Title No. T-2922 issued by the Register of Deeds of the Tacloban
City, and particularly described as follows:
A parcel of land ((Lot No. 1984 of the Cadastral
Survey of Tacloban) with the improvements thereon,
situated in Brgy. 84, San Jose, Tacloban City, Leyte.
Bounded on the NE by the National Road; on the SE, SW
and NW by Lot No. 1983, containing an area of ONE
HUNDRED SEVENTY TWO (172) SQUARE METERS
more or less. This lot is covered by Tax Declaration No.
01502508 in the name of Celestino Cahindo and assessed
value at P5,130.00 for taxation purposes.

WHEREAS, the decedent has left no known debts or obligations that have
remained unpaid or unsettled; neither has he left any other heir entitled to
succeed in his estate, except the herein affiant who is his sole surviving brother.
NOW THEREFORE, for and in consideration of the foregoing premises,
and invoking the provision of Section 1, Rule 74 of the Rules of Court, the herein
affiant does hereby adjudicate unto himself the entire estate hereinabove
described, subject only to contingent liabilities to creditors, heirs and other
persons who might have been deprived of lawful participation therein in
accordance with Section 4, Rule 74 of the Rules of Court.
PROVIDED FURTHER, that IN CONSIDERATION of the sum of ONE
HUNDRED SEVENTY TWO THOUSAND PESOS (PhP172,000.00), Philippine
Currency, to me in hand paid by SUSAN SY SHI, of legal age, Filipino, married and a
resident of Tacloban City, we do by these presents hereby SELL, TRANSFER AND
CONVEY, in a manner absolute and irrevocable unto the VENDEE, her heirs and

assigns the above described real property subject of settlement.

That I hereby warrant valid title to, and peaceful possession of that certain
real property herein sold and conveyed, and will defend the same unto the said
VENDEE, her heirs and assigns against the claims of third persons whomsoever.
PROVIDED, FINALLY, that this Affidavit of Sole Adjudication with Deed of
Absolute Sale cancels the prior Extrajudicial Settlement with Absolute Sale
executed by some purported abovenamed Heirs to Vincent Jan L. Chu,
evidenced by the cancellation of extrajudicial settlement with absolute sale
executed by the parties.
FURTHER, AFFIANT SAYETH NAUGHT.

ACKNOWLEDGMENT
BEFORE ME, a Notary Public for Tacloban City, this ___________ at
Tacloban City personally appeared EVARISTO V. CAHINDO, exhibiting to me his
CTC No. 17807001 issued on
6-1-07 at Tacloban City, known to me to be the
same person who executed the foregoing instrument, consisting of two (2) pages
including this page whereon the acknowledgment is written and signed by the
VENDOR and witnesses, and he acknowledged to me that the same is his free
act and deed.
