This matter came before the Court on the parties joint request for
dismissal of the paraphernalia charge and guilty plea to the trespass charge. The
State is represented by Sac County Attorney Ben Smith. The Defendant is
represented by his attorney Jim Schall. The parties, through County Attorney
Smith, has informed the Court that a plea agreement has been reached, the
terms of which are as follows:
1.

The Defendant has agreed to plead guilty to the trespass charge,

pay the minimum fine of $65.00, with a 35% surcharge, the Law Enforcement
Initiative Surcharge, which is $125.00, court costs of $60.00, and court-appointed
attorney fees in an amount to be determined by the State Public Defender.
2.

The State agreed to dismiss the paraphernalia charge.

IT IS THEREFORE ORDERED that Defendant is guilty of the trespass

charge. Accordingly, Defendant shall pay the minimum fine of $65.00, with a 35%
surcharge, the LEIS, which is $125.00, court costs of $60.00, and courtappointed attorney fees in an amount to be determined by the State Public
Defender.
IT IS FURTHER ORDERED that the paraphernalia charge shall be and is
dismissed and any bond entered herein shall be exonerated.
