Congratulations! Lal Salam!
At the call of the Postal JCA of NFPE & FNPO,
the Postal and RMS workers all over the Country have
magnificently responded and made the one Day Token
Strike on 30.10.2007 a grand and total success.
The response in this strike is stupendous in
many circles. It was a total strike in Assam,
Chhatisgarh and West Bengal. Many circles like
Andhra, Kerala, North East Surpassed 90% mark. In
respect of Karnataka, Maharastra, Tamilnadu, Punjab,
Uttrakhand, Orissa, the Strike was success exceeding
80% participation.
For the first time in the history of the Postal
employees of Delhi Circle, more than 70% of
employees went on strike. New Delhi GPO, Delhi
GPO, I.P. HPO were paralysed, There was total strike
in which more than 75% of delivery post offices were
closed in Delhi Circle.
The reports pouring in from various parts of the
country show that the participation of Postal
employees in this strike is better than the previous
strikes. Particularly there is a vast improvement in our
P3 while comparing the past. Now P3 led the strike in
many circles.
This strike is a warning to the UPA government
and also a caution to Sixth Pay Commission. We are
sending the message that we are united and will fight
against any injustice if caused by the Sixth Pay
Commission. Congratulations once again comrades
and request to maintain this struggle unity at all levels.
Bonus Ordinance 2007
The Ministry of Law & Justice has issued
Gazette Notification on 27.10.07 under the payment
of Bonus (Amendment) ordinance, 2007 (No 8 of 2007).
1. The Bonus Act amendment deemed to come
in to force from 01.04.2006.
2. The ceiling was substituted as Rs. 3500/- & Rs
10000/- in the original notification.
Accordingly, all will get arrears for the bonus
year of 2006-07. So far, the central Government
employees concerned, the DOP & T has to issues
orders.
However, necessary orders have not been
issued so far by the Government for Central Govt.
employees.
14 Days Strike Wages
The Communication Minister Thiru A. Raja while
delivering his speech on 21.10.07 at a state level
conference held at Dindigul, Tamilnadu mentioned that
the strike period of 2000 (14 days) will be treated as
leave and Postal Employees will get salary for the
period.
BHARTIYA POST
This was the announcement of our Minster. Let
us hope that he will translate his assurance in order
at the earliest.
Amendment to Postal Act.
The Department has sent proposal to amend
the Indian Post Office (Amendment) Act to the cabinet
for approval. The following are the main substance:
(i) The letters & Packets up to 150 grams may be
the exclusive preserve of India Post.
(ii) The private couriers will have to charge 2.5 times
the tariff specified for Speed Post.
(iii) There is a cap of 49% on FDI in courier
business. 51% of the paid - up share is held by
the citizens of India.
The draft bill has been sent to the Cabinet and,
once approved, the Government can introduce the Bill
in the Parliament.

TBOP-BCR court case: -
The case came up for hearing on 13.11.07 at
Delhi High Court has been adjourned to 13.03.08 for
next hearing.
Computerisation of BO: -
The Department has been allotted with Rs. 2000
crores funds for computerisation of 60000 Branch Post
offices for the current year. The problems be arisen
due to computerisation of BOS should be studied in
depth and the need to fix norms for any new item of
works be persuaded.
General Secretary's Strike Tour
1 Karnataka: - The Postal JCA has organised
six meetings at the following places on 24.10.07 &
25.10.07.(i) Rajaji Nagar HPO (ii) Circle office (iii)
Bangalore GPO. (iv) Basavangudi HO (V) Musuem
Road HPO (vi) Bangalore GPO. (Dely). Our Circle
Secretary Com. S.S. Manjunath and his team had
optimumly utilised the services of the General
Secretary during his tour. Our sincere appreciations
to Karnataka Circle comrades and special mention to
Com. S.S. Manjunath.
2 Gujarat: - Com. K.B. Barot, Circle Secretary
has well organised the meeting under the banner of
JCA on 25.10.07 evening at Ahmedabad. There was
another meeting at Rajkot, organised by the Postal
JCA on 26.10.07 at 1700 hours. Prior to the meeting,
Com. K.B. Barot has organised a Divisional
Secretaries interaction session in the noon which was
very useful and purposeful. At Rajkot meeting, there
was more than 200 participants and the office bearers
of Rajkot division deserve all appreciations.

 On 27.10.07 morning, the Ahmedabad divisional
Secretary Com. R.C. Waghela organised a meeting
at Navrangpura HPO at 0900 hours and it was well
attended. There was another meeting organised at
Ahmedabad RMS at 11 hours. My special thanks to
Com. K.B. Barot who utilised my services fully from
25.10.07 after noon to 27.10.07 for noon.
3. New Delhi GPO: - A well organised
Demonstration & Gate meeting was conducted on
29.10.07 at 1300 hours at New Delhi GPO. General
Secretary & Com. Balwinder Singh, ATR CHQ
attended and orated before the gatherings. Com. Geeta
Bhattacharya, President, Com. K.K. Verma, Divisional
Secretary & Com. A. K. Chawla, Ex- Branch President
deserve all appreciations for is historic success of
strike at New Delhi GPO on 30.10.07.
General secretary's Tamilnadu Tour
1. Vellore: - A Special meeting was organised
by the Divisional Secretary, Vellore Com. S. Veeran
on 17.10.07 at Vellore HO. The meeting was presided
by Com. Porkai Pandian, President. Com. C.
Karunakaran, Circle Vice President, Com. A.
Veeramani Circle Treasurer and Com. Gunasekaran,
Divisional Secretary AIPEDE union were the prominent
speakers. General Secretary took more than 1 ½
hours to explain all the developments and the need to
go on strike on 30.10.07. The CHQ congratulates Com.
S. Veeran for the excellent arrangement he made for
the meeting and the Vellore team deserves all
appreciations.
2. Gobichettipalayam: - The General Secretary
attended the branch conference of Gobi on 19.09.07.
The conference was converted as a strike preparatory
meeting. Com C. Chandrasekar. Secretary NFPE and
most of the Divisional/Branch Secretaries of Western
region addressed the meeting. Com. P.
Venkatachalam Ex- President was felicitated. G/S
during his speech mentioned the services & sacrifices
of Com. P. Venkatachalam. Com. Mahanasundaram,
Br. Secy, Gobi and his team deserves all appreciations
and we congratulate them for their re election in the
conference unanimously.
3. ED convention at Chennai: - The ED
convention organised by the GDS Union Chennai City
North Division was attended by more than 2000
comrades of the entire circle. It was presided by Com.
J. Srivenkatesh, Circle Vice President P3. The
prominent speakers were Com. K. Raghavendran,
Secretary General NFPE, Com. K.V. Sridharan G/S
P3, Com. C. Chandrasekar, Secretary, NFPE, com.
V. Parthiban, Circle Secretary P3, Tamilnadu. Many
Circle office bearers of P3 & GDS Unions addressed
the meeting. The convention was really a historic
success. It has given a message to Tamilnadu GDS

comrades that GDS are part & parcel of NFPE and
we are united always. Our heartiest appreciations to
com. Vedagiri, Divisional Secretary GDS & Com P.
Mohan, Divisional Secretary P3 Chennai North for their
splendid & superb arrangements.
4. Nagapattinam: - A Special meeting was
organised at Nagapattinam on 22.10.07 evening to
discuss about various issues confronting Postal
Services. General Secretary attended the meeting.
Com J. Ramamoorthy, ACS, Tamilnadu also attended.
The meeting was attended by more than 150
comrades, in the midst of heavy rain. Com. S.
Govindarasu, Divisional Secretary Nagapattinam, Com.
K. Ramalingam Branch Secretary Tiruvarur, Com
Gurusamy, Divisional Secretary Nagapattinam ED and
Com Dhanraj, B/S Tiruvaraur ED deserve all
appreciations. The meeting was lasted for four hours.

Secretary, Nagapattinam.
5. Pondicherry: - An interaction session with
activists of Pondicherry division was organised on
23.10.07 at 1400 hours by Com. E. Sathiyamoorthy,
Divisional Secretary P3 & Com. M. Pannerselvam,
Divisional Secretary P4. We record our appreciations
to Com. E. Sathiyamoorthy & Com. M. Pannerselvam.
6. Salem West: - An interaction meeting was
organised by Com. R. Sundarakrishnan, Divisional
Secretary, Salem West on 18.10.07 evening to discuss
the issues. It was attended by activists of Salem West
& Salem East divisions. Com. K. Sempan, Circle
President had also participated in the discussions.

7. Mayiladuthurai: - A felicitaiton meeting was
organised to Com. C. Chandrasekar for his elevation
as Secretary, NFPE by NCA Peravai mayiladuthurai
on 11.11.07 General Secretary Com. KVS attended
the meeting, Excellent arrangements were made by
Com. J. Ramamoorthy, Asst. Circle secretary & his
team. They deserve all appreciations.

 COMPUTER VISION SYNDROME
While waiting in a clinic, I witnessed the
interaction of a gentleman with an ophthalmalogist.
As I remember, the ophthalmologist, inter alia, asked
the questions like - " Do you work with a computer
for longer hours? Is your monitor 16 to 30 inches
away from you? Is the top of the screen 10 to 20
degree below your eye level and you look
downward ? Do you consider occupational/
computer glasses with anti reflective coating? Is
your monitor placed on the side of a window and
light sources? Do you blink rapidly atleast 10
times a minute while working before the
computer? Are your feet firmly on the ground and
hips, knees and arms straight and at right angle?
Do you place your documents on a copy-stand
adjacedt to the monitor? Do you break every 20
minutes and focus 20 ft. away?..... etc. After
examining other pathological reports, the
ophthalmologist replied the gentleman, " Though
your eyes are organically sound, you have
Computer Vision Syndrome."
What's that - enquired the gentleman?
The ophthalmologist explained, " While working
before the computers for longer hours, it is not possible
to maintain the natural law of normal vision and one
has to focus closely very often compelling the ciliary
muscle which controls the ability of the eye to change
focus, to work two and half times harder by the
computer screen reducing the normal blinking. The
result is, dry, itchy, red and burning eyes. This apart,
there may be headache, neck pain and shoulder pain.
And this spiraling new vision problem is Computer
Vision Syndrome or CVS which is growing rapidly
consequent upon the IT revolution. The probable
causes of this occupational health hazard are
excessive use of computers, bad lighting, sustained
and diversified mental effort, extremely arduous
physical efforts in an improper workstation design,
extremely close work with intense and constant visual
attention, continuous exposure to various intensely
disagreeable conditions etc. The solution is an' yes'
to the above questions".
I became surprised and asked myself, " Have
my colleagues in the Department of Posts any idea
on the above aspects? Immediately, I started doing
Mathematics.
The Department of Posts actively entered into
the digital era through counter mechanization installing
102 personal computer-based MPCMs in 22 selected

post offices during the year 1990-91. The MPCMs were
brought to operation by the existing Postal Assistants
with a mere training of working knowledge. On
successful operation, without looking back, the
Department with a mission for total computerization
of operative offices through Local Area network (LAN),
Wide Area Network (WAN), Metropolitan Area
Network (MAN) and Internet and to provide ' Anytime -
Anywhere' service started introducing various e-
enabled services day by day. As per the Department's
Annual Report - 2007, up to the end of 2005 - 06, India
Post has computerized all 893 Head Post offices, 6184
Sub Post offices, 19 Postal Accounts Offices and 139
Administsrative Offices. Just imagine, the number of
people working with computers in our Department. The
Department is issuing computer security guide lines
from time to time. Recently, in August, 2007 the PTC
Mysore released its first technology bulletin the
'Technotalk' with a view to familiarize the postal
employees with the requirements of computerized
operations especially focusing on the software issues.
But unfortunately, the computer awareness
programmes undertaken by the Department are just
limited to successful implementation/operation of
various modules/packages. The main objectives of the
regional PTCs are confined to impart the skills and
knowledge required for understanding and operating
computer hardware and software systems relevant to
the needs of the Department (Chapter 10, Para-5 of
Annual Report - 2007). Is it not the responsibility of
the Department to consider what is relevant to staff
welfare? The Department is not providing any such
materials/publications/circulars instructing its
employees regarding precautions to be taken before
starting to work with a computer. The Non technical
Postal Assistants who are working continuously for
more than seven hours a day with all sincerity and
devotion are just given the working knowledge on
several modules through short duration training
programmes limited to one/two week(s) in the six
Postal training Centers and sixty Work Place Training
Centers. The Frequently Asked Questions (FAQs) don't
include the above queries. Due to ignorance only, they
are totally careless towards such health hazard. This
is certainly anti-welfare in disguise.
Secondly, the conditions of many post office
buildings are highly precarious not having the required
schedule of accommodation. The officials are
compelled to work in a very cramped situation in the
rented buildings without minimum amenities. The post
offices are identified without proper workplace design.
The computers are installed without standard ground-
works required for civil and electrical purposes and
amongst the heaps of dusty canvass bags, old/
obsolete furniture and forms. There is hardly any
computerized post office which is air conditioned.
Many post offices are not having the standard furniture
for computers. The Postal Administration is just trying
to give a corporate look to the post offices through the
slogon of modernization and computerization in pen
and paper only. The probable causes of CVS are
quite familiar to our post offices. Don't you guess
that thousands of postal employees will certainly
suffer from CVS unless they are properly
educated and the condition of the computerized
PO building are changed? Just imagine the future
financial impact on these low paid postal employees
with sore eyes and cumulative consequences on their
families and society as a whole! In this context, I do

remember the message dated 6th march, 2006 from
the Desk of the Member (Development) Sri IMG Khan,
presently our DG regarding growth and spread of a
healthy physical culture throughout the Department
by organizing sports and cultural activities from grass
root level. Hope, the DG (Posts) will realize the
concern for CVS.
Thus, it is expected that the Department of
Posts will look after the welfare of its employees giving
proper education and training not only for successful
operation of various modules but also imparting them
with the minimum common knowledge and
prerequisites to deal with the hardware/software. A
change in the computer training syllabus and
renovation of computerized post office buildings with
adequate lighting arrangement and space provision,
standard and approved quality furniture are barely
necessary.

discussions on 23.11.07 to discuss about the problems
prevailing in Circles on LSG, HSG II, & HSG I. The
General Secretary is attending and discussing the
issues with the available reports and informations
received from the Circles.

Dear Comrades,
The 7th Federal Council session of the National
Federation of Postal Employees was held at Moulali,
Yuva Kendra, Kolkata [WB] from 7th to 9th October
2007 under the presidentship of comrade
S. P.Mukherjee the Vice President of NFPE. Federal
Councilors of all the affiliates of the federation and ex-
officio members including the federal councillors of
GDS Union as per the direction of the Honourable Delhi
High Court participated in full. The Reception
Committee under the Chairmanship of Honourable
Mayor of Kolkata Com. Bikash Ranjan Bhattacharyya
and with Comrade Milan Bhattacharya the Circle
Secretary P-IV West Bengal as its General Secretary
made a very fine arrangement for the successful
conduct of the Federal Council.
Grand inaugural session:
The 7th Federal Council was officially started with the
flag hoisting and homage to martyrs column on
7.10.2007. The National Flag was hoisted by Com.
S. K. Vyas, Chairman of the Confederation of Central
Government Employees & Workers and the flag of
NFPE was hoisted by the Vice President of NFPE
Comrade P.Suresh amidst resounding slogans renting
the air. The leaders paid floral tributes to the martyr
column before commencing the inaugural session. The
Kolkata University Centenary Hall auditorium in which
the inaugural session was held was jam packed with
more than 2000 comrades. The inaugural session was
chaired by the Vice President of NFPE Comrade
S. P.Mukherjee. Honourable Mayor of Kolkata
delivered the welcome address. Our Chief Guest and
the Honourable Chief Minister of West Bengal
Comrade Budhadeb Bhattacharyya; Comrade
K.K.N.Kutty the Secretary General, Confederation;
Com. S. K. Vyas the Chairman Confederation;
Com.C.C.Pillai, the Ex-Secretary General NFPE;
Com. M.S.Raja the Secretary General Audit
Association; Com. VAN Namboodiri, the General
Secretary of BSNL Employees Union; Com. Des Raj

addressed the session. All the speakers including the
Special Guest exposed the anti worker polices of the
UPA Government emanating from its policies of
liberalisation and globalisation and the problems faced
by the postal and CG Employees. The inaugural
session witnessed a galaxy of most senior veteran
trade union leaders of the CG and P&T TU movement
belonging to West Bengal grace the occasion.
Deliberations:
The Council deliberated in detail on all issues
under the item of agenda of Organisational issue.
Almost half the total number of Federal Councillors
and ex-officio out of the total attendance of 102 took
part in the discussion. The Council resolved to mobilise
the entirety of postal workers for the successful
mobilisation of 30th October Strike on the 12 point
charter of demands. The Council also decided to
observe the whole month of November of 2007 in a
very pompous manner the centenary celebrations of
Calcutta Postal Club that was found by the father of the
postal trade union movement comrade Babu Tarapada
Mukherjee in 1907. The Council had adopted appropriate
resolutions on various issues of agenda items, which
will be published in the Postal Crusader. The Council
decided with the support of more than two-thirds
majority of the house in a secret ballot to amend the
various Articles of NFPE Constitution in accordance
with the requirement of CCS [RSA] Rules 1993.
Champion of GDS:
The Federal Council discussed in depth about
the importance of keeping the unity of GDS and regular
employees of the postal department. The Council noted
that the organisational structure of the NFPE could
not include the GDS Union as an affiliate because of
the Government of India Recognition Rules but decided
to keep the unity of GDS and regular employees
through building a strong unity between the federation,
federated unions and the GDS Union for defending the
class interests of GDS employees. The Council
resolved to carry forward the tradition of NFPE to
champion the cause of more than 2.75 lakhs of GDS
through united struggels and ensure that the entirety
of regular employees stand behind the GDS and
protect them from any kind of attack by the policies of
Government.

Submission of list of office bearers:
The list of newly elected office bearers has been
submitted to the Secretary [P] and Member [P]. A
delegation comprising of the newly elected Secretary
General Comrade K.Ragavendran, Com. C.C.Pillai the Ex-
Secretary General, Com. Des Raj Sharma the Ex-
Dy.Secretary General and Com.K.V.Sridharan the General
Secretary of P3 met the Member [P] on 11.10.2007
afternoon and submitted the list of office bearers and
discussed the issue of RRR Candidates of Tamilnadu as
well as the PLB bonus to postal employees. Member [P]
assured to immediately take action for getting the file on
bonus from the finance ministry for effecting payment. On
RRR candidates issue we have to continue our efforts
politically also in order to make the department withdraw
the SLP from the Supreme Court.
Finance of NFPE:
The financial position of NFPE is on minus
balance. Whatever strength the NFPE could muster
financially after the last federal council at
Thiruvananthapuram in 2004 have gone because of
various court cases filed against the NFPE by the GDS
Union. Even the day-to-day functioning of the federation
has become very difficult without any funds. There is
no funds left even to pay the salary to staff working in
the federation and to the Secretary General and other
office bearers who come on Foreign Service to work
at the headquarters. The days to come are hard and
require a very effective functioning in order to strengthen
the headquarters of federation. The Affiliates at all levels

are only reminded once again the earlier decision of
the Federal Secretariat to collect from all the members
of NFPE a sum of Rs.10/- towards NFPE Fund during
the bonus payment and remit it immediately to NFPE.
It is the responsibility of the rank and file now to pull
the federation out of its present financial crisis and we
are confident that the membership will not disappoint.

Comrades! The Confederation of CG Employees
and the All India State Government Employees
Federation as well as the organizations of Teachers have
already served the strike notice for launching the
nationwide one-day strike on 30th October 2007. The
Government is playing games by leaking out some
information about future pay scales etc as though the
6th CPC has submitted some recommendations. The

the leaked information as available in the media shows
that the minimum demand of pay parity with public sector
or a need-based minimum wage is not going to be
accepted. There appears to be a serious attack on the
DA formula to delay the compensation against price
rise. We cannot forget the looming danger of
recommendation of pay commission for privatisation
of pension, for which a sub-committee had already
been constituted by the 6th CPC itself. Therefore as a
prelude to the future struggles to defend the interests
of the entirety of CG Employees, the 30th October
2007 token strike is to be treated as the forerunner.
The NFPE calls upon the rank and file to take the call
very seriously and organise a total strike on that day
by forging strong unity with the FNPO organisations,
which have also served strike notice jointly with NFPE.
The success of the strike alone will make the Pay
Commission and the Government rethink about their
present course of attacking the interests of the central
government workers and employees.

CIRCULAR
The Government has today announced the raising
ceiling limit for calculation purpose of Bonus from Rs.
2500 to Rs. 3500 a month. The UNI news in this regard
is published hereunder. It requires another order from
the Ministry of Finance for those who are in receipt of
adhoc bonus and from the conerned Ministries in the
case of PLB. scheme. The Govt. has already issued
the bonus order without raising the ceiling limit for those
who are covered by the adhoc bonus. This order will
require to be revised in the light of the present decision
of the Govt. We hope that the bonus in the case of
Postal, Defence and Railway employees and others in
whose case, the bonus order is yet to be issued, will
get the benefit of increased bonus this year itself. The
Confederation will take steps to get the "adhoc bonus"
order revised on seeing the order in the case of PLB.

New Delhi. Oct.1. (UNI) The Centre today
brought the employees in the construction sector under
the Bonus Act and raised the eligibility limit for payment
of Bonus from Rs. 3500 to Rs. 10000 a month and the
ceiling for calculation purpose from Rs. 2500 to Rs.
3500 a month. The decisions were taken at a meeting
of the Cabinet chaired by the Prime Minister
Manmohan Singh, Labour Minister Oscar Fernandes
and information and Broadcasting Minister Priya
Ranjan Dasmunsi told reporters.
On 29th September, a leading vernacular daily,
"Mathrubhoomy" carried a sensational news items
stating that on the request of the Finance Ministry, the 6
th CPC has submitted an interim report on pay scales
and allied issues. We have no reason to believe this.
The Secretary General and President of the Confederation
had called on the Member Secretary on 28 th September
to request her to afford the staff side an opportunity to
react to the suggestions as and when made by the three
committees set up by the Commission. We were told
that the Commission will endeavor to submit its report to
the Government within the stipulated time i.e. by March,
2008. The Committees, as you are aware, have been
given time to submit its suggestions and formulation by
31st October, 2007.
We were told that the Pay Commission has
not received any proposal from the Govt. to refer the
anomaly items to it for resolution, contrary to what
the Secretary Personnel informed the staff side in the
last meeting held with him on 18th September, 2007

for Gazetted and non gazetted employees.

 MINITUES OF THE MEETING HELD WITH THE ALL INDIA POSTAL EMPLOYEES
UNION GROUP 'C' AT PLI DIRECTORATE ON 1ST OCTOBER, 2007
In the context of the letter dated 21.08.2007
addressed to the Secretary (Posts), written by the General
Secretary of All India Postal Employees Union, Group-C,
a meeting was held by the CGM, PLI Directorate with the
General Secretary of the said Union in the Conference
Room, of PLI Directorate at 1200 hrs. on October 1st,
2007. List of those who had attended the meeting is given
in the Annexure. The discussions in the meeting are
summarized below:
1. CGM, PLI Directorate explained the rationale of
the order of decentralization of PLI/RPLI works at the
Divisional level. General Secretary while appreciating the
logic of decentralization, expressed his concern in
matters relating to shortage of staff at the operative offices
for preparation of RPLI schedules, verification of incentive
bills etc. General Secretary of the staff side intimated
that the Department should consider payment of incentive
to operative staff (including the staff of the Accounts
Branch of Head Office and the SPMs) as there was no
time factor assigned for RPLI work. CGM, PLI Directorate
assured to look into the issue and also she explained
that the issue of inclusion of time factors for RPLI work in
the process of establishment review is under
examination.
2. As regards PLI Directorate Order dated 3.7.2007,
relating to payment of honorarium (subject to usual limit
of Rs. 4,000/- per annum per official) to the Supervisors
and staff of the Divisional Office, General Secretary
suggested that PLI Directorate should explore for fixing
some uniform incentive rate for the said work, instead of
giving honorarium.
3. General Secretary of the Staff Union urged that
there is need for simplification of procedure for verification
of the incentive bills for RPLI. According to him, this is
being done in the Accounts Branch of the Head Office
and that turns out to be the major bottleneck for delay in
payment of incentive. CGM, PLI Directorate appreciated
TREATING 14 DAYS STRIKE PERIOD AS LEAVE - MINISTER ANNOUNCES
All efforts will be made to protect the interests of
postal employees. The strike period will be treated as
holiday, said A. Raja, Union Minister for

them in a formal discussion and for fruitful discussion
on the issues raised by them.

GDS Convention At Aluva On 08.11.07

The Kerala Circle Unions have organised an ED
convention at Aluva (Kochi) on 08.11.07 and Com.
Gopinath, presided the convention. There were more
than 2000 participants and the auditorium was flooded
with GDS Comrades both in the ground and upper floor.

 GDS Convention at Chennai
A big convention of GDS employees was
organized by the GDS Union of Chennai City North
Division on 21.10.07 in Kerala Samaj Hall,
Purasawalkam, Chennai. More than 2000 comrades
and mostly from GDS cadre from different parts of
the Circle have attended the Convention. The
Reception Committee had made very fine
arrangements for the Convention. The Convention
was presided over by a presidium consisting of
Comrades Bhoopathy (President Chennai North GDS
Union) and J.S rivenkatesh (Circle Vice President P3,
TN Circle).
The Convention was inaugurated by Com. K.V.
Sridharan, the Gen. Secy. of AIPEU Gr. 'C' and was
addressed by Com. K. Ragavendran, the Secretary
General NFPE. Com. K.V. Sridharan elaborately spoke
on various ED Committees and their recommendations
in contrast to the positive recommendations of Justice
Talwar Committee and the need to continue our
struggle to win the genuine demands of GDS
employees. He also dealt in detail the efforts of the
NFPE to get the Government Rules modified to include
the GDS Union also as an affiliate of the Federation
and the adamancy of the Government to not to concede
the demand. He explained only after exhausting all
avenues the Federation applied for recognition without
the GDS Union as per the decision of the Federal
Executive meeting. He reiterated that only a strong
and united movement of regular and GDS employees

can effectively tackle the attacks of the Govt. Com.
K.Ragavendran explained the historical background
of our movement which always contrived a way out to
keep the movement united against the machinations
of the Government to cause divide amongst the postal
workers. He emphasized the need of the Federation
to get recognition to effectively combat the onslaughts
on the postal employees in particular and the CG
Employees in general. Both of them emphasized that
the Federation and the All India Unions of regular
employees would continue to champion the cause of
the GDS employees and called upon the GDS
leadership to come foreard to create a condition of
unity in the larger interests of entirely of postal workers.
Both emphasized that the message that we require a
strong and recognized NFPE; a strong GDS
Employees Union; and a strong bond of struggle unity
between all postal workers to safeguard our interests
should be spread among all employees.
The Convention was also attended and addressed
by Comrades C.Chandrasekar (Secy. NFPE);
R.Aravindan(OGS Admn. Union CHQ); R.B. Suresh (Dy.
Gen. Secy. Posta A/Cs); V.Parthiban (C/S P3 TN);
S.Ramaraj (Asst.C/S GDS Union TN). The welcome
address was delivered by Comrade Vedagiri the
Organiser of the Convention and the Divisional Secretary
of GDS Union, Chennai City North Division. Comrade
P.Mohan the Divisional Secretary of P3 Chennai City
North Division delivered the vote of thanks.

Letter No. P/2-21/Dehradun dated : 29.10.2007
addressed to the Secretary, Department of Posts
l Providing CGHS facilities to Postal
Employees at Dehradun in Uttrakhand Circle.
It is brought to our notice that there is a CGHS
hospital and also a Postal Dispensary functioning at
Dehradun and the Postal employees have to depend
upon only the postal dispensary.
The dispensary is functioning without sufficient/
essential staff and there is only one doctor with one
Pharmacist and Store Keeper working in the
dispensary. Due to non-availability of lady doctor, nurse
and dresser, proper treatment is not being provided to
the staff.
The CGHS hospital functioning at Dehradun is
having all the facilities and if the postal employees are
covered under CGHS facilities, it will provide better
medical facilities to the staff.
It is therefore requested to consider the same
and intimate the position at the earliest.

l Undue & Abnormal delay in releasing
ROHSC claims- C/o Nagaon Division in Assam
Circle.
Due to non-allotment of adequate funds under
the head, the ROHSC claims of the officials are badly
delayed.
The request of the divisional Union to clear the
bills before Pooja has not been considered and it
causes a concern.
It is requested to instruct the circle head to allot
sufficient fund to the division in to clear the pending
bills at least before Diwali.

l Adhoc Promotion to JAO at GM (Postal
Accounts & Finance) office Chennai- regarding
It is brought to our notice that the General
Manager, Postal Accounts, Chennai is ordering
officiating arrangements within his office even for the
vacancies exceeding four months.
According to Rule 50 of Vol IV, any vacancy
which arrangement likely to exceed four months,
officiating arrangement should be made from the eligible
officials due for promotions.
As such when sufficient no. of JAO qualified

officials are available and awaiting for promotion in
Tamilnadu Circle, the officiating arrangements among
the unqualified officials now ordered by the GM. Postal
Accounts is nothing but the denial of dues and
depriving the eligible candidates. This will tantamount
to the denial of natural law & regulations.
It is therefore requested to issue necessary
instructions to GM Finance to terminate the irregular
officiating arrangements and arrange adhoc promotion
as per the rules on the subject.

l Alleged alarming atmosphere prevailing in
Kovilpatti division in Tamilnadu Circle.

Apropos your letter, I wish to inform that the
regular SSPOs Sri V.V. Venkatasamy was on leave
on 1.8.07 and the SSPOS, Madurai who was holding
additional change has convened a meeting on 01.08.07
and tried to sort out the issues. After the rejoining of
the regular incumbent, he unleashed once again all
repressive measures against the staff and there is a
panic and peaceless atmosphere prevailing.
The said officer Sri V.V. Venkatasami fails to
provide fair administration/ good governance head of
the Division, develop a transparency on issue of staff
welfare and create a congenial atmosphere with the
staff and service Unions.
1. He withdrew services by abolishing deliveries in
POs, removing letter boxes in several places and
submitted proposals for closing down a hundred
POs disregarding the yard sticks prescribed
thereon under the rules.
2. He hated trade union people, desisted to hold
monthly meetings, acknowledged not a single
correspondence of service unions. There is no
monthly meeting over one year.
3. He unleashed repressive measures against office
bearers and a reign of terror among staff still
prevails to inflict rigorous punishments with rigid
adherence to disciplinary procedures in amid/
acute staff shortages.
4. Suspensions of staff have become regular feature
and SSP is still in search of and official well known

 for his good credentials to be served for
suspension memo. Several staff due for retirement
are affected.
5. GDS BPMs are mercilessly kept out of duty not a
valid reason for an unspecified period delivering a
heavy/thick blow to their personal liberties and
great miseries to their families.
6. Hues and cries of staff have become common
whose salaries/wages are slashed down or
withheld in name of treating their leave of absence,
"unauthorized" in a straight jacket orders without
giving opportunity to explain or defend themselves.
They are under great sorrow to feed their families
properly, meet out expenses for education of their
wards, medical treatments etc, No doubt, action
of SSP in this regard is inhuman. Repeated
requests to desist such act went unheeded.
7. Withholding of promotion has also become
perennial. No cautious approach is exercised
before making interruptions in the service earned
through longer span of years of the staff. Many
senior officials are affected. One Shri. G. Senthil
Kumar who was praised for his meritorious service
by top bureaucrats several times is stopped for
Inspector Post promotion.
8. SSP deals staff requests for transfers with inhuman
approaches, several staff especially women are
worst affected. He is against even for mutual
transfers. RO's intervention is needed to set right
things in this regard.
9. Now SSP has taken disciplinary action against
all the Divisional and Branch Secretaries of NFPE
Unions of Kovilpatti Division under rule 16 of CCS
(CCA) Rules, 1965 for their trade union activities.
10. SSP issued directive to the Postmaster, Kovilpatti
HO to remove flag mast and Notice Boards of
NFPE erected in front of the Kovilpatti HPO
Building (Even though it is erected in the highway
department's place - outside the PO)
11. SSP pursues transfer of two women employees
of Vilathikulam SO to remote places against their
willingness reducing the strength of the office
arbitrarily.
12. Sending fake reports to higher ups in several
cases which need a detailed enquiry.
Thus Shri. V.V. Venkatasami functions as an
unbrilled horse and grave misuse of his quasi-judicial
powers. This has created a great discontentment
among staff.
Under there Circumstances, we once again
requested to cause necessary instructions to the

principal chief PMG Tamilnadu Circle to shift him from
Kovilpatti division and ensure peace atmosphere.

l Continuous drawal Periphery HRA at
Trivandrum City rates C/o Malayinkil in Kerala
Circle.

Anent reference, it is constrained to note that
neither the issue is settled nor replied so far. The due
HRA to the staff has been stopped from 1.2.2005 and
the Chief PMG has submitted proposal only on
29.03.07 after a long delay.
The issue is protracted since then and it is learnt
that the Chief PMG had clarified all the queries and
submitted comprehensive proposal on 27.06.07. The
delay in renewal sanction over two years is deplorable.
It is therefore requested to expedite action and
arrange sanction at the earliest.

l Grant of periphery HRA - C/o Karakulam
P.O at Trivandrum City rates.
It is brought to our notice that the Chief PMG,
Kerala Circle has forwarded the proposal for extension of
sanction of HRA to the staff working at Karakulam P.O
form 01.08.2006 to 31.07.2009 vide his letter dt. 08.08.07.
The proposal was submitted after the expiry of
one year of the sanction. Even after, the proposal being
tossed from pillar to post on one pretext or the other.
It causes concern.
It is therefore requested to bestow action for
the immediate sanction for the continued drawal of
HRA to the staff working at Karakulam P.O. with out
any further delay.

Letter No. P/2-2/Nagoan dated : 31.10.2007 addressed
to the Secretary, Department of Post
l Allotment of adequate funds to clear
pending bills & flood relief - C/o Nagaon division
in Assam Circle.
The Nagaon postal division comprises with three
revenue districts Viz. Nagaon. Morigaon and
Karbianglong. Karilbianglong is hilly district and the
people living there always suffer from diseases like

Malaria, Jaundice etc. and scarcity of water. Nagaon
& Morigaon districts are in plain areas and the people
living there most affected by flood and erosion every
year and they suffer mainly from Dy. Santary, Jaundice
and other contagious diseases. The living condition is
worst in the entire areas of the postal division.
Due to inadequate allotment of funds under M
R claim there in huge backlog of pending bill and
officials could not get their reimbursement then of there.
Similar is the case of other bills like TA & OTA.
During the current year, the entire division has
been severely affected by devastating flood and no
relief has so far been provided to the affected postal
employees so far.
It is therefore requested to bestow special
attention to this problem and allot sufficient funds to
clear all the pending bills besides providing immediate
relief to the flood victims of the division.

l Delay in renewal sanction of HRA - C/o
Ernakulam division.
It is brought to our notice that the renewal
sanction of HRA to the periphery areas of Kochi like
Ambaalamedu, Ambalamugal, Panagad, Kumbalangi,
Kannamoly, O Chanthuruthu, Mallipuram, Narakkal
and Elamkunnapuzha has been delayed on one pretext
or the other at the Directorate.
It is further stated that all the required
clarifications sought by the Directorate have been
furnished by the Chief PMG on 13.8.07.
It is therefore requested to expedite the process
and accord sanction at the earliest.

l Non payment of MCPM Allowance- Case of
Uttarkhand Circle.
It is brought to our notice that in Uttarkhand
Circle, the MPCM allowance of Rs. 100/- has not been
paid to the officials and suddenly stopped without any
reason. This causes a concern.
It is therefore requested to cause necessary
instructions to effect payment of MPCM allowance to
the officials deployed in the MPCM Counters.

The above said official has applied for stepping
up of pay with her junior Sri Pramod Bhusan Karmakar
in 1997 itself after the implementation of Fifth Pay
Commission and it is stated that the Chief PMG, West
Bengal has referred the case to Directorate vide his
letter No. A & P/B/9-5/2/97 dt. 13.5.98.
The Directorate has called for the service books
of the both officials and the case is being dealt under
the case mark of No. 2-70/98-PAP. the service books
were sent during 1999 itself and the same were still
lying at the Directorate.
It is therefore requested to expedite approval
for the stepping up of pay and also return the service
books at the earliest.

l Payment of Salaries through Bank - case
of Vijayawada division in A.P. Circle
The staff working at Vijayawada city are
instructed to open a savings bank account at S.B.I
Main branch or Governerpet branch, Vijayawada for
effecting payment of salaries of staff through Banks
from Nov'07 onwards.

 This causes a concern. As per the Finance
Ministry's instruction, the officials should not be
compelled to open Bank account. Even taking it
granted, when we are having our own S.B. Account in
Post office, there is no need to direct our official to
open accounts in SBI.
It is therefore requested to cause necessary
instructions not to insist the officials to open accounts
in private banks and continue the existing system of
salary payments.

addressed to the Secretary, Department of Post
l Adopting double yard sticks in application
of Bench Mark in promotion - case of U.P. Circle.
It is learnt that several officials in PA Cadre/LSG
have been denied their LSG/HSG II/ HSG I promotions
in the U.P. Circle merely on the observation of C.R. for
five years even though they have not been proceeded
and awarded with any punishment or warning.
Whereas one Shri Ashok Kumar Srivastava, Sr.
Postmaster, Faizabad HO who was punished twice
under two Rule 16 cases currently has been promoted
to class I cadre. It is further told that the name of said
officials has been recommended to UPSC for approval
of his promotion in class I.
The Chief PMG. U.P. Circle has violated the
instructions contained in GOI order No. 14017/54/
2003-E (RR) dt. 4.12.03 and promoted him on adhoc
basis arbitrarily and as an act of absolute favouritism.
There are several lapses on the part of him during the
burglary taken place in 2007 at the HPO.
Even though we are not concerned with an
individual case, we wish to bring the fact before you
because many of the Group 'C' employees have been
denied due LSG, HSG II & HSG I Promotions in U.P.
circle by mere application of bench marks without
minding the other aspects.
It is request to take action as deems fit and
intimate the result.

l Protection of pay of defunct scale of PO &
RMS Accountants who opted for general line under
Directorate letter No. 2-22/88 - PE I dt. 01.12.92.

dt. 28.05.02.
A kind attention is invited to the reference cited
above in which directorate letter, the case of late Natha
BHARTIYA POST
Singh, Accountant Punjab Circle was decided.
The decision taken in the said case was purely
a policy decision and the contents of the said letter
might have been applied to all other similar cases.
Unfortunately, the said decision was not
communicated to other circles which causes hardship
to those defunct scale Accountants who switched over
to general line.
To cite an instance one Sri B.S. Dhiman,
Accountant, Dharamshala Division in Himachal
Pradesh who opted to defunct scale earlier was
promoted to LSG APM Accounts on 11.06.91 in the
pre revised scale of Rs. 1400- 2300 and his pay was
fixed under FR 22 (C). When he was switched over to
general line, his pay has been refixed under FR 22 (a)
2 considering that it did not involve higher
responsibilities. There was a drop in his emoluments
and perennial loss on emoluments.
If the decision contained in Directorate letter
dt. 28.5.02 cited above is applied is his case as if
applied in the case of Sri Natha Singh of Punjab Circle,
the official will not face any reduction of pay or recovery.
It is most pertinent to mention that while
deciding the cases of pay fixation of the officials
working in SBCO/ Administrative officials under TBOP/
BCR scheme vide Directorate letter no. 202/92 - PE I
dt. 01.12.95, they were allowed direct fixation in the
pay scale of TBOP/BCR. The Directorate letter dt.
28.05.02 is also based on the similar anology but has
not been applied in any other circle except to Punjab
due to non-circulation of the contents.
It is therefore requested to look in to this matter
personally and cause necessary instruction to all
Heads of Circles based on the letter dt. 28.05.02 of
the Directorate to settle the problems if any prevailing
similar to the case of Shri B. Dhiman.
Letter No. P/2-21/UK Circle dated : 31.10.2007
addressed to DDG (P), Department of Post
l Filling up of residual vacancies - case of
Uttarkhand Circle.
It is constrained to note that despite the
assurances given by the Secretary to direct all circle
heads to fill up all the residual vacancies with out any
further clarifications at once, necessary instructions
have not been reached the circle heads.
Resultantly, the position remains the same and
in particular, no action seems in Uttarkhand Circle to
fill up such posts till now. It causes a concern.
It is therefore requested to cause necessary
instruction to all Circle Heads to fill up the posts
immediately without any further delay.

v PRODUCTION OF MEDICAL CERTIFICATE
FOR LEAVE
I am directed to invite a reference to this office
endt. No. 51/24/58/SPB. dt. 31.3.59 forwarding an
advance copy of correction slip amending Rule 39
of P & T Man. Vol. II. It was laid down in the said
rule that in cases of severe illness where leave is
required for medical reasons and the official is not
able to attend his duties, he should send the medical
certificate during the course of that day.
The matter has been reconsidered. It may not
be possible to produce medical certificates in all
cases on the same day. It has therefore been
decided that the officials may produce the medical
certificates within two days instead of on the same
day. Necessary amendment to Rule 39 of P&T Man.
Vol. II will be issued in due course. In the meantime
this may be brought to the notice of all leave
sanctioning authorities under your control.

v SPLIT DUTY CONCESSION
1. In para 16 of Chapter XXXV of their Report,
the Central Pay Commission have recommended
that when the employee's residence is not close to
the place of duty, seven hours of split duty should
be treated as equivalent to Eight hours of normal

1 The question regarding the duty hours of

Department has been under consideration in this
office for some time past.
2 For purposes of security two types of people
are employed viz. (a) Chowkidars and (b) Gatemen.
The duties of these Categories are, briefly, as
follows:-
Chowkidars :- They maintain a general watch over
property or stores. They may also be employed to
keep a general watch over the buildings at night.
On some other occasions, for instance, when Stores
for installation of automatic exchanges are kept well
secured in large packing cases in a building (which
has not been made over to the Posts and
Telegraphs completely by the Contractor or the
Public Works Department) they may be employed
round the clock.
Gatemen :- They are employed to control the
movement of members of public and/or of staff or of
stores (with pass in/pass out slips) through gates.
A certain amount of literacy will have to be insisted
upon for the recruitment of Gatemen.
3 It has been decided that Chowkidars may
ordinarily be given 12 hours of duty. But in special
cases they may be employed so as to suit local
conditions.
The gatemen are employed for 8 hours of
duty a day.
4 The type and number of staff required in each
case should be decided according to requirements
and circumstances of each case. It has, however,
to be ensured that minimum number of staff is
employed.
5 Necessary instructions may be issued to all
concerned under your control.

Com. Chandra Gupta, Ex Vice President of

breathed his lost on 31.10.07 at Lucknow. He had
a long history of dedication and sacrifice for this
movement. His demise is an irreparable loss to the
movement and particularly for U.P. Circle.

 PAY PANEL : HIRE ON CONTRACT
New Delhi, Oct.12: The Sixth Pay
Commission headed by Justice B.N.Srikrishna (Retd)
plans to recommend to the Government that it hire
bureaucrats in future on a contract basis in order to
increase the efficiency of the administration.
The commission, whose recommendations are,
however, not binding on the government, is expected
to submit them formally by March or April next year.
Justice Srikrishna, when asked if he was
advocating a "hire-and-fire" policy for senior
government officials, said: "Why not? If you want to
end the security of tenure, then such an alternative
(contractual approach) needs to be examined. It is
a logical corollary that needs to be looked at."
Justice Srikrishna said there was a "dire need"
to develop "a sprit of competitiveness in governance
in order to end the prevailing 'mai baap' attitude." In a
no-holds-barred interview to this newspaper, he added:
"We believe a bureaucrat's salary must be related to
his performance. If he performs well, he must be
rewarded; if not, he should be taken to task. As the
Indian Navy says, 'Shape Up or Ship Out'. We are at
present working out the parameters of how such a
policy can be implemented."
The Pay Commission chairman said there was
need for a complete overhaul of the entire
administrative system. "We are studying the whole
issue of the extent to which excessive security of
tenure has affected government servants at all levels.
The Administrative Reforms Commission has also
looked into this at considerable length. When
departmental action has to be taken against a
bureaucrat, the matter will drag on interminably for
years and years."
"The question to be asked is: why does a
private company provide results, whereas this is not
the case with the government? We keep talking about
making India a superpower with growth rates
exceeding nine percent. To bring this about, every
aspect of the nation needs to gear up to achieve these
results. We cannot have a BMW engine attached to
a khattara gadi. I am an optimist. Yeh kyoon nahi ho
sakta hai?" He said he was not suggesting that all
government employees be hired on a contract basis:
this was only for officials at a senior level. "I am not
suggesting that all government jobs be made
contractual. All I am emphasising is that jobs up to a
certain level must remain contractual," Justice
Srikrishna said. "This will help translate into more
discipline, more conscientiousness and extreme
accountability from government employees. The

employee must be able to account for every
rupee that the government spends. The public
is fed up of government servants being paid
more and more for non-performance," he said.
Justice Srikrishna denied that government pay scales
were going to be put at par with private sector
salaries. He said: "Boys coming out of school are
getting salaries of over Rs 1 lakh per month and more.
We have to look into this whole issue to see how
much parity we can achieve." He also denied that
there were plans to give government secretaries
annual pay packages of over Rs 1 crore and more. "I
don't think too much credence should be given
to rumours. All sections are demanding
substantial increases in salaries." He said: "We
have to keep in mind the financial implications
of our recommendations. There is no point in
our recommending an increase of Rs 50 when
all that the finance ministry can afford is Rs 10."
Justice Srikrishna agreed that an increase in
salaries at the Centre was bound to have a ripple effect
on state governments as well. "The exact proportion
(of the increase) would vary from state to state. But it
must be remembered that our recommendations are
not binding on the states, in fact they are not binding
on the Central Government-it is within their discretion
to accept or reject" he said.
If government employees have contract jobs,
how will they be entitled to pension benefits? Justice
Srikrishna said: "Persons on contract would be
entitled to a higher compensation package and not
pension for the contractual period.Those employees
prior to 1.1.2004 would continue to get pensions,
while those employes prior to 1.1.2004 would
continue to get pensions, while those employes
on or after 1.1.2004 would be governed by the
New Pension Scheme".
Justice Srikrishna said he did not want the
Sixth Pay Commission to become one more ritualistic
exercise to dole out more money to government
employees, particularly since a huge chunk of
government revenues were being spent on salaries.
"It is regrettable that what is being spent is
being inefficiently utilized. Leakages must be stopped
at all cost. If the citizen gets every rupee's worth,
then we are working towards having an ideal
government," he said.

CABINET GETS POSTAL DEPT NOTE FOR 49% FDI CAP IN COURIERS
NEW DELHI: This is one mail courier companies

note circulated by the department of posts has
mooted 49% cap on FDI in courier business.
If the proposal goes through, multinationals
like Fedex, DHL, UPS and TNT who hold more than
49% in Indian ventures will have to part stake. The
draft of the Indian Post Office (Amendment) Bill has
another whammy in store for the private sector.
It proposes to make letters, parcels and
packets weighing up to 150 gm the exclusive preserve
of India Post. Private players will have to charge 2.5
times the tariff specified by Speed Post to operate in
this segment.
The proposal to amend the Indian Post Office
(Amendment) Act has been revived despite opposition
from other government departments and the courier
industry. A source said posts secretary I M G Khan
has sent a communication on the proposed changes
to department of industrial policy & promotion (Dipp)
secretary Ajay Shankar.
The proposals specify that a person eligible to
seek registration for operating in the mail sector has
to be a company in which not less than 51% of the
paid-up share capital is held by the citizens of India.
"Any dilution in FDI would be a retrograde step.
Express industry is a leading driver of logistics
industry the world over and India needs large
investments in this sector. It would impact the India
plans of major global service providers like Fedex,
UPS, TNT and DHL, and other international
companies like Aramex and OCS," said Express
Industry Council of India's (EICI) Vijay Kumar. EICI
represents over 80% of the private courier players.

business segment like Speed Post," Mr Kumar added.
The private courier companies had vehemently
opposed the amendments earlier too. "In an era of
free economy, if the country is embracing any
legislation of such nature, it would send a wrong image
internationally and it would also wipe out a vibrant
part of our economy," EICI had said in a
communication to telecom minister A Raja.
EICI had also said that the proposed amendment,
if approved, could maim the Rs 3,500-crore domestic
industry, especially the small players, and limit choice
for consumers. Dipp had opposed the earlier draft of
the proposed Bill and is likely to do so again. Officials
feel the final decision, however, rests with the Cabinet.

whether the element of Service Tax, Education Cess

and it has been decided that the element of Service
Tax, Education Cess and other similar levies being
charged by Government on travel by Air/Road /Rail/
Steamer on tour / transfer or LTC are reimbursable to
the individual officer.
In their application to the staff serving in the

Complaints from various corners are being
received that there is inordinate delay in payment of
dearness relief to pensioners/family pensioners, which
has been receiving attention of the Govt.
2. The matter has been considered in consultation
with the Comptroller & Auditor General of India and
the Reserve Bank of India. It has been decided to
release payment of dearness relief to pensioners/
family pensioners on the basis of orders of the
Department of Pension & Pensioners Welfare without
waiting for any further instructions from this office.
3. It is, therefore, requested that the pension
branch of the circle offices may be advised to act
directly on the Government orders in respect of
dearness relief etc. supplied by Govt. to them through
POST, FAX e-mail or by accessing from the website
of the pension paying authorities concerned without
waiting for receipt of orders from the nodal ministry/
department. A suitable officer in the circle office may
be designated to access the DOPT website http://
persmin.nic.in/pension and send the copies of the
order to the Pension Disbursing Offices without delay.

The undersigned is directed to say that the
Government servants who had drawn lump sum
payment in respect of pro-rata pension (1/3rd as well
as 2/3rd) on absorption in a PSU/Autonomous Body
and have become entitled to restoration of1/3rd
commuted portion of pension as per the provisions of
this Department's O.M. No. 34/2/86-P&PW dated 5th
March 87 after 15 years from the date of commutation
or 1.4.85 whichever is later, are regulated vide this
Department O.M. No. 4/59/97-P&PW(D) dated 14th
July 1998 as clarified from time to time.
2. Andhra Pradesh High Court in its judgment
dated 24.12.03 in Writ Petition No. 8532 of 2003
followed by the Supreme Court Judgment dated
29.11.06 in Civil Appeal No. 5269 of 2006 arising out
of SLP Nos. 21647-648 of 2005 and the Supreme Court
Judgment dated 24.07.07 in Review Petition No. 643
of 07 has decided as under:-
"……..the public sector undertaking absorbees are also
entitled for dearness relief etc. but not on entire pension
commuted as on the date of retirement. Moreover they
received lumpsum amount by way of terminal benefits
on surrendering on 2/3rd pension. In that way, they
have already parted with 2/3rd pension, it cannot be
said to revive after 15 years. But, in case of Central
government pensioners 2/3rd pension was continued
to be received by them. Therefore, what is restored is
1/3rd pension which means full pension. But the same
principle cannot be applied to say that the absorbee
will get full pension after 15 years in case those who
had commuted 1/3rd pension and received terminal
benefits for 2/3rd pension had he not surrendered, he
continue to receive 2/3rd pension, the same principle
apply as in case of Central Government employees.
But having received the cash compensation in respect
of the surrender value of 2/3rd, he cannot be allowed
to say that he is also a pensioner as far as 2/3rd
pension is concerned. Such absorbee stand on a
different footing and they fall in a different class by
themselves on this issue. Under those circumstances,
the ines capable conclusion is that 1/3rd pension has
to be arrived at only on the basis of the basic pension
divided by three after completion of 15 years which
becomes drawable as on the date of respective dates
and not to be arrived by deducting Rs. 403/- from the
pension therefore, the petitioner will be entitled to as
follows:-

In this case the employee had commuted
minimum permissible pension i.e. 1/3rd . But, even if
lesser portion is commuted, the pro-rata commuted
portion has to be deducted from the basic pension to
arrive at restorable pension, but however, he will get
dearness relief, interim relief etc. on full basic pension"
3. The modalities of implementation of above
judgement have been under active consideration of
the Government. The President is pleased to decide
that in partial modification of this Department's O.M
No.4/59/97- P&W (D) dated 14th July 1998, the
Government servants who has drawn lump sum
payment in respect of pro-rata pension (1/3rd as well
as 2/3rd ) on absorption in a PSU/Autonomous Body
and have become entitled to restoration of 1/3rd
commuted portion of pension as per the provisions
of this Department's O.M. No. 34/2/86-P&W dated
5th March 87 after 15 years from the date of
commutation or 1.4.85 whichever is later, shall be
entitled to the benefit of revision of restored amount
of 1/3rd commuted portion of pension as explained
hereunder:-
(1) As on 01. 01.1986
(a) The full pension of the absorbees shall be
notionally revised w.e.f. 1.1986 based on full pension
on absorption in accordance with the instructions for
revision of pension, issued for implementing the 4th
pay Commission Recommendations.
(b) The restorable 1/3rd pension shall be the sum of
the following:-
1. 1/3rd of full pensionas on 31.12.1985
2. Dearness Relief on full pension as on
31.12.1985.
3. Additional benefits on full pension as per this
Department OM No. 2/1/87- PIC dated
16.4.1987 relating to implementation of the
4th Pay Commission Recommendations.
(II) As on 01.01.1996
(a) The full pension of the absorbees shall be

notionally revised w.e.f. 1.1.1996 based on full pension
as on 31.12.95 in accordance with the instructions for
revision of pension, issued for implementing the 5th
pay Commission Recommendation
(b) The restorable 1/3rd pension shall be the sum
of the following:-
I. 1/3rd of full pension as on 31.12.1995.
II. Dearness Relief on full pension as on
31.12.1995.
III. IR-I and IR-II
IV. Fitment @ 40% of the full pension as on
31.12.1995* ( * in terms of this Deptt.

4. payment of DR shall be on full pension and is
subject to the condition that the absorbed employee
was not re-employed/employed under the Central
Government or State Government or a corporation/
Company/Body/Bank at the time of restoration.
5. The benefit of revision of restored amount of
1/3rd commuted portion of pension shall be admissible
from the date the commuted portion of pension is
restored.
6. This issue with the concurrence of Ministry of
Law vide their UO No. 11088/07-A dated 17.8.2007
and Ministry of Finance (Department of Expenditure)
vide their UO No. c-47./E.V./2007 dated 27.8.2007.

unmarried daughters of Central Government
servants/pensioners.

l Extension of scope of family Pension to
unmarried daughters of Central Government
servants/pensioners.
The undersigned is directed to say that as per
existing provisions under clauses (ii) and (iii) of sub-
rule (6) of Rule 54 of the C.C. S. (Pension) Rules,
1972 read with of para 7.2(b) of this Department's O.M.
No. 45/86/97-P&PW (A)-Part I dated the 27th October
1997, son / daughter including widowed/ divorced
daughter is eligible for grant of family pension till he/
she attains the age of 25 years or upto the date of his
/ her marriage/ remarriage, whichever is earlier subject
to income criterion laid down in this Department's O.M.
No. 15/51/97- P&PW(E) dated the 5th March 1998
which stipulates that a son/ daughter, including
widowed/ divorced daughter, shall not have an income

exceeding Rs. 2550/- per month from employment in
Government, the private sector and self employment,
etc., to be eligible for family pension. Orders were also
issued vide this Department's O.M. No. 45/51/97-
P&PW (E) (Vol.II) dated 25th July 2001 regarding
eligibility of disabled divorced/ widowed daughter for
family pension for life subject to conditions mentioned
therein. Further, orders were issued for making the
widowed/ divorced daughter eligible for family pension
vide this Department's O.M. of even number dated 25th
August, 2004.
2. The Staff Side of National council (JCM) had
raised the issue of extension of scope of family
pension to unmarried daughters of the Government
servants/ Pensioners even after attaining the age of
25 years at par with the widowed/ divorced daughters,
which has been agreed to in principle. It has,
accordingly, been decided that the unmarried
daughters beyond 25 years of age shall also be eligible
for family pension at par with the widowed/divorced
daughters subject to other conditions being fulfilled.
Grant of family pension to unmarried/ widowed/
divorced daughters shall be payable in order of their
date of birth and younger of them will not be eligible
for family pension unless the next above her has
become ineligible for grant of family pension. It is
further clarified that family pension to un married/
widowed/ divorced daughters above the age of 25
years shall be payable only after the other eligible
children below the age of 25 years have ceased to
be eligible to receive family pension and that there is
no disabled child to receive the family pension.
3. This issue with the concurrence of the Ministry

done on the basis of average emoluments notionally
drawn during the last 10 months of service under rule

7. (i) Whether the provisions contained in OM dt 17.12.98
issued by the Department of Pension are applicable,
with reference to the upgraded pay scales with effect
from 1.1.96, for the purpose of pension fixation on
notional basis of average emoluments and the actual
benefit will be allowed 19.2.03.

to upgraded scales could be extended to pre-96
retirees also.

l Relaxation in LTC Rules-delegation of
powers to Ministries/Departments regarding time
limit for the submission of the claim.
Rule 14&15 of LTC Rule provide that a claim for
reimbursement of expenditure incurred is to be
submitted within three months after the completion of
the return journey, if no advance had been drawn and
within one month after the completion of the return
journey if advance had been drawn. It has now been
decided to delegate the powers to relax these
provisions to the Ministries/Departments, where a
Government servant is not in a position to submit the
claim within the prescribed time limit and the Ministry/
Department is satisfied that he was not able to do so
due to compelling circumstance of Financial Advisor
can admit the claims in such cases in relaxation of
the provisions subject to the following time limits
without reference to DoP&T.
(a) where no LTC advance is taken, LTC bill
submitted within a period not exceeding six months.
(b) Where LTC advance has been drawn the LTC claim
for reimbursement submitted within a period of three
months after the completion of return journey (provided
the Government servant refunds the entire advance within
45 days after the completion of the return journey).
2. Ministries/Departments are requested to keep
these instruction in view while processing belated LTC
claims.
3. These instructions will be effective from the date
of issue of this O.M.

DoPT OM No.31011/5/2007-Estt.(A) Dated :27.09.2007
l Amendment of the provisions of rule 10 of
the Central Civil Services (Classification, Control
and Appeal) Rules, 1965 regarding review of
suspension.
The undersigned is directed to refer to the
provisions of rule 10 of the Central Civil Services
(Classification, Control and Appeal) Rules, 1965 and
to say that the provisions regarding deemed
suspension have since been reviewed by this
Department.
2. The provisions in Rule 10 of CCS (CCA) Rules
have been modified and amendment to the same have
been notified in Notification No. GSR 105 dated
06.06.2007 published in the Gazette of India dated
16.06.2007.
3. As per the original provisions of rule 10 of the
CCS (CCA) Rules, 1965 the provision for review within
ninety days was applicable to all types of suspensions.
However, in cases of continued detention, the review
becomes a mere formality with no consequences as
a Government servant in such a situation has to
continue to be under deemed suspension. It has,
therefore been decided that a review of suspension
shall not be necessary in such cases. Accordingly, a
proviso has now been added to sub-rule(7) of the said
rule 10 as follows:
"provided that no such review of suspension shall
be necessary in the case of deemed suspension
under sub-rule(2), if the Government servant
continues to be under detention at the time of
completion of ninety days of suspension and the
ninety days period for review in such cases will
count from the date the Government servant
detained in custody is released from detention
of the date on which the fact of his release from
detention is intimated to his appointing authority,
whichever is later."
4. In deemed suspensions under sub-rule (2), the
date of order of suspension may be much later than
the deemed date of suspension. With a view to making
these provisions explicit, sub-rule (6) of the aforesaid
rule 10 has now been amended to substitute the words
"ninety days from the date of order of suspension"
occurring therein with "ninety days from the effective
date of suspension". Consequent upon this
amendment, it would henceforth be necessary to
specifically indicate in the orders of suspension the
effective date of suspension.
5. Sub-rule (7) of the aforesaid rule 10 stipulates
says that "Notwithstanding anything contained in sub-
rule (5)(a), an order of suspension made or deemed to

u Alleged exemplary case of favoritism by
PMG Agra by granting irregular extension to Sri
Udaivir Singh, Postal Assistant, Vrindaban
(Mathura), UP for unauthorized occupation of
Govt. quarter at Mathura HO Campus.
I am directed to refer to your letter No. P-2/20/
Mathura dated 10.05.07 on the above mentioned
subject.
2. The matter has been examined in consultation
with the Circle Office. As reported, one Shri Udai Veer
Singh, PA working at Mathura HO from 07.10.97 was
transferred and posted as PA, Vrindaban Post Office
in Mathura Division. Before joining at Vrindaban PO,
he was allotted Type II Quarter at First floor HPO
Compound Mathura. On transfer Shri Singh was
permitted to retain the Government Quarter at Mathura
for two months on payment of normal rate of license
fee. Subsequently on his request he was further
allowed to retain the Government quarter in question
for further six months. However, the official did not
vacate the Government quarter after the expiry of the
above time on 07.03.2007, despite issue of notice by
the SSPOs Mathura and an amount of Rs. 2588/- per
month as Penal rent is being recovered from the official.
3. Regarding posting of Shri Singh PA again at
Mathura HO, it is to clarify that the official was only
attached at Mathura HO at his request and cost and
he was not transferred back to Mathura HO and that
the HO of official remained Vrindaban during the period
of his attachment at Mathura HO. Therefore, Shri Singh
was allowed to retain the Government Quarter at
Mathura on his transfer and posting at Vrindaban PO
for the permissible period of retention of quarter. No
element of favoritism is thus being shown to the official
concerned in this regard by the authority concerned.
Further, disciplinary action under Rule 16 of CCS (CCA)
Rules, 1965 has also been initiated against Shri Udai
Veer Singh for not vacating the Government Quarter.

2. The matter has been examined in consultation
with the Circle Office. As reported, the SPOs, Inspector
and other employees who worked during the period
from 01.01.96 to 15.08.2004, have been identified as
offenders during the circle level enquiry. Five Gazetted
officers who worked as Supdt. and five Inspectors are
being proceeded against departmentally. On the face
of it, the allegation of the Union does not appear to be
correct.

u Alleged irregular deputation of Postal
Assistants from Ludhiana Mofussil Division to
Circle Office, Punjab Circle.
I am directed to refer to your latter No. P/2-17/
LDH Mfi. Dated 27.02.2007 on the above mentioned
subject.
2. The matter has been examined in consultation
with the Circle Office. As reported, the position is as
follows:
i) At the time of introduction of Rural Postal Life
insurance Scheme in 1995, no separate staff was
sanctioned to run this new scheme. However, some
staff from the sanctioned strength of PLI section was
diverted to handle the work of RPLI Scheme.

ii) With the passage of time, the RPLI Scheme
happened to be very popular in rural area and business
under this scheme increased day by day. During the
past few years PLI/RPLI business has increased
manifold. Due to increase in the business, the 'After
Sale' work relating to both the schemes increased
tremendously which was getting accumulated due to
inadequate staff in both PLI/RPLI Sections to clear
the pending work of concerned Dn.'
iii) Like other Divisions, three PA's from Ludhiana
(M) Dn. were also called for on deputation to clear the
pending work of this Dn. Out of these three PA's one
was returned back to Ludhiana (M) Dn. after one
month. The other two PA's have also been returned
back to Ludhiana (M) Dn. after getting the pending
work on track. At present, no PA from Ludhiana (M)
Dn. Is on deputation to PLI/RPLI section to Punjab
Circle.

I am directed to refer to your letter No. P/4-7
dated 21-08-2007 on the subject mentioned above and
to say that as per Recruitment Rules of Inspectors of
Posts a candidate is allowed a maximum of four
chances to appear in the Departmental Examination
and the candidate, who secures more than 70%
aggregate marks in fourth chance is allowed one more
chance as a special case. As the Recruitment Rules
are statutory in nature, provisions contained therein
are required to be followed strictly. Therefore, it has
not been found possible to accede to the request of
All India Postal Employees Union Group 'C, to give
one more chance to the officials, who exhausted their
chances, to appear in the ensuing Inspectors of Posts
Departmental Examination due to introduction of the
new system.

The joint Circle conference of AIPEU Group 'C'
AIPEU Postmen & Group D and AIPEDE union, West
Bengal Circle was held at Jalpaiguri from 4.11.07 to
07.11.07. A colourful rally consisting more than 2000
comrades was well organised before the

Smt. Minati Sen, Member parliament, Jalpaiguri
addressed the joint subject committee on 06.11.07.
An interaction session was organised on
05.11.07 afternoon with General Secretary in the P3
session. The General Secretary dealt all the issues
and answered to all the 85 querries raised by the
delegates from 27 divisions among the existing 41

is directed to inform you that the case of Shri Ganesh
G Badgujar was put up in the CRC meeting held on
4.11.06/8.11.06 for decision and was rejected by CRC
and the reason of rejection has already been intimated
to the applicant vide this office letter even no. dated
20.03.07.
It is further to intimate that there are very few
vacancies i.e. 5% of the Direct Recruitment quota
approved by Postal Dte. for filling up of the post under
relaxation quota. The appointment is given under
relaxation quota when a Govt. servant dies in harness
and he needs immediate assistance subject to
availability of vacancies for the purpose.
Since vacancies under compassionate quota
are not sufficient compared to the number of cases
put up before CRC, all applications can not be
considered favourably. Hence, we regret that the case
Shri Ganesh G Badgujar was rejected by the CRC
and cannot be re-considered in future and is closed at
this end as per guidelines governing compassionate
appointment.
