Q:

Which parties must the contract for provision of services be established between?

A:

This varies from country to country.


In France, for example, the contract may be part of a global service agreement, for example,
between an HQ in India and a client in the U.S., with an additional letter of assignment or
work order to cover the services in France.
In Italy or Belgium, however, this would not be sufficient and the contract for services must
be directly between the EU sending employer and the receiving local company.
In the Netherlands, this may be subject to change following the recent Essent Energie ruling.
Note that in all cases, the applicant (the worker) must be hired locally in the sending EU
country; he/she cannot be on assignment in that EU country.

Q:

Can the Van der Elst be used in Intra Company Transfer situations?

A:

In Spain, Ireland and Italy, yes. In Belgium, France and the Netherlands, to date, no but
this could change following the Essent Energie ruling.

Q:

Is Van der Elst used in Denmark?

A:

Technically, yes, it is available, but in practice, this is hardly ever used. Most companies
would either opt for a short term assignment for the provision of services under the fitters
rule or would go for a standard work permit. Contact us for more details of either route.
