VARIETIES BUDDED FOR 2012

All trees are priced according to caliper


and the total number of trees available at
the time of shipping.
If available, all 3/8 trees are $4.50 each
plus royalty.

A 2% certification will be added to the


invoice price of each tree.

This Price List supersedes all previous lists


and is subject to change without notice.

A 2% convenience fee will be added when


using a credit card.

Prices are F.O.B. Hartford, Michigan.


Larger trees are Topped at approximately
6 overall (including roots)

Terms for Commercial Growers


ORDERS: Minimum order of one hundred (100) trees. All trees will
be invoiced according to the size and quantity supplied and at the
price in effect at the time of shipping. The quantity rate will be
determined by the total number of trees shipped, without regard
for the number of trees ordered. Trees are graded and sold in bundles
of five or ten, depending on size. If a smaller quantity is ordered, a
$2.00 per item broken bundle charge will apply.

SHIPPING:

DEPOSIT: A deposit of $1.00 per tree is required at time of order.


No deposit is required on subject items, replacement trees. Your
deposit will be refunded if we are unable to supply the trees.

DIRECT POOL TRUCK DELIVERY: When we have sufficient orders


from customers located along or near main routes, we hire an insulated
and temperature controlled truck and deliver directly from our warehouse
to you. This assures you of getting your trees in top condition. Costs will
be prorated and included in your invoice.

PACKING & SHIPPING: The cost for packing and shipping will be at
cost and included in your invoice. This applies to replacement trees
as well.
PAYMENT: Net cash is due on receipt of order confirmation. If we
have a signed credit application on file which has been approved by
our credit department, the amounts will be due within thirty days of
invoice date. All late payments will be charged 1.5% per month on
the unpaid balance (annual rate 18%). All foreign remittances must
be in U.S. dollars.

LOCAL PICK-UP: Midwest and Canadian growers often make


appointments with our nursery office and conveniently pick-up their
trees with their own truck. Growers save big on shipping and packaging
cost. Call a week in advance and well have your order ready! Bring
covers for bare root or have us box your order at cost.

UNITED PARCEL SERVICE can be used for small shipments but packages
can be no larger than 108 combined length and girth.
MOTOR FREIGHT is usually reserved for larger shipments. Trucklines
will not usually accept trees in freezing weather so shipment may be
delayed in February and sometimes in March.

CANCELLATION: Orders, once accepted in writing , cannot be


canceled without the written consent of Hilltop. If canceled, it must
be based upon terms which will indemnify Hilltop against all loss
arising from such cancellation. Deposits will not be refunded on
trees canceled after February 1.

Limited Warranty
All Hilltop Trees Are Warranted To Be:
1. True to name both variety and rootstock.
2. Carefully grown and free of harmful disease or insect damage.

condition
6. To grow if correctly cared for upon receipt and properly planted
and maintained.

3. Properly graded for uniformity of size and quality.


4. Carefully stored to maintain their high quality.
Purchaser assumes the responsibility for proper care and maintenance of
trees as outlined below and in the planting guide. This means that all trees
will be carefully stored and protected until planted properly in suitable soil
on a correctly prepared site. Trees must be pruned at planting time and
planted properly either with a tree planter or in augured holes of adequate
size and tamped in to seal in soil around the root system. Trees should be
watered in at planting time and additionally as needed, mulched or cultivated
to prevent competition from grass and weeds and protected from rodents.
Warranty is void if manure, fertilizer, or similar material is placed in the hole
with the trees. Warranty is void if trees are planted after June 1 of the year
the trees are delivered. If Hilltop trees do not meet our warranty and have
been cared for properly as stipulated above, Hilltop will replace the trees
subject to availability of the stock at the time of notification, or at our option,
refund the purchase price of the trees, providing the purchasers account is
current and Hilltop is notified directly of the loss before July 31, of the year
the trees are delivered. The replacement policy shall extend only to first year
planting of new orchards. It shall not apply to trees purchased for replants or
to trees furnished under this replacement policy. Total replacements shall
not exceed ten percent (10%) of the total original order. Warranty does not
apply to utility grade trees, trees purchased for resale, trees purchased by
non commercial growers or inventory reduction sales. In the event that Hilltop
trees might prove to be untrue to name and Hilltop is notified directly during
the first fruiting season, Hilltop will replace the trees, or at our option, refund
the purchase price. Such action by Hilltop shall constitute full and complete

adjustment and release. Hilltops liability under the above warranty shall not be
greater than the purchase price. The purchaser assumes all risk and liability for
the results obtained by the purchase of trees. No claim of any kind, whether
after the trees are delivered or for non-delivery of same, and whether or not
based on negligence, shall be greater in the amount than the original purchase
price of the trees in respect to which such claim is made and in no event shall
Hilltop be liable for indirect consequential damages, whether or not resulting
from or caused by negligence of the nursery. Hilltop makes no other warranties
of any kind whatsoever, express or implied, and all implied warranties of
merchantability and fitness for a particular purpose which exceed the afore
stated obligations and hereby disclaimed by Hilltop and excluded from the
agreement.
All replacements FOB. Hilltop, Hartford, Michigan. The purchaser is
responsible for all freight and packaging costs on replacement trees.
If trees are delivered damaged, or if trees do not appear to start growing
properly, please contact Hilltop directly immediately, Hilltop may be able to
help correct the problem.
Warning: Ethylene Gas concentration will cause extensive damage or kill
trees if trees are stored with apples or in storage rooms that have not been
completely ventilated.
This warranty supersedes all previous written or verbal warranties.
