LEGAL RESEARCH OUTLINE
I-

Introduction
Gender equality entails a society where men and women enjoy the same and
equal political, civil and economic opportunities, rights and obligations in every
aspect of life. Gender sensitivity between men and women exists when both sexes,
regardless of their social orientation, are able to share mutual respect to each other,
are equal in the distribution of power and influence and enjoy equal access and
treatment. A significant aspect of promoting gender equality and sensitivity is the
empowerment of women, with a focus on identifying and redressing power
imbalances and giving women more autonomy to manage their own lives. Women's
empowerment is essential for the realization of human rights for all. Few of the
methods to make sure that women are empowered are to give them equal footing in
the eyes of law, having laws that will enable them to independently decide and handle
their socio-civic life without the need of consent or dictate of men or of their
husbands, and legislating and passing laws that will protect them from any kind of
abuse.

Legal Issue
a. Whether or not our legal institutions through laws guarantee women
equality in basic legal and human rights, in access to or control of
properties or other resources, in employment and earning, and social and
political participation.
b. Whether or not these Laws empowering and protecting women from
domestic violence as well as putting them in equal footing with men are
seen to be enforced and applied.

Relevant Statutes
a. The Philippine Constitution
i. ARTICLE XIII: WOMEN
1. Section 14. The State shall protect working women by
providing safe and healthful working conditions, taking
into account their maternal functions, and such facilities
and opportunities that will enhance their welfare and enable

them to realize their full potential in the service of the


nation.
b. Several Articles in Family Code that puts men and women on equal
footing
Art. 69. The husband and wife shall fix the family domicile. In
case of disagreement, the court shall decide.
The court may exempt one spouse from living with the
other if the latter should live abroad or there are other valid and
compelling reasons for the exemption. However, such exemption
shall not apply if the same is not compatible with the solidarity of
the family.
Art. 70. The spouses are jointly responsible for the support of the
family. The expenses for such support and other conjugal
obligations shall be paid from the community property and, in the
absence thereof, from the income or fruits of their separate
properties. In case of insufficiency or absence of said income or
fruits, such obligations shall be satisfied from the separate
properties. (111a)
Art. 71. The management of the household shall be the right and
the duty of both spouses. The expenses for such management shall
be paid in accordance with the provisions of Article 70. (115a)
Art. 73. Either spouse may exercise any legitimate profession,
occupation, business or activity without the consent of the other.
The latter may object only on valid, serious, and moral grounds.
In case of disagreement, the court shall decide whether or
not:
(1) The objection is proper; and
(2) Benefit has occurred to the family prior to the objection
or thereafter. If the benefit accrued prior to the objection, the
resulting obligation shall be enforced against the separate property
of the spouse who has not obtained consent.
c. Republic Acts 9208
i. An Act to institute policies to eliminate trafficking in persons
especially women and children, establishing the necessary
institutional mechanisms for protection and support of trafficked
persons, providing penalties for its violations and for other.
d. Republic Act 7192 of 1992

i. An Act known as the Women in Development and Nation


Building Act, promotes the integration of women as full and equal
partners of men in development and nation building.
e. Republic Act 9262
i. An Act Defining Violence Against Women and Their Children,
providing for protective measures for victims, prescribing penalties
therefore, and for other purposes. Otherwise known as the AntiViolence Against Women and Their Children Act of 2004.
f. Republic Act 8972
i. An Act providing for benefits and privileges to solo parents and
their children, appropriating funds therefore and for other
purposes. Also known as the Solo Parents Welfare Act of 2000
g. Magna Carta of Women
i. The Magna Carta of Women is a comprehensive womens human
rights law that seeks to eliminate discrimination against women by
recognizing, protecting, fulfilling and promoting the rights of
Filipino women, especially those in the marginalized sectors.
