AFFIDAVIT
I, TRINIDAD SHINAGAWA, of legal age, widow, Filipino Citizen and with
residence at No. 17 Lower Balacbac, Sto. Tomas Proper, Baguio City,
Philippines, after having been duly sworn to in accordance with law hereby
depose and state:
1. That I am a tenant at the house of MRS. DIONISIA CASTRO, located
at No. 17 Lower Balacbac, Sto. Tomas Proper, Baguio City;
2. That I and my daughter staying at the second floor of the said house
and in the first floor there are tenants namely MIA T. YAP and JOHN
CACAL;
3. That on the last week of February, 2013, I felt, noticed and observed
that the tenants below knows where I am standing, sitting or walking
even if I move slowly and quietly;
4. That they know when I am sitting or lying in my bed, on floor with
mattress, sometime elevated bed;
5. That this observation is supported by what I overheard conversation
from them at the lower floor, to wit:
Ano kayang ginagawa niya habang nakikinig sa radio?
Ano kayang ginagawa habang nakaupo sa higaan niya?
Nahiga na siya.
Umikot siya.
Nakatayo siya diyan.
bli-nok niya. (I hear this when I put a heavy object where I feel there
is a monitoring device. I hear it often.)
Paano siya makagalaw sa higaan niya kung maraming nilagay na
block.
6. That when I was walking briskly on toes, I overheard this
conversation, Hindi niya alam na alam natin ang ginagawa.
7. That on June 13, 2013 at around 10:30 PM, I heard the occupants
arrived, mainly John and Mia and a companion, there were
conversations coming from the lower floor, one kicked something,
words uttered and heard them saying that:
Ano bang sakit niya? Bubulabugin nga natin, other voices said Sige
Ano bang makukuha natin kung sakaling
A voice saying, Kausapin na lang natin bukas.
8. That one was using flash light focusing on the window near my
sleeping area and a light blinking, moving around the perimeter of the
window for a duration of about 2-3 hours;

9. That on June 25, 2013 in the morning, I overheard them talking, to

wit:
Mia, alis na tayo dito
John, gusto kong makaganti sa ginawa nilang ito
Mia, Tayo nga ang nakagawa ng masama sa kanila
10. That on June 26, 2013 at around 6:00 Am, while I am still in bed,
I heard:
nagtext siya (2x)
Text mo sa kabila
John, alis na lang ng maaga, baka nagsuplong, daan tayo sa likod,
delikado palang makabangga itong matanda, matalino, text mo
maingay tubig nila, mabaho kubeta, lababo at lakad sila ng lakad;
11. That between 10:00-11:-00 AM of June 27, 2013, I overheard
another conversation coming from the first floor between the owner of
the house and John and Mia, to wit:
basta maghigante kami sa kanya
kahit makapal ang kurtina niya, hindi kaya ng kurtina niya and
gagawin naming sa kanya, kahit anung mangyari, bahala na
12. That one June 27, 2013 at around 10:30 in the evening, PNPSWAT are on Patrol and the owner of the house texted the occupants
in the first floor of the presence of the police officers. Mia and her
companions removed some monitors and they passed by the back
door going to a neighbor place and then stayed for some hours and
waited for taxi and went to Central Business District;
13. That on June 28, 2013 at about 8:00AM, I heard them saying,
Poison ko kaya ang tubig nila para mamatay sila. On the evening of
the same day I heard, Bulabugin nga natin iyong matanda sa itaas
para palayasin niya itong matandang IGOROT;
14. That on June 29, 2013, I heard them again saying, Bat may tubig
sila, sino kayang nag-ayos ng tubo nila?. May gana pang magluto,
baka hindi mo na makain iyan;
15.

That until now they are monitoring us;

16. That with all the treats and actuations done and being made by
Mia Yap and John Cacal, I told my relatives and friends that should
any harm or even death would happen to me and my daughter, their
person would be responsible;
17. That I made this statement with clear or of sound mind and I am
very sane, contrary to what the people living below us say, that I need
a doctors help. They said that the voices that I heard is not their
voice, they even said that I am paranoid, where in fact it is not;

18. That I am executing this affidavit to attest to the veracity and

truthfulness of the foregoing statement and for all legal intents and
purposes it may serve.
