F'F#( AN+ S'.#( C&ASS /-N'C'PA&'#'$S AN+ FOR O#($R P-RPOS$S Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:: Section . Title.0 This Act shall be known as the 1Barangay Livelihood and Skills Act of 20081. Section 2. Declaration of Policy. - It is hereby declared a policy of the tate to: !a" gi#e the highest priority to social refor$ and focus its inter#ention to po#erty alle#iation through rural e$power$ent% !b" ensure that national econo$ic de#elop$ent progra$s will pro$ote the diffusion and $ore e&uitable distribution of opportunities, inco$e and wealth across all pro#inces, cities and $unicipalities in the country% !c" stri#e to enhance the &uality of life for all its citi'ens, especially the underpri#ileged, by e(panding their capacities for econo$ic producti#ity and increase their inco$es to enable the$ to a#ail of essential goods and ser#ices for their own direct benefit% and !d" pursue rural de#elop$ent with social inclusion. Section 2. Obectives. - )ursuant to the afore$entioned policies, this Act shall ha#e the following ob*ecti#es: !a" To pro$ote and support the establish$ent and $aintenance of li#elihood and skills training centers in e#ery fourth, fifth and si(th class $unicipalities% !b" To ensure that all li#elihood and skills training being offered by the go#ern$ent are properly coordinated and i$ple$ented at the $unicipal and barangay le#els% !c" To ensure that a#ailable li#elihood and skills training are $ade a#ailable to barangay co$$unities that need the $ost help fro$ the go#ern$ent% !d" To ensure that the training needs of barangay co$$unities based on local de#elop$ent plans are properly identified and ade&uately pro#ided% and !e" To prioriti'e rural areas with the highest po#erty incidence in the pro#ision of progra$s and ser#ices under this Act. Section 3. !stablish"ent of a Livelihood and Skills Training #enter. - A li#elihood and skills training center, hereinafter referred to as the +,enter+, shall be established in e#ery fourth, fifth and si(th class $unicipalities: Provided, That other $unicipalities shall be co#ered by this Act upon deter$ination of the -ational Anti-)o#erty ,o$$ission !-A),", taking into account the $unicipality.s population density and de$ographic status, po#erty incidence, inco$e class, le#el of econo$ic de#elop$ent, e$ploy$ent and producti#ity le#els, abundance of raw $aterials which ha#e potential for co$$ercial production, and the a#ailability and accessibility of e(isting li#elihood skills training progra$s and ser#ices. Section 5. Po$ers and %&nctions of the #enter. - The ,enter shall pro#ide educational and instructional acti#ities designed to enhance the knowledge, skills and attitudes of intended beneficiaries and to better prepare the$ to engage in gainful e$ploy$ent and/or entrepreneurship. It shall ha#e the following powers and functions: !a" ,onduct periodic training needs deter$ination and skills $apping of barangays within their *urisdiction: Provided, That the ,enter shall coordinate closely with the local de#elop$ent councils, the local planning offices and other national and local go#ern$ent offices to deter$ine and orchestrate the li#elihood training skills re&uired by the rural barangays concerned% !b" 0ather infor$ation and $aintain an in#entory of all e(isting li#elihood and skills training under the #arious progra$s of the go#ern$ent% !c" ,oordinate the pro#ision of li#elihood and skills training and institute $easures to ensure that such trainings are responsi#e to the needs of the barangays concerned% !d" ,oordinate and orchestrate the conduct of li#elihood and skills training independently or in partnership with national go#ern$ent agencies, pri#ate sector or ci#il society organi'ations% !e" 1acilitate the de#elop$ent and i$ple$entation of capability-building progra$s and ser#ices that will ensure effecti#e skills de#elop$ent and target the $ost nu$ber of people and co$$unities in poor barangays% !f" 2e#elop its capability to de#ise and for$ulate training curricula and training designs% !g" 2e#elop its own capacity as a resource center for li#elihood and skills training by de#eloping in-house trainors to pro#ide training ser#ices% !h" Monitor and e#aluate the progress of the indi#iduals or groups undergoing training as well as the i$ple$entation of training progra$s and ser#ices to ensure that such progra$s and ser#ices are rele#ant and useful to the needs of the co$$unities% and !i" 3nsure that the ,enter is networked with go#ern$ent efforts co#ering other aspects of li#elihood de#elop$ent such as $arketing and financing, under the li#elihood de#elop$ent syste$. Section 4. #reation of a '&nici(al Advisory Board. - The $unicipal go#ern$ents shall be responsible for instituting and $aintaining the ,enter with the assistance of a Municipal Ad#isory Board to be chaired by the $unicipal $ayor and to be co$posed of the representati#es fro$ the following stakeholders: !a" Business organi'ations, cha$ber of co$$erce and cooperati#es% !b" Micro, s$all and $ediu$-scale enterprises% !c" 4ural bankers% !d" ,i#il society organi'ations% and !e" )eople.s organi'ations undertaking li#elihood and skills training. The following shall act as ex officio $e$bers of the Municipal Ad#isory Board: !a" )ro#incial officer of the 2epart$ent of the Interior and 5ocal 0o#ern$ent% !b" )ro#incial officer of the 2epart$ent of Agriculture% !c" )ro#incial officer of the 2epart$ent of Trade and Industry% and !d" )ro#incial officer of the Technical 3ducation and kills 2e#elop$ent Authority. Section 5. Po$ers and %&nctions of the '&nici(al Advisory Board. - The Municipal Ad#isory Board, through the leadership of the $unicipal $ayor, shall pro#ide policy ad#ice and direction to guide the de#elop$ent of plans, progra$s and acti#ities of the ,enter. It shall also de#elop infor$ation, education and co$$unication plan to pro$ote the ,enter. Section ". Progra" and Service. - The ,enter shall pro#ide i#elihood and skills training ser#ices that will de#elop indi#idual and/or collecti#e knowledge, skills and attitudes of residents in co$$unities, for the purpose of enhancing their capability to engage in $ore producti#e e$ploy$ent and/or entreprenuership. This includes, but shall not be li$ited to, trainings on: !a" 2e#elop$ent of practical skills for ho$e-based, #iable inco$e generating pro*ects such as backyard gardening, a&uaculture and li#estock raising, and other such endea#ors that $ake use of the a#ailable resources within the co$$unity% !b" Business de#elop$ent ser#ices such as product design and de#elop$ent, $arketing and pro$otions% !c" Basic entrepreneurial $anage$ent, financial literacy, organi'ational de#elop$ent and other such trainings% !d" ,o$$unity participation skills de#elop$ent to pro$ote and ad#ance the barangay residents. awareness and application of co$$unity $obili'ation approaches, cooperati#e syste$s and techni&ues to create li#elihood opportunities, and participatory i$ple$entation of li#elihood progra$s and pro*ects% !e" 6ccupational ha'ard and safety, labor rights, and #alues that pro$ote the general welfare, de#elop people e$power$ent, self-reliance, and self-help% and !f" ustainable de#elop$ent and en#iron$ent-friendly li#elihood technologies. Section 9. !stablish"ent of Satellite and 'obile Training #enters. - The ,enters shall establish a satellite or $obile li#elihood and skills training center in a barangay or a cluster of barangays where dee$ed necessary by the $unicipal $ayor to ensure that the skills training to be pro#ided reach the intended beneficiaries: Provided, That the satellite or $obile centers shall pro#ide the progra$ and ser#ice of a ,enter as pro#ided for under this Act. Any pri#ate person, group, organi'ation or business entity $ay sponsor the establish$ent, operation and/or $aintenance of a satellite or $obile center in any barangay or cluster of barangays: Provided, That the acti#ities, progra$s and pro*ects of the sponsored satellite center are consistent with the ob*ecti#es of this Act and the priority training needs of the co$$unity as identified by the $unicipal li#elihood and skills training center. Section 0. O(eration and 'aintenance of #enters. - The ,enter and its satellites $ust be located in an area which is safe and accessible to the residents. !a" Maintenance - The $unicipal go#ern$ent shall ensure that the ,enters are supported by appropriate network of organi'ational support syste$s and $echanis$s, including hu$an resource. !b" uper#ision - The $unicipal $ayor shall ha#e o#erall super#ision o#er the progra$s and ser#ices offered by the ,enters: Provided, That the Municipal Ad#isory Board shall pro#ide assistance and guidance in organi'ing, strengthening and sustaining the ,enters hereinafter created. !c" )ersonnel - The personnel co$ponent of the ,enter shall depend on the si'e of the population in the barangays which for$ part of its ser#ice area. The $unicipal $ayor shall appoint a Municipal Training ,oordinator !MT," who shall ser#e in a full-ti$e capacity. The MT, shall o#ersee the day-to-day operations of the ,enter. The MT, $ust be capable of super#ising the planning and the i$ple$entation of ser#ices offered by the ,enter in coordination with other rele#ant $unicipal officers such as, but not li$ited to, the Municipal )lanning and 2e#elop$ent ,oordinator, the Agriculture 6fficer and the )ublic 3$ploy$ent er#ice 6fficer. The $unicipal $ayor shall deter$ine the nu$ber of staff co$ple$ent and appoint the sa$e who shall assist the MT, in discharging its duties. Additional $anpower for the ,enters $ay include the following: !7" 6fficers and $e$bers of barangay councils% !8" 9olunteers fro$ the pri#ate or public sector, including staff of the sangguniang barangay, $e$bers of socio-ci#ic organi'ations, out-of- school youth or students on #acation% and !:" tudents enrolled in practicu$ courses such as the on-the-*ob trainees. !d" 1unding - The $unicipal go#ern$ent shall set aside funds fro$ any a#ailable local re#enues in an a$ount dee$ed appropriate by the $unicipal officials concerned for the operation and $aintenance of the ,enter and their satellite centers, if any. Section . )ole of the *ational +overn"ent. - The national go#ern$ent shall pro$ote and guarantee the establish$ent of the ,enters and assist local go#ern$ents in instituting and $aintaining such ,enters and in ensuring the effecti#eness of the ser#ices being pro#ided. The -ational Anti-)o#erty ,o$$ission !-A)," shall adopt guidelines for identifying additional $unicipalities to be co#ered under this Act as pro#ided for under ection ;. The 2epart$ent of the Interior and 5ocal 0o#ern$ent !2I50" and the Technical 3ducation and kills 2e#elop$ent Authority !T32A" shall *ointly de#elop and i$ple$ent, within two !8" years fro$ the effecti#ity of this Act, a progra$ to facilitate the establish$ent of the ,enters in the $unicipalities co#ered herein: Provided, That the T32A shall allocate twenty-fi#e percent !8<=" of its total annual appropriations for the de#elop$ent, e#aluation, $onitoring and accreditation of for$al and non-for$al technical, #ocational, education and training, for this purpose. All national go#ern$ent agencies that conduct or render co$$unity-based li#elihood and skills training shall de#elop annual training progra$s specifically for the $unicipalities co#ered under this Act: Provided, That said agencies shall allocate funding for such progra$s out of their annual appropriations: Provided, further, That the agencies shall coordinate with the ,enters for the i$ple$entation of such progra$s and shall sub$it an annual acco$plish$ent report on the sa$e to the -A),. The -A), shall consolidate the sub$issions of the agencies and sub$it to ,ongress a consolidated acco$plish$ent report and reco$$endations for the effecti#e i$ple$entation of this Act. Section 2. Donations. - The ,enter $ay recei#e donations or be&uests of property or ser#ices which shall be utili'ed only for the i$ple$entation of the progra$. uch donations or be&uests of property shall be co#ered by the pro#isions of the -ational Internal 4e#enue ,ode !-I4," e(e$pting such fro$ ta(es and other fees and/or procedures. Section 2. )e(ealing #la&se. - 5aws or part of laws, e(ecuti#e orders, circulars, regulations and $e$oranda inconsistent with this Act are hereby repealed or a$ended accordingly. Section 3. Se(arability #la&se. - If any pro#ision of this Act shall be held in#alid, the re$aining pro#isions shall be gi#en full force and effect as co$pletely as if the pro#ision held in#alid had not been included herein. Section 5. !ffectivity #la&se. - This Act shall take effect fifteen !7<" days after its co$plete publication in the Official Gaette or in at least two !8" newspapers of general circulation.
