STATE OF MISSISSIPPI HINDSCOUNTYSHERIFF'SDEPARTMENT PLAINTIFF DEFENDANT MOTION FORCONTEMPT OF COURT PURSUANT TO UNIFORMCIRCUIT ANDCOUNTYCOURT RULE 7.04 COMESNOW, the state of Mississippi, by and through the District attorney for Hinds County, and moves this Court pursuant to UniformCircuit and County Court Rule (UCCR) 7.04 and to find that specific individuals with the Hinds County Sheriff's department are in contempt of court based upon the following, to-w/ it: 1. That the grand jury returned an indictment against a certain defendant on the charge of possession of opium; 2. That the indictment has not been served by the Hinds County Sheriff's Department, the entity charged with the duty of serving indictments in the First Judicial District of Hinds County; 3. That employees of the Hinds County Sheriff, specifically Otha Cain and Chris Picua, published prohibited grand jury material to the media via WLBT, WJTV, 90.1 P.M. and Otha Cain's blog (see State's exhibit "A"); 4. That further, upon information and belief. Deputy Chief Chris Picua contacted WJTVand WLBT, for the purpose of publishing prohibited grand jury information; 5. That Chris Picua and Otha Cain appeared on WMPR90.1 on Wednesday, October 08, 2014, live with Sheriff Tyrone Lewis and broadcasted that the defendant had NOT been indicted; 6. That consequently, these several incidences violate UCCRRule 7.04; 7. That Rule 7.04 provides, in relevant part, that publishing grand jury "no... sheriff or other officer of the court shall disclose any action or proceeding in relation to the indictment before the finding of an indictment or within 6 months thereafter." 8. That the named individuals should be held in contempt of court for violating rule 7.04. WHEREFOREPREMISES CONSIDERED, the State of Mississippi requests that this Court hold the Hinds County Sheriff's Department in contempt of court pursuant to the UCCRRule 7.04.
