PROPOSED ORDINANCE

AN ORDINANCE SETTING THE SPEED LIMITS FOR ALL KINDS OF
MOTOR VEHICLES WITHIN THE TERRITORIAL JURISDICTION OF
DUMAGUETE CITY, PROVIDING FOR ITS SANCTIONS, AND FOR OTHER
PURPOSES.
WHEREAS, Republic Act No. 4136 otherwise known as the Land
Transportation and Traffic Code signed into law on June 20, 1964, is the
governing traffic law of the Philippines, embodying therein, among others, the
Speed Limits on all highways.
WHEREAS, notwithstanding vigorous implementation by appropriate law
enforcement agencies of existing traffic laws, there has been an alarming steady
increase in traffic accidents on the highways, thoroughfares, streets and roads of
Dumaguete City primarily caused by Over Speeding and Reckless Driving,
with Motorists perennially ignoring Lawful Speed Limits;
WHEREAS, it is observed that the existing traffic laws as above-cited are
outdated, and to a great extent no longer suited or responsive to the current
traffic situation in the City due to various factors resulting from rapid urbanization.
WHEREAS, in the interest of public safety and order, there is an
imperative need for the City Government to immediately address this serious
concern through a renewed vigor of regulation as well as the adoption of local
measures responsive to the current situation with a view of reasonable and
effectively obviating traffic accidents resulting from over speeding and reckless
driving.
WHEREAS, Republic Act No. 7160 grants Local Government Units the
power to regulate traffic on all streets and bridges within their territorial
boundaries and to enact such measures that will enhance the public health,
safety, convenience, maintain peace and order, and promote the general
prosperity of its inhabitants;
WHEREAS, prior to the passage of this Ordinance, there is an
indispensible need to conduct an experiment traffic scheme aimed at arriving at
the most appropriate Speed Limit which will effectively address the current traffic
situation prevailing in the City;
NOW THEREFORE, BE IT ORDAINED, AS IT IS HEREBY ORDAINED
by the Sangguniang Panlungsod in session assembled, that:
Section 1. The rate of speed for all types of motor vehicles within the
territorial boundaries of Dumaguete City, shall not exceed the following:

The rates of speed hereinabove prescribed shall not apply to the following:
(1) A physician or his driver when the former responds to emergency calls;
(2) The driver of a hospital ambulance on the way to and from the place of
accident or other emergency;
(3) Any driver bringing a wounded or sick person for emergency treatment
to a hospital, clinic, or any other similar place;
(4) The driver of a motor vehicle belonging to the Armed Forces while in
use for official purposes in times of riot, insurrection or invasion;
(5) The driver of a vehicle, when he or his passengers are in pursuit of a
criminal;
(6) A law-enforcement officer who is trying to overtake a violator of traffic
laws; and
(7) The driver officially operating a motor vehicle of any fire department,
provided that exemption shall not be construed to allow unless or
unnecessary fast driving of drivers aforementioned.
Section 2. Lead and Support Agencies The Traffic Management
Office (TMO), together with the Land Transportation Office (LTO Dumaguete
City) and the Highway Patrol Group (HPG-PNP-Dumaguete City), in the
discharge of their official functions, shall serve as the lead agencies in
implementing this Ordinance. The Land Transportation Franchising Regulatory
Board (LTFRB-Dumaguete City) and the Department of Public Works and
Highways (DPWH-Dumaguete City) are hereby enjoined to give their full support,
assistance and cooperation in the course of the implementation of the provisions
of this Ordinance.
Section 3. Traffic Signs - The Traffic Management Office (TMO) is
hereby directed to provide appropriate traffic signs indication the speed limits on
all affected highways, streets, and roads within the City of Dumaguete;
Section 4. Sanctions Violators shall, if warranted, be subjected to
arrest and their vehicle impounded without prejudice to the imposition of
penalties and fines under the provisions of R.A. No. 4136
Section 5. Separability Clause - If, for any reason or reasons, any part
or provision of this Ordinance shall be held to be unconstitutional or invalid, other
parts or provision hereof which are not affected thereby shall continue to be in full
force and effect.

Section 6. Repealing Clause - All existing Ordinances and resolutions,
local executive orders, rules and regulations inconsistent with any of the
provision of this measure are hereby repealed and/or modified accordingly.
Section 7. Effectivity Clause - This ordinance shall take effect 15 days
after publication thereof in a newspaper of general circulation.
