INSTRUCTIONS TO PERSON TENDERING


1. This tender is opened to all contractors having UPK supplies & service registration
under Head II, Sub Head 3(iii), Category B or above. Tender must be made on the
accompanying Form of Tender with all blanks duly filled in ink and signed. Tender price
must include all incidental and contingency expenses.

2. This Tender is for THE SUPPLY AND DELIVERY OF NUMERICAL PROTECTION
RELAY FOR WESTERN REGION, KUCHING.

The Tender must be submitted on the accompanying Form of Tender together with all the
schedules duly filled up in ink, stamped with company seal and signed. Any correction shall
be done in pen and to initial. Correction using correction fluid/tape will be rejected.

3. No alteration is to be made in the Form of Tender or in the Schedules thereto except in filling
up the blanks as directed. If any such alteration be made or if these instructions be not
fully complied with, the Tender may be rejected.

4. If the Tenderer has any doubt as to the meaning of any portion of the General Conditions or of
the Specifications, he shall, clarify with the relevant engineer concerned before submitting his
tender.

5. Prices quoted shall be inclusive of all duties and taxes and shall include delivery to Syarikat
SESCo Bhd., Kuching (Western Region, WR). The prices quoted shall be firm in Ringgit
Malaysia.

6. Tenderers must be manufacturers or their accredited agents. Evidence of appointment as
accredited agents in the form of original copy agency letter of appointment from
manufacturers must be furnished. Faxed copy is acceptable provided original copy to follow
within 2 weeks. In case of sole agency, photocopy of appointment letter is acceptable
provided original copy is presented to our officer for verification and certification as true
copy. Tenderers not fulfilling this condition will be rejected.

7. Preference shall also be given to ISO9001 certified companies and manufacturers.

8. Tenderers must provide sufficient technical details and literature (e.g: type and routine test
reports, catalogues, etc.) and sales records for adjudication purposes; failing which their offers
will not be considered.

9. If the Tenderer has any doubt as to the meaning of any portion of the General Conditions or
of the Specifications, he shall, clarify with the relevant engineer concerned before submitting
his tender.

10. The rates offered in the Tender should be without consideration of the details/departures. If
there is addition or deduction of the Tender rates by virtue of the Company adopting those
details/departures then such addition/reduced sum should be stated in the annexed documents.

11. The Company will not be responsible for or pay for expenses of losses which may be incurred
by any Tenderer in the preparation of his Tender.

12. The Bumiputra Tenderers are required to submit certified copies of Trade Registration
showing the proportion of Bumiputra participation in the companies and the names of the
directors of the companies.

13. The Tender is to be submitted in a sealed cover, which should be clearly marked

but should bear no writing on the cover which would enable the Tenderer to be identified. The

14. Prior to dropping in the Tender Box, the tender must be stamped by the Companys
representative with the date and time of submission.

15. Tenders received prior to the time of opening will be securely kept unopened. Tenders
received after time of opening will be rejected. The Company bears no responsibilities for
premature opening of Tenders not properly addressed or identified.

16. The Company does not bind itself to accept the lowest or any tender, in part of in whole nor
to assign any reason for the rejection of any Tender.

17. The Tender or any Tenderer who has not conformed to the foregoing instructions may not be
considered.

18. The official currency for this Contract shall be the Malaysian Ringgit and all rates and prices
shall be quoted in this currency.

MATERIAL REQUIREMENT AND SPECIFICATION


General requirement:

This tender call for the supply and delivery (CIF to Western Region, Distribution
Network and Control Division, 2
nd
Floor, Jalan Belian, Kuching) of 32 units of non-
directional OC/EF relays (30VDC), 13 units of non-directional OC/EF relays (110VDC), 23
units of directional OC/EF relays (30VDC) and 10 units of directional OC/EF Relays
(110VDC) for the replacement of the existing electromechanical relays.
The relays are microprocessor type which is capable of recording fault event and also
showing real time power system measurement, including the direction of power flow. This
relay also has fine digital setting resolution which eases the protection coordination process.
The fault recorder helps switching personnel to track the fault current or which phase shorted
so they can concentrate on the particular phase during fault finding.
1 Current and Voltage input
1.1. Current input
The current input is used for phase fault and earth fault protection which can be
configured for operation with either 1A or 5A transformers. The appropriate
connections are required on the terminal blocks and CT rating must be set as
required.
1.2. Voltage input*
For directional relay, the voltage inputs are used for setting the direction of the
overcurrent elements and up to 4 voltage inputs are provided. Each voltage input is
capable to connect to VT with a nominal 63.5V (Line-Neutral) or 110V (Line-Line)
secondary voltage.
2 Protection - Up to four current measuring inputs are available in the relay and may be
phase fault overcurrent or earth fault overcurrent.
2.1 Phase fault and earth fault inputs - Each have four independent overcurrent elements.
The setting of overcurrent elements is selectable between IDMT (Inverse definite
minimum time lag) and DTL (Definite time lag). Four IDMT curves are available
which is NI (Normal inverse), VI (Very inverse), EI (Extremely inverse) and LTI
(Long time inverse). The IDMT algorithms operate correctly for developing faults
where current varies with time. At least two independent highsets and an independent
lowset are included with shaped DTL.
2.2 Directional elements* - available for phase fault and earth fault. Bi-directional
elements provide independent characteristics, current and time setting for each
directional of each overcurrent stage.

3 Auxiliary Supply - DC voltage of the appropriate level must be supplied onto the correct
terminals on the rear of the case.
4 Burden The relay must operate with low AC/DC burden.
5 Status input and output relays
5.1 Status input
Programmable status inputs with independent pick-up and drop-off timers.
5.2 Output relays
Outputs are user programmable to operate from any or all of the protection
characteristics. In normal operation, output contacts remain energised for the duration of fault
current, but with a user programmable minimum time. Besides that, outputs can be
programmed to operate as latching contacts if required. Latched output relays can be reset
either by pressing reset button or by status input.
6 User Interface/Fascia - The user interface is designed to entering settings and retrieving
data from the relay. The following items must include:
a) Relay information
b) Display
c) Protection healthy LED
d) Pick-up LED
e) Trip LED
f) Keypad for entering/retrieving data and reset/test button with proper labelling.
7 Case - The relay is housed in a drawout case designed for panel mounting. The chassis of
the relay can be withdrawn from the case by pulling on the handles provided. Shorting
contacts ensure that CT circuits and normally closed contacts remain short circuited. All
contact will be disconnected before any input contacts in order to prevent maloperation.
8 Front cover - To provide a clear plastic cover over the front which allow the user to see
the entire front of the relay but only allow user to be viewed but not to change.
9 Password The programmable password features available to restrict only user to
change the setting. This feature able to de-activate if password is not required.
10 Monitoring Analogue values can be displayed in primary or secondary quantities of
Current and voltage on LCD screen. Direction of power flow can be monitor for
directional relay.

11 System data Data records are able to store at least 5 fault records from the relay with
time and date of trip, measured quantities and type of fault. The fault record shall include:
a) Pick up for each pole of the elements.
b) The current measured at the time of trip.
The event recorder also allows the time tagging of any change of state. Each event is
logged with the full date and time and actual event condition. The event storage can be
holds 500 records. The event logged shall include:
a) Change of setting.
b) Change of state of output relay.
c) Change of state of input relay.
d) Change of state of any protection characteristic.
e) Trip indicator reset.
f) Trip test.
g) Trip supply failure.
h) Circuit breaker failure.
12 The tenderer is required to submit together with the entire technical manual and brochure
of the relay. Photocopies are also acceptable provided they are clear certified with the
company. Training of the relay also shall be provided.

TERMS AND CONDITIONS OF CONTRACTS FOR SUPPLY OF MATERIALS AND
SERVICES
To Syarikat SESCO Berhad (672931-A), the Company


1.0 PACKING

The Contract shall provide and include in the Contract Price such packing as is required to
prevent damage to or deterioration of the goods during transit to their final destination as
indicated in the Contract. For goods weighing less than 8 tons (single lift), the Company shall
assist by providing the forklift to unload off the carriage or container. However, if the weight
exceeds 8 tons (single lift), the Contractor shall be responsible for arranging own lifting
equipment. In both cases, manpower to unload the goods shall be provided by the Contractor.

The packing, marking and documentation within and outside the packages shall comply
strictly with such special requirements as shall be express provided for in the Contract of any
subsequent instructions and, where appropriate, with the regulations governing the dispatch of
hazardous cargo by sea, air or overland.

2.0 BID VALIDITY PERIOD

The validity period for all Tenders will be specified as 90 days minimum in all cases with
price maintained firm during this period. Tenderers specifying a shorter validity period will
run the risk of being rejected.

3.0 ALTERNATIVE OFFER

Alternative offers are allowed on the condition that separate set of tender document has to be
purchased for additional offer from the same tenderer.

4.0 DELIVERY

In the case of C&F and CIF Contracts, the delivery period shall be taken as the period
between the date of award or subsequent order and the date when the goods arrive at the final
destination.

In the case of FOB Contracts, the delivery period shall be taken as the period between the
date of award or subsequent order and the date when the goods are packed and ready for
dispatch.

The delivery period of the goods shall be within 8 weeks from the date of award.

5.0 PENALTY FOR DELAY

Failure to deliver the goods and services, in whole or in part, within the time specified in the
Contract will, in addition to any other remedies of the Company against the Contractor under
the Contract, render the Contractor liable to a deduction from the Contract Price as a penalty
of a sum to be calculated at the rate of one half of one percent per week of the value of such
portion only of the goods that are subject to the delay for each week or part of a week which
may elapse between the date(s) of delivery specified in the Contract and actual date(s) of
delivery as specified in Clause 4 of these conditions up to a maximum of 10% of the value of
any portion of the goods so delayed and provided further that notwithstanding the provisions
of Clause 4 of these conditions, the Contractor shall be relieved of his abilities under this
Clause 5 in respect of any FOB Contract for any period during which the goods are packed
and ready for dispatch, but cannot be shipped because of a lack of shipping opportunities or
similar cause.

6.0 PENALTIES FOR MODIFICATION AND WITHDRAWAL

If the tenderer withdraws or modifies his tender during the bid validity period or after having
been awarded the contract, the Company shall impose the following sanctions:

a) 20% loading on the tender prices shall be imposed on all of the tenderer future
tenders submission for a period of two consecutive years, for the first offence.
b) Barring the tenderer from tendering for a period of three consecutive years for the
second offence.
c) For any subsequent offence the tenderer, whether participating in his own name
or using a company as a guise or using non-participating partners of any further
tenders and his name and/or the offending company shall be permanently struck
off from the Companys Contractor/Supplier Register

7.0 PERFORMANCE BOND

Performance Bond is required for all contracts above RM 50,000.00 except stated otherwise.

Where the contract provides for advance payment, the contractor/supplier shall submit in
exchange for the said payment, an Advance Payment Guarantee issued by a Bank licensed to
operate in Malaysia.

Performance Bond shall be of any of the following forms:
a) Bankers Guarantee;
b) Bank Draft/Cashier Order;

Bank draft shall be issued by a bank licensed to operate in Malaysia. Whereas, a Bankers
Guarantee shall be issued in an acceptable format similar to the sample format (Form PUR/5)
by a bank licensed to operate in Malaysia.

All contracts exceeding RM 50,000.00 (Ringgit Malaysia Fifty Thousand) must include a
Performance Bond for 10% of the contract sum. Such bond shall be irrevocable and valid for
the duration of the contract period including the defect liability/maintenance period, if any

The performance Bond will be released upon satisfactory completion of Contarct, inclusive of
warranties, if any. Claims by the Company for penalties, delays or unsatisfactory work by the
Contractor if not properly met by the Contactor himself, will be made as liquidated damages
against the proceeds of the Performance Bond. If the goods are not delivered by the expiry
date, the Performance Bond may be forfeited without further notice and the purchase order
automatically becomes null and void. The Performance Bond shall be submitted in an
acceptable format similar to the sample format (PUR/5) by a bank licensed to operate in
Malaysia.

Contracts with consultants/ professionals regulated under professional bodies and suppliers of
proprietary items shall be exempted from the requirement of Bid Bond and Performance Bond
may be exempted on the condition that corporate guarantee shall be provided in lieu.

8.0 PAYMENT

Payment shall be made within 45 days upon satisfactory receipt of goods at destination or
services. To enable payment to be made promptly, the Contractor shall furnish all relevant
documents, e.g. invoice together with other documents (Certificate of Origin, etc.), if
applicable.

9.0 FREIGHT FORWARDING AGENTS/INSURANCE BROKER

It is mandatory requirement for the local tenderer to give preference to the UPK Registered
Forwarding Agents, under Head VII Subhead 4 or Subhead 4(a) for the purpose of shipping
the goods consigned to the Company under CIF delivery.

For insurance cover, preference is to be given to the Insurance Broker appointed by the
Company and the full address for the Insurance Broker is as follows:

10.0 SHIPPING INSTRUCTIONS (For goods consigned to the Company)

Three companies stamped and signed original Bill of Lading and original invoices must be
submitted together with other documents preferably by express mail, to reach us at least one
week before the actual arrival of the vessel for the purpose of declaration to the Customs
Department in time for early port clearance.

For shipment within Malaysia and from Singapore, the shipping documents must be sent by
courier service immediately after the vessel has left port.

The documents must be submitted in sealed envelope clearly marked SHIPPING
DOCUMENTS PURCHASE ORDER NO.:.

Any overtime port storage charges shall be borne by the Supplier/ Contractor if the above
conditions are not complied with.

Contractor and the Company with or without our consent or by any alteration in the
obligations undertaken the Contractor or by any forbearance whether as to payment time
performance or otherwise, but we may be entitled to be informed of such arrangement or
alteration.

4. In the event that the Contract remains substantially unperformed one month before the expiry
date, the contractor shall immediately upon request by the Company, provide the latter with
another guarantee to cover the period of extension as allowed by the Company for the
performance of the said contract. Failure to renew this guarantee in such event, would entitle
the Company to claim under this Guarantee.

5. This Guarantee shall be irrevocable and shall remain in full force and effect until all claims
under this Bond has been settled in full satisfaction of all the rights of the Company hereunder
or the . day . 20 whichever is earlier.

6. Any claims under this Guarantee shall be made within a period of 14 days after the expiry
date.

7. This Guarantee is governed by and shall be construed in accordance with the laws and
regulations of Malaysia.
