PursuanttoSection5of RA9275otherwiseknownasthe PhilippineCleanWater Act of
2004,DENRAdministrativeOrderNo. 2005-10orthe ImplementingRulesandRegulationsof
RA 9275 and DENR Memorandum Circular 2009-15 or the Procedu~alManual for the
Designa~ionof Water Quality Management Areas, and considering its critical importance to
ZambangaCity and its communities, the Tumaga River ishereby designated as a Water
QuaIityManagement Area(WQMA).
Section I. Policy and Objectives. It is the policy of the State to pursue economic
growthinamannerconsistentwiththeprotectionandrevivalofh e qualityofourfresh,brackish
andmarinewaters. Pursuanttothispolicystatement,thisOrderaimsatprotectinganditnproving
the water quality uf thr Tumaga River to make it a sustaining resource for the people of
Zarnboat~gaCity,consistentwiththefollowir~gwaterqualitymanagementobjectives:
a) Tostreamlinetheprocessesand procedures intheprevention, controlandabatement
ofpollution in tlieWQMA;

Topromoteenvironmentalstrategies,useofappropriateeco~~ornic instrumentsand
controlmechanismsfortheprotectionoftheWQMA;

To formulate a WQMA program on waterquality management which recognizes
thatwaterquality tuanagemeniissuesare inherentlyrelated andcannotbe detached
from concernsonwater sources,ecological protection, water supply,publichealth
andqualityoflife;

Toprovide foracomprehensive n~~mgement program forwaterpollution focusing
onpollutionpreventiotiintheWQMA;
e)
Topromote public information and education forstakeholdersofthe WQMA and
encourage\he participationof an informedand concerned public in water quality
managementandmonitoring;and
f)
'To encouragecivil society andother sectors,particularly labor, the academe and
businesses undertaking environment-related activities in their effortsto organize,
educate and motivate the people jn addressing pertinent environmental issues and
problemsintheWQhIA.
Section2. Coverage.TheTurnagaRiverWQMA shall covertheTunlagaRiverand its
tributaries,naturalorartificial,thatarewithintheWQMAboundaryinchdingthelandembraced
bythehydrologicunit identified. The followingdatashall comprisethe geographiccoordinates
oftheTunlagaRiver 'U'QMA:

The Governing Board shall likewise create a 'Technical Secretariat of the WQMA which
shall he based at the EMB, DENR-Region IX.
Sectbn 9. Multi-Sectoral Group. The Governing Board shall create a Multi-Sectoral
Group for water quality monitoring and surveillance network. Said group shall ailgrnent and
complement monitoring and reporting efforts of the DENR.
Section 10. Re-designation of WQMA. U7hen necessary, and oilly after undertaking
necessary studies and conducting consultations with relevant local government authorities, the
Secretary of the DENR. upon recommendation of the EMB, shall revise the designation of
WQMA, re-adjust its boundaries or reconstitute its menlbership for adequate representation.
Section 11. Amendments and Revisions. Amendments or revisions of any of the
provisions hereof shall be made only upon consultation with the concerned stakeholders in
accordance with existing policies on the matter and subject to the wi t t en approval of all the
parties thereto.
Section 12. Separability Clause. Should any of the provisions- of this Order be
subsequently declared invalid or null and void, the validity of the other provisions not affected
shall not be impaired and shall remain in full force and effect.
Section 13. EtTectivity. This Order shall take effect fifteen (15) days after its
publication in a newspaper of general circulation and upon acknowledgment of receipt of a copy
hereof by the Office of the National Administrative Register (ONAR).
