ANNE78I Broad terms and Conditions of MTNL, Broadband/ ADSL Internet Access Service Subscription 1. Definition: Broadband Internet Service - An always-on data connection that is able to support interactive services including Internet access and has the capability of the minimum download speed of 25 !ilo bits per second "!bps# to an individual subscriber from the $oint %f $resence "$%$# of the service provider intending to provide &roadband Internet service where multiple such individual &roadband connections are aggregated and the subscriber is able to access these interactive services including the Internet through this $%$. 'he interactive services will e(clude any services for which a separate licence is specifically re)uired* for e(ample* real-time voice transmission* e(cept to the e(tent that it is presently permitted under I+$ licence with Internet 'elephony., 2. 'he customer is re)uired to desist from putting unsolicited messaging on server hosted at -'./ premises. 'he customer is re)uired to ensure that ob;ectionable or obscene messages or communications* which are inconsistent with the established laws of the country* are not made by him or any other person on the 7eb +erver or web space of the customer. 14. Borce -a;eure A if any time* during the continuance of -'./ &roadband5 A6+/ Internet services* the performance in whole or part* of any obligation under it shall be prevented or delayed by reason of war* hostility* acts of the public enemy* civil commotion* sabotage* fire* flood* e(plosion* epidemic* )uarantine restriction* stri!es* loo!-out or act of C%6 etc. the customer shall not have any claim for damages* against -'./ in respect of such non-performance or delay in performance of -'./ &roadband5A6+/ Internet +ervices. 18. Arbitration of 6isputes A In the event of any dispute or difference arising out of provisions of -'./ &roadband5A6+/ Internet services* the matter will be referred for arbitration in terms of section <"&# of Indian 'elegraph Act* 1885 and any amendments made there to from time to time.
