Dear Asst. Secretary Myers,

I am writing to request participation in the Delegation of Authority Program pursuant to 287 (g) of
the Immigration and Naturalization Act. This partnership will enable us to better serve and meet
the needs of the residents of the City of Morristown and Hamblen County Tennessee.

Our point of contact, ( . ililF C " has been in communications with Agent (b)(6 (b)(7)lC
Program Manager, New Orleans rCE Office and he was very helpful with information and advice
concerning the program. I am proposing the following:

>- Establishment of ail Identification Review officer for the Morristo\\-TI Police
Department.

~ Train two (2) polic:e officers assigned for investigative efforts, with a minimum of two
years experience, which have passed a security background acceptable to ICE.

Willing to discuss availability of training facilities where instructors can utilize


computer training aids, videos and any other materials they need in instruction.

This program will allow us to enter into a Memorandum of Understanding that will enable us to
participate with ICE in Identifying criminal illegal aliens who pose a risk to the citizens of
Morristown and Hamblen County. I look forward to your speedy endorsement of this request and
moving forward with this program for the benefit of all.

WHEREAS, the Mayor of the Town of Manistown desires that the Town enter into a
Memorandum of Understanding with the U.S. Department of Hom.eland Security - Immigration and
Customs Enforcement whereby Town Police Officers ~ha!l be trained and deputized; and

WHKREAS, Section L.87~G of the Immigration and Nationa1,ity Act, authorizes the deputizing
oflocru p()lic(' forces as federal immigration agents; and

WHEREAS, the Town Council of the Town of Morristown wishes to support the Mayor in this
,in.itiative i.n order to address issues wit.hin ,he Town of Morristown.

Dear Mayor Cresitello,

Thank you for your continued interest in the U.S. Immigration and Customs Enforcement
(ICE) 287(g) program, which cross-designates state and local of1icers to enforce immigration
law as authorized through section 287(g) of the Immigration mld Nationality Act. In the past
two years. the 287(g) program has identified more than 27,000 illegal aliens tor possible
deportation. More than 70 municipaL county, and state agencies natioll\vide have requested
287(g) agreements with ICE, and already, more thmI 500 local and state officers have been
trained under the program. I thank you fC)f submitting your 287(g) request with ICE,
untortunately. funding for FY 2007 has been exhausted.

In response to the continued widespread interest from locallaw entorcement agencies like
yours, ICE has launched the new comprehensive ICE ACCESS (Agreements of Cooperation in
Communities to Enhance Safety and Security) progrmn. The 287(g) program is only one
component tmder the ICE ACCESS umbrella of services and programs offered for assistance to
local law enforcement ofticers. Other ICE ACCESS enforcement options include the creation
of local task f()fces targeting specific challenges like gmlgs or document ii-aud. the presence of
a Criminal Alien Program (CAP) team in local detention facilities to identify criminal aliens, or
training to utilize the ICE La,.\' Enforcement Support Center (LESC), which provides officers
the ability to inquire about a person's immigration mId criminal history.

We will continue to assess your pending 287(g) application as more resources are made
available in FY 2008, however through our new ACCESS program, I believe we may be able
to identify an enforcement program that would better serve your community's needs. At my
direction, senior Held representatives from the Office of Investigations and the Office of
Detention and Removal will visit with vou soon to discllss ICE ACCESS mId to assess vour
particular local needs beyond what we ~lready plan to accomplish through the 287(g) progrmn.
I believe these strategic discussions will facilitate a strong partnership between your agency
and ICE_ Combining federaL state and local resources has proven successful in safegum-ding
