BY-LAWS
OF
MOOI\-VIEW MOTINTAIN ESTATES HOMEOWI\rcRS ASSOCIATION, INC.
ARTICLE I
Name and Location
The name of the organization is: Moonview Homeowners Association, Inc., as
named in the Corporate Charter, more commonly referred to as "Moonview Mountain
Estates HOA", and as may be hereinafter referred to as the "Moonview HOA" or
"Association". The office location may be the homes and/or offices of the Association
Officers. Meetings are held at such places, or via recorded Teleconference, as may be
announced which are most convenient to the Operating Officers/Directors, and members,
where practicable.
ARTICLE II
Purpose, Origin & Organization
Section 1. Authoritv. The Association is a "Domestic Non-Profit Corporation"
by a duly authenticated Certificate of Incorporation, Control Number 0428187 originally
dated 4/0112004, issued by the Secretary of State of Georgi4 which is renewed annually
thereafter. This Certificate is renewed by payment of the Corporation Annual
Registration Fee when invoiced by the Secretary of State's Office.
Section 2. I)eclaration of Restrictions. The DECLARATION OF
RESTRICTIONS, previously recorded with the Georgia Union County Clerk's Office
Superior Court in Book 346,Page 769-771, together with these By-Laws, oonstitute the
Covenant, By Laws & Declaration of Restrictions for Moonview Mountain Estates
property owners, which shall run with the land and shall be binding under it, and each
and all subsequent purchasers, their heirs, personal representatives, successors and
assigns.
Section 3. By Laws. This document, as subsequently approved by the Board of
Directors of the Moonview HOA, along with the previously recorded Declaration of
Restrictions, shall be the official governing document by which the Association operates.
A copy of these By Laws is mailed to each Lot Owner of record and a copy witl be
provided each new [,ot Owner upon initial welcome to the Association. The purpose in
attaching the Exhibits to these By-Laws is to "package" all Subdivision procedural and
operating documents into one (l) set for the convenience of Lot Owners.
Section 4. Board of l)irectors and Officers. The Association Board of Directors
and Operating Officers consists of three (3) members, who meet the criteria entunerated
for Membership under Article III and are elected by written ballot by a majority of the
membership annually, as follows:
(a). President

May also serve simultaneously as a Director.
(b). Secretary/Treasurer

May also serve simultaneously as a Director.
(c). Director
-
May Assist in Officer Duties when called upon.
(d). Assistant Secretary/Treasurer/Administrator (No Vote)
