Terms and Conditions: 3 Months Extended Warranty for Laptop

1. Definitions:
Unless the context otherwise requires, the following terms would have the prescribed meanings:
AIPL:
Aegean Infotech Private Limited, a company duly registered under Indian Companies Act 1956 having its Registered Office at New Delhi.
www.warrantybazaar.com:
It is a Portal owned by AIPL, selling Extended Warranty Packs, Extended Support Warranty Packs and Annual Maintenance Contract for Mobile Phone,
Tablet PC, Laptop, Digital Camera,
Consumer Electronic Products, Accidental and Theft Insurance, Remote Assistance & Management.

It is a brand name of AIPL in short it is referred as WBC.
WEP:
Warranty Extension Pack, it is also referred as Extended Warranty Pack (EWP).
AMC:
Annual Maintenance Contract, it is also referred as Post Warranty Pack (PWP).
ESW:
Extended Support Warranty.

WEP and AMC sold by AIPL, either directly or through its portal www.warrantybazaar.com / WarrantyBazaar.Com Authorised Distributor /
WarrantyBazaar.Com Authorised Dealers /
WarrantyBazaar.Com Authorised Resellers including WarrantyBazaar.Com Authorised Online Resellers. WBC Extended Warranty purchased out of India
is not covered under Product definition
and accordingly not eligible for WBC Warranty.
Customer:
An end-user (a person, firm, company or the legal entity) which purchases the Product(s) from Aegean Infotech Private Limited or its portal
www.warrantybazaar.com / WarrantyBazaar.Com
Authorised Distributors / WarrantyBazaar.Com Authorised Dealers / WarrantyBazaar.Com Authorised Resellers / WarrantyBazaar.Com Authorised Online
Resellers.
WBC Authorised Service Centre (WASC):
WBC Authorised Service Centre within the territory of India, which repair/service the product(s). These service centres are authorised by AIPL and located
across India.
WBC extended warranty for the Product(s) is only against any defects in Laptop that occur during normal use. WBC extended warranty does not cover
against any accidental damage, loss, acts of god, or misuse /abuse of the Product(s) or any other event not attributable to the manufacturer's material or
workmanship or manufacture of the product.
2. Warranty Period
This WBC Extended Warranty is valid for 3 (three) months and coverage will begin from the next day after the expiry of the original Manufacturers Limited
Warranty and will be valid for 3 (three) months. For Example, if the Manufacturer warranty is for 12 months, then the extended warranty will be applicable
from 13th to 15th Months. It cannot be transferred to any other Laptop.
For new Laptops, the WBC Extended Warranty may be purchased either at the time of buying new Laptop or within 90 (Ninety) Days months from new
Laptop purchase date.
Manufacturer Warranty validation / Warranty period confirmation would be done through Manufacturer Warranty Card of and Customers purchase Invoice
date of Laptop.
If a Customer transfers the ownership of product(s) to another end user, the remainder of the warranty period will also transfer to the new owner.
Customer shall be required to provide proof of purchase including Warranty Card of the Product(s), as a pre-condition for availing the WBC extended
warranty of the Product(s).
3. Warranty Type:
WBC Extended Warranty shall be Return to Bench Warranty. Customer will have to go to WBC Authorised Service Centre. Pick up and Drop facilities
available where Service Centre is not available at a nominal at Blue Dart rates. For further details contact AIPL Toll Free Number 1800-102-9991.
4. What is covered and how?
WBC Extended Warranty is exclusive and is not a part/extended warranty provided by the manufacturer. This WBC Extended Warranty covers only
mechanical and electrical failures of Laptop that occur during normal use. All Software which is legally purchased by user and licensed to be used by the
user is covered in this WBC Extended Warranty.
Within WBC Extended Warranty period, WASC will repair or replace any defective part(s) of the Product(s), if required, to rectify the problem in the
Product(s). AIPL reserves the right to use new or re-engineered part(s) with performance parameter equivalent to the similar new part(s), for performing
the WBC Extended Warranty services. If any parts are required, the same is not required by user to be purchased. If any upgradation is done to the
existing device by the user, wherein a repair or service solution is not required, the cost of same will have to be borne by the user. For any such upgraded
parts the existing WBC Extended Warranty will not be applicable.
The replaced part(s) shall become the property of AIPL.
In the event of repairs or replacement of any part(s), during the WBC Extended Warranty period, the WBC Extended Warranty of the Product shall
thereafter continue only for the unexpired period of original WBC Extended Warranty.
5. What are not covered?
a) Accessories & parts like battery, charger, casing, cover, plastic body parts, memory card, data cable, External attachments, any add-on USB Devices /
Cards and any third party applications etc.
b) Not covered are any Data losses or Hardware failure due to Software upgradation, installation of third party applications by the user.
c) All data to be backed up by user and will not be the responsibility of the WBC authorised engineer.
d) Any loss occurred to Laptop due to negligence, ignorance and non-compliance by customer.
e) No physical damage, like scratches, cracks, fractures, breakage of Housing, LCD panel or failure due to any liquid spillage, corrosion, burn and
oxidation.
f) Any loss due to accidental, intentional or unintentional, negligence, ignorance, abuse, misuse and non-compliance by customer of the Manufactures
guidelines.
g) Any loss due to act of God, Fire, Flood, War, Earthquake, Act of Violence, Stolen, lost, or any other similar occurrences.
h) Any loss due to virus, short circuit, explosion of battery, non compatible accessory used by customer.
i) Service support if requested in any other country except India.
j) If the product during its warranty period from the manufacture, is declared dead / non repairable by the Manufacturer.

6. Limitation of Liability
AIPL makes no other express Extended Warranty either in writing or otherwise and expressly disclaims all Extended Warranties and conditions not stated
in this Extended Warranty. AIPL does not warrant that the operation of the product(s) will be uninterrupted or error-free. To the extent allowed by the Indian
laws, AIPL disclaims all implied Extended Warranties or conditions, including any implied Extended Warranties or conditions of merchantability,
merchantable quality, and fitness for a particular purpose.
AIPL's maximum liability under this Extended Warranty is limited to the price of the same aged product(s) or the cost of repair or replacement charges, at
the sole discretion of AIPL.
Except as indicated above, in no event will AIPL be liable for
a) Indirect damage caused due to improper functioning of the product, including but not limited to lost profits or savings, business interruption, loss of data,
lost revenue, loss of use, or any other commercial or economic loss of any kind, or special, incidental, or consequential damages.
b) Incidental damages due to malfunction of the product such as loss of revenue or loss of profit etc.
c) Any service request made by a third party or made by customer on behalf of a third party.
d) Any damage that occurs as a result of customer's failure to follow the directions in the User manual.
This limitation of liability applies in all circumstances i.e. when damages are sought, a service request made under this Extended Warranty or as a tort
claim (including negligence and strict product liability), a contract claim / service request, or any other claim / service request. This limitation of liability
cannot be waived or modified by any person. This limitation of liability will be effective even if Customer has advised AIPL / their representatives of the
possibility of any such damages or even if such possibility were reasonably foreseeable.
7. Your Responsibilities
To receive service or support of WBC Extended Warranty, you agree to comply with the following:
a) You are to provide WBC Extended Warranty Certificate / Agreement / Contract Number and a copy of your WBC Extended Warrantys original proof of
purchase and original Laptops proof of purchase as and when requested & required, by authorised WarrantyBazaar personnel.
b) Provide correct and actual information about the symptoms and causes of the issues with the Covered Equipment.
c) Respond to requests for information, including but not limited to the Covered Equipment serial number, Brand, model, version of the operating system
and software installed, any peripherals devices connected or installed on the Covered Equipment, any error messages displayed, actions taken before the
Covered Equipment experienced the issue and steps taken to resolve the issue;
d) Follow instructions as provided by AIPL, not to provide without a valid call report / part acceptance slip on Charger and/or Battery (which are not covered
under the warranty) but may be required by the WBCs authorised Engineer to take along with your defective Laptop for repair / service to the Lab /
WBASC. If you provide any/few/all of the items as mentioned above or any add-on / external devices / gadgets / parts without a copy of valid call report /
part acceptance slip then on any loss of same it will be in your own responsibility not AIPL.
e) Once extended warranty is registered to a laptop, it cannot be transferred to another laptop
8. Governing Laws:
Any disputes arising in connection with this Extended Warranty shall be governed by the laws of India. The courts of Delhi shall have the exclusive
jurisdiction over disputes arising hereunder.
9. Ownership
This contract is personal to the present user of the Device as registered in www.warrantybazaar.com is entitled to obtain services. If the Owner is changed,
for any reason (like gifted, re-sold etc.), the new owner of the Laptop will receive the WarrantyBazaar.com Extended Warranty as per number of days left
with the Extended Warrantys original period. This is as the WarrantyBazaar.com Extended Warranty is linked to the Laptop and not the user / owner.
The original owner is requested to please provide the present user with the necessary supporting documents both from the original manufacturer and from
WarrantyBazaar to ensure the present owner is able to avail of the warranty service from WarrantyBazaar.
10. Registration
After purchasing WBC Extended Warranty it must be registered online at www.warrantybazaar.com within 30 (thirty) days to avail benefit of Extended
Warranty.
11. Service Provider
All repairs are made by Authorised Service Engineer referred by AIPL.
12. Getting Service

13. Services offered
a) Repair and maintenance of covered Laptop as described above in point no.4 till Extended Warranty expires. As described above in point no.5 and 6,
Limitations are applicable on covered Laptop under Extended Warranty Period.
b) Registered WBC Extended Warranty can be checked any time through our website www.warrantybazaar.com.
c) 9/6 (9:30 AM to 6:30 PM) Telephonic Technical Support
14. Cancellation or Return
WBC Extended Warranty cannot be cancelled or returned after purchase and it is non refundable.
15. Transfer of Plan
WBC Extended Warranty can be transferred to new owner at the sole discretion of the present owner. If the Owner is changed, for any reason (like gifted,
re-sold etc.), the new owner of the Laptop will receive the WarrantyBazaar.com Extended Warranty as per number of days left with the Extended
Warrantys original period. This is as the WarrantyBazaar.com Extended Warranty is linked to the Laptop and not the user / owner.
The original owner is requested to please provide the present user with the necessary supporting documents both from the original manufacturer and from
WarrantyBazaar to ensure the present owner is able to avail of the warranty service from WarrantyBazaar.
16. General Terms
a) AIPL may subcontract or assign performance of its obligations to third parties but shall not be relieved of its obligations to you in doing so.
b) AIPL is not responsible for any failures or delays in performing under the Extended Warranty that are due to events outside AIPLs reasonable control.
c) AIPL will not be able to provide any stand by / replacement Laptop / device during the repair / service, whether being carried out by the WBC
authorised engineer or if the Laptop / Device needs to be serviced at a Lab / WBASC so authorised by AIPL.
d) You are not required to perform preventative maintenance on the Covered Equipment to receive service under the Plan.
e) This WBC Extended Warranty is offered and valid only in India only.
f) This WBC Extended Warranty is not offered to minors.
g) This WBC Extended Warranty may not be available in all states, and is not available where prohibited by law.
h) In carrying out its obligations AIPL may, at its discretion and solely for the purposes of monitoring the quality of AIPLs response, record part or all of the
calls / documents /emails between you and AIPL.
i) You agree that any information or data disclosed to AIPL under this Plan is not confidential or proprietary to you. Furthermore, you agree that AIPL may
collect and process data on your behalf when it provides service. This may include transferring your data to affiliated companies or service providers in
accordance with the AIPL Customer Privacy Policy.
j) AIPL has security measures, which should protect your data against unauthorized access or disclosure as well as unlawful destruction. You will be
responsible for the instructions you give to AIPL regarding the processing of data, and AIPL will seek to comply with those instructions as reasonably
necessary for the performance of the service and support obligations under the Plan. If you do not agree with the above or if you have questions regarding
how your data may be impacted by being processed in this way, contact AIPL at the telephone numbers provided.
k) AIPL will try to protect but in no way confirm the privacy of information / data as stored in your device in accordance with AIPL Customer Privacy Policy
as also mentioned in the website, www.warrantybazaar.com
l) The terms of the WBC Extended Warranty, including the original sales receipt of the WBC Extended Warranty and the WBC Extended Warranty
Confirmation, prevail over any conflicting, additional, or other terms of any purchase order or other document, and constitute your and AIPLs entire
understanding with respect to the WBC Extended Warranty.
m) You must register the WBC Extended Warranty after purchase.
n) There is no informal dispute settlement process available under this Extended Warranty.
o) There is no deductible payment due in respect of a service request made under this Extended Warranty.
p) The Extended Warranty will not be cancelled due to pre-existing conditions in the Covered Equipment that are eligible for service under the WBC
Extended Warranty. If the Brand, Model Number or Serial Number of product is not matching with our collected data which were captured during
registration or stored information in the Laptop Device then WBC Extended Warranty will be null and void.
q) WBC Extended Warranty will be null and void if any attempt to open Laptop or repair by unauthorised service centre or repair by unauthorised service
personnel.
r) WBC Extended Warranty will be null and void, if Model Number or Serial Number sticker of the Laptop is removed, altered, damaged, defaced, smudged
or erased unless valid proof of manufacturer is furnished denoting such changes.
Terms and Conditions are subject to change without any prior intimation/notice, at the sole discretion of AIPL.
