To amend the method by which the Social Security Administration determines
the validity of marriages under title II of the Social Security Act.

BALDWIN) introduced the following bill; which was read twice and re-
ferred to the Committee on Finance
A BILL
To amend the method by which the Social Security Adminis-
tration determines the validity of marriages under title
II of the Social Security Act.
Be it enacted by the Senate and House of Representa- 1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the Social Security and 4
Marriage Equality Act. 5
SEC. 2. DETERMINATION OF VALID MARRIAGE UNDER THE 6
SOCIAL SECURITY ACT. 7
(a) IN GENERAL.Section 216(h)(1)(A)(i) of the So- 8
cial Security Act (42 U.S.C. 416(h)(1)(A)(i)) is amended 9

by striking is domiciled and all that follows through 1
the District of Columbia, and inserting and such appli- 2
cant were married (or, if such insured individual and such 3
applicant were not married in any State but were validly 4
married in another jurisdiction, the courts of any State). 5
(b) EFFECTIVE DATE.The amendments made by 6
this section shall apply to all final determinations of family 7
status made after June 26, 2013. 8
