Aneesa went shopping at Mega Mall and saw a handbag displayed on a shelf. The
price tag was RM120. When Aneesa went to the payment counter to pay for the
handbag, she realised that she had left her purse at home. The manager of the shop
insisted that Aneesa pay for the handbag because a valid contract had already
existed between them.
Advise Aneesa

Amir sold his car which costs RM30,000 to Japman for only RM5,000. Now Amir
refuses to perform the contract as the contract price is way below the market value
of the car. Explain whether a contract exists between Amir and Japman.

Ahmad instructed Salim, who runs a transportation service, to deliver some
vegetables from Kuala Lumpur to Kedah. Transport charges and commission had
been agreed between them. In the agreement, there was a clause requiring the
agent to communicate with the principal in any event of adversity. When the lorry
arrived at Perak, there were landslides and also flood which caused the road to be
closed and not accessible to any transport. Salim, thinking that the weather would get
worse, decided to sell the vegetables at Pasar Malam Lambak before the condition of
the goods worsened. Ahmad is upset with the decision made by Salim and wants to
sue for his losses.
