VIOLATIONS OF CONSTITUTIONAL RIGHTS 2 Violations of Americans Constitutional Rights How Americans Constitutional Rights are being violated by The US government, referencing Amendment I, Amendment II, and Amendment IV of The US Constitution. Amendment I violations enabled by the US Patriot Act allows the government to monitor religious and political groups without suspecting criminal activity. This directly ignores the 1 st
Amendment stating, Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof. Further US Patriot Act infractions of the 1 st Amendment, allows the government to prosecute librarians or any other record keepers if they tell anyone about government subpoenaed information. Congress seems to have forgotten the section stating, Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech. The Government seizure of the Associated Press phone records and calling reporter James Rosen a possible co-conspirator ignored the 1 st
Amendments protection of freedom of the press (Willans, 2013)., Amendment II violations started very early on with the National Firearms Act (1934), Omnibus Crime Control and Safe Streets Act of 1968 (1968), Gun Control Act of 1968 (1968) (McNiff, 2014). All of these and the countless other bills that are currently being written attempting to suppress your right to bear arms are by their very existence in blatant disregard of the 2 nd Amendment. As written, A well-regulated Militia, being necessary to the security of a Free State, the right of the people to keep and bear Arms, shall not be infringed (Congress, 1789). Infinite explanation of such simple words shouldnt be continually necessary. Laws such as the Cyber Intelligence Sharing and Protection Act (CISPA), the Patriot Act, the National Defense Authorization Act (NDAA), and every other law that violates our 1 st and VIOLATIONS OF CONSTITUTIONAL RIGHTS 3 4 th Amendment rights are destroying our right to life, liberty, and the pursuit of happiness. The Patriot Act alone makes it allowable to search and seize US citizens papers and effects without probable cause, to assist in a terror investigation (CCAPA, 2003). Using this, the NSA and other government agencies have been collecting phone records, personal records, internet usage habits, and other meta data of innocents without their knowledge (Kopczynski, 2013). The American Civil Liberties Union has filed suit in court challenging the interpretation of the Patriot Act as a violation of Americans constitutional rights. The Patriot Act expanded the government's power to use eavesdropping, surveillance, access to financial and computer records and other tools to track terrorist suspects (Lichtblau, 2003). This has opened the door for the NDAA which seemingly gave the government oversight of your everyday lives. While giving government untethered powers over American citizens. Further infringement into our lives can be seen in what has happened to Robin Speronis, a 54 year-old widow. Three years after her husbands death and facing expensive health care bills, Mrs. Speronis decided to go off grid to save money. Mrs. Speronis bought solar panels for needed power, propane lanterns for her main source of lighting, and water collection in a large collection basin, which she purified with colloidal silver. City officials stepped in and declared Mrs. Speronis was in violation of the International Property Maintenance Code, a coding law that attempts to regulate how homeowners should live on their own property in the interest of public safety (Survival Joe, 2014). Now that we can all see the many ways our rights are being violated and disregarded in just these few examples; government intimidation of the press, NSA spying, and Second Amendment dismantlement just to name a few. It is our duty as good citizens to remove those in government that wish to destroy our once great Republic each starting in his or her own state. VIOLATIONS OF CONSTITUTIONAL RIGHTS 4 Whether its by vote or outright recall and impeachment in some cases We the People have the power and authority to enact such measures. The Declaration of Independence states clearly, We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed, that whenever any Form of Government becomes destructive of these ends, it is the Right of the People to alter or to abolish it, and to institute new Government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to affect their Safety and Happiness (Congress, 1789).
