Days after the State CID started investigating the
death of 25-year-old Agnelo Valdaris, who died
while in custody of the Wadala railway police, the
witnesses have alleged that investigating officers
are biased and are suppressing them. One of the
witnesses, who was allegedly sexually abused and
tortured along with Agnelo by the railway police,
filed a complaint against SD Khedekar, deputy
superintendent of the CID, on Tuesday.
"Khedekar is more concerned with protecting the
accused police officers than with prosecuting
them. He treats me as if I am an accused in the
case and constantly abuses and insults me," the 19-
year-old witness has stated in his complaint, which was submitted to the CID.
The 19-year-old, along with a minor and 23-year-old Sufiyan Khan, were picked up by the Wadala
railway police on April 16 for allegedly robbing a commuter at knife point. Agnelo too was picked up
in connection with the case.
For the next three days, the four were allegedly tortured and forced to have oral sex with each other.
While Agnelo died in custody on April 18, the three were let off on bail on April 22. The Wadala police
had claimed that Agnelo had died when he was hit by a train while trying to escape from custody. The
three witnesses however filed a complaint on May 12 alleging that Agnelo was tortured along with
them. They demanded that 12 cops who tortured and sexually abused them should be booked. Mirror
reported on the allegations of custodial torture on May 21.
The State CID started investigating Agnelo's death. The three witnesses and Agnelo's father Leonard
insisted that the CID also look into allegations of sexual abuse and torture of the three other accused.
The CID refused to go beyond the custodial death case.
The 19-year-old witness claimed on Tuesday that while he was called by Khedekar for a statement, the
officer "conveniently ignored several facts". "Khedekar would continually call me and refer to me as
'chor'. I felt very insulted and threatened by the behaviour of Khedekar," said the complaint.
Sanjeev Dayal, director general of police, told Mirror that his office would ask the CID to look into the
allegations of torture and abuse of those arrested with Agnelo. Dayal said allegations against Khedekar
would also be probed. The minor has filed a complaint with the Child Welfare Committee alleging
torture and sexual abuse. The CWC is expected to pass an order soon.
