Un Marco Jurdico Para El Mobbing

RESUMEN
Debido a que el Mobbing es una modalidad de violencia laboral a la cual
hasta la actualidad en nuestro pas no se le ha dado un tratamiento especfico,
surge la necesidad de realizar esta investigacin. La misma tiene por finalidad
mirar esta figura desde la prevencin
como medio eficaz frente a este tipo de conductas. Se advertir a lo largo de la
presente que, aunque en Argentina se cuenta con una serie de leyes que
protegen las relaciones del trabajo,
ellas no son suficientes para combatir los efectos negativos generados por este
tipo de procedimiento en el mbito laboral.
Por ello, lo ms importante es conceptualizar este tipo de acoso, con sus
modalidades, causas y consecuencias a fin de lograr una identificacin precisa
ante una situacin de sta ndole. Del mismo modo, se establecen los posibles
tratamientos de recuperacin de la vctima y propuestas que pueden atemperar
este tipo de violencia laboral.
La prevencin como herramienta eficaz contra el Mobbing surge, por un lado,
del anlisis
legislativo donde no existe una regulacin que proteja de manera integral a los
trabajadores de ste pas, ya que slo algunas provincias han previsto esta
figura pero con lineamientos poco definidos, como as tambin, proyectos de
ley nacionales truncados. Por otra parte, del anlisis jurisprudencial se puede
concluir que en pocos casos nuestros tribunales han reconocido este
fenmeno y la vctima slo ha conseguido un resarcimiento econmico, lo cual
no es suficiente para la complejidad que encierra esta temtica, ya que a veces
la vctima queda con secuelas irreversibles. Asimismo, se realiza un paneo
general del derecho comparado y la doctrina para conocer las distintas pticas
de tratamiento.Por ltimo, se expone un relevamiento de datos,
plasmados en encuestas y entrevistas, dando cuenta de la falta de informacin,
cantidad de trabajadores acosados y la necesidad de regular el Mobbing.

SUMMARY
When we speak of Mobbing, we refer to a kind of violence at the workplace to
which nowadays in our country no specific treatment has been provided. This is
why the need to carry out this research came up. The aim of this investigation is
to look at this problem through the perpective of prevention as an effective
solution to these kinds of behaviour. You will be able to
see throughout this research that even though in Argentina we have a series of
laws that protect relationships at the workplace, those laws are not enough to
fight the negative effects generated by this way of proceeding at the workplace.
Therefore, the most important is to conceptualize this type of harassment, along
with its
methods, causes and consequences so as to being able to achieve an accurate
identification when dealing with a situation of this kind. In the same manner,
possible treatments for the victim to be recovered and the proposals that can
temper this violence at the workplace are established. Prevention as an
effective tool against Mobbing came up, in one hand, from the legislative
analysis from which we can see that there is not a regulation which
comprehensively protect the workers of this country. This is so, because only
some provinces have foreseen this offense but with no clear guidelines and also
with frustrated national bills. In the other hand, from
the jurisprudential analysis we can conclude that only in a few cases the corts of
our country have recognized this phenomenon and the victim has only achieved
a finantial restitution, which is not enough due to the complexity of the affair and
the after-effects the victim may have to deal with.
Likewise, a panoramic review is done about the comparative law and the
doctrine in order to
know the different ways of dealing with this affair.Finally, an information-
gathering stage is demonstrated by opinion polls and surveys which show lack
of information, number of workers who has to endure Mobbing and the need to
regulate it.
