Prescribe the Systematic Adjudication process of mass titling for the Department'smass landtitling activitiesona barangay-by-barangayor locality-by-localitybasis; 2.Provide guidelines in the designation of the Systematic Adjudication areas;and, 3. Establishguidelines inthecreationand organization of theSystematic AdjudicationTeam: SECTION 2. COMRAGE - ThisOrdershallapplytothedispositionof public lands through free patent and homestead patent in provinces, cities or municipalitiesand barangays selected as systematic adjudicationareas. For LAMPareas,systematicadjudicationareaswillberecommendedbytheProject CoordinatingOfficeand approved bythe LAMP NationalSteeringCommittee chairedbytheDENRSecretary. ForsitesoutsideofLAMPareas,theRegional Executive Director shall recommend an area for approval by the DENR Secretary. SECTION3. DEFINmON OF TERMS - As usedinthisAdministrativeOrder thefollowingtermsandphrasesshallbedefinedandunderstoodasfollows: 'Let's Go Green a) Adjudication- isthe administrativeprocessofdeterminingthe validityof claimsof ownershipof landand other rights and interestsin land, and resultsintheissuanceofpatentstoqualifiedapplicants. b) Adjudicator- refersto duly designated DENR officer or duly deputized personcontractedoutbyDENRtoundertakethefunctionsofinterviewing land claimants, conductingocular inspectionof the lands and assisting landclaimantsinpreparingandorganizingevidencefortheirpublicland application. c) Boundary Agreement Process (BAP)- is a set of prescribed formal procedures usiqg a document referred to as Parcel lnformation Sheet employed to signify the delineationagreement on land boundariesof a publiclandparcelbytheclaimantsbeforesurveyisundertaken. d) Base Camp -refers to the temporary office established in the locality which will be used as base of Systematic Adjudication Team for all systematicadjudicationactivities. e) ReferenceMark - isa point markedon a ground object or permanent structure,suchasatree,fenceorbuilding. f) Sketchperson - refers to individuals who undertake the functions of sketchingand mappingof parcel boundariesunderthe s~~pervision of a GeodeticEngineer. g) SurveyNotificationLetter-isaformalnoticeissuedbytheSATLeaderto all concerned land claimants whose participation is needed in the boundaryagreementprocess. h) Parcel lnformation Sheet (PIS) - isa document prepared prior and in relationtoalandsurvey,indicatinganddescribingonittheboundariesof a land parcel, its improvements and any natural features, marks and occupationsthatareonor nearthe boundary. Itcontainsrecordsof the boundary delineation agreement among all concerned, adjacent and participatinglandclaimantsorownerstoapubliclandparcel. i) Survey Monument- to specifications isany fixed object on the gro~~nd definedintheRevisedManualforLandSurveyingRegulations(DENRA0 98-12)andrecordedinofficialrecordsashavinga particularrelationship toalandparcelto markanddefineitsboundary. j) Systematic adjudication (SA) - is a government-initiated process adjudicating land rights on a locality basis, progressing barangay if y barangayandaimingtoregisteralluntitledlandinthelocality. k) SystematicAdjudicationTeam(SAT)- referstotheteam duly organized by DENR who shall gather.evidence from applicants, cultivators, neighborsandbarangayofficialsandinvestigateinordertodeterminethe validityofadaimfortheissuanceofapatent. SECTION 4. THE SYSTEMATIC ADJUDICATION AREA - The systematic adjudicationapproachmaybeappliedhmplementedinareaswheretheapproach may best work in their operations and interest taking into consideration the provisionsofthisOrder. 4.1 Criteria for the Selection of Provinces Eligible as Systematic Adjudication Area To prepare and develop the regions for the adoption of the systematic adjudicationapproach,the Regionalofficesmay initiallyrecommendone ortwo provincesfordesignationasSystematicAdjudicationareas. Inthe selectionof initial provinceseligiblefor systematic adjudication, primary considerationshouldbecost-effectivenessoftheundertaking,thesupport oftheLGUandoperationalvariables. Inthis regard,thefollowinggeneral criteriashould be consideredinthe selectionandidentificationoftheprovinces,atiesandmuniapalitiestobe designatedasSystematicAdjudicationArea,towit: a. Number of titles that will be issued (i.e. minimum of 2000 lots in a municipality covering at least 50 percent of all municipalities in a province) b. StrongLGUcooperationandcommitment c. Othersthatmaybeidentifiedtoberelevantintheselection(e.g.peace andorder,qualityoflandrecords) 4.2 Designation of the SA Areas TheDENRSecretaryshallissueanOrderfortheofficialdesignationofthe SA areas. The Order designatesthe provinceaswell as the barangays and municipalitiesas SA areas, and shall designate the PENRO of the concernedareaastheoverallcoordinatorfortheSAactivities. SECTION 5. MANAGEMENT AND ADMINISTRATION - To provide the technical and policy guidance and supervisethe operationsof the Systematic Adjudication Approach in the Province, the establishment of a Provinaal SystematicAdjudicationManagementCommitteeisherebyauthorized.Itshallbe headedby a Project Managerandassistedby the Deputy Project Manager It shall be composed ofthe PENRO andCENROlswho hasjurisdichon overtde designatedSA areas. TheDENRSecretaryshalldesignatethePENROconcemedasProjectManager and a qualified personnel from the Land Management Services as Deputy ProjectManagerasperrecommendationoftheRegionalExecutiveDirector. TheREDshallbeauthorizedtoissuetheSpecialOrdercreatingtheSystematic AdjudicationTeam comprisingof qualifiedstaff from CENRO, PENROandthe RegionalOffice.TheSATshallbeunderthesupervisionoftheProjectManagerI PENRO. The ProvincialSystematicAdjudicationManagementCommitteeshall have thefollowingfunctionsintheimplementationofsystematicadjudicationactivities: (i) ensurethattitlingprocessintheprovincelcityareinaccordancewith the systematic adjudication manual process established under LAMP1; (ii) establish interagency coordination mechanisms for the implementationofthe SystematicAdjudicationapproach, definethe roles of participating agenaes, monitor and evaluate such mechanisms and recommend appropriate measures for the continuedimprovementintheSystematicadjudicationprocess; (iii) establishlinkageswiththe LGUsinthe mobilizationof communities for titlingactivities, andingeneratingsupportfor post adjudication programsfromtheLGUs,NGOs,andotherlocalpartners; (iv) establish partnership arrangements with other agencies to ensure coordinatedsupport from relevant agencies in the activities of the titlingactivities; (v) manage and coordinatecommunity participation,cadastral surveys andtheadjudicationsteams;and (vi) coordinate with the DENR regional office in the integration of systematicadjudicationactivitieswithregionaloperations. TheProjectManagerIPENROshallhavethefollowingfunctionsinthesystematic adjudicationarea: (i) provide overall direction and supervise Systematic Adjudication Teams; (ii) work in partnership with the Local Government Units in mobilizing membersofthecommunitytoparticipateinthesystematicadjudication process; (iii) "establishnbase camps withinthe community from which systematic adjudicationactivitiesmaybeundertaken; (iv) authorizetheconductofsurveysupportactivities; (v) signfreepatents5hectaresandbelow;and (vi) performotherrelatedactivitiesthatmayfromtimetotimebeassigned. TheCENROshallhavethefollowingfunctionsinthesystematicadjudicationarea: (vii) provide records, personnel and other resources in support of the systematicadjudicationobjectivesandactivities; (viii) participate in management meetings as part of the Management Committee;and (ix) performotherrelatedactivitiesthatmayfromtimetotimebeassigned. TheDeputyProjectManagershallhavethefollowingfunctionsinthesystematic adjudicationarea: (i) report to the PENRO on a full-time basis and supervise over-all implementationatthefieldlevel,providedthatifthe deputywill come from office other thanthe PENRO, hisor her reassignment shall be coveredbyaRegionalSpecialOrder; (ii) supervise the work of the community mobilization,adjudication, and surveyteams,andothercontractorsorpartnersasappropriate; (iii) coordinatewith other agenciesinthe developmentof common maps thatwillreflectlandinformationandconsolidationofrecordsnecessary tosupportadjudicationactivities; (iv) establishpartnershiparrangementswith relevantagenciesand other localgroupstoensuretheprojectsuccess; (v) coordinatewith LGUs inthe implementationof titling activities and facilitation of post adjudication activities in their respective municipalities;and (vi) performotherrelatedactivitiesthatmayfromtimetotimebeassigned. ThefunctionsoftheSystematicAdjudicationTeamshallindudethefollowing: (x) work in partnership with the Local Government Units in mobilizing membersofthecommunitytoparticipateinthesystematicadjudication process, so that as many unregisteredlandparcels as possible are registered; (xi) work in cooperation with other government offices involved in land administrationsuch asbut not limitedto,the Departmentof Agrarian Reform (DAR) in the administration of its comprehensive agrarian reformactivitiesandformalizationofleaseholdcontracts,theNational Commission of lndigenous People in the implementation of the lndigenousPeoplesRightsAct, andthe Registryof Deedsinitsland andtransactionactivities. (xii) coordinatewiththeCENROfficewhichhasjurisdictionoverthelocality wheretheSAToperates; (xiii) liaisewith, orient and mobilizecommunity to participate in the land titlingprogram; (xiv) process patent applicationsand to prepare the judicial forms in the field or at the PENRO office, as the case maybe, for approval by PENRO; (xv) facilitate cadastral survey and to carry out field verification of field surveysinordertospeedtheplanapprovalprocess. (xvi) to undertakeadjudicationactivitiessuch as: (a)interviewingpotential applicants and assisting them to completean Application for Public Land;(b)conductinganocular inspectionofthe landandpreparinga Final Inspection Report; (c) evaluating the claim and supporting evidence andrequestingfurther supportingevidenceas required;(d) assisting the applicant in the preparation and subscription of supporting documents such as affidavits; and (e) assisting in mediationsondisputesorconflictsrelatedtolands;and (vii) toperformotherrelatedactivitiesthatmaybeassigned. SECTION 6. STRATEGIES - SystematicAdjudicationstrategiesmay beapplied underthefollowingconditions: (i) Ifthelandisunsurveyed:Simultaneoussurvey andadjudicationshall be undertaken where the correct daimants are identified, the lots are sketched inthe Parcel Information Sheet (PIS), a boundary agreement process between the claimants and adjoining claimants is conducted where agreementsareevidencedby thesignaturesinthe PIS,lotcomer markers are planted in the ground and public land applications are completed.Theoutputsofsystematicadjudicationarethe PIS,approved cadastralsurveysandregisteredpatents. (ii) Ifthelandissurveyed:Adjudicationshallbeundertakentoidentifyexisting rights on the ground, assess the strengths of the claims based on documents and corroborative evidence and community confirmation to issueapatenttothequalifiedapplicant.Outputsareregisteredpatents. SECTION 7. GENERAL PROCEDURES - Inthe distributionof publicA&D lands andissuanceofFreePatentsthroughthisOrderthefollowingshallbeundertaken: 7.1 BaseCampSet-up The Base Camp shall be established and locatedstrategically inthe locality identifiedas SystematicAdjudicationArea. All relevantland recordsshall be madeavailableandvalidatedatthe Camp to fi~lly support allactivitiesof the SAT. Security copieswill be retainedat the source of the land recordsfor control purposes. At theendofthesystematicadjudicationperiodallrecords shouldbereturnedupdatedtothesourceoffice. 7.2CommunityMobilizationandConvergenceActivities The Community Developmentshall involve establishing partnershipwith the localgovernmentunitstoundertakeallphasesofthecommunityengagement- municipal partnership, barangay partnership, barangay land tenure improvement planning, municipal land tenure and local development and convergenceactivities. 7.3Adjudication Adjudicationactivitiesinvolvecollectingandassessingevidence insupportof theissuanceofafreepatentandforownershipofsomelesserinterestinthe land,andshallindudebutneednotbelimitedtothefollowing:(a)interviewing potentialapplicantsand assistrngthem to completean Applicationfor Public Land; (b)conductingan ocular inspectionof the land and preparing a Final Inspection Report; (c) evaluating the claim and supporting evidence and requestingfurther supportingevidenceas required;(d)assistingthe applicant inthepreparationands~~bscription ofsupportingdocumentssuchasaffidavits; and (e) assisting in mediations on disputes or conflicts related to lands. However,if,thecaseremains unresolved,the claimantswill beadvisedofthe existingDENRrulesandregulationsrelativetoclaimsandconflicts.Thematter shall also be endorsed by the SA to the regional Executive Director having jurisdictionovertheparceloflandforproperaction. Where lot surveys are required, adjudication activities are extended to the servingofthesurvey notificationletterandthecompletionofthe PISafterthe boundaryagreementprocess,priortotheexecutionofsurveyoperations. 7.4SurveysVerificationandApprovals Theofficeverificationandapproval processisthe responsibilityof the DENR RegionalSurveysDivision.Thisinvolvescheckingandcorrectingofthesurvey returnsinaccordancewiththeRevisedManualfor LandSurveyingRegulations in the Philippines (DAO 98-12) and LAMP specifications. The Regional TechnicalDirectorforLandsshallstillsignfortheapprovalofthesurveys. 7.5ProcessingandApprovalofPatents TheprocessingstaffoftheSATshallprocessallapplicationsattheBaseCamp or at the PENROICENRO, as the case maybe.This includesthe acceptance and numbering of the patent applications, review and evaluation of the application,preparationof technical description, preparationof documents to support the applications, final review of the application by the SAT Leader, preparationof Orderof Approval of PatentApplicationandpreparationof the PatentintheappropriateJudicialForm. All DENR Officials who shall perform functions necessary to support the systematicadjudicationactivitiesshalleitherbeassignedtotheBaseCampor shallvisitthe BaseCampregularlytoperformsaidfunctions. Thiswill include the RegionalTechnical Directorfor LandsandChiefof the RegionalSurveys Division for the approval of surveys, and the PENRO for the approval of patents. SECTION 8. EXEMPTION FROM FEES - FreePatents issuedfrom Systematic AdjudicationAreasshallbeexemptedfromthefollowingfees: 0) registrationfees,asprovidedinthePARCExecutiveCorr~niittee Policy Order No. 01 Series of 2005 on the "Implementing Guidelines on Exemptionfrom Paymentof Fees inthe Registrationof Patents"and asadoptedbyLRAunderLRACircularNo.12-2005; (ii) documentarystampsontheaffidavitof applicantandjoint affidavitsof disinterested persons and any otheraffidavitspreparedinsupportof the application (Sec. 196 and Sec. 199 of the National Internal Revenue Code); In cases, where the patent is issued for land with arrears in real property taxes, tax clearance need not be required, (DENR DAO 37-93 "New Guidelines in the Implementation of the Handog Titulo Program) said arrears can be annotated on the Patent as a lien against the title. SECTION 9. MANUAL OF PROCEDURES - The LAMP Field Operations Manual for Systematic Adjudication herein attached shall serve as initial guide for the implementation of SA Approaches in the designated SA Areas. For revisionslamendments to the Manual affecting LAMP areas, the Undersecretary authorizedlassigned by the DENR Secretary to supervise the land sector may revise or update this manual as new processes and procedures are developed subject to approval of the Secretary. For revisionslamendments to the Manual affecting other areas, the same shall be subject to approval by the Secretary upon recommendation by the Undersecretary for Planning and Policy. SECTION 10. ORIENTATION AND TRAINING -The Lands Management Bureau shall conduct the orientation and training on systematic adjudication concept and procedures immediately after the approval of this Order. The orientation and training shall be conducted at the field level in coordination with the Human Resources Development Sector of the concerned Regional Oflice. SECTION 11. OTHER PROVISIONS - Designated SA areas may access external funding source to support systematic adjudication. For areas using external funds, hiring of contractual personnel shall only be an option when there are no qualified personnel in the regional/provinaal/field office to perform the specific task. Such however, shall follow government procedures for the hiring of contractual personnel. Designated SA areas may also utilize ARFunds subject to the usual accounting procedures. SECTION 11. EFFECTNITY- This Order shall take effect fifteen (15) days after the publication thereof in a newspaper of general circulation and acknowledgement of receipt of a copy from the Office of the National Administrative Register (ONAR).
