IN THE NAME OF THE ALMIGHTY GOD, we the students of the Takoradi Polytechnic,

DETERMINED in raising to the highest level the spiritual, political, and intellectual standard of our society for the worth emulation of posterity,

SEEKING to promote the welfare of students of this Polytechnic as well as securing strong ties of fraternal solidarity and harmony among the student population of Ghana and elsewhere.

INTENT on establishing an accountable student government to enrich our heritage and safeguard the excellent principles of probity, truth, honesty, impartiality, equality and trust.

CHAPTER ONE THE CONSTITUTION ARTICLE 1 NAME There shall be formed an organi:ation under this constitution known and called the Stud !t"# R $% " !t&t'( referred to as the SRC0 C)u!*'+ ), T&-)%&d' P)+.t */!'* hereinafter

ARTICLE 2

SUPREMACY OF THE CONSTITUTION 5; This constitution shall be the supreme constitution of all students, clubs, associations or unions in the Takoradi Polytechnic, and any other constitution found to be inconsistent with any provision of this constitution shall, to the extents of its inconsistency, be null and void. 3; %otwithstanding (rticle <3; clause <5;, this constitution shall be sub=ect to the constitution of the *epublic of Ghana, ,aws of Ghana and the statute establishing this Polytechnic.

ARTICLE 1

ENFORCEMENT OF THE CONSTITUTION 5; (ny student who alleges that8 a. (n act or omission of any person or group of persons or b. ( constitution, decision or resolution of anybody, organi:ation, club, union, or association is in contravention with a provision of this constitution, may apply to the $isciplinary and ,egal .ommittee for a declaration to that effect. 3; The $isciplinary and ,egal .ommittee shall for the purpose of such declaration under clause of this article make such orders and give such

directions as it may consider appropriate for giving effect, or enabling effect to be given to the directions so made. >; 'ailure to obey or carryout the terms of an order or direction made or given under clause <3; of this article constitutes a violation of this constitution and contempt of the $isciplinary and ,egal .ommittee shall specify sanctions to the culprit and shall in the case of an .ommittee member constitute a ground for removal from office. xecutive

CHAPTER T2O ARTICLE 3 AIMS AND OB4ECTIVES OF THE SRC

5; The aims and ob=ectives of the "*. shall include but not limited to? a. "eeking the interest and welfare of the student today of Ghana in general and this Polytechnic in particular. b. "erve as the mouthpiece of the entire student body of this polytechnic. c. Provide means of communication between the students and the polytechnic authorities in all matters affecting the student body as a whole or part thereof. d. .o8ordinate with other student organi:ations in Ghana and elsewhere in matters of mutual interest and, e. 'oster good relations between students of this Polytechnic and the outside world. 3; 'or purpose of achieving these ob=ects, the "*. shall organi:e lectures, symposia, debates etc., and such other activities as are necessary to fulfill these general aims and ob=ectives.

CHAPTER THREE

ARTICLE 5

COMPOSITION OF THE SRC

5; The "*. shall be composed of the General .ouncil, which shall include@ a. The xecutive .ommittee, b. The 7.* and "chool !eads and their "ecretaries and Treasurers c. (ll .hairpersons of .ommittees formed under this constitution or by a resolution of the General .ouncil.

ARTICLE 6

THE GENERAL COUNCIL

"ecretary shall within three <>; days of assumption of office request in writing to the various bodies concerned, all such members as provided for in paragraph <a; to <t; of clause <5; of this article. >; (ny person or body written to by the "ecretary shall forward the names of such representatives qualified to be members of the General .ouncil by virtue of paragraphs <a; to <t; of clause <5; of this article to the "*. D; The $isciplinary and ,egal .hairperson shall swear the same to the "*. President before taking his6her seat in the General .ouncil.

ARTICLE 7

MEETINGS

5; The General .ouncil shall meet at least once each semester 3; The "*. "ecretary shall in writing, or in any other form as may be decided on by xecutive .ommittee notify members of such meetings, specifying the (genda in not less than two clear days before the meeting. >; The quorum for a General .ouncil meeting shall be@ a. Two8 thirds <36>; including the President, the "ecretary and or the Treasurer. b. The first sitting of the General .ouncil shall be within fifteen <5D; days after assumption of office of new xecutive .ommittee 2embers.

ARTICLE 8

EMERGENCY MEETINGS of article B of this constitution, the xecutive

.ommittee or, any two8thirds <36>; of the members of the General .ouncil, may call for an emergency meeting provided that the notice shall be given in writing duly signed by them, and that the (genda shall be attached and delivered to the "*. "ecretary. %o other business shall be discussed apart from the attached agenda. 3; The "*. "ecretary shall in consultation with the xecutive .ommittee summon such meeting within three <>; days of receipt of such request. >; The "*. President in consultation with the xecutive .ommittee shall call for an emergency meeting when the need be.

ARTICLE 9

DECISION MAKING

5; The General .ouncil shall be the highest decision making body of the "*.. 3; The General .ouncil may concern itself with questions of general policy referred to it by the xecutive .ommittee of the "*..

ARTICLE 10

ATTENDANCES OF OBSERVERS AT GENERAL COUNCIL MEETINGS

5; &bservers or a member of any committee who is not a member of the General .ouncil, shall be entitled to participate in the proceedings of the General .ouncil, shall be accorded all privileges of a member of the General .ouncil except that he is not entitled to vote, or take allowance if any.

CHAPTER FOUR THE EXECUTIVE ARTICLE 11: EXECUTIVE COMMITTEE

1; There shall be an xecutive .ommittee of the "*. which shall consist of@ a; The President, 0ice president, "ecretary and the Treasurer. 2; The executive committee may invite any member or committee to assist or address them in any deliberations in relation to their performance of their functions. 1; The quorum to xecutive committee meeting shall be 1 including the president or the secretary. 3; The executive committee shall in times of emergency, have powers to promptly meet without pre=udice to any provisions of this constitution, provided that the executive committee shall report their action to the General .ouncil at its subsequent meeting for ratification. 5; The General .ouncil members before assuming office shall take and subscribe, either at a public gathering or at any other general meeting of the General .ouncil, the oath of membership set out in this constitution.

ARTICLE 11:

DUTIES OF EXECUTIVE COMMITTEE MEMBERS

1; THE PRESIDENT a; There shall be a president who shall be the chief spokesperson of all students in this polytechnic b; /efore assuming office the President shall take and subscribe before the general student body, the Presidential &ath set out in the first schedule to this constitution.

c; The authority of the president shall extend to the execution and maintenance of all provisions, including article C, of this constitution. d; (ll meetings of the General .ouncil or the xecutive .ommittee shall be chaired by the President, and in his absence, the 0ice President. e; The President shall not, be personally liable to proceedings in any court for the performance of his functions, or for any act of omission commission in the performance of his functions, under this constitution.

1; THE SECRETARY a; There shall be a secretary who shall be the secretary to both the General .ouncil and the xecutive .ommittee b; The "ecretary shall perform duties and functions which shall include? i; )eeping and maintaining true and accurate minutes and records of all proceedings of the General .ouncil and xecutive .ommittee meetings. ii; *esponsible for both internal and external correspondences iii; .ompilation of an official list of all members of the General .ouncil in accordance with the provisions of this .onstitution.

iv; The performance of other duties as may be assigned from time to time by the President. c; /efore assuming office, the "ecretary shall take and subscribe before the general student body at a public gathering, the executive officers oath set out in the second schedule to this constitution.

CHAPTER FIVE REMOVAL FROM OFFICE ARTICLE 13 GROUNDS FOR REMOVAL 5. (n xecutive .ommittee 2ember shall be removed from office if found in accordance with the provisions of this article? a. To have acted in violation of the oath of office, or have violated the provisions of this constitution or, b. To be inefficient in the discharge of his6her duties or, c. To have embe::led funds or recklessly handled the finance of the "*. or, d. To have conducted him6herself in a manner likely to bring the high office of the President or 0ice President or "ecretary or Treasurer into disrepute, ridicule or contempt.

ARTICLE 15

REMOVAL OF A MEMBER OF THE GENERAL COUNCIL 5. ( 7.* or "chool shall have power to withdraw or remove any or all of its representatives in the General .ouncil provided that such exercise shall be effected through a resolution properly passed by the said 7.* or "chool. 3. The General .ouncil of the "*. shall have power to suspend or expel any member who is not an xecutive .ommittee 2ember upon stated misbehaviour provided that such a member shall have the right of appeal to $isciplinary and ,egal .ommittee.

ARTICLE 16 15

CESSATION TO BE A MEMBER OF THE SRC GENERAL COUNCIL

5. Without pre=udice to any provisions of this .onstitution, a person shall cease to be a member of the "*. General .ouncil, if@ a. !e6she is ad=udged to have embe::led funds. b. !e6she is ad=udged to have acted in a manner pre=udicial to the interest of the General "tudent body. c. !e6she absents his6herself from meetings without reasonable excuse. d. !e6she resigns in writing delivers same to the .hairman of the $isciplinary and ,egal .ommittee.

ARTICLE 17

IMPEACHMENT PROCEEDINGS 5. (ny student may by notice in writing addressed to the $isciplinary and ,egal .ommittee through the "*. to commence impeachment proceedings against a member of the "*. provided that such members shall be served with a copy of the notice two <3; clear days before the start of the proceedings. 3. The $isciplinary and ,egal .ommittee shall within seventy8two <B3; hours of receiving the notice of impeachment , convene a sitting of the $isciplinary and ,egal .ommittee in consultation with the "*., to deliberate over the issue<s;. >. (ny member so impeached shall cease forthwith to be a member of the "*. xecutives. C. (ny vacancies created by virtue of any provisions of this constitution shall be filled within twenty8one <35; days after such vacancies are created.

D. (ny student who is found to have allegedly falsely against any member of the "*. or any student shall be asked by the $isciplinary and ,egal .ommittee, "*. and the ditor8in8.hief for copies to be made available on "tudents %otice /oards. %otwithstanding that, the $isciplinary and ,egal .ommittee in consultation with the "*. shall sit and recommend appropriate punishment to be meted out.

CHAPTER SIX ELECTIONS AND <UALIFICATIONS ARTICLE 18 ELECTION OF THE EXECUTIVE COMMITTEE 5. ( student shall not be a candidate in any election unless he is nominated for election as President or "ecretary or Treasurer by a document which@ a. +s signed by him6her and b. +s delivered to the lectoral /oard on or before the day fixed for the close of nomination in relation to the election. c. +s sub=ect to the provisions of this constitution all xecutive

.ommittee 2embers, excluding the 0ice President and including the G%#P" ,ocal *epresentative and the WomenAs .ommissioner of the "*. shall be elected by secret popular vote through the ballot box.

ARTICLE 19

<UALIFICATIONS 5. ( student shall not be qualified for election to any student affairs. xecutive

.ommittee unless he6she has considerable exposure and experience in

(ny student of the Polytechnic is qualified to stand and contest for elections to any xecutive Position provided that he6she is an officially full8time tertiary student pursuing at least a fifteen credit hour course. >. (ny student who has been ad=udged to have misappropriated funds or caught involving in Theft, 'ight, *ape, known to be $runkard or a $rug (ddict or any bad moral behavior, shall not qualify to contest for election to any position under this constitution. C. Without pre=udice to any provision in this constitution, a student shall qualify to stand and contest elections to any provided he6she is not a final year student. D. 'inal year students shall be defined to include all who receive a !igher %ational $iploma <!%$; certificates awards at the end of the (cademic year in which elections are being held. E. %o student shall be elected as xecutive .ommittee 2ember unless at such elections the number of votes cast in his6her favour is more than fifty percent <D4F; of the total number of valid votes cast at the election. B. Where no candidates scores more than D4F of the valid votes cast, there shall be a run8off election between the first two candidates with the highest number of votes within seven <B; days. G. The lectoral /oard shall declare immediately the provisional election results after an election and unless or until such results are challenged, shall declare the final results within forty8eight <CG; hours after the election. H. General lections to student leadership positions on the "*. shall be conducted within ten <54; weeks after the commencement of the second semester of the academic year. xecutive .ommittee

ARTICLE 20

TENURE OF OFFICE OF THE EXECUTIVE COMMITTEE 5. ( student elected as an xecutive committee member shall hold office for a term of one <5; (cademic year. 3. %otwithstanding clause one <5; of this article, the .ommittee members shall hand over to newly elected the final election results. >. ARTICLE 22

INDEPENDENCE OF COMMISSION xcept as provided in this constitution or in any resolution of the General .ouncil not inconsistent with this constitution in the performance of its functions, the lectoral .ommission shall not be sub=ected to the direction and control of any person or authority.

ARTICLE 21

VETTING COMMITTEE There shall be a vetting committee which shall be chaired by the lectoral .ommissioner and be responsible for ensuring that candidates for any election under this constitution satisfy the requirements provided for in this constitution. This vetting committee shall have the power to disqualifying candidates for any election under this constitution on the grounds stated only in this constitution under chapter six <E;.

ARTICLE 23

COMPOSITION OF THE VETTING COMMITTEE The members of the lectoral .ommission shall constitute themselves into the 0etting .ommittee for the purpose of vetting during elections.

CHAPTER 7 FINANCE ARTICLE 25 THE STUDENTS FUND 5. There shall be an (ccount to be known as "*. (ccounts into which all monies belonging to the "*. shall be paid into. 3. ARTICLE 27

THE AUDIT BOARD 5. There shall be an (udit /oard of the "*. which shall comprise of five <D; members appointed by the xecutive .ommittee of the "*. with the prior approval of the General .ouncil at its first sitting provided that three of the persons so appointed shall be persons having reasonable knowledge in accounting and6 or auditing. 3. The accounts of the "*. and its committees, commissions or institutions established under this constitution or by a resolution of the General .ouncil shall be audited and reported on by the .hairperson of the (udit /oard to the General .ouncil. >. 'or the purpose of clause <3; of this article, the chairperson of the (udit /oard or any person authori:ed or appointed for such purpose by the chairperson of the (udit /oard shall have access to all books, records, returns and other relevant documents. C. The accounts of the "*. and of all other committees and commissions referred to in clause <3; of this article shall be kept in such forms as the (udit /oard shall approve. D. 'or the purpose of its work, it shall be lawful for the (udit /oard to subpoena any person including members of the xecutive .ommittee of the " * . to appear before it. E. (ny student who knowingly or recklessly makes orally or in writing to the (udit /oard any statement conveying any information or explanation required by the /oard or to which the /oard is entitled and

which is misleading, false or deceptive shall be liable to any sanctions approved by the $isciplinary and ,egal .ommittee in consultation with the "*..

ARTICLE 28

INDEPENDENCE AND PO2ERS OF THE AUDIT BOARD 5. The (udit /oard? a. "hall not be sub=ect to the direction or control of any other person or authority. b. "hall disallow any item of expenditure which is contrary to the provisions of this constitution or a resolution of the General .ouncil and surcharge I i. "hall not be sub=ect to the direction or control of any other person or authority. ii. The amount of any expenditure disallowed upon the person responsible for incurring or authori:ing the expenditure. iii. The amount of any loss or deficiency upon any person by whose negligence or misconduct the loss or deficiency has been incurred. c. The amount of any loss or deficiency upon any person by whose negligence or misconduct the loss or deficiency has been incurred. 3. C. +f findings still prove that, there has been a deficiency, the General .ouncil by resolution shall request the .entral (dministration to surcharge, withhold all documents of the person, stop him or her from writing examinations if not finished writing, or dismiss him or her from the institution, whichever appropriate.

ARTICLE 29

ADMINISTRATIVE EXPENSES OF THE BOARD/ BUDGETS 5. The expenses of the /oard shall be a charge on the "*. 'und. 3. The accounts of the (udit /oard and those of the entire "*. machinery shall be received and audited by the Polytechnic (uditor or by a professional6 qualified (uditor appointed by the General .ouncil and the findings published on the %otice /oards of the students each semester. >. The president shall cause to be prepared and presented to the General .ouncil, at the beginning of each semester, estimates of revenues and expenditure of the "*. or committees of the General .ouncil for that semester. C. The president shall within fourteen <5C; days after assumption of office, present to the General .ouncil, the proposed programmes of pro=ects to be undertaken by the xecutive .ommittee during their tenure of office. D. The General .ouncil shall meet and deliberate on the viability or otherwise of such programmes or pro=ects before authori:ing the allocation of funds for it from the "*. fund and the General .ouncil shall have power to modify the terms of any contract.

ARTICLE 10

LOANS 5. %o loan shall be raised for, or on behalf of the "*. or any committee otherwise than by or under the authority of a resolution of the General .ouncil. 3. ( resolution of the General .ouncil passed in accordance with clause <5; of this article shall provide8 a. That the terms and conditions of a loan shall be presented to the General .ouncil and shall not come into operation unless they have been approved by a resolution of the General .ouncil. b. That any monies received in respect of that loan shall be paid into the "*. fund.

CHAPTER EIGHT COMMITTEES OF THE SRC ARTICLE 11 COMMITTEES 5. The General .ouncil shall appoint standing committees and other committees as may be necessary for the effective running of the "*.. 3. The standing .ommittees shall be appointed at the first sitting of the General .ouncil and shall be charged with such functions assigned by this constitution or any other decision of the General .ouncil.

ARTICLE 12

FINANCE COMMITTEE 5. There shall be a 'inance .ommittee which shall pre8audit all financial transactions of the "*.. 3. The 'inance .ommittee shall comprise? a. The Treasurer who shall be the "ecretary of the .ommittee. b. &ne representative from each 7.* and "chool appointed to serve the 'inance .ommittee provided that such representative is pursuing a course in (ccountancy or has knowledge in (ccounting or (uditing. c. Two other persons nominated by the General .ouncil. >. ARTICLE 11

DEFAULTS BY THE FINANCE COMMITTEE 5. "ub=ect to clause <>; of this article, where there is a default on the part of the 'inance .ommittee due to wilful refusal or neglect to comply with this part of the constitution or incompetence or both, every member of the committee shall cease forthwith to be a member of the "*. 'inance .ommittee. 3. Where the default is found to have caused either wholly or in part by any member of the xecutive .ommittee or General .ouncil, such member shall suffer the penalty as may be determined by the (udit /oard. >. (ny person who whether intentionally or otherwise, fails to comply with the provisions of this chapter shall be liable to account for, or to any other punishment prescribed by the General .ouncil or determined by the $isciplinary and ,egal .ommittee. C. The quorum for 'inance .ommittee meetings shall be decided by said committee itself at its first sitting.

ARTICLE 13

DUTIES OF FINANCE COMMITTEE 5. The 'inance .ommittee shall? a. ncourage and promote the efficient utili:ation of the resources of the "*. through effective and efficient financial measures. b. /e responsible for monitoring the receipts and payments out of the "*. fund and shall report to the General .ouncil. 3. The 'inance .ommittee, before the end of each semester shall submit to the (udit /oard for auditing a statement of receipts and payments into and from the "*. fund.

ACADEMIC COMMITTEE 5. There shall be an (cademic .ommittee consisting of members appointed by the xecutive .ommittee sub=ect to the approval of General .ouncil. The chairperson shall be a member of the General .ouncil. 3. The .ommittee shall advise the "*. on students academic matters, pertaining to the nature of teaching, research and content of courses, conduct of examination, vacation training, the availability of study aids and equipment etc.

ARTICLE 16

RELIGIOUS BODIES 5. There shall be an "*. .haplaincy /oard who shall liaise between the "*. and other *eligious bodies on .ampus on all matters concerning religion. 3. The "*. shall recogni:e all *eligious /odies on .ampus. >. ach *eligious body shall submit a copy of its constitution to the "*., clearly stating the aims and ob=ectives. C. ARTICLE 17

DUES AND MONIES PAID BY STUDENTS 5. %o amount shall, unless by a resolution of the General .ouncil introduced by the xecutive .ommittee, be imposed on any student.

The xecutive .ommittee are satisfied that a .ommission of inquiry should be appointed, or b. The xecutive .ommittee advises that it is in the interest of students so to do or c. The General .ouncil, by a resolution requests that a .ommission of inquiry be appointed to inquire into any matter specified in that resolution as being a matter of importance to students. 3. ( person who possesses a special qualifications or knowledge in respect of the matter being inquired into.

ARTICLE 55

There shall be a preliminary hearing on the proposals for amendment by the $isciplinary and ,egal .ommittee and where it is satisfied that conditions require an amendment of this constitution, it shall give permission for the amendments. >. The $isciplinary and ,egal .ommittee in consultation with the xecutive .ommittee shall present a present a proposal to the General .ouncil to appoint a .ommission6 .ommittee. C. ( .ommission or .ommittee appointed in accordance with clause <>; of this article shall present draft proposal to the General .ouncil for consideration. D. 'or the purposes of consideration and debating on the draft proposals at least half of the total membership of the General .ouncil shall be present and the vote of two8thirds of such members shall be required to commence the process of the amendment. The .ommission responsible for the amendment shall publish the provisions intended to be amended together with the proposals for amendments and the draft provisions on all %otice /oards for at least fourteen <5C; days and provided that within the said fourteen days, there shall be a 7.* and "chool forum to debate on the proposals.

unregistered .lub, (ssociation formed on campus. D. The xecutive .ommittee of the "*. shall accept all letters of

registration provided that the aims and ob=ectives are not in conflict with the provisions of the constitution. E. (ll dues to be charged by such .lubs, (ssociations etc. shall be reasonable. B. The "*. President shall by the virtue of his office be an ex8officio member of all .lubs and (ssociations.

CHAPTER SEVENTEEN MISCELLANEOUS ARTICLE 62 COPIES OF THE CONSTITUTION 5. .opies of this constitution shall be made available to every member of the General .ouncil at the beginning of the tenure of office of such member of the General .ouncil, the $isciplinary and ,egal .ommittee members shall also be given copies of the .onstitution and statute of the Polytechnic at the same periods as General .ouncil members are given copies of this .onstitution. 3. Without pre=udice to clause <5; of this article, the "ecretary shall cause to be kept in each "chool library and the Polytechnic library copies of this constitution and shall make available copies of this constitution for reference. >. The "ecretary shall also make available, the constitution to the Principal, Polytechnic "ecretary, the $ean of "tudents and anyone who may be in need of the constitution for reference.

ARTICLE 61

INDEMNITY 5. 2embers of the General .ouncil, xecutive .ommittee and all other

.ommittees shall be indemnified out of the assets and funds of the "*. against any legal or other liabilities as may be incurred for and on behalf of the "*., provided that such liabilities shall have been incurred in the course of lawful execution of duties assigned to them under this .onstitution or by a decision of the General .ouncil. 3. +n the event of any legal proceedings being instituted against the "*., the President or his nominee shall represent the "*..

6; ELECTORAL OFFENCES 5; ( person who8 a; forges, fraudulently defaces, or destroys a nomination paper, or any other document relating to an election, or delivers to a returning officer or the electoral board any nomination paper knowing it to be forged? or b; 'orges or counterfeits or fraudulently destroys a ballot paper or the official mark on a ballot paper? or c; Without authority supplies a ballot to any person? or d; "ells or offers to sell a ballot paper to any person or purchases or offers to purchase a ballot paper from any person? or e; %ot being a person entitled under this constitution or regulations made under it, to be in possession of a ballot paper which has been marked with the official mark, has such a ballot paper in his possession? or f; )nowingly and intentionally puts into a ballot box anything other than the ballot paper which he is authori:ed by constitution to put in? or

g; Without authority, destroys, takes, opens or otherwise interferes with a ballot box, ballot paper or packet of packet papers in use or intended to be used for the purposes of an election? or h; Without authority, prints a ballot paper or what purports to be or is capable of being used as a ballot paper at an election? or i; %ot being authori:ed to do so under this constitution or regulations made under it, make a mark on a ballot paper issued to a person, other than himself, with intent that the ballot paper shall be used to record the vote of the person, commits an electoral offence.

7; UNAUTHORI?ED VOTING 5; ( person who knowingly8 a; votes at an election at which he is not entitled to vote? or b; 0otes more than once at an election commits an offence.

8; OFFENCES BY ELECTORAL OFFICERS 5; (n electoral officer, clerk, interpreter or other person who has a duty to perform, whether under this or otherwise, in relation to an election and who8 a; makes in any record, return or other document, which he is required to keep or make in pursuance of this constitution or of regulations made under it, any entry which he knows or has reasonable cause to believe to be false, or does not believe to be true? or

b; Permits a person whom he knows or has reasonable cause to believe not to be a person who is blind or incapacitated from voting by other physical cause to vote in the manner provided for such personAs? or c; *efuses to permit a person whom he knows or has reasonable cause to believe to be a person who is blind or incapacitated from voting by other physical cause to vote in the manner provided for such persons? or d; Willfully prevents a person from voting at the polling station at which he knows or has reasonable cause to believe the person is entitled to vote at? or e; Willfully counts a ballot paper as being cast for a candidate which he knows or has reasonable cause to believe was not validly cast for the candidate? or f; Without reasonable cause acts or fails to act in breach of his official duty, commits an electoral offence.

9; RE<UIREMENT OF SECRECY 5; very person present at the counting of votes shall maintain and help in maintaining the secrecy of voting and shall not communicate any information obtained at the counting of the votes as to the candidate for whom a vote is given on any particular ballot paper. 3; %o person shall8 a; +nterfere with or attempt to interfere with a voter when recording his vote? or b; &btain or attempt to obtain in a polling station information about the candidate for whom a voter in that station is about to vote or has voted? or c; .ommunicate anytime to any person any information obtained in a polling station about the candidate for whom a voter in that station has voted or about the number, if any, on the ballot paper given to a voter at that station? or

d; $irectly or indirectly induce a voter to display his ballot paper after he has marked or selected it so as to make known to another person the name of the candidate for whom he has or has not voted? or >; ( person who has undertaken to assist8 a; a blind voter to vote? or b; ( voter who is incapacitated from voting by any other physical cause to vote, shall not communicate at any time to another person information as to the candidate for whom that disabled voter tends to vote or has voted, or as to the number, if any, on the ballot paper given for the use of the disabled voter? or C; ( person who contravenes any provision of this section commits an electoral offence.

10; PERSONATION 5; ( person commits the sin of personation if he6she a; votes as another person, whether that other person is living or dead or is a fictitious person? or b; 0otes for a person whom he knows or has reasonable ground to believe to be dead or to be a fictitious person.

11; BRIBERY 5; ( person commits the offence of bribery8 a; +f he directly or acting through another person8 i; Gives money or obtain an office for a voter in order to induce the voter to vote or refrain from voting? or

ii; .orruptly does such an act on account of a voter having voted or retrained from voting? or iii; 2akes a gift or provides something of value to a voter to induce the voter to vote in a certain way or to obtain the election of a candidate? or b; +f he advances or pays money or causes money to be paid to or for the use of a person with the intent that the money or part of it shall be expended in bribery at an election, or knowingly pays money wholly or in part expended in bribery at an election? or c; +f after an election he directly or through another person receives money or valuable consideration on account of a person having voted or refrained from voting or having induced another person to vote or to refrain from voting. 3; 'or the purpose of subsection <5;8 a; *eferences to giving money include giving, lending, agreeing to give or lend, offering, pro missing and promising to procure or to endeavor to procure money or valuable consideration?

12; TREATING 5; ( person commits the offence of treating8 a; +f he corruptly either himself or through another person, before, during or after an election gives or provides or pays wholly or in part the expenses of giving or providing meat, drink, entertainment or provision to or for any person8 <i; 'or the purpose of corruptly influencing that person or another person to vote or refrain from voting? or <ii; &n account of that person or another person having voted or refrained from voting or being about to vote or refrain from voting? or

<b; +f he corruptly accepts or takes any meat, drink, entertainment or provision offered in the circumstances for the purposes mentioned in paragraph <a; of this section.

11; UNDUE INFLUENCE 5; ( person commits the offence of undue influence8 a; +f he directly or indirectly or through another person acting on his behalf8 i; 2akes use of or threatens to make use of force, violence or restraint? or ii; +nflicts or threatens to inflict on another person a temporal or spiritual in=ury, damage, harm or loss, b; +f by abduction, duress or any fraudulent method he impedes or prevents the free exercise of the franchise of a voter.

13; INTERFERENCE 2ITH ELECTIONEERING ACTIVITIES OF OTHER PERSONS0 5; ( person who, before or during an election for the purpose of effecting or preventing the election of a candidate either directly or indirectly. a; /y words, whether spoken or written, sign or any other representation or in any manner whatsoever seeks to excite or promote disharmony, enmity or hatred against another person, group of persons or political party on grounds of religious, tribal, professional, regional or political affiliation? or b; &rgani:es a group of persons with the intention of training the group in the use of, force, violence, abusive, insulting, corrupt or vituperative songs or language calculated to discredit, malign, disparage, condemn, insult or abuse another person or candidate or with a view to causing disharmony or a breach of the peace or to

disturbing public tranquility so as to gain unfair advantage in the election over that other person or candidate? or c; &bstructs or interferes or attempts to obstruct or interfere with the free exercise of the franchise of a voter or compels or induces or attempts to compel or induce a voter to vote or to refrain from voting? or d; .ompels, induces or attempts to compel or induce a candidate to withdraw his candidate or voter with in=ury or harm of any kind? or e; +n any manner whatsoever threatens any candidate or voter with in=ury or harm of any kind? or f; +nduces or attempts to induce any candidate or voter to fear or believe that he will suffer illness or will become an ob=ect of divine, spiritual or fetish displeasure or censure? commits an offence.

15; CERTAIN ACTIVITIES PROHIBITED ON POLLING DAY 5; $uring the hours when a poll is open on polling day, no person shall, of any polling station, seek to influence, in whatever manner, any person to vote for any candidate or to ascertain for which candidate any voter intends to vote or has voted. 3; $uring the hours when a poll is open on polling day, no person shall within five8hundred <D44; metres of any polling station, sell any intoxicating liquor or share elements. >; (ny person who contravenes any provision of this section commits an offence.

16; FALSE STATEMENTS 5; ( person who before or during an election for the purpose of effecting or preventing the election of a candidate makes or publishes or causes to be made or published by words whether written or spoken, or by song, a statement which is false or which he knows or has reason to believe to be false in relation to the personal character of another candidate commits an offence. 3; ( person who before or during an election knowingly publishes a false statement of the withdrawal of a candidate for the purpose of promoting or procuring the return of another candidate commits an offence. >; The provisions of this section shall not take away the right of a person to sue for defamation of character.
