ISSUE PRESENTED FOR REVIEW Whether the Ducks Like You Campaign, (hereafter Respondent), is guilty of violating Election Rule 9.8 . On April 14th and 15th against Mighty Oregon, (hereafter Petitioner) Summary of Arguments 1. Addressing allegations by PETITIONER. Part A, Infra 2. Arguments Part A Concerning the allegation of a person going up to Hanna Cook while she was street teaming and was told she was a racist for supporting Mighty Oregon, the PETITIONER did not describe them as being a volunteer or part of any campaign. Therefore RESPONDENT cannot and should not be held responsible for a random person going up to Hanna Cook and saying she was a racist for supporting Mighty Oregon especially when there is no clear link. RESPONDENT was never approached about this instance. Concerning the allegation of a Ducks Like You volunteer telling Charlie Truxal to go fuck yourself, PETITIONER provides no evidence as to who this volunteer was, where this volunteer was, or if they were in a Ducks Like You shirt. RESPONDENT was also never approached about this instance. Concerning the allegation of a Ducks Like You volunteer going up to Evan Roth, Charisse Gluck, and Josh Losner and calling them racist assholes, RESPONDENT was able to contact the volunteer Tru Mallon. They provided a statement saying I was walking with my debate partner from this year (Kristen Schafer https://www.facebook.com/kristen.d.shafer) and complaining about judges who don't like the activism type debate that we do and as I was walking along I was complaining about one specific judge who I particularly don't like and referred to him as "this racist asshole" at the moment that we happened to be walking past the Mighty Oregon table. The campaign didn't tell me to complain about that judge or how to refer to him, least of all while near Mighty Oregon tables Trus email is truthmallon@gmail.com. Provided this statement, it is clear that Tru wasnt directing their comments at any member at Mighty Oregon. Also RESPONDENT isnt at fault for Mighty Oregon members mishearing Tru Mallon. Concerning the allegation of Mack Smith approaching a student about Mighty Oregon and getting a response Yeah, the campaign with blatant racism and bigotry PETITIONER provides no evidence as to who this volunteer was or proof that they were actually volunteering. Just because someone is in a Ducks Like You shirt does not mean they are a volunteer. If this instance is actually factual, PETITIONER just assumed that because the person was wearing a Ducks Like You shirt that they are a volunteer. RESPONDENT cannot be held accountable to what people say in Ducks Like You shirts. Ducks Like you has passed out over 600 shirts in the past 2 days, which means any one of those 600 people could have said such a statement., Concerning the allegation that a Ducks Like you supporter called Samantha Smith a racist, RESPONDENT cant and shouldnt be held liable for what a supporter says, if it was even said at all. PART B

Helena Schlegel was never contacted about these concerns. Lamar Wise however was contacted once about Trus allegations, which RESPONDENT believes has been now cleared up. Lamar Wise conducted an internal investigation of the allegations at hand. Wise asked the slate and management members who monitored the tables and volunteers if any of the allegations presented by the PETITIONER are true. People who monitored/ helped monitor the table and volunteers: Beatriz Gutierrez, Tran Dinh, Patrick Kindred, Helena Schlegel , Jaki Salgado, Diana Salazar, Mary Weatherhead, Will Iversen, Casey (James) Edwards, Johnny Olson, Morgan Snook, Perla Alvarez, Steven Rao, Jazmin Avalos, Samantha Cohen, Evan Schultz, Shaniece Curry. Wise interviewed the people listed above and everyone confirmed that: 1) they did not tell volunteers or voters that Mighty Oregon was racist. 2) that they themselves did not call Mighty Oregon racist, 3) that they didnt overhear any volunteers call mighty Oregon racist. Part C Slate members from Ducks Like You expressed that Mighty Oregon has participated in slanderous language, telling freshman and volunteers that Ducks Like You will defund Greek life. This is not only an absurd claim but it is not even possible. Other unwarranted and slanderous claims include but are not limited to: The Ducks Like You cutting athletics, and that the Ducks Like You will only fund multicultural unions These statements are serious misrepresentations of the Ducks Like You campaign. Slate member Casey Edwards also reported that he was laughed at when he was alone under a tent by Mighty Oregon members, one that was identified as Alex Titus. The RESPONDENTS would like to apply the same election rule violations upon Mighty Oregon which include: Elections Rule 9.8 Severe campaign violations, but are not limited to: submitting votes for other students; tampering with the electronic system; harassment, intimidation, bribery or fraud with the intent of affecting the outcome of the election; libelous or slanderous statements or conduct; tampering with another campaigns materials with malicious intent, intentional actions to mislead or obstruct the duties of the Elections Board. Elections Rule 9.8.1 Consequences may include, but are not limited to, loss of all campaigning privileges including presence on the ballot, and, should sanctions be applied after election, removal from any office other than the ASUO Presidency 6.1

Campaigns shall be held responsible for all election-related activities undertaken by their affiliated, including but not limited to volunteers, employees, and representatives. Campaigns have a positive duty to ensure that all such persons do not violate these Rules; this duty increases with the degree of affiliation between an individual and the campaign Part 4 RESPONDENTS will also make sure to check in with volunteers to ensure they are treating the Mighty Oregon campaign and voters with respect. RESPONDENT expects the same from the Mighty Oregon campaign. Additionally the remedy suggested by the PETITIONER should be dismissed based on a lack of evidence and outlandish claims by supporters of Ducks Like You. The degree of separation between supporters and the actual Ducks Like You campaign is too great to place any blame on the Ducks Like You campaign.
