NR13 Boilers and Pressure Vessels (113.

000-5)

13.1. Steam boilers - general provisions. 13.1.1. Steam boilers are equipment for the production and accumulation of steam under pressure greater than atmospheric pressure using any source of energy, except for reboilers and similar equipment used in process units. 13.1.2. For the purposes of this NR (Regulatory Norm), a Qualified Professional is considered to be a person with the legal competence to exercise the profession of engineer in activities relating construction projects, monitoring of operation and maintenance, inspection and inspection supervision of boilers and pressure vessels, in conformity with the professional regulations in force in the Country. 13.1.3. Maximum Permitted Working Pressure (PMTP) or Maximum Permissible Working Pressure (PMTA) is the highest pressure value compatible with the project code, the strength of the materials used, the dimensions of the equipment and its operational parameters. 13.1.4. The absence of any of the following items constitutes a serious and imminent risk: a) safety valve with opening pressure set to a value equal or less than the maximum permissible working pressure (PMTA); (113.071-4) b) instrument indicating the accumulated steam pressure; (113.072-2) c) injector or other means of feeding water, independent of the main system, in solid fuel boilers; (113.073-0) d) rapid water drain system for alkali recovery boilers; (113.074-9) e) indication system for controlling the water level or other system preventing overheating due to insufficient feed. (113.075-7) 13.1.5. All boilers shall have affixed to the body, in a location of easy access and clearly visible, an indelible identification plate with at least the following information: (113.001-3 / I 2) a) manufacturer; b) serial number given by the boiler manufacturer; c) year of manufacture; d) maximum permissible working pressure; e) hydrostatic test pressure; f) steam production capacity; g) heating surface area; h) project code and year of edition. 13.1.5.1. In addition to the identification plate, the boiler category, as defined in sub item 13.1.9 of the Regulatory Norm, and its identification number or code shall be indicated in a visible location. 13.1.6. All boilers shall have at the establishment where they are installed the following documentation, properly updated:

a) "Boiler Record", containing the following information: (113.002-1 / I3) - project code and year of edition; - specification of materials; - procedures used in manufacture, assembly, final inspection and determination of the Maximum Permissible Working Pressure (PMTA); - set of drawings and other data necessary for monitoring the useful life of the boiler; - functional characteristics; - data on safety devices; - year of manufacture; - boiler category; b) "Safety Record", in conformity with sub item 13.1.7; (113.003-0 / I4) c) "Installation Project", in conformity with item 13.2; (113.004-8 / I4) d) "Alteration or Repair Projects", in conformity with subitems 13.4.2 and 13.4.3; (113.005-6 / I 4) e) "Inspection Reports", in conformity with subitems 13.5.11, 13.5.12 and 13.5.13. 13.1.6.1. If non-existent or lost, the Boiler Record shall be reconstituted by the owner with the technical responsibility of the manufacturer or Qualified Professional mentioned in sub item 13.1.2, it being essential to reconstitute the functional characteristics, data on safety devices and the procedures for determining the Maximum Permissible Working Pressure (PMTA). (113.0064 / I 3) 13.1.6.2. If the boiler is sold or transferred from the establishment, the documents mentioned in paragraphs "a", "d", and "e" of sub item 13.1.6 shall accompany it. 13.1.6.3. When required to do so by the competent authority of the regional agency of the Department of Labor, the owner of the boiler shall submit the documentation mentioned in sub item 13.1.6. (113.007-2 / I4) 13.1.7. The Safety Record shall consist of a book with numbered pages or other equivalent system, in which shall be recorded: a) all important occurrences capable of influencing the safety conditions of the boiler; b) periodic and non-routine safety inspections, with mandatory inclusion of the legible name and signature of the "Qualified Professional mentioned in sub item 13.1.2, and of the boiler operator present on the occasion of the inspection. 13.1.7.1. If the boiler is considered inadequate for use, the Safety Record shall contain this information and be formally closed. (113.008-0 / I4) 13.1.8. The documentation referred to in sub item 13.1.6 shall be permanently available for consultation by maintenance operators, inspection personnel and for workers and employers representations to the Internal Accident Prevention Commission (Cipa), and the owner shall ensure full access to this documentation. (113.009-9 / I3) 13.1.9. For the purposes of this Regulatory Norm, boilers are classified in 3 (three) categories, as follows: a) category A boilers are those whose operating pressure is 1960 KPa (19.98 Kgf/cm2) or higher;

b) category C boilers are those whose operating pressure is 588 KPa (5.99 Kgf/cm2) or lower and whose internal volume is 100 (one hundred) liters or less; c) category B includes all boilers that do not fall into the above categories. 13.2. Installation of steam boilers. 13.2.1. Authorship of the steam boiler "Installation Project", in regard to this Regulatory Norm, shall be the responsibility of the "Qualified Professional", as mentioned in sub item 13.1.2, and shall comply with the safety, health and environmental provisions in the Regulatory Norms, conventions and legal provisions applicable. 13.2.2. The boilers of any establishment shall be installed in the "Boiler Room" or in a location specifically for such purpose, called the "Boiler Area". 13.2.3. If the boiler is installed in an open environment, the "Boiler Area" shall satisfy the following requirements: a) be located at least 3.00 m (three meters) from: (113.010-2 / I4) - other installations in the establishment; - fuel stores, excepting startup tanks of up to 2.000 (two) thousand liters capacity; - the boundaries of third party property; - the boundary with public highways; b) have at least 2 (two) exits of ample proportions, permanently unobstructed and arranged in different directions; c) have easy and safe access, necessary for operating and maintaining the boiler, any guard rails with gaps being dimensioned so as to prevent people from falling through; (113.011-0 / I4) d) have a system for capturing and discharging gases and particulate material produced by combustion outside the area of operation, satisfying the environmental norms in force; e) have lighting in conformity with the official norms in force; (113.012-9 / I4) f) have an emergency lighting system if operated at night. 13.2.4. If the boiler is installed in a confined environment, the "Boiler Room " shall satisfy the following requirements: (Alteration given by SIT Administrative Rule no. 57, of June 19th, 2008) a) form a separate building, constructed of fire-resistant material, with only one wall adjacent other installations in the establishment, but with the other walls at least 3.00 m (three meters) away from other installations, the boundary of third party property, the boundary of public highways and fuel stores, excepting startup tanks of up to 2 (two) thousand liters capacity; (113.013-7 / I4) b) have at least 2 (two) exits of ample proportions, permanently unobstructed and arranged in different directions; c) have permanent ventilation with air intakes that cannot be blocked; d) have a sensor for detecting gas leaks for gas-fueled boilers. e) not be used for any other purpose;

f) have easy and safe access, necessary for operating and maintaining the boiler, any guard rails with gaps being dimensioned so as to prevent people from falling through; (113.014-5 / I3) g) have a system for capturing and discharging gases and particulate material produced by combustion outside the area of operation, satisfying the environmental norms in force; h) have lighting in conformity with the official norms in force, and an emergency lighting system. 13.2.5. Non-compliance with the following requirements constitutes a serious and imminent risk: a) for all boilers installed in an open environment, subparagraphs "b" , "d" and "f" of sub item 13.2.3 of this Regulatory Norm; b) for category A boilers installed in confined environments, subparagraphs "a", "b", "c", "d", "e", "g and h" of sub item 13.2.4 of this Regulatory Norm; (Alteration given by SIT Administrative Rule

c) for category B and C boilers installed in confined environments, subparagraphs "b", "c", "d", "e", "g and h" of sub item 13.2.4 of this Regulatory Norm. (Alteration given by SIT Administrative

13.2.6. If the establishment is not capable of satisfying the provisions of subitems 13.2.3 or 13.2.4, an "Alternative Installation Project " shall be prepared, with additional safety measures to attenuate the risks. 13.2.6.1. The "Alternative Installation Project" shall be submitted by the owner of the boiler for the agreement of the union representation of the predominant professional category in the establishment. 13.2.6.2. If agreement is not reached, as stipulated in sub item 13.2.6.1, the mediation of the regional agency of the Department of Labor can be requested by any of the parties, and, if the impasse persists, the decision shall be made by this agency. 13.2.7. Boilers classified category A shall have an instrument panel installed in a control room, constructed as laid down in the Regulatory Norms applicable. (113.015-3 / I4) 13.3. Safety in the operation of boilers. 13.3.1. All boilers shall have an up-to-date "Operating Manual" in the Portuguese language, in a place easily accessible to operators, containing at least the following: (113.016-1 / I3) a) startup and shutdown procedures; b) routine procedures and operational parameters; c) procedures for emergency situations; d) general procedures for safety, health and conservation of the environment. 13.3.2. Boiler instruments and controls shall be kept calibrated and in good running order, the use of artifices that neutralize the boilers control and safety systems constituting a serious and imminent risk. (113.017-0 / I2)

13.3.3. Water quality shall be controlled and treatments implemented when necessary to render the physico-chemical properties of the water compatible with the boilers operating parameters. (113.018-8 / I4) 13.3.4. All steam boilers shall mandatorily be under the control and operation of the boiler operator, non-compliance with this requirement characterizing a condition of serious and imminent risk. 13.3.5. For the purposes of this Regulatory Norm, the boiler operator shall be considered as the person who satisfies at least one of the following conditions: a) has the "Safety Training in the Operation of Boilers" certificate and proof of practical training course (b) in conformity with sub item 13.3.11; b) has the "Safety Training in the Operation of Boilers" certificate stipulated in Regulatory Norm NR 13 approved by Administrative Rule no. 02, dated 05.08.84; c) has proof of at least 3 (three) years experience in this activity, by May 8th, 1984. 13.3.6. The minimum requirement for participating as a trainee in "Safety Training in the Operation of Boilers" is a certificate of completion of 1st grade. 13.3.7. "Safety Training in the Operation of Boilers" shall mandatorily: a) be technically supervised by the "Qualified Professional" mentioned in sub item 13.1.2; b) be administered by professionals qualified for this purpose; c) comply, at least, with the curriculum proposed in Annex I-A of this Regulatory Norm. 13.3.8. Those responsible for promoting the "Safety Training in the Operation of Boilers" shall be prevented from administering new courses, as well as suffering other legal sanctions applicable, in the event of non-compliance with the provisions of sub item 13.3.7. 13.3.9. All boiler operators shall complete a supervised and documented practical training course in the operation of the boiler that they will operate, with a minimum duration of: (113.019-6 / I4) a) category A boilers: 80 (eighty) hours; b) category B boilers: 60 (sixty) hours; c) category C boilers: 40 (forty) hours. 13.3.10. The establishment in which the supervised practical training course is administered shall give prior notification to the union representation of the predominant professional category in the establishment of the following: (113.020-0 / I3) a) period of the training course; b) entity, company or professional responsible for "Safety Training in the Operation of Boilers"; c) list of training course participants. 13.3.11. Operators shall be constantly recycled by means of constant information regarding the physical and operational conditions of the equipment, technical updating, safety information, participation in courses, and attendance at lectures and relevant events. (113.0218 / I 2)

13.3.12. A serious and imminent risk is constituted if any boiler is operated under conditions different from those specified in the original project, unless: a) it is redesigned, taking into account all the variables involved in the new operating condition; b) all safety procedures resulting from the new classification are adopted in relation to installation, operation, maintenance and inspection. 13.4. Safety in boiler maintenance. 13.4.1. All repairs or alterations to boilers shall comply with the respective construction project code and the instructions of the manufacturer in regard to: (113.022-6 / I4) a) materials; b) execution procedures; c) quality control procedures; d) qualification and certification of personnel. 13.4.1.1. If the construction project code is not known, the original boiler design shall be respected, with the strictest control procedure stipulated in the relevant codes. 13.4.1.2. In category A and B boilers, at the discretion of the "Qualified Professional mentioned in sub item 13.1.2, more advanced calculation technologies or procedures can be used in place of those stipulated by the project codes. 13.4.2. "Alteration or Repair Projects" shall be designed beforehand in the following situations: (113.023-4 / I3) a) whenever the project conditions are modified; b) whenever repairs that may compromise safety are carried out. 13.4.3. The "Alteration or Repair Project" shall: (113.024-2 / I3) a) be designed or approved by the "Qualified Professional", mentioned in sub item 13.1.2; b) determine materials, execution procedures, quality control and qualification of personnel. 13.4.4. All interventions that require machining or welding of parts operating under pressure shall be followed by hydrostatic testing, with the characteristics defined by the "Qualified Professional mentioned in sub item 13.1.2. (113.025-0 / I 4) 13.4.5. Boiler control and safety systems shall be subject to preventive or predictive maintenance. (113.026-9 / I4) 13.5. Inspection of boiler safety. 13.5.1. Boilers shall be subject to initial, periodic and non-routine safety inspections, noncompliance with the periods laid down in the Regulatory Norm being considered a condition of serious and imminent risk. (113.078-1)

13.5.2. The initial safety inspection shall be carried out on new boilers, before they are placed in service, at the location of operation, and shall include internal and external examinations, and hydrostatic and accumulation testing. 13.5.3. The periodic safety inspection, consisting of internal and external examinations, shall be carried out with the following maximum periodicity: a) 12 (twelve) months for category A, B and C boilers; b) 12 (twelve) months for alkali recovery boilers of any category; c) 24 (twenty-four) months for category A boilers, provided that safety valve opening pressures are tested at 12 (twelve) monthly intervals; d) 40 (forty) months for special boilers as defined in item 13.5.5. 13.5.4. Establishments that have their "Own Equipment Inspection Service ", as laid down in Annex II, can extend the periods between safety inspections, complying with the following maximum periodicities: a) 18 (eighteen) months for category B and C boilers; (Alteration given by SIT Administrative Rule no. 57, of
June 19th, 2008)

b) 30 (thirty) months for category A boilers. 13.5.5. Boilers that operate continuously and use gases or waste from process units as the main fuel for making use of heat or for environmental control purposes can be considered special if all the following conditions are satisfied: a) they are installed in establishments with their "Own Equipment Inspection Service ", as mentioned in Annex II; b) the interlock system and opening pressure for each safety valve are tested every 12 (twelve) months; c) there are no unexpected variations in steam and gas outlet temperature during operation; d) water quality is analyzed and controlled periodically; e) deterioration of the materials that comprise the main parts of the boiler is controlled; f) they are approved as special class, subject to: - agreement between the union representation for the predominant professional category in the establishment and the employer; - mediation by the Department of Labor regional agency, requested by one of the parties when there is no agreement; - decision by the Department of Labor regional agency when the impasse persists. 13.5.6. On completing 25 (twenty-five) years of use, on the next inspection, boilers shall be subjected to strict integrity assessment to determine the remaining useful life and new maximum periodicities for inspection, if they are still serviceable. (113.027-7 / I4) 13.5.6.1. In establishments that have their "Own Equipment Inspection Service ", as mentioned in Annex II, the limit of 25 (twenty-five) years can be altered depending on the monitoring of boiler conditions, carried out by the above mentioned service.

13.5.7. Safety valves installed in boilers shall be inspected periodically in compliance with the following: (113.028-5 / I4) a) at least once a month, by operation of the lever, in operation, for boilers of categories B and C; b) by disassembling, inspecting and bench testing flanged valves and, in the field, welded valves, recalibrating them at a frequency compatible with operational experience of same, but complying with the maximum periodicity for inspection laid down in sub item 13.5.3 or 13.5.4, where applicable, for boilers of categories A and B. 13.5.8. In addition to the tests stipulated in sub item 13.5.7, safety valves installed in boilers shall be subjected to accumulation tests on the following occasions: (113.029-3 / I4) a) on initial boiler inspection; b) when modified or significantly overhauled; c) when the boilers operational parameters are modified or there is a change in the Maximum Permissible Working Pressure (PMTA); d) when the inlet or discharge pipes are modified. 13.5.9. A non-routine safety inspection shall be carried out on the following occasions: a) whenever the boiler is damaged by an accident or other occurrence capable of compromising its safety; b) if the boiler is subjected to extensive repair or alteration capable of changing its safety conditions; c) before the boiler is returned to operation, if it has been inactive for more than 6 (six) months; d) when the boilers installation location is changed. 13.5.10. The safety inspection shall be carried out by the "Qualified Professional" mentioned in sub item 13.1.2, or by the "Own Equipment Inspection Service ", mentioned in Annex II. 13.5.11. After boiler inspection, an "Inspection Report" shall be issued, and become an integral part of the boilers documentation. (113.030-7 / I4) 13.5.12. A copy of the "Inspection Report" shall be sent by the "Qualified Professional mentioned in sub item 13.1.2, within a maximum period of 30 (thirty) days as from termination of inspection, to the union representation of the predominant professional category in the establishment. 13.5.13. The "Inspection Report", mentioned in sub item 13.5.11, shall contain at least the following: a) data on the boilers identification plate; b) boiler category; c) boiler type; d) type of inspection carried out; e) date of commencement and termination of inspection;

f) description of inspections and tests carried out; g) inspection results and action taken; h) list of items in this Regulatory Norm or other legal requirements that are not satisfied; i) conclusions; j) recommendations and action required; k) planned date for fresh inspection of the boiler; l) legible name, signature and professional council registration number of the "Qualified Professional", mentioned in sub item 13.1.2, and legible names and signatures of technicians who participated in the inspection. 13.5.14. Whenever the inspection results determine alterations in the identification plate data, this data must be updated. (113.031-5 / I1) 13.6. Pressure vessels - general provisions. 13.6.1. Pressure vessels are equipment that contains fluids under external or internal pressure. 13.6.1.1. The field of application of this Regulatory Norm, in relation to pressure vessels, is defined in Annex III. 13.6.1.2. Pressure vessels covered by the Regulatory Norm are classified in categories according to Annex IV. 13.6.2. The absence of any of the following items constitutes a serious and imminent risk: a) safety valve or other safety device with the opening pressure set to the Maximum Permissible Working Pressure (PMTA) or lower, installed directly in the vessel or in the system that includes it; (113.079-0) b) safety device preventing the inadvertent disabling of the valve when it is not installed directly in the vessel; (113.080-3) c) instrument indicating the operating pressure. (113.081-1) 13.6.3. All pressure vessels must have affixed to the body in an easily accessible and clearly visible location an indelible identification plate with at least the following information: (113.032-3 / I2) a) manufacturer; b) identification number; c) year of manufacture; d) maximum permissible working pressure; e) hydrostatic test pressure; f) project code and year of edition.

13.6.3.1 In addition to the identification plate, there shall be in a visible location, an indication of the vessel category, in conformity with Annex IV, and its identification number or code. 13.6.4 All pressure vessels shall have, in the establishment in which they are installed, the following documentation properly updated: a) "Pressure Vessel Record" to be supplied by the manufacturer, containing the following information: (113.033-1 / I2) - project code and year of edition; - specification of materials; - procedures used in the manufacture, assembly, final inspection and determination of the Maximum Permissible Working Pressure (PMTA); - set of drawings and other data necessary for monitoring its useful life; - functional characteristics; - data on safety devices; - year of manufacture; - vessel category; b) "Safety Record" in conformity with sub item 13.6.5; (113.034-0 / I4) c) "Installation Project" in conformity with item 13.7; (113.035-8 / I4) d) "Alteration or Repair Project" in conformity with subitems 13.9.2 and 13.9.3; (113.036-6 / I 4) e) "Inspection Reports" in conformity with sub item 13.10.8. 13.6.4.1. If non-existent or lost, the "Pressure Vessel Record " shall be reconstituted by the owner with the technical responsibility of the manufacturer or Qualified Professional mentioned in sub item 13.1.2, it being essential to reconstitute the functional characteristics, the data on safety devices and the procedures for determining the Maximum Permissible Working Pressure (PMTA). (113.037-4 / I2) 13.6.4.2. The owner of the pressure vessel shall submit, when required to do so by the competent authority of the regional agency of the Department of Labor, the documentation mentioned in sub item 13.6.4. (113.038-2 / I4) 13.6.5. The Safety Record shall consist of a book of numbered pages, folders or a system, whether computerized or not, with equivalent reliability, in which the following are recorded: a) all important occurrences capable of influencing the vessels safety conditions; (113.039-0 / I 3) b) occurrences of safety inspections. (113.040-4 / I4) 13.6.6. The documentation referred to in sub item 13.6.4 shall be permanently available for consultation by maintenance operatives, inspection personnel and for workers and employers representations to The Internal Accident Prevention Commission - Cipa, and the owner shall ensure full access to this documentation, including to union representation for the predominant professional category in the establishment, when formally requested. (113.041-2 / I4)

13.7. Installation of pressure vessels. 13.7.1. All pressure vessels shall be installed so that all existing drains, breathers, inspection openings and level, pressure and temperature indicators shall be easily accessible. (113.042-0 / I 2) 13.7.2. If pressure vessels are installed in confined environments, the installation shall satisfy the following requirements: (Alteration given by SIT Administrative Rule no. 57, of June 19th, 2008) a) have at least 2 (two) exits of ample dimensions, permanently unobstructed and arranged in different directions; (113.082-0) b) have easy and safe access for activities of maintenance and inspection, any guard rails with gaps being dimensioned so as to prevent people from falling through; (113.043-9 / I3) c) have permanent ventilation with air intakes that cannot be blocked; (113.083-8) d) have lighting in conformity with the official norms in force; (113.044-7 / I3) e) have an emergency lighting system. (113.084-6) 13.7.3. If the pressure vessel is installed in an open environment, the installation shall satisfy subparagraphs "a", "b", "d" and "e" of sub item 13.7.2. 13.7.4. Non-compliance with the following subparagraphs of sub item 13.7.2 shall constitute a serious and imminent risk: - "a", "c and e" for vessels installed in confined environments; - "a" for vessels installed in open environments; - "e" for vessels installed in open environments and operated at night. 13.7.5. If the establishment is unable to satisfy the provisions of sub item 13.7.2, an "Alternative Installation Project " shall be prepared, with additional safety measures for attenuating the risks. 13.7.5.1. The "Alternative Installation Project" shall be submitted by the owner of the pressure vessel for the agreement of the union representation of the predominant professional category in the establishment. 13.7.5.2. If agreement is not reached, as stipulated in sub item 13.7.5.1, the mediation of the regional agency of the Department of Labor can be requested by any of the parties, and, if the impasse persists, the decision shall be made by this agency. 13.7.6. Authorship of the "Installation Project" for pressure vessels in categories I, II and III, as in Annex IV, in regard to compliance with this Regulatory Norm, shall be the responsibility of the "Qualified Professional", as mentioned in sub item 13.1.2, and shall comply with the safety, health and environmental provisions in the Regulatory Norms, conventions and legal provisions applicable. 13.7.7. The "Installation Project" shall contain at least a ground plan of the establishment, with the position and category of each vessel and the safety installations. (113.045-5 / I1) 13.8. Safety in the operation of pressure vessels. 13.8.1. All pressure vessels in categories I and II shall have their own Operating Manual or operating instructions contained in the Operating Manual of the unit in which they are

installed, in the Portuguese language, and easily accessible to operators, containing at least the following: (113.046-3 / I3) a) startup and shutdown procedures; b) routine procedures and operational parameters; c) procedures for emergency situations; d) general procedures for safety, health and conservation of the environment. 13.8.2. Pressure vessel instruments and controls shall be kept calibrated and in good operational order. (113.047-1 / I3) 13.8.2.1. The use of artifices that neutralize control and safety systems shall constitute a serious and imminent risk. (113.085-4) 13.8.3. The operation of units containing pressure vessels of categories I and II shall be carried out by a professional with "Safety Training in the Operation of Process Units", noncompliance with this requirement constituting a condition of serious and imminent risk. (113.048-0 / I4) 13.8.4. For the purposes of this Regulatory Norm, a professional with "Safety Training in the Operation of Process Units" shall be a professional who satisfies the following conditions: a) having a "Safety Training in the Operation of Process Units" certificate issued by an institution competent to provide the training; b) have proven experience in the operation of pressure vessels of categories I or II of at least 2 (two) years prior to the coming into force of this Regulatory Norm. 13.8.5. The minimum prerequisite for participation as a trainee in "Safety Training in the Operation of Process Units" is a certificate of completion of 1st grade. 13.8.6. " Safety Training in the Operation of Process Units " shall mandatorily: a) be technically supervised by the "Qualified Professional" mentioned in sub item 13.1.2; b) be administered by professionals qualified for this purpose; c) comply, at least, with the curriculum proposed in Annex I-B of this Regulatory Norm. 13.8.7. Those responsible for the provision of "Safety Training in the Operation of Process Units " shall be prevented from administering fresh courses, as well as suffering other legal sanctions appropriate, in the event of non-compliance with the provisions of sub item 13.8.6. 13.8.8. All professionals with "Safety Training in the Operation of Process Units" shall complete a supervised practical training course in the operation of pressure vessels with the following minimum durations: (113.049-8 / I4) a) 300 (three hundred) hours for vessels of categories I and II; b) 100 (one hundred) hours for vessels of categories III, IV and V. 13.8.9. The establishment in which the supervised practical training course is given shall give prior notice to the union representation of the predominant professional category of the

following: (113.050-1 / I3) a) period during which the training course is to be carried out; b) entity, company or professional responsible for "Safety Training in the Operation of Process Units"; c) list of training course participants. 13.8.10. Operators shall be constantly recycled by means of constant information regarding the physical and operational conditions of the equipment, technical updating, safety information, participation in courses, and attendance at lectures and relevant events. (113.0510 / I 2) 13.8.11. A serious and imminent risk is constituted if any pressure vessel is operated under conditions different from those specified in the original project, unless: a) it is redesigned, taking into account all the variables involved in the new operating condition;(113.086-2) b) all safety procedures resulting from the new classification are adopted in relation to installation, operation, maintenance and inspection. (113.087-0) 13.9. Safety in pressure vessel maintenance. 13.9.1. All repairs or alterations to pressure vessels shall comply with the respective construction project code and the instructions of the manufacturer in regard to: (113.052-8 / I4) a) materials; b) execution procedures; c) quality control procedures; d) qualification and certification of personnel. 13.9.1.1. If the construction project code is not known, the original vessel design shall be respected, with the strictest control procedure stipulated in the relevant codes. 13.9.1.2. At the discretion of the "Qualified Professional mentioned in sub item 13.1.2, more advanced calculation technologies or procedures can be used in place of those stipulated by the project codes. 13.9.2. "Alteration or Repair Projects" situations: (113.053-6 / I3) shall be designed beforehand in the following

a) whenever the project conditions are modified; b) whenever repairs that may compromise safety are carried out. 13.9.3. The "Alteration or Repair Project" shall: (113.054-4 / I3) a) be designed or approved by the "Qualified Professional", mentioned in sub item 13.1.2; b) determine materials, execution procedures, quality control and qualification of personnel;

c) be publicized to establishment employees who may be involved with the equipment. 13.9.4. All interventions that require welding of parts operating under pressure shall be followed by hydrostatic testing, with the characteristics defined by the "Qualified Professional mentioned in sub item 13.1.2, taking account of the provisions of item 13.10. (113.055-2 / I4) 13.9.4.1. Hydrostatic testing can be dispensed with for small surface interventions, at the discretion of the "Qualified Professional", mentioned in sub item 13.1.2. 13.9.5. Pressure vessel control and safety systems shall be subject to preventive or predictive maintenance. (113.056-0 / I4) 13.10. Inspection of pressure vessel safety. 13.10.1. Pressure vessels shall be subject to initial, periodic and non-routine safety inspections. (113.057-9 / I4) 13.10.2. The initial safety inspection shall be carried out on new pressure vessels, before they are placed in service, at the final location of operation, and shall include internal and external examinations and hydrostatic testing, bearing in mind the limitations in sub item 13.10.3.5. (113.058-7 / I4) 13.10.3. The periodic safety inspection, consisting of internal and external examinations and hydrostatic testing, shall be carried out with the following maximum periodicity: (113.059-5 / I 4) a) for establishments without their "Own Equipment Inspection Service", as mentioned in Annex II:

13.10.3.1. Pressure vessels for which it is physically impossible to carry out the internal or external examination shall alternatively be subjected to hydrostatic testing, bearing in mind the limitations stipulated in sub item 13.10.3.5. (113.060-9 / I4) 13.10.3.2. For vessels with internal filling or with a catalyzer, the periodicity of internal examinations or hydrostatic testing can be extended to coincide with the replacement of the filling or catalyzer, provided that the extension does not exceed 20 (twenty) percent of the period laid down in sub item 13.10.3 of this Regulatory Norm. (113.061-7 / I4) 13.10.3.3. Vessels with internal moisture-absorbent linings shall be hydrostatically tested before the lining is applied, subsequent tests being substituted by alternative techniques. (113.062-5 / I4)

13.10.3.4. If it is not technically feasible, and subject to an entry in the "Safety Record" by the "Qualified Professional mentioned in sub item 13.1.2, the hydrostatic test can be substituted by another nondestructive test technique or inspection for achieving the same level of safety. (113.063-3 / I4) 13.10.3.5. The following are considered technical reasons rendering hydrostatic testing nonfeasible: a) structural strength of the foundation or support of the vessel incompatible with the weight of water that would be used in the test; b) damaging effect of the test fluid on the internal elements of the vessel; c) technical impossibility of purging and drying the system; d) existence of internal lining; e) damaging effect of the test on subcritical defects. 13.10.3.6. Vessels with an operating temperature lower than 0C (zero degrees Centigrade) and that operate in conditions in which experience has shown that no deterioration occurs shall not require periodic hydrostatic testing, the internal examination being mandatory every 20 (twenty) years and the external examination every 2 (two) years. (113.064-1 / I4) 13.10.3.7. If there is no alternative, a pneumatic test can be carried out, provided that it is supervised by the Qualified Professional mentioned in sub item 13.1.2, and special care is taken, since it is a high-risk activity. (113.065-0 / I4) 13.10.4. Pressure vessel safety valves shall be disassembled, inspected and recalibrated when the periodic internal examination is carried out. (113.066-8 / I4) 13.10.5. Non-routine safety inspections shall be carried out on the following occasions: (113.067-6 / I4) a) whenever the vessel is damaged by an accident or other occurrence that compromises its safety; b) when the vessel undergoes significant alterations or repair, capable of altering its safety condition; c) before the vessel is returned to service, when it has been inactive for more that 12 (twelve) months; d) when there is an alteration in the vessels installation location. 13.10.6. The safety inspection shall be carried out by the "Qualified Professional mentioned in sub item 13.1.2 or by the "Own Equipment Inspection Service ", as mentioned in Annex II. (113.068-4 / I4) 13.10.7. After inspection of the vessel, an "Inspection Report " shall be issued and become part of the vessels documentation. (113.069-2 / I4) 13.10.8. The "Inspection Report" shall contain at least the following: a) pressure vessel identification; (113.088-9)

b) service fluids and pressure vessel category; (113.089-7) c) pressure vessel type; (113.090-0) d) date of commencement and termination of inspection; (113.091-9) e) type of inspection carried out; (113.092-7) f) description of examinations and tests carried out; (113.093-5) g) results of inspections and action taken; (113.094-3) h) conclusions; (113.095-1) i) recommendations and action required; (113.096-0) j) planned date of the next inspection; (113.097-8) k) legible name, signature and professional council registration number of the "Qualified Professional", mentioned in sub item 13.1.2, and legible names and signatures of technicians who participated in the inspection. ANNEX II Requirements for Certification of "Own Equipment Inspection Service" Before putting in practice the special intervals between inspections, laid down in subitems 13.5.4 and 13.10.3 of this Regulatory Norm, the companys "Own Equipment Inspection Services", organized as a sector, section, department, division or equivalent, must be certificated by the National Institute of Metrology, Normalization and Industrial Quality (Inmetro), either directly or through "Certification Bodies " accredited by Inmetro, that will verify the following minimum requirements specified in subparagraphs "a" to "g". This certification

can be cancelled where any of these requirements is not complied with: a) existence of company personnel at the boiler or pressure vessel installation location, dedicated exclusively to the activities of inspection, integrity assessment and residual life, with education, qualifications and training compatible with their proposed activity of ensuring safety; b) labor contracted for nondestructive testing certificated in accordance with the regulations in force and for other services that may be required, selected and assessed based on criteria similar to those used for own labor; c) the equipment inspection service proposed shall have a head formally appointed to the management function; d) existence of at least 1 (one) "Qualified Professional", as defined in sub item 13.1.2; e) existence of conditions for maintaining up-to-date the technical archive required for satisfying this Regulatory Norm, as well as mechanisms for distributing information when required; f) existence of written procedures for the main activities carried out; g) existence of apparatus consistent with the proposed activities. ANNEX III 1. This Regulatory Norm shall be applied to the following equipment: a) any vessel whose product "PV" is greater than 8 (eight), where "P" is the maximum operating pressure in kPa and "V" its geometric internal volume in m3, including: - heat exchangers, evaporators and similar; - pressure vessels or parts subjected to direct flame that do not fall within the scope of other Regulatory Norms, nor item 13.1 of this Regulatory Norm; - jacketed pressure vessels, including reboilers and reactors; - autoclaves and non-vaporizing thermal fluid boilers; b) vessels containing class "A" fluid, specified in Annex IV, irrespective of the dimensions and the "PV". 2. This Regulatory Norm does not apply to the following equipment: a) transportable cylinders, vessels intended for transporting products, portable compressed fluid reservoirs and fire extinguishers; b) vessels intended for human occupation; c) combustion chambers or vessels that are an integral part of rotary or reciprocating machinery, such as pumps, compressors, turbines, generators, engines, and pneumatic cylinders, and that cannot be characterized as independent equipment; d) ducts and pipes carrying fluid; e) coils for heat exchange; f) tanks and recipients for storage and warehousing of fluids not covered by norms and project codes relating to pressure vessels;

g) vessels with an internal diameter of less than 150mm (one hundred and fifty millimeters) for fluids of classes "B", "C" and "D", as specified in Annex IV. ANNEX IV Classification of Pressure Vessels 1. For the purposes of this Regulatory Norm, pressure vessels are classified in categories according to type of fluid and risk potential. 1.1. Fluids in pressure vessels are classified as indicated below: Class "A": - flammable fluids; - fluids combustible at a temperature of 200 C (two hundred degrees Centigrade) or higher; - toxic fluids with a tolerance limit of 20 (twenty) ppm or less; - hydrogen; - acetylene. Class "B": - fluids combustible at a temperature lower than 200 C (two hundred degrees Centigrade); - toxic fluids with a tolerance limit higher than 20 (twenty) ppm; Class "C": - water vapor, simple asphyxiating gases or compressed air; Class "D": - water and other fluids not in class "A", "B" or "C", with a temperature higher than 50C (fifty degrees Centigrade). 1.1.1. For classifying mixtures, the fluid presenting the highest risk to workers and installations shall be considered in terms of its toxicity, flammability and concentration. 1.2. Pressure vessels are classified in risk potential groups according to the product PV, where P is the maximum operating pressure in MPa and V the geometric internal volume in m3, as follows: Group 1 - PV > 100 Group 2 - PV < 100 and PV > 30 Group 3 - PV < 30 and PV > 2.5 Group 4 - PV < 2.5 and PV > 1 Group 5 - PV < 1 Declares, 1.2.1. NR 13 BOILERS AND PRESSURE VESSELS


13.1 STEAM BOILERS GENERAL 13.1.1 Steam boilers are equipment used to generate and accumulate steam at a pressure higher than the atmospheric pressure, using any source of heat, except reboilers and similar equipment used in process units. For the accomplishment of this Regulation Standard, it is considered Qualified Professional the one who has legal qualifications to exercise the engineering professional in the activities related to the construction design code, operational and maintenance examination, inspection supervision of boilers and pressure vessels, in accordance with the prevailing professional regulation of Brazil. Maximum Permitted Working Pressure MPWP or Maximum Allowable Working Pressure MAWP is the highest pressure value in accordance with the design code, the resistance of the materials used, the equipment dimensions and their operational parameters. It constitutes a serious and eminent risk the lack of any of the following items: a) b) c) d) e) Safety valve with opening pressure set at or below the MAWP; Device that shows the accumulated steam pressure; Injector or other means of feeding water, independent from the main system, for boilers that are fired with solid fuel; Fast water drain system, in recovering alkali boilers; Indicating system to control the level of water or other system that avoids superheating by defective feeding. 13.1.6 a)

with the provisions of 13.1.9 hereto, and its identification number or code. Every boiler shall have, in the site it has been installed, the following records, duly updated:

A Boiler Dossier, having the following information: Design Code and year of edition Materials specification; Procedures used in the f abrication, assembly, final inspection and determination of the MAWP; A set of drawings and necessary data to follow the service life of the boiler; Functioning characteristics; Safety devices data; Year of fabrication; Boiler category. Safety Record, in accordance with the provisions of 13.1.7 Installation Design, in accordance with the provisions of 13.2; Changing of Repair Designs, in accordance with provision of 13.4.2 and 13.4.3; Inspection Reports, in accordance with provisions of 13.5.11, 13.5.12 and 13.5.13. When nonexistent or lost, the Boiler Dossier shall be restored by the owner, with the manufacturer or Qualified Professionals (summoned in 13.1.2) technical responsibility, being indispensable the restoration of the functioning characteristics, safety devices data and procedures for MAWP determination. When the boiler is sold or transferred to other site, the records mentioned in a, d and c in 13.1.6 shall follow it. The owner of the boiler shall present when requested by the appropriate authority of the Regional Labor Department, the records mentioned in 13.1.6. The Safety Record shall be made up of a separate book, with numbered pages, or other similar system where the following will be recorded:

Every boiler shall have attached on its body, in a visible and of easy and accessible place, and enduring identification plate with, at least the following information: a) b) c) d) e) f) g) h) Manufacturers name; Order number given by the boilers manufacturer; Year of fabrication; Maximum allowable working pressure; Hydrostatic test pressure; Capacity for steam production; Heating surface area; Design Code and year of edition. Besides the identification plate there shall be, in a visible place, the boiler category, in accordance

All the relevant events capable to influence on the boiler safety conditions; b) The events of periodical and extraordinary safety inspections, containing the legible name and signature of the Qualified Professional, summoned in 13.1.2, and the boiler operator present in the event of the inspection. 13.1.7.1 In the event of the boiler is considered inadequate for use, the Safety Record shall contain such information and receive a formal conclusion.

13.1.8 The records referred in the 13.1.6 shall be at all times


available for the examination of the operators, the maintenance and inspection personnel and the employee and employer representatives at the Accident Prevention Internal Commissions, and the owner shall endure complete access to these records. 13.1.9 For the accomplishment of this Regulation Standard, boilers are classified in three categories accordingly to the following:

a) Category A boilers are those which the operation


pressure is 1960 kPa (19.98 Kgf/cm) or higher;

b) Category C are those which the operation pressure is c)


58.8 kPa (5.99 Kgf/cm) or lower, and the internal volume is 100 liters or lower; Category B boilers are all boilers that are out of the previous categories;

13.2

INSTALLATION OF STEAM BOILERS

13.2.1 The authorship of the Installation Design, as far as this Regulation Standard is concerned, is responsibility of the Qualified Professional, as summoned in 13.1.2, and shall obey the safety, health and environment aspects foreseen in the Regulation Standards, agreements and legal arrangements. 13.2.2 The boilers of any enterprise shall be installed in a Boiler House or in a specific site for this purpose, called a Boiler Area, 13.2.3 When the boiler is installed outdoors, the Boiler Area shall meet the following requirements: a) Be at least 3 (three) meters away from: Other equipment of the enterprise; Fuel storage, except tanks for the startup with up to 2,000 (two thousand) liters of capacity; From the border of third party properties; From the border of public roads. b) Provide at least 2 (two) wide exits, permanently unblocked and arranged in different directions; c) Provide an easy and safe access, necessary to the boiler operation and maintenance, taking into account that for vacant guard rails, the gaps shall have dimensions to avoid personnels falls; d) Have captivation and discharging systems for gasses and particle matters from combustion to send them out of the operation area, in accordance with the prevailing environment standard; e) Provide illumination in accordance with the prevailing official standards; f) Have emergency illumination systems in case of operating at night. 13.2.4 When the boiler is installed indoors, the Boiler House shall meet the following requirements:

a) Constitute a separate building, built of fire resistant material, being able to have only one wall close to other equipment of the enterprise, however with the other walls distant, at least 3 (three) meters from other equipment, from third party properties, from the limit with public roads and fuel storage except tanks for the startup with up to 2,000 (two thousand) liters of capacity. b) Provide at least 2 (two) wide exits, permanently unblocked and arranged in different directions; c) Provide permanent ventilation with air openings which cannot be blocked; d) Provide gas leakage detecting devices when the boiler source of heat is a gaseous fuel; e) Not be used to any other purpose; f) Provide and easy and safe access, necessary to the boiler operation and maintenance, taking into account that for vacant guard rails, the gaps shall have dimensions to avoid personnels falls; g) Have captivation and discharging systems for gasses and particle matters from combustion to send them out of the operation area, in accordance with the prevailing environment standards; h) Provide illumination in accordance with the prevailing official standards and have emergency illumination systems. 13.2.5 It constitutes a serious and eminent risk the lack of any of the following: a) For all boilers installed outdoors, the items b, d and f of 13.2.3 hereto; b) For the category A: boilers installed indoors, the items a, b, c, d, e, g and h of 13.2.4 hereto; c) For the categories B and C boilers installed indoors, the items b, c, d, e, g and h of 13.2.4 hereto. 13.2.6 When the enterprise can not meet what is shown in 13.2.3 or 13.2.4 an Alternative Installation Design shall be claborated, with complementary safety measures which allow the risk attenuation. 13.2.6.1 The Alternative Installation Design shall be shown by the owner of the boiler to obtain and agreement with union representatives of the prevailing professional category in the enterprise. In the event of reaching no agreement, as foreseen in 13.2.6.1, the intermediation of the Regional Labor Department can be

required by any of the parties and, continuing the deadlock, the decision shall be taken by this Department. 13.2.7 The boilers classified in the category A: shall have an instrumentation board installed in a control room, built in accordance with prevailing Regulation Standards. 13.3 SAFETY IN BOILER OPERATION

Operation is to have the Junior High School certificate. 13.3.7 The Safety Training in Boiler Operation shall compulsorily: a) Be technically supervised by a Qualified Professional, summoned in 13.1.2; b) Be ministered by skilled professionals qualified for this propose; c) Obey, at least the curriculum showed in the Appendix 1-A herein. 13.3.8 The responsible personnel for the Safety Training in Boiler Operation performance shall be restrained from ministering new courses, as well as subjected to legal penalties, in case of noncompliance of what is required in 13.3.7. 13.3.9 Every boiler operation shall fulfill a practical training, in the boiler he will operate, which it shall be supervised, recorded and have the minimum duration of: a) Category A boilers 80: (eighty) hours; b) Category B boilers: 60 (sixty) hours; c) Category C boilers: 40 (forty) hours. 13.3.10 The enterprise where the supervised practical training is performed shall inform in advance the union representatives of the prevailing professional category in the enterprise: a) The duration of training performance; b) The responsible private group, company or professional for the Safety Training in Boiler Operation; c) The list of training applicants. 13.3.11 The knowledge refreshment of the operators shall be continuous, by means of constant (information of the physical and operational conditions of the equipment, technical refreshment, safety information, attendance in courses, speeches and concerned events. 13.3.12 It constitutes a serious and eminent risk the operation of any boiler in different conditions foreseen in the original design, unless: a) It is redesigned taking into account all the relevant variables contained in the new operational condition; b) All the safety procedures shall be adopted arising from its new classification in respect of installation, operation, maintenance and inspection.

13.3.1 Every boiler shall have an updated Operational Manual, in Portuguese, in an easy and accessible place to the operators containing at least: a) b) c) d) Startup and shutdown procedures; Routine operational parameters and procedures; Emergency situation procedures; Safety, health and environment preservation general procedures;

13.3.2 The boiler devices and controls shall be maintained calibrated and in good operational conditions, constituting a serious and eminent risk the use of tricks which neutralize control and safety systems. 13.3.3 The water treatments necessary, properties to quality shall be controlled and shall be implemented, when to adjust its physicochemical the boiler operational parameters.

13.3.4 Every steam boiler shall be compulsorily under boiler operators operation and control, constituting a serious and eminent hazardous condition the lack of compliance of this request. 13.3.5 For the accomplishment of the Regulation Standard, it is considered boiler operator the one who satisfies at least one of the following conditions; a) To have the Safety Training in Boiler Operation certificate and prove a practical training in accordance with 13.3.11; b) To have the Safety Training in Boiler Operation certificate proclaimed herein and approve by Brazilian Regulation number 02/84 on May 8, 1984; c) To have corroboration of at least 3 (three) years of experience in this activity until May 8, 1984 13.3.6 The minimum basic requirement to participate, as a pupil in the Safety Training in Boiler

being considered a serious and eminent hazardous condition the lack of compliance and any of the deadlines established herein. 13.5.2 The initial safety inspection shall be made on new boilers, prior to the startup, in the operational site, having to be submitted to an internal end external exam, hydrostatic and accumulation test. 13.5.3 The periodic safety inspection, constituted by an internal and external exam, shall be carried out in the maximum deadlines as follows: a) 12 (twelve) months to categories A, B and C boilers; b) 12 (twelve) months to recovering alkali boilers of any category; c) 24 (twenty-four) months to category A: boilers, provided that at 12 (twelve) months the safety valves opening pressures are tested; d) 40 (forty) months to special boilers in accordance with defined in 13.5.5. 13.5.4 Enterprise which have their Own Service of Equipment Inspection, in accordance with the provisions established in Appendix II, may postpone the period between safety inspections, respecting the following maximum deadlines: a) 18 (eighteen) months to categories B and C boilers; b) 30 (thirty) months to category A boilers. 13.5.5 Boilers which operate in a continual way and use gases or residues from the process units, as main fuel to take the advantage of the heat or on purpose to environment control may be considered special when all the following conditions are satisfied: a) They are installed in enterprises which have their Own Service of Equipment Inspection, summoned in Appendix II; b) They have tested every 12 (twelve) months the interlock system and opening pressure of every safety valve; c) They do not show unexpected variations in the gases and steam outlet temperature, during the operation; d) There is water quality analysis and periodic control there is material deterioration control of the boiler main parts; e) It is approved as special class by means of:

13.4.1 All repairs of changes in boilers shall respect the corresponding construction design code and the manufacturers direction in respect of: a) b) c) d) Materials; Performance procedures; Quality control procedures; Personnel qualification and certification. When the construction design code is unknown, the original concepts of the boiler shall be respected, using the toughest control procedures written in the concerned codes. For the categories A and B boilers, by the Qualified Professionals judgment, summoned in 13.1.2, calculus technologies or more advanced procedures shall be used, in exchange of the prevailing design standards.

13.4.2 The Modifying and Repair Design shall be admitted in advance in the following conditions: a) At all times that the design conditions have been changes; b) At all times that repairs which compromise the safety are performed. 13.4.3 The Modifying and Repair Designs shall: a) Be authorized or approved by a Qualified Professional, summoned in 13.1.2; b) Determine material, execution, quality control and personnel qualification procedures. 13.4.4 All the performances that require broaching or welding in parts that operate under pressure shall be followed by a hydrostatic test, with characteristics defined by the Qualified Professional, summoned in 13.1.2. 13.4.5 The boiler safety control system shall be submitted to preventive or predictive maintenance. 13.5 BOILER SAFETY INSPECTION

13.5.1 The boilers shall be submitted to initial, periodical and extraordinary safety inspections

Agreement between union representatives of the prevailing professional category in the enterprise and employer; The intrermediation of the Regional Labor Department, required by any of the parties when there is no agreement; Decision of the Regional Labor Department when the deadlock continues.

b) When the boiler is submitted to important changes or repairs able to alter its safety conditions. c) Prior to the boiler startup, when it has been idle for more than 6 (six) months; d) When there is a change in the boiler installation site. 13.5.10 The safety inspection shall be carried out by a Qualified Professional, summoned in 13.1.2, or by Own Service of Equipment Inspection summoned in Appendix II. 13.5.11 Once the boiler is inspected, an Inspection Report shall be emitted, which shall belong to its records. 13.5.12 A copy of the Inspection Report shall be sent by the Qualified Professional, summoned in 13.1.2, in a time limit of 30 (thirty) days from the termination of the inspection, to the union representatives of the prevailing professional category in the enterprise. 13.5.13 The Inspection Report, summoned in 13.5.11, shall contain at least: a) b) c) d) e) f) g) h) The recorded data in the boiler identification plate; Boiler category; Type of boiler; Type of inspection carried out starting and finishing date of inspection; Description of the realized inspections and test; Result of the inspections and measures; List of items from this Regulation Standard or from other legal demands which are not satisfied; i) Conclusions; j) Necessary recommendations and measures; k) Foreseen date for the next boiler inspection; l) Legible name, signature and the professional counsel recording number of the Qualified Professional, summoned in 13.1.2, and legible name and signature of technicians who have attended the inspection. 13.5.14 At all times that the inspection results determine changes on the identification plate data it shall be updated. 13.6 PRESSURE VESSELS GENERAL

13.5.6 After 25 (twenty-five) years of use, in their following inspection, the boilers shall be submitted to a strict integrity evaluation to determine their reaming life and new maximum inspection deadlines, in case of they are still in condition of use. 13.5.6.1 Enterprises which have their own Service of Equipment Inspection, summoned in Appendix II, the 25 (twenty-five) year limit may be changed in terms of boiler conditions, made by the referred department.

13.5.7 The safety valves installed in boilers shall be periodically inspected as follows: a) At least once a month, by means of manual actions in operation to categories B and C boilers; b) Demonstrating, inspecting and testing on a bench the flanged valves and, o n site, the welded valves, recalibrating them in periods compatible with the operational experience of themselves, but respecting as a maximum limit the inspection period established in 13.5.3 or 13.5.4, if applied, to the categories A and B boilers. 13.5.8 In addition to the prescribed test in 13.5.7, the safety valves installed in the boilers shall be submitted to accumulation tests, in the following opportunities: a) In the boiler initial inspection; b) When they have been modified or have suffered significative reforms; c) When there is a change in the boiler operational parameters or a MAWP variation; d) When there is a change in the inlet or outlet piping. 13.5.9 The extraordinary safety inspection shall be carried out in the following opportunities: a) At all times that the boiler is damaged by accident or other happening able to compromise its safety;

13.6.1 Pressure Vessels are equipment, which contain fluids under internal or external pressure.

13.6.1.1

The application field of this Regulation Standard, referred to pressure vessels, is defined in Appendix III. 13.6.1.2 Pressure vessels included in this Regulation Standard are classified in categories in accordance with Appendix IV. 13.6.2 It constitutes a serious and eminent risk the lack of any of the following items: a) A valve or other safety device with opening pressure set at the MAWP or lower, installed directly on the vessel or in the system which includes it; b) A safety device against a blockage without warning of the valve when it is not installed directly on the vessel; c) A device that indicates the operational pressure. 13.6.3 Every pressure vessel shall have attached on its body, a visible and of easy and accessible place, and enduring identification plate with, at the, the following information: a) b) c) d) e) f) Manufacturers name; Identification number; Year of fabrication; Maximum allowable working pressure; Hydrostatic test pressure; Design code and year of edition.

e) Inspection Reports, in accordance with provisions of 13.10.8. 13.6.4.1 When nonexistent or lost, the Pressure Vessel Dossier shall be restored by the owner, with the manufacturer or Qualified Professionals (summoned in 13.1.2) technical responsibility, being indispensable the restoration of functioning characteristics, safety devices data and procedures for MAWP determination.

13.6.5 The Safety Record shall be made up of a separate book, with numbered pages, portfolios or information retrieval or not, with similar reliability, where the following will be recorded: a) All the relevant events capable to influence on the pressure vessel safety condition; b) The events of safety inspections. 13.6.6 The records referred in the 13.6.4 shall be at all times available for the examination of the operators, the maintenance and inspection personnel and the employee and employer representatives at the Accident Prevention Internal Commission, and the owner shall ensure complete access to these records, inclusive the union representatives of the prevailing professional category in the enterprise, when formally requested. 13.7 INSTALLATION OF PRESSURE VESSELS

13.6.3.1

Besides the identification plate there shall be, in a visible place, the pressure vessel category, in accordance with Appendix IV, and its identification number of code. 13.6.4 Every pressure vessel shall have, in site it has been installed, the following records, duly updated: a) A Pressure Vessel Dossier, to be supplied by the manufacturer, having the following information: Design code and year edition; Materials specification; Procedures used in the fabrication, assembly, final inspection and determination of the MAWP. A set of drawings and necessary data to follow its service life; Functioning characteristics; Safety devices data; Year of fabrication; Pressure vessel category. b) Safety Record, in accordance with the provisions of 13.6.5; c) Installation Design, in accordance with the provisions of 13.7; d) Changing or Repair Designs, in accordance with provisions of 13.9.2 and 13.9.3;

13.7.1 Every pressure vessel shall be installed in a way that all drains, vents, manholes and level, pressure and temperature indicators, when existing, are easily accessible. 13.7.2 When the pressure vessels are installed indoors, the installation shall meet the following requirements: a) Provide at least 2 (two) wide exits, permanently unblocked and arranged in different directions; b) Provide an easy and safe access to the maintenance operation and inspection, taking into account that for vacant guard rails, the gaps shall have dimensions to avoid personnels falls; c) Provide permanent ventilation with air openings which cannot be blocked; d) Provide illumination in accordance with the prevailing official standards; e) Have emergency illumination systems.

13.7.3 When the pressure vessels are installed outdoors, the installation shall meet the a, b, d, and e of 13.7.2 hereto. 13.7.4 It constitutes a serious and eminent risk the lack of compliance of the following items of 13.7.2 hereto: a) a, c, and e to pressure vessels installed indoors; b) a to pressure vessels installed outdoors; c) c to pressure vessels installed outdoors and operate at night. 13.7.5 When the enterprise can not meet what is shown in 13.7.2 and Alternative Installation Design shall be elaborated, with complementary safety measures which allow the risks attenuation. 13.7.5.1 The Alternative Installation Design shall be shown by the owner of the pressure vessel to obtain and agreement with union representatives of the prevailing professional category in the enterprise. In the event of reaching no agreement, as foreseen in 13.7.5.1, the i ntermediation of the Regional Labor Department can be required by any of the parties and, continuing the deadlock, the decision shall be taken by this Department. a) b) c) d)

13.8.2 The pressure vessel instruments and controls shall be maintained calibrated and in good operational conditions. 13.8.2.1 It constitutes a serious and eminent risk the use of tricks which neutralize their control and safety systems.

13.8.3 The operation of units which have pressure vessels of categories I and II, shall be done by a professional with Safety Training in Process unit Operation, constituting a serious and eminent hazardous condition the lack of compliance of this request. 13.8.4 For the accomplishment of this Standard, it is considered professional with Safety Training in Process Operation the one who satisfies one of the following conditions: a) To have the Safety Training Process Unit Operation certificate dispatched by a competent training constitution; b) To have proved experience, in pressure vessel operation in the categories I and II, of at least 2 (two) years prior to the existence of this Regulation Standard. 13.8.5 The minimum basic requirement to participate as a pupil in the Safety Training in Process Unit Operation, is to have the Junior High School certificate. 13.8.6 The Safety Training in Process Unit Operation shall compulsorily: a) Be technically supervised by a Qualified Professional, summoned in 13.1.2; b) Be ministered by skilled professionals qualified for this purpose; c) Obey, at least, the curriculum showed in the Appendix 1-B herein. 13.8.7 The responsible personnel for the Safety Training in Process Unit Operation performance shall be restrained from ministering new courses

13.7.5.2

13.7.6 The authorship of the pressure vessel Installation Design within the categories I, II and III, in accordance with Appendix IV, as far as this Regulating Standard is concerned, is responsibility of the Qualified Professional, as summoned in 13.1.2, and shall obey the safety, health and environment aspects foreseen in the Regulation Standards agreements and applicable legal arrangements. 13.7.7 The Installation Design shall contain at least the enterprises plan, showing the position and the category of each vessel and the safety installations. 13.8 SAFETY IN PRESSURE VESSEL OPERATION

13.8.1 Every pressure vessel within the categories I and II shall have its Operational Manual, or operational instructions contained in the unit operational manual where it is installed, in

as well as subjected to legal penalties, in case of noncompliance of what is required in 13.8.6. 13.8.8 Every professional with Safety Training in Process Unit Operation, shall fulfill a supervised practical training, in the operation of pressure vessels, with the minimum duration of:

13.9.1.1

When the construction design code is unknown, the original concepts for the vessel shall be respected, using the toughest control procedures written in the concerned codes. By the Qualified Professionals judgement, summoned in 13.1.2, calculus technologies or more advanced procedures shall be used, instead of prevailing design standards.

13.9.1.2 a) 300 (three hundred) hours to vessels of categories I or II; b) 100 (one hundred) hours t o vessels of categories III, IV, or V. 13.9.2 13.8.9 The enterprise where the supervised practical training is performed shall inform in advance the union representatives of the prevailing professional category in the enterprise: a) The duration of training performance; b) The responsible private group, company or professional for the Safety Training in Process Unit Operation; c) The list of training applicants. 13.8.10 The knowledge refreshment of the operators shall be continuous, by means of constant information of the physical and operational condition of the equipment, technical refreshment, safety information, attendance in courses, speeches and concerned events. 13.8.11 It constitutes a serious and eminent risk the operation of any pressure vessel in different conditions foreseen in the original design, unless: a) It is redesigned taking into account all the relevant variables contained in the new operational condition; b) All the safety procedures shall be adopted arising from its new classification in respect of installation, operation, maintenance and inspection. 13.9 SAFETY IN THE MAINTENANCE PRESSURE VESSEL

The Modifying and Repair Designs shall be performed in advance in the following conditions:

a) at all times that the design conditions have been changes; b) at all times that repairs which compromise the safety are performed 13.9.3 The Modifying and Repair Design shall: a) Be performed or approved by a Qualified Professional, summoned in 13.1.2; b) Determine materials, execution, quality control and personnel qualification procedures; c) Be proclaimed to the enterprises employees who may be concerned with the equipment. 13.9.4 All the performances that require welding in parts that operate under pressure shall be followed by a hydrostatic test, with characteristics defined by the Qualified Professional, summoned in 13.1.2, taking into consideration what is determined in 13.10. 13.9.4.1 Small superficial performances may have the hydrostatic test dismissed, according to the criteria of the Qualified Professional, summoned in 13.1.2.

13.9.5 The pressure vessel safety control systems shall be submitted to preventive or predictive maintenance. 13.10 PRESSURE VESSEL SAFETY INSPECTION 13.10.1 The pressure vessels shall be submitted to initial, periodical and extraordinary safety inspections. 13.10.2 The initial safety inspection shall be made on new vessels, prior to the startup, in the

definitive operational site, having to be submitted to an internal and external exam and hydrostatic test, considering the limitations mentioned in 13.10.3.5. 13.10.3 The periodic safety inspection, constituted by an internal and external exam and hydrostatic test, shall obey the maximum deadlines as follows:

13.10.3.4

When technically impracticable and by means of waiting on the Safety Record by the Qualified Professional, summoned in 13.1.2, the hydrostatic test may be replace by other nondestructive technique or inspection which allows it to obtain similar safety. It is considered technically impracticable to perform the hydrostatic test when:

a) The structural resistance of base or vessel support are not compatible with the weight of the water that should be used in test; b) The testing fluid harms the internal parts of the vessel; c) It is technically impossible to blow down or dry the system; d) There is an internal coating; e) The test brings about a harming influence on subcritical defects. 13.10.3.6 Vessels which work with operational temperature under 0C and operate in conditions with which the experience shows that deterioration does not occur, are free from the periodical hydrostatic test, being required to perform an internal exam every 20 (twenty) years and external exam every 2 (two) years. When there is no other alternative, the pneumatic test may be performed, provided that it is supervised by the Qualified Professional, summoned in 13.1.2, and surrounded by special care, because it is a highly risky activity.

b) To enterprises which have their Own Service of Equipment Inspection, in accordance with the provisions established in Appendix II. 13.10.3.7

13.10.3.1

Pressure vessels which can not be internally inspected due to physical impossibility shall be submitted to a hydrostatic test instead, considering the foreseen considerations in 13.10.3.5. Vessels with internal filling or catalyst may have the periodicity of the internal exam widen, in order to coincide with the changing time of the filling or catalysts, provided that this extension do not go beyond 20% of the established deadline in 13.10.3 herein. Vessels with hygroscopic internal coating, shall be hydrostatically tested prior to the application of it, being the forthcoming tests replaced by alternative techniques.

13.10.3.2

13.10.4 The safety valves of the pressure vessels shall be disassembled, inspected and recalibrated when the periodic internal exam is due. 13.10.5 The extraordinary safety inspection shall be carried out in the following opportunities: a) At all times that the vessel is damaged by accident or other happening able to compromise its safety; b) When the vessel is submitted to important changes or repairs able to alter its safety conditions; c) Prior to the vessel startup, when it has been idle for more than 12 (twelve) months; d) When there is a change in the vessel installation site.

13.10.3.3

13.10.6 The safety inspection shall be carried out by a Qualified Professional, summoned in 13.1.2, or by Own Service of Equipment Inspection, summoned in Appendix II. 13.10.7 After the pressure vessel is inspected, a Inspection Report shall be emitted, which shall belong to its records. 13.10.8 The Inspection Report, shall contain at least:

REQUIREMENTS OT CERTIFY THE OWN SERVICE OF EQUIPMENT INSPECTION Prior to put in practice the special periods between inspections, established in 13.5.4 and 13.10.3 herein, the enterprises Own Service of Equipment Inspection, arranged in sectors, sections, departments, divisions, or similar, shall be either directly certified by the Brazilian Institute of Metrology, Standardization and Industrial Quality or through Inspection Organizations duly authorized by the Institute, which shall verify the following minimum requirements shown from a to g here under. a) Transportable cylinders, vessels used to transport products, compressed fluid portable reservoirs and fire extinguishers; b) The ones used for human occupation; c) Combustion chamber of vessels which are part of rotative or alternative machines, such as pumps, compressors, turbines, generators, engines, pneumatic and hydraulic cylinders and that can not be considered as independent equipment; d) Pipes and tubes used to fluid flow; e) Heating coils; f) Tanks and reservoirs to store fluids, which are not included in design standards and codes, related to pressure vessels; g) Vessels with inside diameter smaller than 150 (one hundred and fifty) mm to fluids of class B, C and D, in accordance with the provisions of Appendix IV.

APPENDIX IV PRESSURE VESSEL CLASSIFICTION


1 For the accomplishment of this Regulation Standard the pressure vessels are classified in categories accordingly with the type of fluid and the potential risk. The fluids contained in the pressure vessels are classified as described below:

APPENDIX III
1 - This Regulation Standard shall be used in the following equipment: a) Any vessel where the product P.V is higher than 8 (eight), where P is the maximum operational pressure in Kpa and the V is its internal geometric volume in m including Heat exchangers, evaporators and similar; Pressure vessels or parts subjected to direct flame, which are neither, included in other Regulation standards not in 13.1 herein; Jacket pressure vessels, including reboilers and reactors; Autoclaves and boilers of thermic fluid which do not vaporize; b) Vessels which contain A fluids, specified in Appendix IV herein, independently of its dimensions and of the product P.V.. 2 - This Regulation Standard shall not be used in the following equipment:

CLASS A Inflammable fluids; Fuel with temperature at 200C or higher; Toxic fluids with a limit of tolerance at 20 ppm or lower; Hydrogen; Acetylene. CLASS B Inflammable fluids with temperature lower than 200C; Toxic fluids with a limit of tolerance higher than 20 ppm ; CLASS C Steam, simple asphyxiant gases or compressed air. CLASS D Water or other fluids excluded in Classes A, B, or C, with temperature higher than 50C. 1.1.1 When it is a mixture of fluids, it shall be considered regarding the classification, the fluid

with shows the highest risk to the employees and equipment considering its toxicity, inflammability and concentration. 1.2 The pressure vessels are classified in groups of potential risk in accordance with the product P.V., where P is the maximum operational pressure in Mpa and V is the internal geometric volume in m, as follows:

GROUP 1 P.V. = 100 GROUP 2 P.V < 100 and P.V = 30 GROUP 3 P.V < 30 and P.V = 2.5 GROUP 4 P.V < 2.5 AND P.V = 1 GROUP 5 P.V < 1 1.2.1 Pressure vessels which operate under a vacuum condition shall be in the following categories:

Category I: for inflammable fluids and fuels; Category V: for other fluids 1.3 The following table classifies pressure vessels in categories in accordance with the groups of potential risk and the fluid class contained.

TIME LIMITS FOR THE ENTERPRISE TO ADAPT THEMSELVES TO THE NR13 REGULATION STANDARD
In a meeting held in Brazil on November 18, 1994, the WORKING GROUP FOR THE REVIEW OF THIS NR-13 REGULATION STANDARD established the following time limits for the enterprises to adapt themselves to the requirements of the standard hereto.

BOILERS
13.1.4 Adjustment of pressure gauges, safety valves, level control systems, etc. 180 (one hundred eighty) days Adjustment of identification plate and painting or placing additional plates. 90 (ninety) days Adjustment of the boiler dossier and complementary documentation. 120 (one hundred twenty) days Boiler classification in accordance with volume and pressure. 90 (ninety) days Adjustment of the installation to the standard minimum requirements. 180 (one hundred eighty) days Adjustment of the operation manuals. 180 (one hundred eighty) days Adjustment of the new operators training. 90 (ninety) days Introduction of the preventative maintenance plan in safety control systems. 90 (ninety) days The time limits for the boiler safety inspection shall be immediately adjusted, taking the date of the last periodical/extraordinary inspection as the starting point.

THE TIME REMAINING ITEMS RELATED TO THE BOILERS SHALL BE IMMEDIATELY ADJUSTED AFTER THE EDITION OF THIS REGULATION.
