FUNDAMENTAL RULES

Effective from 1.1.1922

FUNDAMENTAL RULES
Are basic rules applicable to all government servants whose pay is debitable to Civil Estimates. Any other Government Servants specifically declared from time to time.

SUPPLEMENTARY RULES
Instructions to implement Fundamental Rules and fill up gaps.

Rule Making Power Rests with Nodal Ministry i.e. Ministry of Finance and Department of Personnel & Training Relaxation The Rules can be relaxed when it causes undue hardship to any person, for reasons to be recorded, in a just and equitable manner, with the concurrence of Ministry of Finance.

Delegation of Powers The powers have been delegated to specified authorities under Rule 6/7 in a limited manner.

GENERAL CONDITIONS OF SERVICE


Medical Certificate of Health (Rule 10) Whole time of a GS is at the disposal of the Govt. who pays him and he may be employed in any manner (Rule 11) Draw the pay and allowances attached to his tenure of a post with effect from the date he assumes the duties of that post and shall cease to draw them as soon as he ceases to discharge those duties (Rule 17(1))

Unauthorised Absence Break in service (Rule 17-A) Leave upto 5 years (Rule 18) Govt. Residences (Rule 45) Suspension (deemed) (Rule 53) Retirement Age (i) Gp. A/B officers (who enters service after attaining the age of 35 years) after he attained the age of 50 yrs. (ii) Gp. C/D (after he has attained the age of 55 years)

Deputation/Foreign Service

Deputation or Foreign Service


Deputation: Where pay is debitable to Consolidated Fund of India. Foreign Service: Where pay is received from any source other than Consolidated Fund of India. Appointment/selection: The selection is made by the borrowing authority as per Service Rules or Recruitment Rules.

Tenure: As prescribed in the Recruitment Rules or decided by the borrowing authority. Extendable as per rules. Special Pay or Deputation Duty Allowance Option for Pay Fixation: Pay Scale or Special Pay Deputation Duty Allowance: (i) Same Station 5% of BP or Max of Rs. 500 p.m. (ii) Another Station 10% of BP or Max of Rs. 1000 p.m.

Conditions for transfer on Foreign Service


G.S. should be willing Sanctioned by Competent Authority Duties should be more or less similar as required to be performed Jointing Time/Travelling Allowance to and fro and pay during the period should be settled before hand Medical facilities/CCA/HRA Contribution towards Pension or CPF Contribution towards Leave Salary (within India) Who is going to pay for Contributions Benefits during Foreign Service

Leave Salary Contributions


Basic purpose to allow benefit of accumulation of leave earned during Foreign Service Pay during Foreign Service Rate 11% p.m. in respect of Pay Leave Salary availed during foreign service to be paid by the parent cadre

Pension Contribution
Basic purpose to count service rendered during Foreign Service as Qualifying Service for Pensionery benefits Group to which GS belongs (A/B/C/D) Maximum of the Pay Scale GS holds in parent cadre Length of Service in Government (total years) Rate as laid down in Table prescribed During Leave no contribution

Calculation for contributions paid by the Government Servant


(i) Leave Salary contribution alone: L = F x r/(100 + r) (ii) Pension Contribution alone: L = (F-P) x r/100 (iii) When both contribution are paid: L = (F-P) x r/(100 + r)
