.he prevention and control of marine pollution shall be governed b1 the 6arine %nvironmental Protection Law of the Peoples Republic of China+ <rticle / :n the prevention and control of water pollution2 we shall follow the principles of giving priorit1 to prevention2 combining prevention with control and preventing and controlling in an allround wa12 protect drin?ing water sources first2 rigorousl1 control industrial pollution and urban domestic pollution2 prevent and control agricultural non-point pollution2 vigorousl1 promote the construction of ecological management pro(ects2 and prevent2 control and reduce water pollution and ecological damage+ <rticle 8 .he peoples governments at or above the count1 level shall bring the protection of water environment into the national economic and social development planning+ .he local peoples governments at or above the count1 level shall ta?e countermeasures and actions to prevent water pollution2 and be responsible for the @ualit1 of water environment of their respective region of administration+ <rticle 9 .he state practices the ob(ective responsibilit1 s1stem and the evaluation s1stem for the protection of water environment2 and ta?es the accomplishment of the protection ob(ectives of water environment as a content for evaluating and assessing the local peoples governments and persons in charge of them+ <rticle & .he state encourages and supports the scientific and technological research on the prevention and control of water pollution2 the application and promotion of advanced technologies as well as the publicit1 and education of water environment protection+ <rticle , .he state shall2 in the mode of financial transfer pa1ment or other2 establish a compensation mechanism for the ecological protection of the water environment in drin?ing water source reserve areas and upper reaches of rivers2 la?es and reservoirs+ <rticle .he administrative departments of environmental protection under the peoples governments at or above the count1 level shall e5ercise unified supervision and administration over the prevention and control of water pollution+ .he maritime administrative bod1 under the administrative department of traffic shall e5ercise supervision and administration over the prevention and control of water pollution from vessels+ .he departments in charge of water administration2 state land and resources2 health2 construction2 agriculture and fisher1 under the peoples governments at or above the count1 level as well as institutions in charge of protecting water resources in important rivers and la?es shall2 within their respective scope of duties and functions2 e5ercise supervision and administration over the prevention and control of water pollution+ <rticle 7 !ischarge of water pollutants shall be within the state or local standards for the discharge of water pollutants and indicators for the total discharge control of ma(or water pollutants+ <rticle '0 <ll entities and individuals have the obligation to protect water environment2 and have the right to report to authorities acts polluting or damaging water environment+ .he peoples governments at or above the count1 level and the relevant administrative departments thereunder shall honour and reward entities and individuals that have made great contributions to the prevention and control of water pollution+ Chapter :: "tandards and Planning for the Prevention and Control of Water Pollution

<rticle '' .he power to formulate the state @ualit1 standards of water environment shall remain with the administrative department of environmental protection under the "tate Council+ .he peoples government of an1 province2 autonomous region or municipalit1 directl1 under the Central ;overnment ma12 for issues not provided in the state @ualit1 standards of water environment2 wor? out local standards and file such standards with the administrative department of environmental protection under the "tate Council for archival purpose+ <rticle '2 .he administrative department of environmental protection under the "tate Council ma12 together with the competent department of water administration under the "tate Council and the peoples governments of the related provinces2 autonomous regions or municipalities directl1 under the Central ;overnment2 in accordance with the use functions of the waters of important rivers and la?es as determined b1 the state as well as the relevant local conditions on econom1 and technolog12 determine the @ualit1 standards of water environment applicable to the waters of these important rivers and la?es at provincial boundar1 areas2 and implement such standards after filing them with the "tate Council and obtaining the approval thereof+ <rticle '/ .he administrative department of environmental protection under the "tate Council shall formulate the state standards for the discharge of water pollutants in accordance with the state @ualit1 standards of water environment and the national economic and technological conditions+ 0or issues not provided in the state standards for the discharge of water pollutants2 the peoples government of an1 province2 autonomous region or municipalit1 directl1 under the Central ;overnment ma1 wor? out local standards for the discharge of water pollutantsA for issues provided in the state standards for the discharge of water pollutants2 it ma1 also wor? out local standards stricter than the state standards+ "uch local standards must be filed with the administrative department of environmental protection under the "tate Council for archival purpose+ !ischarge of pollutants to waters under the governance of certain local standards for the discharge of water pollutants must strictl1 abide b1 the said local standards+ <rticle '8 .he administrative department of environmental protection under the "tate Council and the peoples governments of provinces2 autonomous regions and municipalities directl1 under the Central ;overnment shall2 in light of the re@uirements of water pollution prevention and control as well as the state or local economic and technological conditions2 amend the @ualit1 standards of water environment and the standards for the discharge of water pollutants at time appropriate+ <rticle '9 .he prevention and control of water pollution must be under unified planning b1 drainage area or region+ .he planning for the prevention and control of water pollution of an important river or la?e determined b1 the state must be prepared b1 the administrative department of environmental protection and departments of macroeconomic control and water administration under the "tate Council together with the peoples government of the related province2 autonomous region or municipalit1 directl1 under the Central ;overnment2 and be submitted to the "tate Council for approval+ .he planning for the prevention and control of water pollution of a river or la?e across more than one province2 autonomous region or municipalit1 directl1 under the Central ;overnment2 other than one prescribed in the preceding paragraph2 shall be prepared b1 the administrative departments of environmental protection under the peoples governments of the related provinces2 autonomous regions or municipalities directl1 under the Central ;overnment together with the competent departments of water administration at the same level and the related municipal or count1 peoples governments in accordance with the planning for the prevention and control of water pollution of important rivers and la?es determined b1 the state and in light of the local situation2 and be submitted to the "tate Council for approval after it is e5amined and approved b1 the peoples governments of the related provinces2 autonomous regions or municipalities directl1 under the Central ;overnment+

.he planning for the prevention and control of water pollution of a river or la?e across more than one count1 in a province2 autonomous region or municipalit1 directl1 under the Central ;overnment shall be prepared b1 the administrative department of environmental protection under the peoples government of the province2 autonomous region or municipalit1 directl1 under the Central ;overnment together with the competent department of water administration at the same level in accordance with the planning for the prevention and control of water pollution of important rivers and la?es determined b1 the state and in light of the local situation2 be submitted to the peoples government of the province2 autonomous region or municipalit1 directl1 under the Central ;overnment for approval and be filed with the "tate Council for archival purpose+ .he approved planning for the prevention and control of water pollution is the fundamental basis for the prevention and control of water pollution2 and the amendments to such planning must be under the approval of the organ approving the planning+ .he local peoples government at or above the count1 level shall organiBe the preparation of the planning for the prevention and control of water pollution in this administrative region in accordance with the legall1 approved planning for the prevention and control of water pollution of rivers and la?es+ <rticle '& When developing2 utiliBing2 ad(usting or transferring water resources2 the relevant departments under the "tate Council and the local peoples governments at or above the count1 level shall ma?e overall plans and ta?e all factors into consideration2 maintain the water flow of rivers and the water level of la?es2 reservoirs and groundwater at a reasonable place2 and protect the ecological functions of waters+ Chapter ::: "upervision and <dministration of the Prevention and Control of Water Pollution <rticle ', .he building2 renovation and enlargement of construction pro(ects directl1 or indirectl1 discharging pollutants to waters and other water establishments shall be sub(ect to environmental impact assessment+ Cefore building2 renovating or enlarging the outfall to a river or la?e2 the construction entit1 shall obtain the consent of the competent department of water administration or the governing authorit1 of the drainage area concernedA where it involves water area for navigation or fisher12 the administrative department of environmental protection shall2 when e5amining and approving the environmental impact assessment document2 as? for the opinion of the competent department of traffic and that of fisher1+ :nstallations for the prevention and control of water pollution as concerned in a construction pro(ect shall be designed2 constructed and put into use simultaneousl1 with the principal part of the pro(ect+ "uch installations shall be sub(ect to the acceptance chec? of the administrative department of environmental protection2 and2 if the1 fail to pass the chec?2 the construction pro(ect ma1 not be put into production or use+ <rticle ' .he state practices the s1stem of control over the total discharge of important water pollutants+ .he peoples government of each province2 autonomous region2 or municipalit1 directl1 under the Central ;overnment shall2 in accordance with the provisions of the "tate Council2 reduce and control the total discharge of important water pollutants in its administrative region2 and have the peoples government of each cit1 or count1 bear corresponding responsibilit1 and tas? for the reduction and control of the total discharge of important water pollutants+ .he peoples government of each cit1 or count1 shall2 in accordance with the re@uirements of its tas? on the reduction and control of the total discharge of important water pollutants2 decompose the indicators of its tas? and assign them to all

entities discharging pollutants+ .he specific measures and implementation steps shall be formulated b1 the "tate Council+ .he peoples government of a province2 autonomous region2 or municipalit1 directl1 under the Central ;overnment ma12 in light of the water @ualit1 of its administrative region and the re@uirements of the water pollution prevention and control wor?2 determine the important water pollutants whose total discharge is sub(ect to reduction and control+ 0or areas where the total discharge of important water pollutants is over the prescribed level2 the administrative department of environmental protection of the related peoples government shall suspend the e5amination and approval of the environmental impact assessment documents of construction pro(ects which increase the total discharge of important water pollutants+ <rticle '7 .he administrative department of environmental protection under the "tate Council shall publish the provinces2 autonomous regions and municipalities directl1 under the Central ;overnment that fail to reach their indicators on reduction and control of total discharge of important water pollutants+ .he administrative department of environmental protection of the peoples government of each province2 autonomous region2 or municipalit1 directl1 under the Central ;overnment shall publish each cit1 or count1 that fails to reach its indicators on reduction and control of total discharge of important water pollutants+ .he administrative department of environmental protection under the peoples government at or above the count1 level shall publish the enterprises which violate the provisions of this Law and seriousl1 pollute water environment+ <rticle 20 .he state practices the licensing s1stem for pollutant discharge+ %nterprises and public institutions which directl1 or indirectl1 discharge industrial waste water or medical sewage to waters or which are re@uired to obtain the pollutant discharge license before discharging waste water and sewage water must obtain the pollutant discharge licenseA and entities operating facilities and establishments for the concentrated treatment of urban sewage must also obtain the pollutant discharge license+ .he power to provide for the specific measures and implementation steps for licensing pollutant discharge shall remain with the "tate Council+ <ll enterprises and public institutions are prohibited from discharging the above-mentioned waste water and sewage to waters without the pollutant discharge license or in violation of the terms of the pollutant discharge license+ <rticle 2' <n1 enterprise2 public institution or individual industrial and commercial household which directl1 or indirectl1 discharges industrial waste water or medical sewage to waters shall2 in accordance with the provisions of the administrative department of environmental protection under the "tate Council2 declare for registration to the administrative department of environmental protection of the local peoples government at or above the count1 level its facilities for discharging and treating water pollutants as well as the categor12 @uantit1 and concentration of water pollutants discharged under normal operating conditions2 and provide the relevant technical data about the prevention and control of water pollution+ Where there is an1 great change in the categor12 @uantit1 and concentration of water pollutants discharged b1 an enterprise2 a public institution or an individual industrial and commercial household2 the entit1 shall declare such change for registration in a timel1 manner2 in this case2 it shall maintain the normal use of its facilities for treating water pollutants2 and2 if it intends to demolish such facilities or leave them unused2 it shall obtain the approval of the administrative department of environmental protection of the local peoples government at or above the count1 level beforehand+

<rticle 22 %nterprises2 public institutions and individual industrial and commercial households which discharge water pollutants to waters shall set up outfalls in accordance with laws2 administrative regulations and the provisions of the administrative department of environmental protection under the "tate CouncilA if such outlets are to rivers or la?es2 the1 shall also abide b1 the provisions of the competent department of water administration under the "tate Council+ :t is prohibited to discharge water pollutants b1 illegall1 setting up underground pipes or avoiding supervision and administration in other wa1s+ <rticle 2/ 6a(or pollutant-discharging entities shall install automatic monitoring e@uipment for the discharge of water pollutants2 have such e@uipment networ?ed with the monitoring e@uipment of the administrative department of environmental protection2 and guarantee the normal operation of such e@uipment+ %nterprises discharging industrial waste water shall have the industrial waste water discharged b1 them under monitoring2 and ?eep the original monitoring record+ .he specific measures shall be wor?ed out b1 the administrative department of environmental protection under the "tate Council+ .he list of ma(or pollutant-discharging entities re@uired to install automatic monitoring e@uipment on the discharge of water pollutants shall be determined b1 the administrative department of environmental protection of the local peoples government at the level of municipalit1 divided into districts or above b1 consulting with the related departments at the same level in light of the environmental capacit1 of the administrative region2 the re@uirements of the indicators on total discharge control of important water pollutants as well as the categor12 @uantit1 and concentration of water pollutants discharged b1 pollutant-discharging entities+ <rticle 28 %nterprises2 public institutions and individual industrial and commercial households that directl1 discharge pollutants to waters shall pa1 pollutant discharge fee according to the categor1 and @uantit1 of the discharged water pollutants as well as the charging rates of such fee+ :ncome from pollutant discharge fee shall be used to prevent and control pollution onl1+ <rticle 29 .he state shall set up a water environment @ualit1 and water pollutant discharge monitoring s1stem+ .he administrative department of environmental protection under the "tate Council shall be in charge of wor?ing out water environment monitoring norms2 releasing information about the states water environment in a unified wa1 and organiBe monitoring networ? with the competent department of water administration under the "tate Council+ <rticle 2& .he wor? institutions of protection of water resources of important rivers and la?es determined b1 the state shall be in charge of monitoring the water environment @ualit1 of provincial boundar1 waters where the1 are located2 report the monitoring results to the administrative department of environmental protection and the competent department of water administration under the "tate CouncilA and report the monitoring results to the leading institution of protection of water resources of drainage areas established upon the approval of the "tate Council2 if an1+ <rticle 2, .he administrative department of environmental protection and other departments e5ercising the right of supervision and administration according to this Law have the right to ma?e spot inspection on pollutant discharging entities within their (urisdiction2 and the said entities shall truthfull1 report the relevant information and provide necessar1 material+ .he inspecting authorit1 has the obligation to ?eep the trade secrets of the said entities ?nown in the process of inspection+ <rticle 2 <n1 dispute over water pollution which involves more than one administrative region shall be settled upon the negotiations of the related local peoples governments2 or upon the coordination of their common higher peoples government+ Chapter := 6easures for the Prevention and Control of Water Pollution

"ection ' ;eneral Rules <rticle 27 :t is prohibited to discharge oil2 acid2 al?aline or highl1 to5ic waste li@uids to waters+ :t is prohibited to clean in waters the vehicles and containers which have carried or stored oil or pathogenic pollutants <rticle /0 :t is prohibited to discharge or dump radioactive solid waste or waste water containing highl1 and medium radioactive substances to waters+ Waste water containing low radioactive substances ma1 onl1 be discharged to waters in accordance with the state provisions on and standards for the prevention and control of radioactive pollution+ <rticle /' 0or discharging heated waste water to waters2 corresponding measures shall be ta?en to guarantee that the temperature of waters is in line with the water environment @ualit1 standards+ <rticle /2 Waste water containing pathogen ma1 be discharged onl1 after it is steriliBed in accordance with the relevant state standards+ <rticle // :t is prohibited to discharge or dump industrial solid waste2 urban refuse and other castoffs to waters+ :t is prohibited to discharge or dump soluble highl1 to5ic waste residues containing mercur12 cadmium2 arsenic2 chromium2 lead2 c1anide or 1ellow phosphorus to waters2 or directl1 bur1 them underground+ 0or places storing soluble highl1 to5ic waste residues2 corresponding waterproof2 anti-lea?age and anti-loss measures must be ta?en+ <rticle /8 :t is prohibited to stoc?pile or store solid wastes and other pollutants at bench land and ban? slopes below the highest water level of rivers2 la?es2 canals2 channels and reservoirs+ <rticle /9 :t is prohibited to use an1 seepage well2 sin?2 fissure or dissolved cavern to discharge or dump waste water containing pathogenic pollutants2 sewage containing pathogen and other castoffs+ <rticle /& :t is prohibited to use an1 ditch2 pit or pool which has not been dealt with anti-lea?age measures to transmit or store waste water containing pathogenic pollutants2 sewage containing pathogen and other castoffs+ <rticle /, 0or multi-la1er ground water2 la1ered e5ploitation shall be resorted to if the water @ualit1 differs greatl1 from one a@uifer to another+ #o combined e5ploitation of phreatic water and confined water alread1 polluted ma1 be permitted+ <rticle / When constructing underground engineering facilities or conducting underground e5ploitation or mining activities2 preventive measures must be ta?en to prevent groundwater pollution+ <rticle /7 <rtificial recharge for ground water ma1 not deteriorate the @ualit1 of groundwater+ "ection 2 Prevention and Control of :ndustrial Water Pollution <rticle 80 .he relevant departments under the "tate Council and the local peoples governments at or above the count1 level shall reasonabl1 plan the distribution of industr12 re@uire enterprises causing water pollution to ma?e technical innovation and ta?e comprehensive prevention and control measures

to improve the repeating utiliBation factor of water and reduce the discharge of waste water and pollutants+ <rticle 8' .he state applies the washing-out s1stem to bac?ward techni@ues and e@uipment that seriousl1 pollute water environment+ .he department of macro economic control under the "tate Council shall2 together with the relevant departments of the "tate Council2 publish the catalogue of techni@ues which seriousl1 pollute water environment and are to be eliminated within a certain time limit and the catalogue of e@uipment which seriousl1 pollutes water environment and is prohibited to be produced2 sold2 imported and used+ Producers2 sellers2 importers or users shall2 within the prescribed time limit2 stop producing2 selling2 importing or using an1 e@uipment listed into the aforesaid catalogue of e@uipment to be eliminated+ %ntities and individuals adopting an1 techni@ue listed into the aforesaid catalogue of techni@ue to be eliminated shall stop using it within the prescribed time limit+ %@uipment to be eliminated pursuant to the preceding two paragraphs of this <rticle ma1 not be transferred to others to use+ <rticle 82 .he state prohibits the building of small-scale production pro(ects of paper ma?ing2 leather ma?ing2 printing and d1eing2 d1estuff2 co?ing2 sulfur refining2 arsenic refining2 mercur1 refining2 oil refining2 electroplating2 pesticides2 asbestos2 cement2 glass2 steel2 thermal power etc+ that seriousl1 pollute water environment and do not conform with the state industrial policies+ <rticle 8/ %nterprises shall adopt clean techni@ue that utiliBes raw materials at a higher efficienc1 and discharges fewer pollutants2 and strengthen administration to reduce the generation of water pollutants+ "ection / Prevention and Control of Water Pollution in >rban <reas <rticle 88 >rban sewage shall be treated in a concentrated wa1+ .he local peoples government at or above the count1 level shall raise funds through fiscal budget and other channels2 and ma?e unified planning and overall arrangement for the construction of facilities for the concentrated treatment of urban sewage as well as the supporting pipe networ? so as to improve the collection rate and treatment rate of urban sewage of the administrative region+ .he administrative department of construction under the "tate Council shall2 together with the administrative department of macro economic control and the administrative department of environmental protection under the "tate Council2 in accordance with the urban and rural planning and water pollution prevention and control planning2 organiBe the establishment of the national planning for construction of urban sewage treatment facilities+ .he local peoples government at or above the count1 level shall organiBe the departments in charge of construction2 macro economic control2 environmental protection and water administration to establish the planning for construction of urban sewage treatment facilities of the administrative region+ .he administrative department of construction under the local peoples government at or above the count1 level shall2 in accordance with the planning for construction of urban sewage treatment facilities2 organiBe the construction of facilities for the concentrated treatment of urban sewage as well as the supporting pipe networ?2 and strengthen supervision and administration over the operation of such facilities+ %ntities operating such facilities shall provide paid services of sewage treatment for entities discharging pollutants in accordance with the relevant state provisions2 charge for sewage treatment and guarantee the normal operation of such facilities+ :t is not re@uired to pa1 pollutant discharge fee if the pa1ment for discharging sewage to facilities for the concentrated treatment of urban sewage has been made+ "ewage treatment fees collected shall be used for the construction and operation of urban sewage concentrated treatment facilities onl1+

Where an1 entit1 engages in cage breeding or organiBes traveling2 going angling or an1 other activities that ma1 pollute drin?ing waters in a ;rade : drin?ing water source reserve2 the administrative department of environmental protection under the local peoples government at or above the count1 level shall order it to stop the illegal act and impose upon it a fine of not less than 202000 1uan but not more than '002000 1uan+ 0or an1 individual doing such illegal act2 the administrative department of environmental protection under the local peoples government at or above the count1 level shall order it to stop the illegal act and ma1 impose upon him a fine of not more than 900 1uan+ <rticle 2 Where an1 enterprise or public institution commits an1 of the following acts2 the administrative department of environmental protection under the peoples government at or above the count1 level shall order it to correct2 and2 if the circumstances are serious2 shall impose upon it a fine of not less than 202000 1uan but not more than '002000 1uan: '+ failing to wor? out an1 emergenc1 plan for water pollution accidents as re@uiredA or 2+ failing to initiate such a plan or ta?e corresponding emergenc1 measures in a timel1 manner after a water pollution accident occurs+ <rticle / Where an1 enterprise or public institution violates this Law and causes a water pollution accident2 the administrative department of environmental protection under the peoples government at or above the count1 level shall2 in accordance with the provision of paragraph 2 of this <rticle2 impose a fine upon it and order it to ta?e measures for treatment within a certain time limit to eliminate pollutionA if the enterprise or public institution refuses to ta?e measures for treatment as re@uired or is not capable of doing so2 the administrative department of environmental protection shall appoint a capable entit1 to do so on behalf of the enterprise or public institution with the necessar1 e5penses being paid b1 the latterA if the accident is serious or e5traordinaril1 serious2 the administrative department of environmental protection ma12 upon the approval of the peoples government with the right to approve2 order it to close2 and impose upon each of the directl1 liable person in charge and other directl1 liable persons a fine of not more than 90D of the income obtained from the enterprise or public institution in the previous 1ear+ :f the accident is ordinar1 or relativel1 serious2 the fine shall be calculated on the basis of 20D of the direct losses caused b1 the accidentA if the accident is serious or e5traordinaril1 serious2 the fine shall be calculated on the basis of /0D of the direct losses caused b1 the accident+ :f the accident is a fisher1 one or one caused b1 a fisher1 vessel2 the power to punish shall remain with the administrative department of fisher1A if the accident is caused b1 a non-fisher1 vessel2 the power to punish shall remain with the maritime governing authorit1+ <rticle 8 :f an1 part1 concerned refuses to accept the decision of administrative penalt12 it ma1 appl1 for administrative reconsideration2 or file a lawsuit with the peoples court within '9 da1s after receiving the notice of decisionA if it does not appl1 for administrative reconsideration or file a lawsuit after the prescribed time limit and still refuses to perform the decision of administrative penalt12 the organ ma?ing the decision ma1 appl1 to the peoples court for compulsor1 e5ecution+ <rticle 9 .he part1 whose rights and interests are damaged b1 a water pollution accident is entitled to as? the part1 discharging pollutants to eliminate the damage and ma?e compensation for their losses+ :f the damage is caused b1 force ma(eure2 the part1 discharging pollutants bears no liabilit1 for compensation2 unless it is otherwise prescribed b1 law+ :f the damage is caused b1 the victim on purpose2 the part1 discharging pollutants bears no liabilit1 for compensation+ :f the damage is caused b1 the gross negligence of the victim2 the liabilit1 for compensation of the part1 discharging pollutants ma1 be mitigated+ :f the damage is caused b1 a third part12 the part1 discharging pollutants has the right to2 after ma?ing compensation according to law2 recover the compensation from the third part1+

<rticle & 0or a dispute over liabilit1 for damage or amount of compensation in a water pollution accident2 the administrative department of environmental protection2 the maritime governing authorit1 or the administrative department of fisher1 ma12 according to the division of functions and duties among them and in light of the re@uest of the parties concerned2 settle it through mediationA if no agreement can be reached upon mediation2 the parties concerned ma1 file a lawsuit with the peoples court+ .he parties concerned ma1 also file a lawsuit with the peoples court directl1 without going through the mediation procedure+ <rticle , 0or an action of damage due to a water pollution accident2 the part1 discharging pollutants shall assume the burden of proof for legall1 prescribed e5emptions and the none5istence of relation of cause and effect between its act and the harmful conse@uences thereof+ <rticle :f the number of parties whose legitimate rights and interests are damaged in a water pollution accident is relativel1 huge2 these parties ma1 select a representative to file a (oint action+ .he administrative department of environmental protection and the related social groups ma1 legall1 support the parties whose legitimate rights and interests are damaged in a water pollution accident to file a lawsuit with the peoples court+ .he state encourages law offices and law1ers to provide legal assistance for victims of lawsuits on damage of water pollution accidents+ <rticle 7 0or an1 dispute over liabilit1 for damage or amount of compensation in water pollution2 the parties concerned ma1 entrust the environmental monitoring institution to provide the related monitoring data2 and the institution shall accept such entrustment and truthfull1 provide the re@uired monitoring data+ <rticle 70 Where an1 entit1 or individual commits a violation against management of public securit12 itEhe shall be imposed on a punishment in respect to management of public securit1A if an1 crime has been constituted2 itEhe shall be sub(ect to corresponding criminal liabilit1+ Chapter =::: "upplementar1 Provisions <rticle 7' .he interpretation of terms mentioned in this Law is as follows: '+ water pollution means that2 due to the intervention of certain substances2 the chemical2 ph1sical2 biological or radioactive character of waters is changed2 which affects the effective utiliBation of such water2 causes harm to peoples health or damages the ecological environment and causes the deterioration of water @ualit1+ 2+ Water pollutants refer to substances which are directl1 or indirectl1 discharged to waters and ma1 cause pollution to waters+ /+ Pathogenic pollutants refer to pollutants which are capable of2 after being directl1 or indirectl1 absorbed b1 organism2 causing the organism or its descendants to become sic?2 act abnormall12 var1 geneticall12 ph1siologicall1 function abnormall12 become deformed or die+ 8+ fisher1 waters refer to waters designated as places for fish and shrimps to la1 eggs2 search baits2 live in winter and migrate as well the a@uatic plants of fish2 shrimps2 shellfish and alga+ <rticle 72 .his Law shall come into force as of 3une 'st2 200 +
