2. OBJETIVOS
El objetivo fundamental de esta asignatura de Grado consiste en la
formacin de los profesionales del Derecho que hayan de relacionarse con
el Poder Judicial y, de modo especial, con los Jueces y Magistrados,
miembros del Ministerio Fiscal, Secretarios Judiciales, Abogados y
Procuradores.
Como es sabido, en el mundo de los tribunales, para ganar un proceso, no
slo hay que tener la razn, sino que hay que saber tambin demostrarla o,
lo que es lo mismo, hemos de persuadir al Juez de que nos asiste. Para ello,
es necesario el conocimiento del Derecho Procesal y, de modo especial, del
Derecho Procesal Civil, cuya Parte general lo es de todo el Derecho
Procesal, pues no en vano la Ley de Enjuiciamiento Civil resulta ser de
aplicacin directa en otros procesos (por ej.: en toda la materia probatoria
del proceso administrativo: art. 60.4 Ley 29/1988) y siempre, de aplicacin
supletoria art. 4 Ley 1/2000- en todos los rdenes jurisdiccionales (penal,
en el laboral, contencioso-administrativo y militar), incluida la jurisdiccin
del Tribunal Constitucional (art. 80 L.O. 2/1979) .
Por ello, el estudio de los presupuestos procesales y del objeto procesal, el
de los actos de alegacin, prueba e impugnacin, el de la Sentencia y su
ejecucin se revela como indispensable para satisfacer, con xito, no slo
las pretensiones civiles, sino tambin las que puedan deducirse ante otros
tribunales.
El contenido terico de esta Asignatura se complementa con nuestra
monografa sobre Casos Prcticos de Derecho Procesal Civil, en el que
el alumno, en paralelo al estudio de las distintas Lecciones del Manual, ha
de resolver los distintos supuestos de hecho y cuestiones que se le plantean
mediante el auxilio de los correspondientes preceptos de la Ley de
Enjuiciamiento Civil y de la jurisprudencia, cuya determinacin se le
facilita.
De la aplicacin, por el alumno y a travs de la argumentacin, de los
conceptos fundamentales de la Asignatura a tales supuestos de hecho,
estamos persuadidos de poder contribuir a la formacin, ms que de futuros
opositores, de autnticos profesionales del Derecho.

slo para el estudio de la asignatura de Derecho Procesal Civil , sino
tambin de Derecho Procesal Penal. A dicha obra escrita se incorpora un
CD en el que puede consultarse con minuciosidad la totalidad de la
legislacin procesal, as como una relacin de Formularios, que servirn de
complemento al Manual de Casos Prcticos.

4. OTROS MEDIOS DE APOYO
El medio de apoyo esencial es la plataforma de Aula virtual que constituye
WebCT (http://virtual0.uned.es), donde el alumno utilizando sus claves
personales podr participar en foros temticos o de consulta general y
ver apoyado su estudio con diversos contenidos. Adems tendr el apoyo
constante, tanto del Profesor Tutor correspondiente a su Centro Asociado
como del Equipo docente de la sede central para resolver sus dudas.
Evidentemente estos contenidos nunca pueden ni quieren sustituir el
estudio personal de la materia objeto de la asignatura a travs de los
correspondientes manuales.
Esta prevista la realizacin de varios programas de radio que traten de dar
una breve e intensa explicacin de algunos temas de la asignatura.
Se emitirn en el horario habitual en fecha que se anunciar en el BICI.
Adems de estar disponibles en ese momento, quedan guardados y
disponibles para ser escuchados on line en el www.teleuned.es.
Adems y a peticin de los centros asociados, se podrn realizar
convivencias y videoconferencias, que siempre son de gran utilidad para
centrar el esfuerzo de estudio individual.
5. TIPO DE EXAMEN, CORRECCIN, RECLAMACIONES

5.1 PRUEBAS PRESENCIALES
El examen constar de dos preguntas tericas y un caso prctico a las que
el alumno deber contestar obligatoriamente. Para la realizacin del
examen, el alumno podr utilizar las Leyes Procesales que estime
convenientes, siempre y cuando no estn comentadas y se trate de textos
originales; no se admiten fotocopias.
En el examen se podr consultar el programa oficial del curso acadmico
2012/2013.
El tiempo para la realizacin del examen ser de dos horas.

5.2 CALIFICACIONES
Les recordamos que tengan en cuenta que los exmenes realizados en
cualquier punto geogrfico de Espaa o del extranjero no se reciben en el
Departamento de Derecho Procesal para su correccin, ubicado en la
Facultad de Derecho de la UNED (c/ Obispo Trejo, n. 2; Ciudad
Universitaria; 28040-MADRID) hasta transcurridas, aproximadamente, dos
semanas, a contar desde la realizacin del examen.
Las correcciones se hacen valorando conjuntamente el examen, sin
baremos prefijados para cada pregunta.
La calificacin mnima para aprobar es la de cinco (apto).
Se tendrn en cuenta los informes remitidos por los Profesores Tutores de
los Centros Asociados.
El nico nmero para consultar sus calificaciones es: 902 25 26 01.
5.3 REVISION DE EXAMENES
Las solicitudes de revisin de exmenes debern realizarse por
escrito en el plazo de 7 das naturales siguientes a la divulgacin de
las calificaciones en el Sistema Informtico de Respuesta Aludible
(SIRA).

Una vez revisado el examen, de persistir las discrepancias sobre la

calificacin otorgada, el alumno podr solicitar en el plazo de cinco das
mediante escrito razonado, la formacin de una Comisin de Revisin de
Calificaciones.
6. HORARIO DE ATENCIN AL ALUMNO
Las consultas telefnicas pueden ser realizadas dentro del
siguiente horario de guardia y permanencia del correspondiente
